HILLSIDE & MEADOW LANE COLLECTION SEWER PROJECT - 1996 A Public Hearing was held by the Tom Board of the Town of Cortlandville on December 18, 1996 at 5:00 p.m. at the Cortlandville Town Hall, 3577 Terrace Road, Cortland, New York, concerning Hillside Dr. & Meadow Lane Collection Sewer Project - 1996. ® Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present were: Town Attorney, John Folmer; Highway Supt, Carl Bush and News reporter, Pat Lewis. Supervisor Thorpe called the Public Hearing to order at 5:00 p.m. The Town Clerk read aloud the Legal Notice, as posted and filed. Supervisor Thorpe offered those in attendance privilege of the floor. No questions or comments were heard. Councilman O'Donnell made a motion, seconded by Councilman Pilato, to close the Public Hearing. All voting aye, the motion was carried. The Public Hearing was closed at 5:05 p.m. C1 1 31,6 DECEMBER 18, 1996 TOWN BOARD MEETING 5:00 P.M. The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 3577 Terrace Road, Cortland, New York, with Supervisor Thorpe presiding, following a Public Hearing. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Councilman, Edwin O'Donnell Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present were: Town Attorney, John Folmer; Highway Supt, Carl Bush and News reporter, Pat Lewis. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to approve as written, the Town Board Minutes of November 06, 1996. All voting aye, the motion was carried. RESOLUTION #212 AUTHORIZE PAYMENT OF VOUCHERS DECEMBER Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers #653-682 $43,193.66 General Fund B 167-172 $ 8,316.75 Highway Fund DB 500-525 $36,021.24 Water Fund 292-305 $13,016.74 Sewer Fund 184-189 $ 381.15 Privilege of the floor was given to Councilman O'Donnell. He attended an informational meeting held at the Village of McGraw regarding the Bennett Street Bridge. County Highway Supt, Walt Tennant and Engineer, Joe Eggleston were in attendance. Joe Eggleston presented a map for every one to review, and requested it be made available for others for their requests or changes. He requested this be done by mid January and another meeting be held to make changes and decisions. Traffic concerns, location and exits of a road, and other concerns were discussed. Reports for the month of November 1996, from the Supervisor and Justice Department are on the table for review, and filed in the Town Clerk's Office. RESOLUTION #213 ACCEPT STATEMENT OF COMPLETION FOR LUKER ROAD SEWER IMPROVEMENT PROJECT Motion by Councilman O'Donnell Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Statement of Completion for Luker Road Sewer Improvement Project - 1996, in the amount of $114,809.96, is hereby accepted, and shall be received and filed. U DECEMBER 18, 1996 TOWN BOARD MEETING PAGE 2 RESOLUTION #214 ACCEPT STATEMENT OF COMPLETION FOR ROUTE 215 CONNECTION WATER IMPROVEMENT PROJECT Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Statement of Completion for Route 215 Connection Water Improvement Project - 1996, in the amount of $256,565.33, is hereby accepted, and shall be received and filed. RESOLUTION #215 ACCEPT STATEMENT OF COMPLETION FOR ROUTE 13 SCM WATER MAIN IMPROVEMENT PROJECT Motion by Councilman Rocco Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Statement of Completion for Route 13 SCM Water Main Improvement Project - 1996, in the amount of $127,302.82, is hereby accepted, and shall be received and filed. RESOLUTION #216 ACCEPT STATEMENT OF COMPLETION FOR MID -TOWN SEWER IMPROVEMENT PROJECT Motion by Councilman Pilato Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Statement of Completion for Mid -Town Sewer Improvement. Project - 1996, in the amount of $790,906.41, is hereby accepted, and shall be received and filed. RESOLUTION #217 ESTABLISH CUT-OFF DATE TO SUBMIT VOUCHERS FOR PAYMENT IN 1996 Motion by Councilman O'Donnell Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Board does hereby declare the last date to submit vouchers for payment within the 1996 Budget shall be December 27, 1996. RESOLUTION #218 AUTHORIZE NYS DOT TO UTILIZE NORTH . HOMER AVENUE BETWEEN FISHER AVENUE AND ROUTE 11 AS A DETOUR DURING THE BRIDGE REPLACEMENT PROJECT ON ROUTE © 11 (BIN 1008390) Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, the New York State Department of Transportation proposed to replace the Route 11 Bridge (BIN 1008390) over the New York Susquehanna and Western Railroad in the Town of Cortlandville, WHEREAS, in conformance with Section 42 of the New York State Highway Law, the New York State Department of Transportation proposes to utilize North Homer Avenue between Fisher Avenue and Route 11 as detours during the period of construction, DECEMBER 18, 1996 TOWN BOARD MEETING PAGE 3 WHEREAS, the New York State Department of Transportation will provide traffic control devices and resurface this highway with 1.5 inches of asphalt concrete to make them adequate to handle the additional detour traffic, now therefore BE IT RESOLVED, that the Town Board of the Town of Cortlandville does hereby authorize the New York State Department of Transportation to utilize the above mentioned roads and streets as detours during the period of construction, • BE IT FURTHER RESOLVED, that the clerk of this Board is hereby directed to transmit three (3) certified copies of this resolution to the State Department of Transportation. RESOLUTION #219 AUTHORIZE NYS DOT TO CLOSE THE INTERSECTION OF NORTH HOMER AVENUE WITH ROUTE 11 FOR THE BRIDGE REPLACEMENT PROJECT ON ROUTE 11 (BIN 1008390) Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, in connection with the replacement of the Route 11 Bridge (BIN 1008390) over the New York Susquehanna & Western Railroad, SH 208 and 5058, Cortland County, and under the provisions of Subdivision 25 of Section 10 of the New York Highway Law as amended, which provides in part, that the Commissioner of the Department of Transportation shall "Have power to combine, connect, alter, relocate, terminate, and pave intersecting highways, roads, streets" and also, that "The maintenance of any highway, road or street which is affected by this subdivision and which, in the judgment of the Commissioner, is not deemed to be part of the State Highway system, shall be maintained by the municipality of the municipalities in which North Homer Avenue is located," and WHEREAS, the Commissioner proposes to improve State Highways 208 and 5058, Cortland County, and in connection therewith to close the intersection of North Homer Avenue with Route 11 approximately 380 feet north of the existing bridge, and WHEREAS, said highways, roads or streets are to be located within the Town of Cortlandville and in the judgment of the Commissioner of the Department of Transportation, will not be deemed to be part of the State Highway system, now therefore BE IT RESOLVED, the Town Board of Cortlandville approves the above -described closure, and be it further RESOLVED, that upon completion of construction of the above -described closure, the Town of Cortlandville will continue to maintain the remaining portion of North Homer Avenue in accordance with the provisions of the Highway Law, BE IT FURTHER RESOLVED, that the Clerk of this Board is hereby directed to transmit three (3) certified copies of the foregoing resolution to the State Department of Transportation. 2/q DECEMBER 18, 1996 TOWN BOARD MEETING PAGE 4 Attorney Folmer had nothing to report. Supervisor Thorpe advised Board members of a letter he received from County Highway Supt, Walt Tennant. it advised the Town Highway Superintendent's Association of Cortland County meet monthly, October thru May, the third Thursday of each month. Their next meeting will be held at the American Legion in Marathon on December 19th. Supervisors and Town Board members are also invited. Councilman O'Donnell made a motion, seconded by Councilman Testa to recess, the regular meeting and convene to an executive session to discuss a personnel matter. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to adjourn the executive session and reconvene to the regular meeting. All voting aye, the motion was carried. No action was taken. Councilman Rocco made a motion, seconded by Councilman Pilato, to adjourn the regular meeting. All voting aye, the motion was carried.
