TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 3577 Terrace Road, Cortland, New York, with Supervisor Thorpe presiding. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Ronal Rocco Councilman, John Pilato Councihnan, Edwin O'Donnell Town Clerk, Karen Q. Snyder Others present were Town Attorney, John Folmer; Highway Sup't., Carl Bush; Planning Board Member, Nick Renzi; Water Supt., Peter Alteri; and News Reporter, Chris Nolan. Supervisor Thorpe called the meeting to order. Councilman O'Donnell made a motion, seconded by Councilman Testa, to approve the Town Board Minutes of January 19, 2000 as written. All voting aye, the motion was carried. Councilman Testa made a motion, seconded by Councilman O'Donnell, to approve the Town Board Minutes of February 02, 2000 as written. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file Town Planning Board Minutes of January 25, 2060. All voting aye, the motion was carried. Councilman Testa made a motion, seconded by Councilman O'Donnell, to receive and file Town Zoning Board of Appeals Minutes of January 25, 2000. All voting aye, the motion was carried. RESOLUTION #73 AUTHORIZE PAYMENT OF VOUCHERS - MARCH Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the vouchers submitted have been audited and shall be paid as f ollows: General Fund A Vouchers #122 - 177 $16,209.71 General Fund B 22 - 23 $ 54.87 Highway Fund DB 84 - 101 $18,874.86 Water Fund 68 - 89 $27,63-1.43 Sewer Fund 31 - 45 $ 5,766.97 Capital Projects 12 - 16 $ 3,342.55 Supervisor Thorpe offered privilege of the floor to those in attendance. Planning Board member, Nick Renzi inquired into the final decision regarding the water line extension for Raphael Drive. 1 1 231. MARCH 15, 2000 TOWN BOARD MEETING PAGE 2 Attorney Folmer explained the construction of the water line would be done on the north side of Raphael Drive past Dr. Ambrose's property. The water he is to go across the road and around the arc to prevent additional construction by Dr. Ambrose. The construction plan is for the water line to go down Raphael Drive far enough to be available to loop in the future. The present plan does not include the looping of lines but this should be done. Arrival of Councilman Pilato. Mr. Renzi continued stating Raphael Drive needs to be resurfaced. This should be done when the water line is installed. Raphael Drive was accepted from Dr. Ambrose and is relatively new but was poorly constructed and is falling apart. Mr. Renzi stated this is not a reflection on Highway Sup't. Carl Bush. Councilman Rocco stated road specifications have been updated since Raphael Drive was constructed. 1\1r. Renzi inquired into the money authorized at the February 16, 2000 Board meeting for the proposed new water and sewer building. It was explained the money authorized is f or an engineering design and is in the budget. If a new building is approved to be constructed it would be bonded. Water and Sewer Sup't., Peter Alteri, explained he is waiting for the plans to be completed to determine how much work can be done by his department. Monthly reports for the Supervisor and Justice for February 2000, are on the table for review and filed in the Town Clerk's office. Town Clerk, Karen Snyder, apprised the Board of a letter she received from the County Board of Elections Commissioners, Charlotte Bahou and Robert Howe. The letter was a request for the Town Board to move voting district 13-3 from Town Hall to the new Cortlandville Fire Station located at 999 NYS Route 13. A discussion was held regarding this issue. Town Clerk Snyder recommended reserving a decision until a response is received from the Fire District as their approval is required to hold elections in their building. No action was taken. Town Clerk Snyder also apprised the Board she will be out of town from April 14th through April 22, 2000 f or vacation with her f amily. Attorney Folmer reported: Ambrose Litigation: Attorney Folmer stated Dr. Ambrose's assessment litigation would be settled as per authorization from the Board at the March 1, 2000 meeting. A commitment from Dr. Ambrose regarding assessments of subdivided lots being a flat $25,000 rate per lot will now be a written agreement as opposed to the mutual understanding of the past. Pall Trinity discussions: PTM discussions continue concerning their water and sewer charges and benefit tax. Attorney Folmer explained a clerical error concerning PTM's water benefit tax and their questions regarding the calculation of the benefit tax. Assessor, David Briggs will analyze PTM's concerns regarding the benefit tax calculation, a proposal will be brought to the Board. Information regarding engineering contract: Attorney Folmer received an engineering contract from Water & Sewer Sup't., Peter Alteri regarding the design of a new water and sewer building. He has not had time to go over the contract as yet. �32 MARCH 15, 2000 TOWN BOARD MEETING PAGE 3 Consolidation of debt: Attorney Folmer stated Councilman Testa had asked for a review of consolidating all outstanding town debt and BANS into one Bond to save on interest rates. After speaking to Bond Council, Attorney Folmer stated there would be two important problems: 1). Certain bonds may not be able to be prepaid. 2). The consolidation of several bonds may not be saleable clue to size. Attorney Folmer felt consolidation would not be possible. This issue could be reviewed in the future. Mr. Renzi inquired about the assessment of two of Dr. Ambrose's subdivided lots on Raphael Drive. Attorney Folinier explained every subdivided unimproved lot is assessed at $25,000. Councilman O'Donnell made a motion, seconded by Councilman Pilato, to receive and file correspondence from Supervisor Thorpe to Jacquelyn Gailor, Director of Cortland County Board of Health. All voting aye, the motion was carried. The correspondence was in regards to the town's opposition to fluoride to the town's municipal `eater systems. Councilman O'Donnell made a motion, seconded by Councilman Pilato, to receive and file a packet of information regarding fluoridation in water systems submitted by Water Sup't., Peter Alteri at the March 01, 2000 Town Board Meeting. All voting aye, the motion was carried. RESOLUTION #74 DECLARE OPPOSITION OF FLUORIDATION TO CORTLANDVIL E'S WATER SUPPLY Motion by Councilman Rocco Seconded by Councilman. O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, at the March 1, 2000 Town Board Meeting a letter from the Cortland County Board of Health regarding fluoridation of municipal water was received and filed, and WHEREAS, at said meeting the Board received an informational packet from the town's Water Superintendent explaining the pros and cons of fluoride in municipal water supplies, therefore BE IT RESOLVED, based on the documentation submitted, the Board is in agreement that fluoride could be considered a medication and poses other unnecessary health risks, and it is further RESOLVED, the Town Board hereby opposes fluoridation of Cortlandville's water supply, and it is further RESOLVED, a certified copy of this resolution shall be forwarded onto the Cortland County Board of Health. Councilman Rocco requested an executive session. MARCH 15, 2000 TOWN BOARD MEETING 233 PAGE 4 1 I Councilman O'Donnell made a motion, seconded by Councilman Testa, to recess the Regular Meeting to an Executive Session to discuss a town hall matter. All voting aye, the motion was carried. The meeting was recessed at 5:20 p.m. The following hiforniation was received from the Supervisor's office. Councilman O'Donnell made a motion, seconded by Councilman Testa, to adjourn the Executive Session and reconvene to the Regular Meeting. All voting aye, the motion was carried. No action was taken. Councilman Testa made a motion, seconded by Councilman O'Donnell, to adjourn the Regular Meeting. All voting aye, the motion was carried.
