TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 3577 Terrace Roan., Cortland, New 'York, with Supervisor Thorpe presiding. Members present: Supervisor, Raymond Thorpe Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, Jahn Pilato Town Clerk, Karen Q. Snyder Absent: Councilman, Theodore Testa Others present were: Town Attorney, John Folmer; Highway Supt, Carl Bush; Keyboard Specialist, Patty O'Mara, and Town Resident, Carl Staley. Supervisor Thorpe call the meeting to order. Councilman Pilato made a motion, seconded by Councilman O'Donnell, to approve the Town Board Minutes of April 7, 1999 as written. All voting aye, the motion was carried. Supervisor Thorpe offered privilege of the floor to those in attendance. Councilman O'Donnell reminded the Board of the next Town Board meeting scheduled for Blodgett Mills and he will notify the Cortland Standard. Supervisor Thorpe suggested two meetings a year instead of one be held in the Village of McGraw and Blodgett Mills. It was decided this could be discussed at a later date. No action was taken. Councilman Rocco apprised the Board regarding a resident making a complaint to him about people walking their dogs and leaving their dog's waste on their yard. A discussion was held concerning people being more considerate while walking their dogs and possible regulations for developed areas. No action was taken. Monthly reports for the month of April 1999 for the Supervisor, the Town Clerk, the Justice and the second quarter Water and Sewer reports are on the table for review and filed in the Town Clerk's office. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file notification dated May 5, 1999 from the NYS DOT. All voting aye, the motion was carried. The notification was acknowledging the NYS DOT receipt of the Town's speed limit reduction request for West River Road, Blue Creek Road, Allen Drive, Pleasantview Drive, Terrace Road and NYS Route 41. They will be conducting an investigation and will notify the Town of the results. Attorney Folmer reported: NYS Route 13 Water Improvement Project: The adoption of the bonding resolution for the NYS Route 13 project will be available for the next board meeting. MAY 19, 1999 TOWN BOARD MEETING PAGE 2 1 1 Town Engineer, Hayne Smith, has informed him of a unexpected expense for $25,000 that will require a resolution subject to permissive referendum. He will have this available for the next meeting, also. Litigation for Local Law #2: The motion was argued in front of .Judge Dowd in Norwich on May 17th. Judge Dowd has received all the necessary documents and Attorney Folmer will inform the Board when a decision is reached. He explained this litigation involves the Panzanella's, Suit -Kate, the Town Board and the Town Planning Board. This is to make a determination if Local Law #2 is unconstitutional due to spot zoning. Also if the SEQRA process was done properly and if the Planning Board's action on the rezoning of Lorings Crossing was done correctly. Supervisor Thorpe complimented Attorney Folmer on his skills as a litigator with the presentation of this case before Judge Dowd, as he also attended the May 17th court date. Attorney Folmer stated if the judge finds a. flaw with the SEQRA procedure, the Board will need to take Judge Dowd"s decisions and repeat the SEQRA process. RESOLUTION #97 APPROVE TOWN ATTORNEY TO ATTEND SEMINAR FOR LAND USE CONTROLS IN ALBANY Motion by Councilman Pilato Seconded by Councilman O'Donnell NOTES: ALL AYE ADOPTED WHEREAS, a request was made by the Town Attorney to attend the ITYS Bar Association seminar on land use control in Albany on June 11, 1999, and WHEREAS, the cost of said seminar will be $145.00 to be charged against the Town Attorney's contractual account, therefore BE IT RESOLVED, the Torun Board does hereby approve their Town Attorney to attend the seminar for land use control in Albany on June 11, 1999. A discussion was held concerning the tub grinder being purchased by the Village of Homer, the City of Cortland and the Town of Cortlandville. Highway Supt, Carl Bush stated the bid has gone in and it takes time to complete the purchase. Mr. Bush stated he would look into the status of the purchasing of the tub grinder. M MAY 19, 1999 TOWN BOARD MEETING PAGE 3 RESOLUTION #98 AWARD BID FOR SUPPLY AND INSTALLATION OF CONCRETE CURBING FOR THE BENNETT STREET BRIDGE REPLACEMENT TO J.J.P. SLIPFORM INC IN THE AMOUNT OF $23,902.00 Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, }aids were advertised for the supply and installation of concrete cubing for the Bennett Street Bridge replacement, and WHEREAS, sealed bids were opened on May 17, 1999 at 3:00 p.m. and provided to Highway Supt, Carl Bush, for review, as follows: Syrstone, Inc. $27,974.40 P.O. Box 247 Syracuse, N.Y. 13212 JJP Slipforming, Inc. $23,902.00 7 Northway Lane Latham, N.Y. 12110 THEREFORE, BE IT RESOLVED, the }aid, as recommended by the Highway Supt., is hereby awarded to the lava bidder, .JJP Slipforming, 7 Northway Lane, Latham, NY, for the supply and installation of concrete curbing for the Bennett Street Bridge replacement, in the amount of $23,902.00, and further RESOLVED, the Supervisor is hereby authorized and directed to sign appropriate contracts. RESOLUTION #99 AWARD BID FOR SUPPLY AND INSTALLATION OF GUIDE RAILS FOR THE BENNETT STREET REPLACEMENT TO PAVILION DRAINAGE IN THE AMOUNT OF $27 194 25 Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, bids were advertised for the supply and installation of guide rails for the Bennett Street Bridge replacement, and WHEREAS, sealed bids were opened on May 17, 1999 at 3:00 p.m. and provided to Highway Supt, Carl Bush for review, as follows: Elderlee $32,234.00 729 Cross Road Oak Corners, N.Y. 14518 Pavilion Drainage $27,194.25 P.O. Box 219 Pavilion, N.Y. 14532 THEREFORE, BE IT RESOLVED, the bid, as recommended by the Highway Supt, is hereby awarded to the low bidder, Pavilion Drainage, P.O. Box 219, Pavilion, NY, for the supply and installation of guide rails for the Bennett Street Bridge replacement, in the amount of $27,194.25. and further RESOLVED, the Supervisor is hereby authorized and directed to sign appropriate contracts. I MAY 19, 1999 TOWN BOARD MEETING PAGE 4 RESOLUTION #100 REFER ZONE CHANGE REQUEST FOR CARL J. STALEY FOR PROPERTY LOCATED AT 3876 ROUTE 11 TO TOWN AND COUNTY PLANKING BOARDS Motion by Councilman Rocco Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, a Zone Change request, submitted by Carl J. Staley, for property located at 3876 Route 11, from agriculture to industrial, shall be forwarded to the Town and County Planning Boards for their review and recommendation. Carl Staley explained the location of his property and the reason he is requesting the zone change. He felt this was a reasonable request as the properties to the North and East of his 1/2 acre parcel are zoned industrial. Highway Supt, Carl Bush, apprised the Board of a proposal for a propane back-up for the Town's water and sewer systems. This back-up would be in addition to the natural gas back-up generator all ready in place. The cost for a propane back-up system at both crater boaster stations would be approximately $3,000. A discussion was held concerning the necessity for having a back-up to the back-up generators and the effects of a Y2K problem. It No was decided another back-up system was not needed. action was taken. RESOLUTION #101 ADOPT WATER AND SEWER FEE SCHEDULE FOR REPAIR WORK. All voting aye, the motion was carried. The meeting was adjourned at 5:30 p.m. Those in attendance were invited for a casual walk through of the new Cortlandville Fire Station after the meeting.
