TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 3577 Terrace Road, Cortland, New York, with Supervisor Thorpe presiding. Members present: Absent: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Town Clerk, Karen Snyder Councilman, John Pilato Others present were: Town Attorney, John Folmer; Highway Sup't., Carl Bush; Water/Sewer Sup't, Peter Alteri; Planning Board member, Nick Renzi; town residents, Anthony Bonarti, John Bishop, Lydia Ferro; and News Reporter, Chris Nolan. Supervisor Thorpe called the meeting to order. Councilman O'Donnell made a motion, seconded by Councilman Testa, to approve the Town Board Minutes of June 07, 2000 as written. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Testa, to approve the Town Board Minutes of June 21, 2000 as written. All voting aye, the motion was carried. Councilman Testa made a motion, seconded by Councilman O'Donnell, to approve the Town Board Minutes of July 05, 2000 as written. All voting aye, the motion was carried Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file Cortlandville Zoning Board of Appeal Minutes of May 30, 2000 as written. All voting aye, the motion was carried POW""JW9 r. ►, .r , Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers #414 - 434 $ 15,263.92 General Fund B 100 - 104 $ 35,862.41 Highway Fund DB 283 - 310 $ 60,267.13 Water Fund 207 - 221 $ 12,161.24 Sewer Fund 120 - 132 $ 95,517.39 Capital Projects 43 - 43 $ 1,000.00 Supervisor Thorpe offered privilege of the floor to Anthony Bonarti Mr. Bonarti referred to an article published in the Cortland Standard on Friday August 4, 2000 regarding flooding within the Renaissance Development. The article indicated the Town of Cortlandville has plans to eliminate the flooding by coordinating the Route 281 widening with the Renaissance/Cosmos Hill drainage plan. Mr. Bonarti's concern was nothing was mentioned of the drainage problems on the north side of the Renaissance Development where his property is located. He explained the growth the ditch on his property has become due to eroding topsoil from rushing water. -So U AUGUST 16, 2000 TOWN BOARD MEETING PAGE 2 Mr. Bonarti requested "rip -rap" be installed on his property as was done on the south side of the Renaissance Development. Also a retention basin be built. He felt water could overflow to a "rip -rapped" drainage ditch extending down the hill to Route 281 and tie into the proposed drainage system adjacent to Adam's properly. The Board explained to Mr. Bonarti the past drainage problems of the Renaissance area. The discussion continued regarding efforts to rectify the situation in corporation with the widening of Route 281 and the use of more "rip -rap". A discussion occurred to speak with Thoma Development Consultants regarding applying for grant money to offset the expense of correcting the drainage problems. The Board agreed the town would look into Mr. Bonarti's request of flooding within his property. Councilman Rocco made a motion, seconded by Councilman Testa, to receive and file correspondence from Anthony Bonarti. All voting aye, the motion was carried. The letter was in regards to Mr. Bonarti's concerns with water drainage on his property and within the Renaissance Development. Supervisor Thorpe offered privilege of the floor to Councilman O'Donnell. Councilman O'Donnell apprised the Board of a request he received concerning lines being painted on the side of the road of Clinton Street Extension located outside the Village of McGraw. With no ditches along the road it is difficult to distinguish the sides of the road when it is foggy. Highway Sup't. Bush stated many roads do not have lines painted on the sides. He will look into the request. Councilmen O'Donnell also discussed the possibility of a left turn arrow onto Groton Ave. from Route 281. Supervisor Thorpe stated a request to the NYS DOT has been made in the past. A discussion was held regarding cars passing on the right while a car is attempting to turn left onto DaVinci Drive from Route 281. This is a dangerous situation. Attorney suggested calling the State Police as this may be a violation of the vehicle traffic law. Supervisor Thorpe referred to a memorandum from the Department of Solid Waste concerning amnesty day for disposing of old tires and containers that may hold water. Residents may bring these items to the landfill between August 21' - 25'h-. Old tires maybe brought to the town highway garage also. Amnesty Day is being held through the County due to the West Nile Virus outbreak. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file the Cortland Free Library Report for 1999. All voting aye, the motion was carried. Monthly reports for July 2000 for the Town Justice are on the table for review and filed in the Town Clerk's office. Attorney Folmer reported: Land purchase on Starr Road: Attorney Folmer has checks ready for the purchase of property on Starr Road from Gary Law. The deed will be picked up from Mr. Law on Monday. RESOLUTION #159 ACCEPT DEED TO LAND PURCHASED FROM GARY LAW FOR PROPERTY LOCATED ON STARR RD. FOR A FUTURE TOWN PARK SUBJECT TO TOWN ATTORNEY APPROVAL Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED 11 1 BE IT RESOLVED, the Town Board does hereby accept the deed for land purchased from Gary Law for property located on Starr Rd. subject to Town Attorney approval. -36l AUGUST 16, 2000 TOWN BOARD MEETING PAGE 3 Councilman Rocco inquired into the tax collector excepting credit cards for tax bill payments. Town Clerk/Tax Collector Karen Snyder stated she has no means of excepting credit cards at this time. Attorney Folmer continued: Traffic flow and drainage problems on Route 281: Attorney Folmer stated the letter to be drafted to Senator Seward regarding traffic flow and the drainage problems on Route 281 was not written due to a meeting held with the Senator where these problems were discussed. Manufactured Housing: Attorney Folmer stated the main concern with the proposed Manufactured Housing Law is the necessity of a public hearing for each manufactured home request. A public hearing needs to be scheduled for the public to speak on this issue. RESOLUTION #160 SCHEDULE PUBLIC HEARING FOR LOCAL LAW-2000 MANUFACTURED HOUSING Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, a Public Hearing shall be scheduled for September 06, 2000 at 7:00 p.m. for Local Law-2000 Manufactured Housing. Bingo: A request has been made for Bingo to be allowed in the Town of Cortlandville. Attorney Folmer apprised the Board if adopted, this Local Law must go to a mandatory town wide referendum by being placed on a General Election ballot. The vote would exclude the Village of McGraw. The village must adopt their own Local Law if they choose to allow Bingo. Before the Bingo Local Law can be adopted and placed on the ballot, a Public Hearing must be held at least 60 days prior to the General Election. The Board of Elections must receive the request at least 56 days before the General Election in order to prepare the ballot. If this is not accomplished the alternative is to wait until the next election or bear the expense of a Special Election. Attorney Folmer distributed draft copies of the proposed Local Law for the Board's consideration. RESOLUTION #161 SCHEDULE PUBLIC HEARING FOR LOCAL LAW-2000 BINGO Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, a Public Hearing shall be scheduled for September 6, 2000 at 7:00 p.m. for Local Law-2000 Bingo. RESOLUTION #162 RESCHEDULE A PUBLIC HEARING FOR AN AQUIFER PROTECTION PERMIT APPLICATION FOR ROYAL CHEVROLET FOR PROPERTY LOCATED AT 3838 NYS ROUTE 281 Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, a Public Hearing shall be rescheduled for September 06, 2000 at 7:00 p.m. for an Aquifer Protection Permit application submitted by Royal Chevrolet for property located at. 3838 NYS Route 281, tax map #86.17-01-10.211. AUGUST 16, 2000 TOWN BOARD MEETING PAGE 4 RESOLUTION #163 AUTHORIZATION TO AMEND TOWN OF CORTLANDVILLE 2000 BUDGET Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Board does hereby authorize and direct the Town Supervisor to amend General Fund B, expense account B1940.2 from $0.00 to $35,095.00, and it is further RESOLVED, these monies will be utilized for the land purchase on Starr Rd. for a future town park. RESOLUTION #164 AUTHORIZE SUPERVISOR TO TRANSFER $3,280.00 FROM THE SEWER FUND SURPLUS FOR THE CRESTWOOD COURT AND PENDLETON ST. SEWER PROJECTS Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, the Bookkeeper has requested a cash advance be transferred from the Sewer Fund Surplus to the Crestwood Court and Pendleton St. sewer project, therefore BE IT RESOLVED, the Supervisor is hereby authorized and directed to transfer $3,280.00 from the Sewer Fund Surplus to the Crestwood Court and Pendleton St. sewer project, and it is further RESOLVED, the Sewer Fund Surplus will be replenished when these projects are bonded. With no further comments or questions the Regular Meeting was adjourned. Councilman O'Donnell made a motion, seconded by Councilman Testa, to adjourn the Regular Meeting.
