TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Town Cortlandville was held at the Town Hall, 3577 Terrace Road, Cortland, New York, with Supervisor Thorpe presiding. Members present.: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, John Pilato Councilman, Ronal Rocco Town Clerk, Karen Q. Snyder Others present were: Town Attorney, John Folmer; Highway Sup't., Carl Bush; Planning Board Member, Nick Renzi; Cort.landville Fire Department Assistant Chief, Wayne Freidman; Tim Buhl from Resource Associates; town employee, Patty O'Mara, and News Reporter, Chris Nolan. Supervisor Thorpe called the meeting to order. Councilman O'Donnell made a motion seconded by Councilman Rocco, to approve the Town Board Minutes of October 6, 1999, as written. All voting aye, the motion was carried. Councilman O'Donnell made a motion seconded by Councilman Rocco, to receive and file the Town Planning Board Minutes of September 28, 1999, as written. All voting aye, the motion was carried. Councilman Testa made a motion, seconded by Councilman O'Donnell, to receive and file the Town Zoning Board of Appeals Minutes of September 28, 1999, as written. rill voting aye, the motion was carried. RESOLUTION #250 AUTHORIZE PAYMENT OF VOUCHERS DECEMBER Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers #612 - 653 $42,807.28 General Fund B 153 - 159 $10,486.01 Highway Fund DA 70 - 70 $ 126.64 Highway Fund DB 478 - 502 $26,769.44 Water Fund 296 - 318 $33,590.95 Sewer Fund 159 - 171 $29,920.89 Capital Projects 103 - 107 $ 1,738.08 Supervisor Thorpe offered privilege of the floor to those in attendance. Councilman O'Donnell asked his constituents of holding the May 3rd, 2000 Town Board meeting at the McGraw Community Center and June 7th, 2000 at the Blodgett Mills Church. These two meetings would be held at 7:00 p.m. They agreed. It is noted the Town Board meetings held last May and June at the above facilities were well attended. 7 1 DECEMBER 15, 1999 TOWN BOARD MEETING PAGE 2 /37 Monthly reports for the Supervisor, Town Justice and SPCA for November 1999 are on the table for review and filed in the Town Clerk's office. Councilman Rocco made a motion, seconded by Councilman O'Donnell,'to .receive and file a letter dated December 7, 1999 from Barry Stevens, Regional Traffic Engineer from the State DOT. All voting aye, the motion was carried. The letter was acknowledging the town's request to reduce the speed limit. on McLean Rd. ' ` ' . Attorney Folmer reported: At the lastmeeting there was a discussion regarding the Lockbox ordinance. Under the provisions of the drafted ordinance the only time the Lockbox system would be activated would be a 911 call directly to the fire station. Mr. Folmer received a phone call from the Cortlandville Fire Department on this statement. It was stated that there is no direct link to the Cortlandville Fire Department. A direct link to the Cortlandville Fire Station would require a 24 hour a day 7 day a week dispatcher. This ordinance as presently drafted would not accomplish the purpose of which it was intended to do. Currently all calls of 911 have a direct link to the Cortland County Public Safety Building. It was decided Attorney Folmer would be in contact with Richard Beebe and Joseph Kuck to inform them of this new information. The next Town Board meeting will be January 5, 2000 at 5:00 p.m. Attorney Folmer will ask Mr. Beebe and Mr. Kuck to attend for their input before the Lockbox ordinance is adopted. Councilman Rocco questioned if a response had been received regarding reducing - the weight limit on McLean Rd. It was stated to Councilman Rocco the speed limit issue has been forwarded on to the County Highway Sup't. with the weight limit being overlooked for McLean Rd. Supervisor Thorpe indicated he will draft a letter to County Highway Sup't., Joseph Eggleston to investigate this issue also. RESOLUTION #251 ACKNOWLEDGE APPLICATION RECEIVED FROM THE FCC REGARDING FRANCH-CABLEVISION AND HORNELL TELEVISION TO TRANSFER CONTROL TO TIME WARNER ENTERTAINMENT COMPANY L.P. Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, the application for Franchise Authority Consent to transfer control from Franch-Cablevision and Hornell Television to Time Warner Entertainment Co., L.P. from the Federal Communications Commission is hereby received and filed, and it is further RESOLVED, the Town Clerk will forward a copy of this resolution to Time Warner. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file information dated December 10, 1999 from the Town of Ledyard regarding the Cayuga Lake Watershed Management Plan. All voting aye, the motion was carried. Attorney Folmer reported: The Saunders Rd. water, Fisher Ave. water and sewer, and NYS Route 13 water, all capital improvements will be signed Friday December 17, 1999 for BANS by Supervisor Thorpe and Town Clerk Snyder. Adding these projects have been consolidated into one BAN. / � DECEMBER 15, 1999 TOWN BOARD MEETING PAGE 3 Attorney Folmer apprised the Board of in past years he was allowed to hire temporary help to assist him with closing and cataloging Town of Cortlandville Attorney files by the end of the year. Attorney Folmer is requesting to hire Tiffany Folmer and/or Marci Widger for a cost of $200.00. RESOLUTION #252 AUTHORIZE HIRING TIFFANY FOLMER AND/OR MARCI WIDGER AS TEMPORARY HELP TO ASSIST TOWN ATTORNEY WITH CLOSING 1999 TOWN FILES Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, the Town Attorney has requested additional temporary help in order to close and catalog 1999 Town of Cortlandville Attorney files, therefore BE IT RESOLVED, the Town Board does hereby authorize the Town Attorney to hire Tiffany Folmer and/or Marci Widger to assist with closing and cataloging 1999 Town of Cortlandville Attorney files, and further RESOLVED, they shall be paid by voucher, subject to audit by the Town Board not to exceed $200.00 from the Town Attorney's contractual expense. The following are notifications from NYS DOT of there right of exercising Eminent Domain to acquire property located on NYS Route 13 (Dryden Rd.) Councilman O'Donnell made a motion,; seconded by Councilman Rocco; to,receive and file appropriation map #92, parcel #99 from the NYS DOT. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file appropriation map #96, parcel #103 from the NYS DOT. All voting. aye, ;the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file appropriation map #99 & #114, parcel #106 & #107 from the NYS DOT. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file appropriation map #103, parcel #111 from the NYS DOT. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file appropriation map #106 & #115, parcel #115 & #116 from the NYS DOT. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file appropriation map #107, parcel #117 from the NYS DOT. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman -Rocco, to receive and file appropriation map 4110, parcel #120 from the NYS DOT. Allvoting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Rocco; -to receive and file appropriation map #1 It, parcel #121 from the NYS DOT. All voting aye, the motion was carried. 1 1 I DECEMBER 15, 1999 TOWN BOARD MEETING PAGE 4 189 Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file Apportionment of Mortgage Tax Monies from the Cortland County Treasurer. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman Testa, to receive and file a letter written by Supervisor Thorpe to County Highway Sup't., Joseph Eggleston. All voting aye, the motion was carried The letter was in regards to a request for a four way stop sign for Page Green Rd. and Saunders Rd. Councilman Pilato made a motion., seconded by Councilman Rocco, to recess the Regular Meeting to an Executive Session to discuss possible litigation. All voting aye, the motion was carried. The meeting was recessed at 5:15 p.m. The following information was received from the Supervisor's office. Councilman Testa made a motion, seconded by Councilman O'Donnell, to adjourn the Executive Session and reconvene to the Regular Meeting. All voting aye, the motion was carried. No action was taken. Councilman Testa made a motion, seconded by Councilman Rocco, to adjourn the regular meeting. All voting aye, the motion was carried.
