Dan Kwasnowski went over the amendments that were brought before the Town Board at their last meeting. The public hearing for those amendments is scheduled for February 11. Other items of interest from the ]'own Board meeting were discussed like the Lew -Lin Farm, Campbell property, and upcoming projects. M Hatch made a motion to approve the November and December Planning Board Minutes. D Weinstein seconded the motion. All voted aye and the motion passed. * Please forward the final set of amendments that will be used at the public hearing on 2 /11 to the Planning Board once they are available electronically. Agenda — M Welti went over the agenda. 'There were no changes. Review Zoning Amendment Process 2009 Discussion of timeline for moving forward and when the DRAFT should be sent to the other boards. It was felt that it could be sent now with a note that there was still fine tuning to be done before it was sent on to the Town board. Meeting Schedule: 214 2125 Will schedule March meeting next month. Tentatively, a draft will be available for the public in early iklarch with a public information session to be held in Varna a week or two after release. A revised and then final draft should be available in early and late April, respectively, with a Public Hearin€ and joint PBrI "B meeting in May with adoption in June. Amended Zoning Law — Complete Preliminary Draft (December l8, 2008) An overview by Article was done with feedback from the Planning Board, Article 11, Purpose: minor change. Article III, Definitions: no longer an Appendix. Many definitions updated and added. Article IV, Zoning Districts: new names from Comprehensive Plan, new language for boundary ;40 determination. PB 01 -I5-2009 Page 2 of 3 Article V, Use Regulations: Move footnotes to notes section prior to table. Article V1, Area and Bulk Regulations: Area and Bulk 'fable created, Frontage based density for RR and RA Districtuions, Sliding Scale for CV District. Behan will be redoing sketches before including them to illustrate points without flourish for ease of understanding concepts. Article VII, Conservation Subdivisions: Optional for arty subdivision, required to exceed frontage -based density in the RR and RA Districts. Article VIII, Overlay Districts: covers areas identified as "Suburban Residential'' in the Comprehensive Plan (requires public water and sewer) Article 1X, General Regulations: Section 900 — old Section 500 Section 901 — from Yards and Landscaping sections for each district in old code Section 902 — Off- Street Parking — old code has been revised Section 903 — Signs — old Article 15 Section 904 — Elder Cottages — old Article 11 V Section 905, 906, 907, 908; and 909 — old Article 16 * Old Article 10 — Mobile Homes — should this be added? Also, there is a Mobile Home Park Ordinance and a Mobile Nome Ordinance. Off street parking — do we want to set a maximurn instead of a minimum? Paving definition needs to be better. It doesn't have to be asphalt. Park & ride Commercial Parking lot Discussion of Mobile Home Parks, single -wide trailers vs. double wide manufactured homes vs. modular homes and where the Town wants to go in regards to these topics. There are enough trailer parks. Some expansion might be ok if accompanied by improvements — the thought being that the expansion might be an incentive to draw improvements. Discussion of Cornell, SUNY vs. endowed and who oversees building. Section 907: One Lot in Two Zones Move to 402: Boundary Determinations —so these are in the same place. Discussion of slope and wel:land maps and using them to help determine map zoning boundaries. The map needs more review and discussion. Article. X, Planned Unit Development Districts: PUD changed to 25 acres. Discussion of why it was at 100. It swill stay at 100 acres and may be discussed further. Article XI, Site Plan Review: new Article X11, Special Use Permits. new Gas drilling, pipelines? Page 54 — special use permits run with land — remove tills section. Variances go with the land, Special Use Permits with the owner. This review needs to happen automatically when a property / business /etc. changes hands. Could have an abbreviated process for change of ownership as opposed to a new application, but this review needs to happen. Article X111, Variances and Appeals: new Article XIV, Non - Conforming Uses and Structures: mix of old Article 17 and new, still needs to be cleaned up. PB 01- 154009 Page 3 of 3 • Article XV, Administrative Provisions: new Article XVI, Enforcement: new, replaces portions of former Section 1800 Article XVII, Miscellaneous Provisions — new — covers items in former Article 20 and 21 Zoning Map - new districts reflect laird use categories from the Comprehensive Plan.
