RESOLUTION #19-084 APPROVAL OF MINUTES Draft of the Regular Town Board Meeting Minutes dated September 12, 2019: Member Stiles moved to approve the minutes for Sept. 12, 2019 regular Town Board Meeting with corrections on Hope Lake Park Report that the beach is closed. Member Pelton seconded the motion. Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays-None RESOLUTION #19-085 AUTHORIZATION TO PAY BILLS GENERAL FUND FOR OCTOBER 2019 NUMBER 010: Member Denniston moved to approve payment of the General Fund’s audited vouchers numbered 262-291 in the amount of $20,398.47. Pelton had a question regarding the VISA bill which was answered. Member Pelton seconded the motion. Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays- None HIGHWAY FUND FOR OCTOBER 2019 NUMBER 010: Member Snow moved to approve payment of the Highway Fund audited vouchers numbered 1165-1178 in the amount of $19,162.51. Member Pelton seconded the motion. Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays- None SEWER DISTRICT #1 FUND FOR OCTOBER 2019 NUMBER 010: Member Denniston moved to approve payment of the Sewer District #1 audited voucher’s numbered 2094-2104 in the amount of $9,556.97. Member Pelton seconded the motion. Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays- None WATER DISTRICT #1 FUND FOR OCTOBER 2019 NUMBER 010: Member Denniston moved to approve payment of the Water District #1 audited vouchers 3048-3054 in the amount of $5,785.12. Member Pelton seconded the motion. Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays-None MONTHLY REPORTS SUPERVISOR’S MONTHLY REPORT FOR SEPTEMBER 2019 LONG FORM: Member Stiles moved to accept the Supervisor’s Monthly Report in long form for September 2019. Member Snow seconded the motion. Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays –None TOWN CLERK’S MONTHLY REPORT FOR SEPTEMBER 2019: Member Stiles moved to accept the Town Clerks Monthly Report for September 2019. Member Snow seconded the motion. Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays- None SEWER DISTRICT OPERATIONS REPORT: Ken Scherrieble was present from the Camden Group. Supervisor Kaminski asked if the tank for Holbrook’s was delivered yet. He said that they need to make plans to get it installed. The question was asked if the tank had been put in today. Scherrieble said yes and the top would be in tomorrow. Supervisor Kaminski said they’d authorized the pump to be ordered last month and asked if it had been done. Scherrieble said he’d check and see if it’s here. Member Stiles moved to accept the Sewer Districts Report. Member Snow seconded the motion. Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays- None WATER DISTRICT OPERATIONS REPORT: Doug and Jenea Withey was present. Supervisor Kaminski had some questions for Doug Withy. Withy said that the Chlorination test can back positive again, but the numbers were down the second time. He continued discussion on the testing and the procedure. There was also some discussion on the electricity supply to the water tank. There was a mishap where some lines were dug up and the estimated cost to fix it is $25,000-$30,000. Member Stiles moved to accept the Water District Report. Member Snow seconded the motion. Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays-None ANIMAL CONTROL OFFICER’S REPORT: Member Stiles moved to accept the Animal Control Officer’s Report. Member Snow seconded the motion. Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays-None CODE ENFORCEMENT AND ZONING OFFICERS REPORT: A written report was submitted by Code and Zoning Officer Kevin McMahon. Member Stiles motioned to accept the Code and Zoning Officers report. The motion was seconded Member Snow. Vote: Ayes- Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays- None COUNTY LEGISLATOR’S REPORT: County Legislator Sandy Price submitted a written report. Deputy Supervisor Stiles asked what was going on with the County budget. Price said that there have been a number of cuts, but she feels it’s still high. Stiles wanted to know when the budget will be finalized. She said ideally it should be completed before Election Day. December 20th is the deadline, but that creates problems for County tax billing. She said some employees got a 2% raise and others got none. Stiles wanted to know what was going on with the Administrator position. Stiles feel that the position should be an elected position and gave his reasons. Supervisor Kaminski said that back in June or July he submitted a FOIL request to the county for information from 2016 and 2017 Virgil Town Board Meeting October 10, 2019 2 | P a g e and he hasn’t heard anything yet. Price said that she will follow up on that. She said that she is sure there is information that was filed with the state that should be available and the County Attorney has information for him, its just a matter of getting it to him. Stiles said that there is still some sticking point with workers compensation. Member Snow asked Price about the solar project at the landfill. Price said that it is on the next legislative agenda. She said they need more clarification. Stiles said not to put money into a study to see if the solar project should be done. Member Stiles motioned to accept the County Legislators report. The motion was seconded Member Snow Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays- None HOPE LAKE OPERATIONS REPORT: Wes Kryger was not present at this meeting. Member Pelton said that the committee met and the year-end report is here. He said that there is money being saved for the fireworks next year. He also said that Virgil residents will be able to ski at the Nordic center, if they have their own equipment. VIRGIL YOUTH COMMISSION REPORT: Cornea Morse said that they are trying to work through bussing issues for the Virgil ski Club. Kaminski asked what she thought attendance will look like in the ski club this year. Morse said that she didn’t know until after the Oct. 24th meeting. They are looking into future program, some maybe held at the Virgil Fire Station, but they need permission. Stiles wanted to know if they could use the Virgil E-mail list to get the word out about events. Member Stiles motioned to accept the Virgil Youth Commission report. The motion was seconded Member Snow Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays- None HIGHWAY DEPT. SUPERINTENDENTS REPORT: Highway Superintendent Britt Morse was present an oral report. TYPE HERE: Morse said that they are getting prepared for the winter. Kaminski asked about truck purchases for the transfer station and for the highway garage. Morse said that they have salt, but they may need to purchase more sand. There was some discussion regarding bridges around town. Stiles said that they will have an engineer look at them. Morse said that they patched many pot holes. Member Stiles motioned to accept the Highway Supervisor report. Member Snow seconded the motion. Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays: None. OLD BUSINESS RESOLUTION #19-086 APPROVAL OF LOCAL LAW #1 OF 2019-TRANSFER STATION LAW: Member Pelton asked if the law include the three cubic yards limit. Stiles was wondering if the limit was limited to person or household. Attorney Snyder read what the law stated regarding this clause. Member Stiles motioned to approve Local Law#1 of 2019 Transfer Station Law. Member Snow seconded the motion. Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays: None SCHOOL BUILDING UPDATE: Supervisor Kaminski said they toured the school and it looked to be in good shape. He said the kitchen is intact. He said that there are some cosmetic damages and the building needs to be cleaned. He said he had a discussion with the School Superintendent. He was told that the town needs clarity on what we can or can not use the building for. Kaminski was told they the town can charge a fee for the use of the building, but the town can not make a profit form it. He said he needs to verify this and he plans on setting up a meeting with the city and other attorneys, so he can have a clear explanation on what can be done. Sylvia cook asked if it had been decided if the contents of the building are being sold on auctions international? It was stated that a school in Hamilton county had a similar situation to Virgil. Kaminski spoke about the court moving and he said it is up to the town board as to where the court is held. Kaminski said he’s going to set up a meeting with the attorneys and she what can be done. Then he’s going to set up a fact sheet and present it to the board to see what the next step should be. DISCUSSION ON TOWN BUDGET: Deputy Supervisor Stiles said that the tax payers will pay and increase of .08¢ per thousand on the town taxes. The cost of workers compensation went down, but the cost of fuel, salt and sand is up 20%. Member Pelton said that there will me no raise in the water and sewer rents this year. NEW BUSINESS RESOLUTION # 19-087 SET A DATE FOR THE 2020 BUDGET HEARING: Supervisor Kaminski said he would like to hold the budget hearing on November 7th at 6:00 PM and then adopt the budget at the next regular town board meeting on November 14th. Member Stiles made a motion to set the budget hearing date on November 7th at 6:00 PM at the Virgil Town Hall. Member Denniston seconded the motion. Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays: None RESOLUTION # 19-088 APPOINT A TOWN ZONING OFFICER: Members Stile and Denniston conducted interviews for the Zoning Officer position. Two people applied for the position. Member Stiles recommended Adam Brown for the position. Sylvia Cook also applied. Stiles told Cook that he would like for her to keep a look at for other positions opening in the community in the future. Member Stiles made a motion to hire Adam Brown as the town’s Zoning Officer. Member Denniston seconded the motion. Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays: None PLANNING & ZONING BOARD TRAINING WILL BE CONDUCTED AT THE TOWN HALL: Supervisor Kaminski said that Attorney Pat Snyder will be conducting training on Virgil’s Zoning Law on November 25th. The training will be open to all Zoning and planning Board members. He will he holding training for Zoning board members at 6:00 PM on that day and at 7:00 PM for Planning Board members. All are encouraged to attend. Virgil Town Board Meeting October 10, 2019 3 | P a g e SEXUAL HARRASSMENT POLICY: Supervisor Kaminski asked the town board members to look over the policy and they will make changes and potentially adopt it at the next town board meeting. RESOLUTION # 19-089 SURPLEUS A 2015 ONE TONE TRUCK: Highway Superintendent Britt Morse said that he would like to surplus a 2015 one-ton truck from the Virgil transfer station to the Virgil Highway department. He said that it needs some work and they got a quote from Casey’s for $18,000. He would like to have the funds transferred from the Transfer Station fund to the Highway fund in order to have the truck fixed. Member Stiles made a motion to have the truck transferred from the Transfer Station to the Highway Garage and to have the Highway garage pay for the repairs not to exceed $18,000. Member Snow seconded the motion. Vote: Ayes- Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays: None RESOLUTION #19-090 APPROVE THE PURCHSE OF A 2019 NATIONAL SIVERADO FOR THE TRANSFER STATION: Highway Superintendent Britt Morse said he would like to purchase a lighter smaller truck for the Transfer Station to replace the 2015. He found one on state bid for $31,500 and if they ordered it now, it will be sixteen weeks until delivery. He would like to have the truck paid for out of the Transfer Station reserve fund. Member Stiles made a motion to approve the state bid price of $31,500.00 for a 2019 National Silverado for use at the Virgil Transfer Station and to have the money come out of the Transfer Station reserve fund. Member Snow Seconded the motion. Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski. Nays: None SOME FURTHER DISCUSSION: Sylvia Cook said that the Cortland Voice records meetings and broad casts them on the internet. Member Stiles said that she brought up an interesting point. With no further business to discuss, Member Stiles moved to adjourn the meeting at 7:40 PM. Member Snow seconded the Motion. Vote: Ayes-Members Pelton, Snow, Denniston, Stiles and Kaminski.
