AQUIFER PROTECTION PERMIT
BORG-WARNER MORSE CORPORATION
3877 LUKER ROAD
TAX MAP #95.00-05-09.000
A Public Hearing was held by the Town Board of the Town of Cortlandville at the
Village of McGraw Community Center, McGraw, New York, concerning an Aquifer
Protection Permit application of Borg-Warner Morse Corp. permitting the operation of an
industrial facility located at the former NCC site at 3877 Luker Road in the Town of
Cortlandville, tax map parcel #95.00-05-09.000.

Supervisor Thorpe called the Public Hearing to order.
The Town Clerk read aloud the Legal Notice, as published, posted and filed.
Supervisor Thorpe offered privilege of the floor to those in attendance.
No questions or comments were heard.
Councilman Testa made a motion, seconded by Councilman O'Donnell, to close the
Public Hearing. All voting aye, the motion was carried.
The hearing was closed at 7:02 p.m.

TOWN BOARD MEETING
The Regular Meeting of the Town Board of the Town of Cortlandville was held at
the Village of McGraw Com
munity mmunity Center, McGraw, New York, with Supervisor Thorpe
presiding.
Members present:

Supervisor Thorpe called the meeting to order followed by a tour of the McGraw
Library and a Public Hearing for an Aquifer Protection Permit application.

Monthly reports f or the Town Clerk f or April 2000 and SPCA f or March 2000, are
on the table for review and filed in the Town Clerk's office.
Attorney Folmer reported:
Zoning Violations:
Attorney Folmer requested Town Clerk Snyder f orward a memo to Code
Enforcement Officer, Bruce Weber regarding three zoning violations. One violation may
have been corrected. CEO Weber needs to forward the others to Judge Kelsen.

Pall Trinity Micro:
Attorney Folmer stated the refund for Pall Trinity Micro has been accomplished.
PTM attorneys have been hif ormed that this is the extent of the town's involvement. PTM
has made a request for copies of the original resolutions adopting the standards by which
water and sewer charges were established. Mrs. Snyder will forward these resolutions to
Attorney Folmer. If any other information is received from PTM, Attorney Folmer will
inform the Board.

BAN SALE:
Attorney Folmer stated the sale of the town's outstanding BANS for approximately
$2,270,000 is anticipated for June 10, 2000 with the money distribution being June 1 S" ,
2000.
Planning Board Public Hearings:
The Town Planning Board has requested the Town Board change regulations
concerivng the necessity of a Public Hearing for each subdivision. According to the
Planning Board, based upon certain criteria, a Public Hearing may not be necessary.
Public. Hearing rules and regulations may be amended by the Planning Board through
resolution subject to approval of Town Board. The Planning Board is requesting full
discretion in determining if a Public. Hearing is necessary. It is not necessary for the Town
Board to hold a Public Hearing regarding this issue. Attorney Folmer stated he will speak
with Planning Board member, Nick Renzi, and will have more to report at the next Board
meeting.
Lowell Craft property:
Attorney Folmer stated Lowell Craft sold his property in Blodgett Mills to an
individual that purchases, renovates and rents or resells properties. Attorney Folmer
informed the attorneys involved of the zoning violations to this property. Presumably
these violations will be handled appropriately.
Privilege of the floor was offered to Dan Bilodeau.
Dan Bilodeau, Village of McGraw Recreation Director, thanked the Board and
Highway Sup't., Carl Bush, for support given to the Village Recreation Department. Mr.
Bilodeau stated lie has many activities planned and will keep the Board informed.
Councilman Rocco questioned the parking for games with regard to the new Elm
Street Extension.
Mr. Bilodeau stated parking is on the opposite side of the street but additional
parking is needed.
Councilman ®'Donnell inquired if all with the Elm Street Extension went well
between the Village, Town and County departments.
It was reported all did go well. The county handled most of the paperwork for the
project.
Arrival of John Helgren.
Councilman Pil ato made a motion seconded by Councilman Rocco, to receive and
file recommendations from the Cortland County Planning Board regarding the Aquifer
Protection Permit application of Borg-Warner Morse Corp. All voting aye, the motion was.
carried.
Supervisor Thorpe offered John Helgren privilege of the floor
John Helgren of the Cortland County Health Department, reminded and encouraged
the Board to consider municipal water for the Polkville area. Mr. Helgren stated many of
the public places in Polkville are on well water. According to Town Engineer, Hayne
Smith, municipal water in Polkville is potentially two years in the future. Mr. Helgren also
stated he would be willing to help the Board apply for any state aid necessary for this
project. Supervisor Thorpe inquired into the possibility of a state grant. Mr. Helgren
stated a low interest loan was more likely then a state grant. Supervisor Thorpe stated
there is no preliminary design at this time for the Polkville area.
Mr. Helgren encouraged the installation of town sewer on Highland and Kinney
Gulf Road. There are documented cases of failing septic systems in that area. A
discussion was held on municipal water in the Highland and Kinney Gulf Road area. Mr.
Helgren stated there is no issue with water only sewer problems. Supervisor Thorpe
stated there are plans for installing a sewer system in the future.

Nick Renzi, Town Planning Board member, commented on the need f or the Raphael
Drive water line project to be defined. Mr. Renzi recommends Resource Associates show
the completion of the water line continuing around Raphael Drive to the existing fire
hydrant. Mr. Renzi also recommended the laterals should be shown at 1" and not X". The
homes are set back too far from the road for a %" lateral to be effective.
Councilman O'Donnell commented on the Barker- house on Route 41 before you
enter the Village of McGraw. Attorney Fohner contacted the owner with a name of a
possible buyer. Councilman O'Donnell will investigate into the progress of the sale of this
home.
Attorney Folmer read aloud questions from the short environmental assessment
form for Borg-Warner Morse Aquifer Protection Permit application.
Councilman Rocco questioned the possibility of noise or odors clue to steam
released by the proposed industrial facility. He also expressed concerns regarding traffic
at the intersection of Luker Road and NYS Route 281.
Joe Gainey from Borg-Warner explained there would be no noise or odor from the
steam being released. He also stated the Development Corp. approached the NYS DOT
regarding a traffic light at the Luker Road and NYS Route 281 intersection due to increased
traffic in this area. The NYS DOT drawings indicate a traffic light is to be installed.
Supervisor Thorpe stated the Cortland County Planning Department and Board
recommended approval of Barg -Warner Morse Aquifer Protection Permit, subject to
conditions.
RESOLUTION #96 DECLARE NEGATIVE IMPACT FOR AQUIFER
PROTECTION PERMIT #2 OF 2000 BORG-WARNER
MORSE FOR PROPERTY LOCATED AT 3877 LUKER RD

VOTES: ALL AYE ADOPTED
WHEREAS, an Aquifer Protection Pen -nit application was submitted by Borg-Warner
Morse, property located at 3877 Luker Road the former NCC site owned by NCWP, LLC,
permitting the operation of an industrial facility, tax map #95.00-05-09.000 and
WHEREAS, the Town Board as Lead Agent, duly reviewed and completed the Short
Environmental Assessment Form, therefore
BE IT RESOLVED, the Town Board, as Lead Agent, does hereby declare the proposed
project of Borg-Warner Morse, Aquifer Protection Permit #2 of 2000, shall have no
significant environmental impact.
RESOLUTION #97 AUTHORIZE SUPERVISOR TO SIGN SEQRA
APPLICATION OF AQUIFER PROTECTION PERMIT
#2 OF 2000

VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Supervisor is hereby authorized and directed to sign the SEQRA
application relating to Aquifer Protection Permit #2 of 2000, submitted by Borg-Warner
Morse.

APPROVE AQUIFER PROTECTION PERMIT #2 OF 2000
FOR BORG-WARNER MORSE FOR PROPERTY
LOCATED AT 3877 LUKER ROAD SUBJECT TO
CONDITIONS

VOTES: ALL AYE ADOPTED
WHEREAS, the Cortland County Planning Department and the Town Planning Board
have reviewed and recommended approval of this Aquifer Permit Protection application
subject to conditions, and
WHEREAS, a Public. Hearing was duly held by this Town Board, therefore
BE IT RESOLVED, the Town Board does hereby approve Aquifer Protection Permit #2
of 2000, submitted by Borg-Warner Morse, for property located at 3877 Luker Road
permitting the operation of an industrial facility located at the former NCC site owned by
NC'WP, LLC., tax map #95.00-05-09.000, subject to the following conditions:
1) Secondary containment for chemical storage areas within the building be
provided.
2) The applicantprovides emergency and spill prevention and response plans for
the facility to be reviewed by the appropriate county agencies.
3) A subdivision being applied for and obtained which includes a provision that
the subdivision sections be consolidated by deed with the appropriate adjoining
parcels to prevent the creation of substandard or "landlocked" parcels.
4) A negative declaration of environmental impact. under SEQRA.

RESOLVED, the Supervisor is hereby authorized and directed to sign the permit.
RESOLUTION #99 AUTHORIZE AGREEMENT WITH NYS DOT FOR
THE NYS ROUTE 11 RECONSTRUCTION AND
PRESERVATION PROJECT LOCATED IN THE
TOWN OF CORTLANDVILLE
Motion by Councilman Rocco
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, the NYS DOT will be reconstructing NYS Route 11 from the Cortland North
City Lille to NYS Route 41 located in the Town of Cort.landville/Village of Homer,
Cortland County, Pin 304351121, and
WHEREAS, a request. was made by the NYS DOT for authorization to relocate one
manhole and sanitary line in conflict with proposed drainage, therefore
BE IT RESOLVED, the Town Board does hereby authorize the agreement with the NYS
DOT to relocate one manhole and sanitary line in conflict with proposed drainage along
NYS Route 11 in the Town of Cortlandville/Villlage of Homer.
Councilman O'Donnell in.ade a motion seconded by Councilman Pilato, to receive
and file correspondence from Town Attorney John Folmer to Attorney John Bardsley
regarding the Davinci Drive drainage project. All voting aye, the motion was carried.

Supervisor Thorpe stated a request to use Cortlandville's Citzens Park was received
from Homer Central School. They are requesting the park for practices and/or games next
school year for some of their teams. A discussion was held regarding scheduling and the
town's liability. It. was decided to table the request until further information is obtained.
Councilman Pilato will contact Evelyn L. Sammons, director of Physical Education and
Athletics for Homer Central School.
Councilman Pilato made a motion seconded by Councilman Testa, to receive and
file correspondence from NYS DDT to Assemblyman Martin Luster regarding McLean
Road traffic study. All voting aye, the motion was carried.
Attorney Foliner stated the Town Planning Board did not include the stormwater
management condition with their approval of Borg-Warner Morse Aquifer Protection
Permit. request as the stormwater management. regulation refers to a project of 10,000 sq.
feet or more. Borg -Warner's project is less than 10,000 sq. feet therefore does not qualify
for this condition.
Councilman Pilato made a motion, seconded by Councilman Testa, to adjourn the
regular meeting. All voting aye, the motion was carried.
The meeting was adjourned at 7:30 p.m.
