TOWN BOARD MEETING
The Regular Meeting of the Town Board of the Town of Cortlandville was held at
the Town Hall, 3577 Terrace Road, Cortland, New York, with Supervisor Thorpe
presiding.

Others present were: Town Attorney, John Folmer; Water & Sewer Sup't., Peter
Alteri; Town Planning Board member Nick Renzi and News Reporter, Chris Nolan.
Supervisor Thorpe called the meeting to order.
Motion by Councilman O'Donnell

Supervisor Thorpe offered privilege of the floor to Nick Renzi.
Mr. Renzi discussed the "field trip" with David Tagg of McNeil - Tagg Engineers,
Anthony Bonarti, Carl Bush, Theodore Testa and Edwin O'Donnell. The group met within
the Renaissance Development. They visual inspected the drainage problem within the area
investigating Anthony Bonarti property also. All in attendance agreed the area has a
drainage problem. Because the existing ravine is within a wooded area it would be
difficult to move equipment in and out in order to install "rip rap". David Tagg suggested
an easement could be attained from the property to the north, the Ottenschot property to
dig a new ravine. Fill from the new ravine could be used to fill in the ditch area near Mr.
Bonarti's property. That ditch near Mr. Bonarti's property has become approximately 8'
wide and 6' deep over several years.
Councilman Testa and O'Donnell suggested involving the Town of Homer to assist
since the flow of water begins on top of Cosmos Hill in the Town of Homer. It was
requested Highway Sup't. Carl Bush contact the Town of Homer's Highway Sup't. Tom
Bell f or discussion on this issue.
Nick Renzi commended Highway Sup't. Carl Bush and his crew for a job well done
applying base coat within DaVinci and Raphael Drives. It was stated the shoulders would
be dressed up with gravel soon.
Councilman Testa discussed the continuing problem with traffic between Westmore
Lane and Commons Ave. Mr. Testa suggested a chain with a lock be put into place for
emergency vehicle use only. Attorney .Folmer will investigate the suggestion to see if the
Town of Cortlandville has legal jurisdiction to install a chain across an access road.
Monthly reports for August 2000 for the Justice and SPCA are on the table for
review and filed in the Town Clerk's office.

Supervisor Thorpe apprised the Board of a letter received by property owner Paul
Semeraro of Kinney Gulf Rd. Mr. Semeraro is requesting town water. Currently Mr.
Semeraro's well water smells and tastes like sulfur. When the Highland Rd. and
Collegview water project occurred several years ago this property was not included. The
town's existing water line is approximately 50' from this property.
Supervisor Thorpe spoke to Town Engineer Hayne Smith regarding the extension
of a water line to Mr. Semeraro's properly. Engineer Smith suggested, if the Board so
desired, to incorporate this water extension within the Highland and Kinney Gulf Rd.
Sewer Project drawings now. Mr. Smith estimated the cost to be $12,000.00. Several
other homes within this area would be able to connect to town water.
Councilman Testa made a motion, seconded by Councilman Rocco, to receive and
file a letter from Paul Semeraro from Kinney Gulf Rd. requesting connection to town
water. All voting aye, the motion was carried.
RESOLUTION #177 AUTHORIZE TOWN ENGINEER TO INCORPORATE A
WATER MAIN EXTENSION ON KINNEY GULF ROAD
WITHIN THE HIGHLAND ROAD SEWER PROJECT
Motion by Councilman Testa
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Town Engineer is hereby authorized and directed to incorporate
within the Highland Road Sewer Project, plans to extend the water main on Kinney Gulf
Rd. for an estimated cost of $12,000.00
Councilman Rocco apprised the Board of a tour he attended of the Suit-Kote
facility. Mr. Rocco asked if one Board member could participation in such activities for
representation of our town. The Board will coordinate with each other for attendance for
future functions.
Attorney Folmer reports:
Yellow Lantern Campground:
The appeal with Suit-Kote and Yellow Lantern Campground was argued in court
last Monday. Within 6 to 8 weeks there should be a decision.
Supervisor Thorpe attended the appeal with Attorney Folmer noting Mr. Folmer
and Attorney Bernstein representing Suit-Kote did a wonderful job arguing the case.
Aquifer Protection Permits:
The current ordinance requires the Town Board give notice of Public Hearings for
such applications. Not more than 20 days and not less than 10 days in advance of the
scheduled Public Hearing. The problem with this current time frame is the legal notice can
not always be posted and published in time. Also the time frame can hold up the applicant.
Mr. Folmer spoke with CEO Bruce Weber regarding this issue to see if there was a statute
stating this time frame. Mr. Weber was unaware of one. Mr. Folmer entertained to the
Board adopting a Local Law changing the time frame to 15 days and not less than 5 days
for publication. The Board agreed. Mr. Folmer will draft the proposed Local Law for the
next meeting and schedule a Public Hearing at that time.
Wallace Industries:
Attorney Folmer read an article in the local newspaper regarding a proposed scrap
yard to be located in Polkville. The property is owned by Suit-Kote with a possible lease
agreement with Wallace Industries. The Cortland County Planning Board as stated in the
newspaper, has referred the application back to the town for local determination. Attorney
Folmer advised the Board to carefully look at the application when presented for
environmental issues, water control, etc.
Councilman O'Donnell questioned the status of Kris Larson's recycling facility in
Blodgett Mills. Attorney Folmer- reported he spoke with CEO Bruce Weber regarding
Larson's approval with conditions as stated by residents from the Blodgett Mills area. Mr.
Weber did not find within minutes any condition place upon Nfr. Larson's application.
Councilman O'Donnell will revisit the site and report back to the Board.

Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive
and file Cortlandville Fire District Operating Budget for 2001. All voting aye, the motion
was carried.
Councilman O'Donnell made a motion, seconded by Councilman Rocco, to recess
the Regular Meeting to an Executive Session regarding a personnel matter. All voting aye,
the motion was carried.
The meeting was recessed at 5:30 p.m.
The following information was received from the Supervisor's office.
Councilman Testa made a motion, seconded by Councilman Rocco, to adjourn the
Executive Session and reconvene to the Regular Meeting. All voting aye, the motion was
carried.
RESOLUTION #178 AUTHORIZE WATER & SEWER SUPERINDENTENT TO
HIRE AN ADDITIONAL EMPLOYEE
Motion by Councilman Testa
Seconded by Councilman Rocco
NOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Water & Sewer Sup't. is hereby authorized to hue an additional
employee immediately with a salary not to exceed $24,000.00.
Councilman O'Donnell made a motion, seconded by Councilman Rocco, to adjourn
the Regular Meeting. All voting aye, the motion was carried.
The meeting was adjourned at 5:43 p.m.
