TOWN BOARD MEETING

The Regular Meeting of the Torun Board of the Town of
Cortlandville was held at the Town Hall, 3577 Terrace Road,
Cortland, New York, with Supervisor Thorpe presiding.
Members present: Supervisor, Raymond Thorpe
Councilman, Theodore Testa
Councilman, Edwin O'Donnell
C'nuua_ilman- Ronal Rocco
Councilman, John Pilato
Town Clerk, Karen Snyder
Others present were: Town Attorney, Jahn Folmer, Highway
Supt, Carl Bush; Water and Sewer Supt, Peter Alteriy Town
Residents, Nick Renzi and Carl Staley, Audrey Lewis, member of
the Aquifer Protection Alliance Steering Committee.
Supervisor Thorpe called the meeting to order.
Councilman Pilato made a motion, seconded by Councilman
Testa, to receive and file Board of Assessment Review Minutes of
May 25, 1999. All voting aye, the motion was carried.
Councilman O'Donnell made a motion, seconded by Councilman
Pilato, to approve the Town Board Minutes of May 5 and May 19,
1999 as written. All voting aye, the motion was carried.
Councilman O'Donnell made a motion, seconded. by Councilman
Testa, to receive and file Planning Board Minutes of April 27 and
May 25, 1999. All voting aye, the motion was carried.
Councilman O'Donnell made a motion, seconded by Councilman
Testa, to receive and file Zoning Board. of Appeals Minutes of
April 27 and May 25, 1999. All voting aye, the motion was
carried.

Supervisor Thorpe offered privilege of the floor to Nick
Renzi.
Mr. Renzi had addressed a letter to Supervisor Thorpe with
concerns about the water pressure in the Cosmos Hill area.
Supervisor Thorpe suggested Mr. Renzi speak with the Town
Engineer first but Mr. Renzi asked to speak to the Board in order
to be on the record.

Water Sup't. Peter Alteri felt this would be better answered
by the Town Engineer. Mr. Alteri stated the Board was not
notified of this concern earlier, as he felt this was not a Town
Board issue and could be handled by the water department, Town
Engineer and residents.
Mr. Alteri continued to explain in order to correct the
amount of pressure coming into a home, a pressure regulator could
be purchased from the Town's water and sewer department and
installed at the homeowners expense. Another option would be
adding a regulator to the main but could inhibit fire fighting
capabilities.
The line on Cosmos Hill is feed by a booster station system
increasing the pressure to get the water up to the residents at
the top of Cosmos Hill. This causes very high pressure for the
residents living below. The ending result could be the burst of
residential water meters.
Mr. Rend will be speaking with Town Engineer, Hayne Smith
on Friday.
Mr. Renzi voiced another concern with the proposed water
lines on Raphael Drive. He explained the newly approved sub-
division of two lots and two dead end water legs would function
better if they were looped together and joined. Right now once a
month the Water Department has to come to the area to let the
hydrants run for half an hour.
He felt at the time the subdivision was approved, the
developer should of informed the Board of his intentions for the
services and utilities in that area.
Attorney Folmer stated that at the time the Planning Board
approved the original subdivision of the Renaissance Area, the
developer did include plans for the location of utilities.
Attorney Folmer explained the litigation before Judge Dowd
on July 21, 1999 is to determine the validity of the Planning
Board's approval of the newly approved subdivision and determine
the laying of a water line.
A discussion was held concerning Dr. Ambrose's
responsibility for installing water and sewer lines in the
Renaissance development.
Mr. Renzi will be speaking with Town Engineer, Hayne Smith,
regarding this issue on Friday also.
Councilman O'Donnell introduced Audrey Lewis, member of the
Aquifer Protection Alliance Steering Committee. He apprised the
Board of what the committee is trying to accomplish.
First is to inform the Board of the study which has been
done on the feasibility of intermunicipal cooperative drinking
water activities.
Second, to allow the municipal department heads to
investigate the possibility of intermunicipal cooperation between
the town, the Village of Homer and the City of Cortland.
Councilman O'Donnell informed the Board of a few members on
the committee including Audrey Lewis, Robert Buerkle from
Cortlandville's Planning Board, and Carl Kimberly from the
Village of McGraw, and himself.
Audrey Lewis referred to consolidation of water supplies,
possibilities of cost saving measures, productivity, and opening
lines of communication within municipal water departments.
Councilman O'Donnell spoke with the dater and Sewer
Department heads, Carl Bush and Peter Alteri. They have agreed to
investigate the possibilities of cooperation.
Supervisor Thorpe brought to the attention of those in
attendance, municipal water cooperation has been brought up
before with no results in the past. The study presented shows
concrete suggestions of the proposal.
Supervisor Thorpe expressed concern for this becoming a
bureaucratic organization.
Councilman O'Donnell distributed a summary of an evaluation
to the Board to complete for the next committee meeting and
thanked Highway Sup't. Carl Bush, for his completed summary.

He stated Carl Kimberly has written a resolution concerning
the Steering Committee's report and asked Attorney Folmer for his
input.
Attorney Folmer stated the resolution presented was well
written. It is appropriate for the Board to pass a resolution
endorsing the concept of intermunicipal cooperation.
He expressed concerns with the eventual direction of this
program and what may occur in the future. Adding the Town of
Cortlandville is in full charge of their water and sewer
operation. As a town taxpayer Mr. Folmer would not like to see
intermunicipal cooperation taking control of organized and well
established water departments such as Cortlandville's.
A discussion was held concerning the advantages and
obstacles of intermunicipal cooperation and the possible cost of
doing a study.
Councilman O'Donnell stated further intermunicipal
cooperation will not transpire without approval by this Board.
Attorney Folmer read the proposed resolution aloud.
RESOLTTTION #125 SUPPORT AND ENDORSE A REPORT TITLED
FEASIBILITY OF INTERMUNICIPAL COOPERATIVE
DRINKING WATER ACTIVITIES AND FORWARD TO THE
TOWN PLANNING BOARD
Motion by Councilman Rocco
Seconded by Councilman Testa
MOTES: ALL AYE ADOPTED
WHEREAS, a special report titled Feasibility of Intermunicipal
Cooperative Drinking Water Activities, dated May 1999 was
received from the Cortland Aquifer Protection Alliance Steering
Committee, therefore
BE IT RESOLVED, the Town Board -of Cortlandville does hereby
support and endorse the concept of intermunicipal cooperation
among other Cortland County water operations, and further
RESOLVED, authorize forwarding the report on Feasibility of
Intermuni.cipal Cooperative Drinking Water Activities to the Town
Planning Board for their review and recommendations, requesting a
reply within six months.
The June 1999 monthly report for the Town Clerk is on the
table for review and filed in the Town Clerk's office.
Supervisor Thorpe apprised the Board of a thank you note
received from retired Town Clerk, Pauline Parker, thanking the
Board for the commemorative plate presenter) to her at the April
28th Board meeting and for her retirement dinner May 8, 1999.
He also spoke of Angela Leddy, news reporter from the
Cortland Standard, winning an award for an essay contest and that
they are very proud of her.
Attorney Folmer reported:

Attorney Folmer reminded the Board this violation had been
tabled from the previous meeting with the understanding it has
been taken care of. He questioned if this has happened.
Water Sup't. Peter Alteri, stated he would investigate and
report back to Attorney Folmer.
Sterling Park Read. Dedication:
Mr. Folmer has received a bank draft in response to the
Town's bonding request and a proposed deed for Sterling Park.
The Town is not ready to accept the road due to the curb cut not
being approved by the NYS DOT. When this is completed, the road
will be accepted.
Renaissance dater Line Litigation:
This will be before Judge Dowd on July 21, 1999.

Suit -Rote Re -Zone Litigation:
There has been no information on the decision from Judge
Dowd. Attorney Folmer dues not know if the length of delay is
related to the eventual outcome.
BAN Renewal:
This was accomplished on July 2, 1999 for another year.
Attorney Folmer expects within a year to be able to combine the
remaining obligations into one lame bond as was done two years
ago.
RESOLUTION # 26 ACCEPT 1999 TAX COLLECTOR' S SUMMARY
Motion by Councilman O'Donnell

VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the 1999 Tax Collector's Annual Summary is hereby
accepted and shall be received and filed.
RESOLUTION #127 AUTHORIZE SUPERVISOR AND DEPUTY SUPERVISOR
TO RESEARCH OPTIONS FOR THE CORTLANDVILLE
FIRE STATION BUILDING ON NYS ROUTE 281
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, the Cortlandville Fire District has constructed a new
station located on NYS Route 18, and
WHEREAS, the Cortlandville Fire District will be vacating the
current building located on HYS Route 281 which is owned by the
Town of Cortlandville, therefore
BE IT RESOLVED, the Board does hereby authorize the Supervisor
and the Deputy Supervisor to research options available for the
property the Town owns located on NYS Route 281.
Councilman O'Donnell made a motion, seconded by Councilman
Rocco, to receive and file the County Planning Board
recommendations for the Zone Change Request of Carl Staley. All
voting aye, the motion was carried.
RESOLUTION #128 SCHEDULE A PUBLIC HEARING FOR A ZONE
CHANGE REQUEST SUBMITTED BY CARL STALEY
ON JULY 21 1999 AT 5.00 P.M.

VOTES: ALL AYE ADOPTED
BE IT RESOLVED, a Public Hearing shall be scheduled for July 21,
1999 at 5:00 p.m. for a Zone Change request submitted by Carl
Staley, for property located at 3876 Route 11, tax map #87.00-02-
05.000.
Councilman Rocca reminded the Board of the name change of
the First National Bank to Alliance Bank and asked if a
resolution was needed for our records. Adding First National and
Oneida Bank have merged.
Attorney Folmer stated as the Town is now c:nnc1uating
business with Alliance Bank it should be clarified by resolution
for auditing purposes.

RESOLUTION #129 DESIGNATE ALLIANCE BANK, NA AS
DEPOSITORY FOR TOWN ACCOUNTS FOR 1999
Motion by Councilman Testa
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, the First National Bank of Cortland was designated as
depository for various accounts of the Town as per resolution #13
of 1999, and
WHEREAS, due to the merge of First National Bank and Oneida Bank,
the name has been changed to Alliance Bank, NA, therefore
BE IT RESOLVED, the Board does hereby designate the Alliance
Bank, NA as depository for the Town Accounts for 1999.
Councilman Testa made a .motion, seconded by Councilman
O'Donnell, to adjourn the regular meeting. All voting aye, the
motion was carried.
The meeting was adjourned at 7:55 p.m.
