Members present: Absent: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, John Pilato Town Clerk, Karen Snyder Councilman, Ronal Rocco Others present were: Town Attorney, John Folmer; Highway Sup't., Carl Bush; Water and Sewer Sup't., Peter Alteri; Town Planning Board Member, Nick Renzi; Joseph Reagan of Royal Chevrolet; Town Residents, Pat Breed, Gary Henry, Scott Cavillier, Steve Wilson, Anthony Bonarti, Wilma Puderbaugh, Gerrick Henry, John Bishop; News Reporter, Chris Nolan. Supervisor Thorpe called the Public Hearing to order. The Town Clerk read aloud the Legal Notice, as published, posted and filed. Supervisor Thorpe offered privilege of the floor to those in attendance. Joe Reagan of Royal Chevrolet in Cortland explained the Aquifer Protection Permit application is a request for a 1,000-gallon petrohopper gas tank system to be installed at 3838 Route 281. He explained a petrohopper is an above ground gas storage and spill containment tank. Town Planning Board member, Nick Renzi, stated the vendor for this project. made a presentation at the Planning Board meeting. Councilman Testa stated the Town and County Planning Boards have approved this application. With no further comments or questions heard the Public Hearing was adjourned. Councilman Testa made a motion, seconded by Councilman O'Donnell, to close the Public Hearing. All voting aye, the motion was carried. LOCAL LAW OF 2000 BINGO A Public Hearing was held by the Town Board of the Town of Cortlandville at the Town Hall, 3577 Terrace Road, Cortland, New York, regarding the adoption of a Local Law of the Town of Cortlandville for the year 2000 which would permit the conduct of Bingo by authorized organizations pursuant to the Rules and Regulations of the New York State Racing and Wagering Board within the Town of Cortlandville, exclusive of the Village of McGraw. Members present: Absent: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, John Pilato Town Clerk, Karen Snyder Councilman, Ronal Rocco Others present were: Town Attorney, John Folmer; Highway Sup't., Carl Bush; Water and Sewer Sup't., Peter Alteri; Town Planning Board Member, Nick Renzi; Joseph Reagan of Royal Chevrolet; Town Residents, Pat Breed, Gary Henry, Scott Cavillier, Steve Wilson, Anthony Bonarti, Wilma Puderbaugh, Gerrick Henry, John Bishop; News Reporter, Chris Nolan. Supervisor Thorpe called the Public Hearing to order. The Town Clerk read aloud the Legal Notice, as published, posted and filed. Supervisor Thorpe offered privilege of the floor to those in attendance. Gary Henry of Blodgett Mills thanked the Board for pursuing this proposed Local Law. Mr. Henry feels this will open opportunities for nonprofit organizations to raise extra money. Attorney Folmer apprised the Board the statute he wrote is "Bingo Authorization Law". If voter approved it would allow Bingo to be conducted within the town. Attorney Folmer stated he has corresponded with Village of McGraw's attorney John Ryan, Jr. concerning the Town Board's intention regarding this law. If the Village of McGraw intends to allow bingo in the village, they will need to adopt a local law also. Attorney Folmer commented on the rigorous and various requirements connected with this law. The proposed Bingo Law will go before the voters as a proposition - Local Law #5 of 2000 and needs approval by a majority of the voters at the next General Election. If approved it will then be filed with the State before it becomes effective. Councilman O'Donnell stated the organizations interested in the passing of this law will need to promote it. With no further comments or questions heard the Public Hearing was adjourned. Councilman Testa made a motion, seconded by Councilman Pilato, to close the Public Hearing. FOR PROPERTY LOCATED AT 3838 NIS ROUTE 281 Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, an Aquifer Protection Permit application was submitted by Royal Chevrolet Cortland Inc., for property located at 3838 NYS Route 281, permitting the installation of a 1,000 gallon petrohopper gas tank system, tax map #87.17-01-10.211 and WHEREAS, the Town Board as Lead Agent, duly reviewed and completed the Short Environmental Assessment Form, therefore BE IT RESOLVED, the Town Board, as Lead Agent, does hereby declare the proposed project of Royal Chevrolet Cortland Inc., Aquifer Protection Permit #4 of 2000, shall have no significant environmental impact. 'S SEPTEMBER 6, 2000 TOWN BOARD MEETING PAGE 2 RESOLUTION #167 AUTHORIZE SUPERVISOR TO SIGN SEQRA APPLICATION OF AQUIFER PROTECTION PERMIT #4 OF 2000 Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Supervisor is hereby authorized and directed to sign the SEQRA application relating to Aquifer Protection Permit #4 of 2000, submitted by Royal Chevrolet Cortland Inc. RESOLUTION #168 APPROVE AQUIFER PROTECTION PERMIT #4 FOR OF 2000 ROYAL CHEVROLET CORTLAND INC. FOR PROPERTY LOCATED AT 3838 NYS ROUTE 281 SUBJECT TO CONDITIONS Motion by Councilman Pilato Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, the Cortland County Planning Department and the Town Planning Board have reviewed and recommended approval of this Aquifer Protection Permit application subject to conditions, and WHEREAS, a Public Hearing was duly held by this Town Board, therefore BE IT RESOLVED, the Town Board does hereby approve Aquifer Protection Permit #4 of 2000, submitted by Royal Chevrolet Cortland Inc., for property located at 3838 NYS Route 281 permitting the installation of a 1,000 gallon petrohopper, tax map #86.17-01- 10.211, subject to the following conditions: 1) The applicant filing for and receiving a petroleum bulk storage permit from the County Health Department. 2) A spill prevention, control and countermeasures (SPCC) plan as required by the EPA must be completed and on file at the facility. 3) A negative declaration of environmental impact under SEQRA. and it is further RESOLVED, the Supervisor is hereby authorized and directed to sign the permit. Supervisor Thorpe offered privilege of the floor to Scott Cavallier. Scott Cavallier of 4074 Westmore Lane, expressed his concerns with the access road from Commons Ave. to Westmore Lane being used as a thoroughfare. Attorney Folmer stated he understood the acceptance of Commons Ave went to the top of the hill but did not go onto Westmore Lane. The access road is to be used for emergency access only. Presently the only sign at the top of Commons Ave. is a "Dead End" sign. Highway Sup't. Carl Bush stated "Emergency Vehicles Only" signs have been ordered. One to be posted at the top of Commons Ave. and one at the other end of the access road at Westmore Lane. Attorney Folmer stated the town has the authority to restrict usage on certain roads. Disobeying a traffic control sign is a vehicle and traffic violation and the police could be called. Other problems discussed were children riding bikes and playing on the access road. "Children at Play" signs are not recommended by the State. Children believe they are allowed to play in the road with such signs. Attorney Folmer will look at. the minutes of the Town Board meeting regarding the exact acceptance of Commons Ave. F 1 Supervisor Thorpe offered privilege of the floor to Anthony Bonarti. PAGE 3 3 6 -7 Anthony Bonarti of 4444 Raphael Drive, spoke in reference to the drainage problem in the Renaissance Development. He inquired into the town's intentions regarding the rip - rap delivered to Davinci Drive and when the north side of the Renaissance Development would be accomplished. Mr. Bonarti explained the ditch problem behind his house. Highway Sup't. Bush stated the rip -rap delivered is for the retention basin to be built in that area. The water needs to be slowed down first. Planning Board member Nick Renzi suggested an engineering assessment be done to evaluate the whole problem in the Renaissance Development. The rip -rap will need to be accomplished regardless of a retention basin. A discussion was held concerning hiring a different consulting firm to assess the drainage problems in the Renaissance Development. RESOLUTION #169 AUTHORIZE SUPERVISOR TO HIRE MCNEIL AND TAGG ENGINEERING FIRM TO INVESTIGATE DRAINAGE PROBLEMS IN THE RENAISSACE DEVELOPMENT Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED: the Board does hereby authorize and direct the Supervisor to hire McNeil and Tagg Engineering firm to investigate drainage problems in the Renaissance Development, and it is further RESOLVED, Planning Board member Nick Renzi will offer any assistance necessary. Supervisor Thorpe offered privilege of the floor to Wilma Puderbaugh. Wilma Puderbaugh of 3588 Terrace Road, expressed her concerns with debris along Thomas and Donna Keane's fence line that borders her property. Mrs. Puderbaugh inquired into proposing a change to the zoning law. Mrs. Puderbaugh spoke with Code Enforcement Officer, Bruce Weber who stated what she calls "junk" are their possessions. Attorney Folmer stated the Keane's have been prosecuted in the past for different code violations. He will speak with Mr. Weber regarding this complaint. Mrs. Puderbaugh also stated when the repaving of Terrace Road was completed the end of her driveway was not filled in. She now has a problem with ice build-up. Highway Sup't. Bush stated the Town of Cortlandville repaved Terrace Road and he would look at her driveway. Supervisor Thorpe offered privilege of the floor to Pat Breed. Pat Breed of Blodgett Mills, stated since the June Town Board meeting in Blodgett Mills nothing has been done with the Dutcher house. There are various personal possessions still in the yard. Councilman O'Donnell stated Code Enforcement Officer Bruce Weber is checking on Mr. Dutcher's property. Councilman O'Donnell will speak with Mr. Weber. Attorney Folmer inquired about Lowell Craft's house. Mrs. Breed stated there is a "For Rent" sign in the front yard and the front door is now closed. Supervisor Thorpe offered privilege of the floor to Steve Wilson. Mr. Wilson inquired into the proposed Manufactured Housing Law tabled from the last Town Board meeting. Attorney Folmer stated he has a Manufactured Housing Law draft with him tonight for the Board's consideration. Monthly reports for July of 2000 for the SPCA and August of 2000 for the Town Clerk are on the table for review and filed in the Town Clerk's office. Supervisor Thorpe commented on conservation licenses sold in the Town Clerk's office. The town receives only a small portion of the fees collected. b SSEPTEMBER 6, 2000 TOWN BOARD MEETING PAGE 4 RESOLUTION #170 ADOPT LOCAL LAW NO.5 OF 2000 AUTHORIZING THE CONDUCT OF BINGO GAMES BY AUTHORIZED ORGANIZATIONS WITHIN THE TOWN OF CORTLANDVILLE SUBJECT TO MANDATORY REFERENDUM Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, a resolution was duly adopted by the Town Board of the Town of Cortlandville for a public hearing to be held by said Board to hear all interested parties on a proposed Local Law entitled "Bingo", and WHEREAS, notice of said public hearing was duly published in the Cortland Standard, the official newspaper of the said Town, and posted at Town Hall, 3577 Terrace Road, Cortland, New York, as required by law, and WHEREAS, said public hearing was duly held and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law, or any part thereof, and WHEREAS, the Town Board of the Town of Cortlandville, after due deliberation, finds it in the best interest of the Town to adopt said Local Law, therefore Be it enacted by the Town Board of the Town of Cortlandville as follows: Section 1 Statutory Authority: Title This Local Law is adopted pursuant to the authority of article 14-H of the General Municipal Law of the State of New York and shall be know as the "Bingo Control Law". A. The words and terms used in this Local Law shall have the same meanings as such words and terms are used in article 14-H of the General Municipal law, unless otherwise provided herein or unless the context requires a different meaning. Section 3 Bin_..go Games Authorized: Restrictions Pursuant to, and in accordance with, the provisions of the General Municipal Law of the State of New York and other applicable provisions of law, it shall be lawful for any authorized organization, upon obtaining a license therefor (as provided in article 14-H of the General Municipal Law) to conduct bingo games within the territorial limits of the Town of Cortlandville, subject to the provisions of this Local law, the provisions of article 14-H of the General Municipal Law, the provisions of Section 479 of the General Municipal Law, and any applicable rules and regulations set forth by the New York State Racing and Wagering Board. Section 4 When Effective In accordance with the provisions of section 496 of the General Municipal Law and section 23(1) of the Municipal Home Rule Law, this Local Law shall not become operative or effective unless and until it shall have been approved at the next general election held within the Town by affirmative vote of a majority of the qualified electors of the Town voting upon the proposition. Attorney Folmer stated adopting this local law would place it on the ballot for voter approval. The Election Board needs a 56-day notice to place this on this November's ballot. 1 1 1 ICJ SEPTEMBER 6, 2000 TOWN BOARD MEETING PAGE 5 RESOLUTION #171 ACKNOWLEDGE RECEIVING A NOTICE OF CLAIM FILED BY MATTHEW PACE OF 1284 FISHER AVE. Motion by Councilman O'Donnell Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Board does hereby acknowledge, by receiving and filing, the Notice of Claim, filed by Matthew Pace of 1284 Fisher Avenue. Attorney Folmer stated this notice has to do with alleged damages suffered by Matthew Pace in connection with the Fisher Ave. Water and Sewer connection project. Attorney Folmer has spoken with Town Engineer Hayne Smith. Mr. Smith stated neither the town nor the contractors were the cause of any damage to the landowner's properly. The town's insurance adjuster is investigating the claim and will deal with the matter appropriately. Town Clerk Karen Snyder apprised the Board of an informal meeting the NYS DOT will be holding at Town Hall on September 27, 2000 at 7:00 p.m. regarding their replacement of the bridge on Route 11 near Hoxie Gorge. Attorney Folmer reported: Suit-Kote/Panzanella Litigation: Attorney Folmer apprised the Board of the Suit-Kote/Panzanella zoning litigation, scheduled for September 11, 2000 at 1:00 p.m. in Albany. A decision should be reached 60 to 90 days after. Pall Trinity Micro Certiorari Preceding: Attorney Folmer apprised the Board of the pending certiorari proceeding regarding a tax levy against PTM. The motion is returnable on September 15, 2000. This standard motion will be put on the judge's deferred calendar until appraisals are accomplished. Manufactured Housing Zoning Law: Attorney Folmer stated the Town Planning Board recommended amending the zoning law to permit manufactured housing in agricultural zones subject to conditions of a site review and a public hearing for each application. Attorney Folmer spoke with Code Enforcement Officer Weber regarding the Planning Board's conditions. A concern of the Planning Board is in the view of some property owners, manufactured housing may depreciate the value of their homes. The Planning Board has set requirements for a manufactured home in an agricultural zone. Attorney Folmer explained difficulties may arise in the future if a Public Hearing is required for a manufactured home that has satisfied those requirements. No Public Hearing is required for a stick built home. In 1976 the Federal Government enacted standards for manufactured housing and is administered by HUD. The ordinance as Attorney Folmer drafted for the Board's consideration adds manufactured housing to the definition of the Town Zoning Law. The ordinance also requires a site plan review for manufactured housing with no public hearing and amends uses in an agricultural zone. RESOLUTION #172 ADOPT LOCAL LAW NO.6 OF 2000 AMENDING THE ZONING LAW OF THE TOWN OF CORTLANDVILLE TO PERMIT THE LOCATION OF MANUFACTURED HOUSING IN AGRICULTURAL ZONES Motion by Councilman Pilato Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, a resolution was duly adopted by the Town Board of the Town of Corllandville for a public hearing to be held by said Board to hear all interested parties on a proposed Local Law entitled "Amendment to Permit the Location of Manufactured Housing in Agricultural Zones," and SEPTEMBER 6, 2000 TOWN BOARD MEETING PAGE 6 WHEREAS, notice of said public hearing was duly published in the Cortland Standard, the official newspaper of the said Town, and posted at Town Hall, 3577 Terrace Road, Cortland, New York, as required by law and WHEREAS, said public hearing was duly held and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law, or any part thereof, and WHEREAS, pursuant to Part 617 of the implementing regulations pertaining to Article 8 (State Environmental Quality Review Act) of the Environmental Conservation Law it has been determined by the said Town Board that adoption of said proposed Local Law would not have a significant effect upon the environment and could be processed by their applicable governmental agencies without further regard to SEQRA, and WHEREAS, the Town Board of the Town of Cortlandville, after due deliberation, finds it in the best interest of the Town to adopt said Local Law, NOW, THEREFORE, the Town Board of the Town of Cortlandville hereby adopts said Local Law as Local Law No. 6 — 2000 entitled "Amendment to Permit the Location of Manufactured Housing in Agricultural Zones", a copy of which is attached hereto and made a part hereof, and the Town Clerk be and she hereby is directed to enter said Local Law in the minutes of this meeting and in the Local Law Book of the Town of Cortlandville, and to give due notice of the adoption of said local law to the Secretary of State. Be it enacted by the Town Board of the Town of Cortlandville as follows: Section 1. The Definition Section of the Town of Cortlandville Zoning Law is amended to add the f ollowing definition: "Manufactured Housing — A single family dwelling built according to the Federal Manufactured Housing Construction and safety Standards (24 CFR 3280) HUD Code which is at least a Double Wide measuring 23x40 feet, with skirting enclosure constructed of a masonry material in accordance with generally accepted standards." Section 2. Section 178-14 of the Town of Cortlandville Zoning Law is amended by adding to said Section a new subdivision to read as follows: D. Manufactured Housing Section 3. This act shall take effect upon filing with the Secretary of State of the State New York as required by law. Councilman Pilato made a motion seconded by Councilman Testa, to receive and file correspondence from the NYS Board of Real Property Services regarding the Town of Cortlandville equalization rate. All voting aye, the motion was carried. The correspondence informed the Board the final State Equalization Rate is at 102.42. Councilman Testa made a motion seconded by Councilman O'Donnell, to receive and file correspondence from the NYS Department of Real Property Services regarding the Town of Cortlandville's 1999 Maintenance Aid Certification. All voting aye, the motion was carried. The correspondence informed the Board the town has met the NYS Board of Real Property Services standards and is eligible for a Maintenance Aid payment. SEPTEMBER 6, 2000 TOWN BOARD MEETING PAGE 7 '�' I RESOLUTION #173 AUTHORIZE WATER AND SEWER SUP'T. TO LET OUT FOR BID A NEW MUNICIPAL BUILDING AND SET DATE OF OCTOBER 02, 2000 AT 3:00 P.M. FOR BID OPENING AND AWARD BID ON OCTOBER 04 2000 Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Board does hereby authorize the Water and Sewer Sup't. to let out for bid, a new municipal building, and further RESOLVED, the bid opening date shall be set at 3:00 p.m. on October 02, 2000, and further RESOLVED, the Town Board shall award the bid attheir scheduled meeting on October 4, 2000. Councilman Testa made a motion, seconded by Councilman Pilato, to receive and file the Cortland County Planning Board's recommendations for an Aquifer Protection Permit application submitted by Gary Crisalli representing Intertek. All voting aye, the motion was carried. RESOLUTION #174 SCHEDULE A PUBLIC HEARING FOR AN AQUIFER PROTECTION PERMIT APPLICATION SUBMITTED BY GARY CRISALLI FOR PROPERTY LOCATED AT US ROUTE 11 Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, a Public Hearing shall be scheduled for September 20, 2000 at 5:00 p.m. for an Aquifer Protection Permit application submitted by Gary Crisalli representing Interiek located at US Route 11, tax map #87.00-03-20.000. Supervisor Thorpe opened a discussion regarding the Water and Sewer Sup't.'s request for an additional employee. Councilman O'Donnell inquired into how the new building and an additional employee would effect the water and sewer rates. Water and Sewer Sup't Peter Alteri explained an additional employee would not cause a rate increase. The rates will change regardless of a new employee due to the rapid growth of the town. Councilman O'Donnell expressed his concern for the continual increase in the number of projects and the town's ability to afford them. Mr. Alteri commented the Board might want to slow projects down in order to maintain what is currently in place. In reference to the municipal building, Mr. Alteri stated prevailing rates apply for work done for a government project, which raises the cost of construction for the municipality. Mr. Alteri was uncertain of the effect the building would have on water and sewer rates. Planning Board member Nick Renzi suggested assessing financial revenues from the water and sewer department to determine the effect of an additional employee and a new building with the water and sewer rates. Highway Sup't. Carl Bush stated the City of Cortland recently raised their water and sewer rates and the town's rates remain among the lowest in the area. Supervisor Thorpe requested Mr. Alteri compare the current water and sewer budget with the new proposed budget to determine the impact an additional employee would have on the water and sewer rates. The decision on a new employee is tabled until the next. Board meeting. SEPTEMBER 6, 2000 TOWN BOARD MEETING PAGE 8 RESOLUTION #175 AUTHORIZE SELLING SURPLUS EQUIPMENT AT MUNICIPAL AUCTION IN THE TOWN OF CAMILLUS Motion by Councilman Testa Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Board does hereby authorize disposing at the municipal auction to be held October 27, 2000 in the Town of Camilus, NY, surplus equipment as follows: 1) 1982 FMC Sewer Cleaner (serial #259062) 2) Solar Mig Welder (serial #S02225) 3) Harley Power Rake (serial #59AC1027) FURTHER RESOLVED, said equipment shall be removed from the Town's Fixed Assets program. Attorney Folmer mentioned to the Board according to 1622 of the Vehicle Traffic Law the Town Board has no authority to fix speed limits on County roads.
