Others Present: Mce #ing called to order at 7:00 p.n,_ 41nules for January 2011 as amended, moved by .D Weinstein, seconded by .M Hatch, all in favor, rni.mutes approved, Mj mutes for Mareh 201 l as amended, moved by D Weinstein, seconded by J Laqua#ra, al] in favor, minutes approved_ Discussion of PUJD Process Jane Nicholson went over the changes that were made in the flow chart based on ccrnMents received from meetings #his past month_ D Kwasnowski reviewed the changes in the roles and responsibilities of the PB and TB in the PUD process in relation to what was proposed last month, `F'here are parts of the process that have to be done by tine Town Board by law. The P'8 would get the application in the concept phase prior to it going to the Tovm Board, This step will include a 60 day time frame. Once the zoning change has been made it would go back to the PB for subdivision and site plan review if necessary, There was a recommenda #ion to add the PlB in a step _just after the Preliminary Developmemt Plan has been submitted and prior to the Town Board scheduling a public hearing and doing Sl�QKreviev��. A time frame of 60 days for the PB to review at this stage will be added_ The concept plan clock listed in the text of the process does not specify t here is a 90 -clay review time frame for the Planning Depaent to determine whether or not the application i rtm s complete and then a 90 -day review time frame for the Planning Beard. It is possible that a PUD application could result in the Comprehensive Phut being reviewed and amended as well as [lie zoning change that normally results from a successful PUD application. An applicant is asked to state how the PUD fits in with the Co rnprehensive Flan. A PUl) isn't meant to be a way around the coning law It is meant to be a way to allow a development that is in line with the Comprehensive Plan that doesn't necessarily fit exactly into the zoning in that section. ince there is no way to account for every possibiIIty that might be PB 04 -21 -2011 Page 2 of 4 proposed that does fit the Comprehensive flan, a PUD is one more tool to help give towns the flexibility for development to help them grow in the way they want to grow. The PB discussed whether or not to have a size limitation on a PUD. There was one initially but the research D Kwasnowski has done discourages having size limitations. "There are so many different ways a PUD can be used that a size limitation can't be determined ahead of time. A size limit is completely arbitrary. Update on the Hamlet of Varna Plan First meeting was held with Behan consulting and Varna Plan Advisory Group of residents and D Makar from the 'Town Board. (Note to add Megan Whitman to the list of attendees for future meetings.) Josh Bogdan, the town's GIS "Technician, and Jane Nicholson presented existing conditions. Jane did a character area study and presented that information. Josh did a demo on Community Viz — a GIS tool — which will be available on the website soon — you can put in different factors and see how a development would affect an area. Right now, the group is taking an indepth look at the existing conditions in terms of the land and also doing community outreach through a survey that will be going out soon. They have advertised some public outreach sessions. There will be series of three that will be related to milestones. They are also working on putting together a focus group of business owners and those with real estate interests. D Kwasnowski is working on transportation information (the 366 redesign) and getting DOT involved in the process as well. They have traffic data. They talked a little about the vision of ® what the section of 366 through downtown Varna area will be. The timeline the group has adopted has them submitting a final draft to the Town Board in September. Cornell Grant J Lalley reported that the Town will be receiving a grant spread out over 2 years for general planning efforts in the srun of $15,000. LULA Learnings Land Use Leadership Academy — J Lalley was invited to and attended recently — 4`h and Final session is tomorrow. Dan Spitzer has been a speaker at these sessions. Each session has had a theme with the most recent session being centered on what towns can do about drilling and mining operations. One recommendation Mr. Spitzer made during his session was that, as Planning Board members, we shouldn't voice an opinion on a project except in the terms of the review and approval process. It is perfectly fine to ask questions and use that as the basis for our decision, but in order to protect the town, that is how we need to arrive at our decisions. Make the developers "learn on our nickel" — meaning make the developers pay our consultants to do the work — not rely on the developers' consultants to do the work - which is what we do. Require developers to meet with stakeholders. Another important thing to remember is that we cannot say no based on public opinion. That is not the basis for approving or denying an application. We can decide and we should decide on the impacts: be they environmental such as traffic, or societal, or economic, but focus on the impacts. Those were just a few savings from NL•. PB 04-21 -2011 Page 3of4 Spitzer's sessions that J Lalley wanted to pass along from this training to Planning Board members. J i..alley sent a link to PB members for the LULA website that has some information that may be of interest to PB members. He talked about bringing the Comprehensive Plan to life in zoning law, which is where we are in this process. Energy was a topic at the session two weeks ago and what towns can do in terms of their zoning law. They spoke on drilling and wind energy, among other items. Hclen Slotzje came and spoke in the afternoon. The basic theme was: any use in the town is prohibited unless specifically allowed. There is a process by which towns develop a mining overlay district. We can't regulate the process but we can regulate the impacts. H Slotzje's presentation is also on the LULA website. A joint meeting oil " the various boards of the town was discussed and Mary Ann Sumner is going to update us on what the town is doing around these efforts right now. There are also some things we may want to incorporate into the various planning processes once the zoning ordinance is passed. M Sumner updated the PB on the work other boards have been doing to date including passing out a copy of the resolution that was passed by the Town Board the previous evening. A handout with recently passed and upcoming events TCCOG has been involved in or organized. The second handout is an excerpt from a presentation that TG Miller gave recently on highway regulations. Jack Bush has been spearheading the process of working with Delta on analyzing existing road conditions, as well as reviewing the Town's highway regulations and recommending changes. The Town Board had discussed the possibility of passing a moratorium in regards to new construction in Varna. After reviewing the progress of the Zoning Law work to date, it is passible to finish up in the next few weeks, introduce the updates in May and pass the final law in June. That is the timeline Supervisor Sumner is aiming for. Passing the final law would preclude the need i'or a moratorium. This would allow us to focus on the next big issue which is hydrofracking and other heavy industry and what we can do to protect the town and its resources. The noise ordinance was passed last night as well. Just as a cell tower ordinance in the beginning stages became a tall structures ordinance, actual gas drilling regulations may not be possible, but regulations ensuring environmental et %cts are mitigated are possible. Water protection is in the mix but is a separate issue. Existing illicit discharge law applies to all streams in the town. The information J Lalley came away from the LULA meetings with is this: The approach of taking on drilling head -on could be very costly, ineffective and could bankrupt us. By dealing with gas drilling in terms of the environmental impacts and regulating those, which the Town does have control over, the Town is taking a proactive approach to protecting the Town, its residents, and its resources. The Town is headed in the right direction. M Sumner — the work we're doing now and have been doing for the past 3 years is so much greater and more difficult than the work we've done in the past 10 years. J Lalley will ask D Spitzer at the session tomorrow if he would be interested in helping with this. The Plamiing Federation also has a number of trainings coming up. Planning Briefly discussed the plan with Campbell Meadows and the Conservation Board's review of it recently.
