TOWN BOARD MEETING
5:00 P.M.
The Regular Meeting of the Town Board of the Town of Cortlandville was held at.
the Town Hall, 3577 Terrace Road, Cortland, New York, with Supervisor Thorpe
presiding.
Members present:
Supervisor, Raymond Thorpe
Councilman, Theodore Testa
Councilman, Ronal Rocco
Councilman, John Pilato
Councilman, Edwin O'Donnell

Others present were Town Attorney, John Folmer; Highway Sup't. Carl Bush; town
employee, Patty O'Mara; Wayne Freidman; and News Reporter, Chris Nolan.
Supervisor Thorpe called the meeting to order.
RESOLUTION #31 AUTHORIZE PAYMENT OF VOUCHERSIANUARY

Supervisor Thorpe offered privilege of the floor to those in attendance.
Councilman Testa reported he has audited the Town Clerk books. Councilman
O'Donnell has audited the books of the Supervisor and Water and Sewer Dept. for 1999.
They found all to be in order.
Councilman Rocco apprised the Board he and Town Bookkeeper, Marcia Hicks,
met with a representative of the Excellus Benefits and all is in order.
Councilman Rocco also met with employees interested in participating with the
deferred savings plan offered to town employees. In order to expedite the deferred
savings process, Councilman Rocco is looking into wiring the town employee's monthly
contribution to the Copeland Company. He has asked Alliance Bank to waive the fee for
wiring funds and is waiting for their reply.
Monthly reports for December 1999 of the Town Justice and SPCA are on the table
for review and filed in the Town Clerk's office.

RESOLUTION #32 ACCEPT ANNUAL REPORT OF WATER AND
SEWER DEPARTMENT
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Annual Report of the Water and Sewer Department for the year
1999 is hereby accepted, and shall be received and filed.
Councilman Testa made a motion seconded by Councilman O'Donnell to receive
and file the first quarter Water and Sever report for 2000. All voting aye, the motion was
carried.
RESOLUTION #33 ACCEPT ANNUAL REPORT OF THE TOWN CLERK
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Annual Report of the Town Clerk for the year 1999 is hereby
accepted, and shall be received and filed.
Councilman O'Donnell made a motion seconded by Councilman Pilato to receive
and file correspondence from the Cortland County Highway Department regarding water
and sewer maid installation on Page Green Rd. All voting aye, the motion was carried.
Councilman O'Donnell made a motion seconded by Councilman Pilato to receive
and file correspondence from the Cortland County Highway Department to the NYS Police
Troop C, regarding their response to the passing zone on the McLean Rd. All voting aye,
the motion was carried.
Supervisor Thorpe statecl1..the .passing zone, issue was asked to bg re -viewed by the
NYS Police. This is a separate issue regarding the speed limit on McLean Rd.
Concerning the proposed law for Lockboxes, Attorney Folmer apprised the Board
it was brought to his attention that fire alarm systems do not go directly to the Fire
Department but to the 911 center. There is no 24-hour dispatcher at the Fire Department.
The proposed law now states all new and existing buildings, other than one or two family
dwellings, that have installed systems that notify the 911 center and in turn require a
response from the Fire Department, are required to have a lockbox.
Since this change occurred after Richard Beebe and Joseph Kuck attended a Town
Board meeting, Attorney Folmer forwarded a letter to Mr. Beebe and Mr. Kuck on January
12, 2000, informing them of the change and the pending adoption of this law.
Mr. Beebe responded stating his primary concerns regarding mandatory installation
had been satisfied.
Attorney Folmer read aloud the letter- sent to Mr. Beebe and Mr. Kuck. He has had
no response from Mr. Kuck. Attorney Folmer stated he believes the objections to the
proposed law have been dealt with. The Cortlandville Fire Department is satisfied with the
proposed law. It is necessary for the Board to make a decision concerning the adoption of
this law.

RESOLUTION #34 ADOPT LOCAL LAW NO. 1 OF 2000
LOCKBOX
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, a request was received from the Cortlandville Fire District and the
Cortlandville Fire Department for a Local Law for the installation of Lockboxes within the
Town of Cortlandville, and
WHEREAS, Public Hearings were held on this issue with many comments and concerns,
and
WHEREAS, the Town Board and Town Attorney drafted the following Local Law based
on the input from the public, therefore
BE IT ENACTED, by the Town Board of the Town of Cortlandville as follows:
Chapter 86, Fire Protection and Building Inspection, Section 86-6 `of the Code of the
Town of Cortlandville is hereby amended by adding thereto a new Section to be numbered
86-6-1, to provide as follows:
Section 86-6-1 LOCKBOXES
A. The purpose and intent of this section is to minimize the time of entry to
property by Fire Department personnel at times of fire alarms, thus reducing the
loss of property, both real and personal, and to enhance the response time
experienced by fire personnel.
B. A lockbox for storing building keys shall be obtained and affixed on
certain premises described herein. Such lockbox shall be as prescribed by the
Cortlandville Fire District and shall be obtained in the manner established by
said Fire District.
C. Lock Boxes shall be required for all new and existing buildings, other
than one or two family dwellings, that have fire alarm and/or fire detection
systems that result in the Cortland County 911 Center being notified of a fire
alarm and which in turn require a response for the Cortlandville Fire
Department. Alarm systems include but are not limited to municipal fire alarms,
radio, telephone -leased line, telephone dialer or central station systems, subject
to the provisions of Section E hereof.
D. Lockboxes shall be affixed to structures in the manner detailed by the
manufacturer and in the location established) by the Cortlandville Fire District.
E. In the event that it is determined by the Cortlandville Fire District that the
intent of this ordinance would not be served by the installation of a lockbox at
specific premises by reason of impracticability, government regulation or other
factor, a written waiver of the provisions of this Section, limited to the specific
premises in question may be issued by the District. The determination of the
Fire District as to the issuance of such waiver shall be final and determinative.
Any such waiver issued in conjunction with new construction shall be provided
to the Code Enforcement Officer at the time an application for a building permit
is submitted. Any such waiver issued in conjunction with structure existing on
the effective date of this ordinance shall be retained by the owner of the
premises described in such waiver, and shall be exhibited to the Code
Enforcement Officer upon his request.
F. Any entry obtained by Fire District personnel utilizing the lockbox keys
shall be reported by the person supervising such entry as soon as is practical
after such entry.

G. With regard to new structures, this ordinance shall take effect when filed
with the Secretary of State as required by law. With respect to structures in existence on
the date of such filing, this ordinance shall take effect on January 1, 2001.
Cortlandville Fire Chief Kevin Whitney arrived.
The Town Clerk distributed to Town Board members for their review and input,
copies of the proposed resolutions to be voted on at the Association of Town's. They will
take action at their- annual meeting to be held next month. Any input should be given to the
town delegate, Justice Mardis Kelsen.
Also distributed was the 2000 Town of Cortlandville official list, notification of a
training session offered by the State Comptroller to be held at TC3 in February, Town
Board minutes of November 3 and 17 of 1999, Planning Board minutes of November 30
of 1999 and ZBA minutes of October 26 and 30 of 1999.
RESOLUTION #35 AC.KNOWLEDGE NOTIFICATION FROM THE STATE
FOR FILING OF LOCAL LAW NO.4 OF 1999

BE IT RESOLVED, NYS Dept. of State acknowledged receipt of Local Law No. 4 of
1999, effective December 22, 1999, which provided for a zone change for four- properties
located on US Route 11 and Weaver Rd. as follows:

RESOLUTION #36 ACCEPT ANNUAL REPORT OF TOWN RMO AND
SCHEDULE OF DISPOSED RECORDS IN 1999 IN
ACCORDANCE WITH THE RECORDS RETENTION
AND DISPOSITION SCHEDULE

VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Town Board does hereby accept the Annual Report of the
Records Management Officer of the Town, including the list of disposed records in 1999,
in accordance with the Records Retention and Disposition Schedule, MU-1.
Attorney Folmer reported:
Cortland Mobile Home Park:
Attorney Folmer stated the tax certiorari action against the Cortland Mobile Home
Park has been settled. There will be no change in assessment for three years. There are
requirements regarding reports to be filed annually by the park using a formula to
determine the value of each unit based upon the year of manufacture.
William Cleary Easement:
William Cleary and Dr. Ambrose would like to relocate an easement over a tot
owned by Mr. Cleary. As a result of this Dr. Ambrose is going to convey a lot, at no cost
to the town. This will allow the town to relocate a retention basin to deal with the drainage
situation in the Renaissance area. Attorney Folmer asked for permission to pursue this
request, as long as he and Highway Sup't.. Bush approves the prepared documents.

RESOLUTION #37 AUTHORIZE TOWN ATTORNEY TO PROCEED
WITH DEED AND EASEMENT CONVEYANCE
BETWEEN THE TOWN OF CORTLANDVILLE,
WILLIAM CLEARY AND DR. LEE AMBROSE
Motion by Councilman Rocco

VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Town Board does hereby authorize and direct the Town Attorney
to proceed with deed and easement conveyance between the Town, William Cleary and
Dr. Lee Ambrose for property within the Renaissance subdivision, subject to approval by
the Town Highway Superintendent.
RESOLUTION #38 AUTHORIZE AGREEMENT WITH NYS DOT TO
RELOCATE EXISTING TOWN WATER LINES ALONG
NYS ROUTE 11 IN TIIE TOWN OF CORTLANDVILLE

VOTES: ALL AYE ADOPTED
WHEREAS, NYS DOT will be reconstructing NYS Route 11, from the City of Cortland
line to the Village of Homer line in the Town of Cortlandville, and
WHEREAS, a request has been made by the NYS DOT for authorization from the town to
relocate existing town water lines, therefore
BE IT RESOLVED, the Town Board does hereby authorize the agreement with the NYS
DOT to relocate existing town water lines along NYS Route 11 from the City of Cortland
line to the Village of Homer line in the Town of Cortlandville.
RESOLUTION #39 APPROVE ANNUAL CONTRACT WITH
CORTLAND YOUTH BUREAU
Motion by Councilman Rocco
Seconded by Councilman Pilato
VOTES: ALL AYE ADOPTED
BE If' RESOLVED, the Town Board does hereby approve the 2000 annual contract with
Cortland Youth Bureau, in the amount of $9,724.00, effective January 1, 2000.
RESOLUTION #40 AUTHORIZATION TO AMEND TOWN OF
CORTLANDVILLE 2000 BUDGET
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, payment of $18,048.09 was received for final payment of a grant which was
applied for by Cortland County for the construction of the Bennett Street Bridge (known as
the Elm St. Ext.), therefore
BE IT RESOLVED, the Town Board does hereby authorize and direct the town wide
highway fluid be increased from $50,000.00 to $68,048.09 amending the Town 2000
Budget, and it is further
RESOLVED, these monies will be utilized by the Highway Superintendent for town wide
highway expenses.

Councilman Pilato made a motion, seconded by Councilman Testa, to recess the
Regular Meeting to an Executive Session to discuss a personnel matter. All voting aye, the
motion was carried.
The meeting was recessed at 5:20 p.m.
The following information was received from the Supervisor's office.
A discussion was held concerning summer hours for Town Fall employees. An
option discussed was 9 - 4 with a half hour lunch for the months of June, July and August,
of 2000.
Councilman O'Donnell made a motion, seconded by Councilman Testa, to adjourn
the Executive Session and reconvene to the Regular Meeting. All voting aye, the motion
was carried.
No action was taken.

the Regular Meeting. All voting aye, the motion was carried.
The meeting was adjourned at 5:55 p.m.
