PUBLIC HEARING STARR ROAD SEWER PROJECT A Public Hearing was held by the Town Board of the Town of Cortlandville at the Town Hall, 15 Terrace Road, Cortland, New York, on December 16, 1992 at 5:30 p.m. I or the Starr Road Sewer Project. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Town Clerk, Pauline Parker Absent: Councilman, Donald Beard Others present were: Highway Superintendent, Carl Bush; Town Attorney, Phillip Rumsey. The Public Hearing was called to order by Supervisor Thorpe at 5:30 p.m.. The Town Clerk read aloud the legal notice, as posted and filed. No other comments or questions were heard. Councilman O'Donnell made a motion, seconded by Councilman Rocco to close the Public Hearing. '_11 voting aye, the motion was carried. The Public Hearing was closed at 5:35 p.m. 1 336 Wednesday, December 16, 1992 TOWN BOARD MEETING 5:00 P.M. The Regular Meeting of the Town Board of the Town of Cortlandville, was held at the Town Hall, 15 Terrace Road, Cortland, New York, at 5:00 p.m. Members present: Supervisor, Raymond Thorpe Councilman, Edwin O'Donnell Councilman, Theodore Testa Councilman, Ronal Rocco Town Clerk, Pauline Parker absent: Councilman, Donald Beard Others present were: Town Attorney, Phillip Rumsey; Highway Sup't, Carl Bush; and Dave Olp of Walden Oaks. The meeting was called to order by Supervisor Thorpe at 5:00 p.m. Councilman O'Donnell made a motion, seconded by Councilman fiesta, to approve as written, the November 4, 1992 Town Board Minutes. All voting aye, the motion was carried. RESOLUTION #243 AUTHORIZE PAYMENT OF VOUCHERS DECEMBER Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers# 468-493 $ 9,571.17 General Fund B 113-115 $ 59.49 Highway Fund 421-448 $45,115.23 Water Fund 234-242 $ 6,515.61 Sewer Fund 125-127 $ 4,158.28 Capital Projects 100-103 $ 4,547.52 Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file the Cortlandville Planning Board Minutes of September 29, 1992 and October 27, 1992. All voting aye, the motion was carried. Supervisor Thorpe offered privilege of the floor to Councilman O'Donnell. He expressed concern about the Cortlandville Fire Department and the process they have used in the past. Is there something that we could do to assist them? Their lack of contracts and communication with the public has everyone concerned. Councilman O'Donnell- suggested that we request copies of their minutes. Would it be beneficial to work with them before their budget is submitted? He stated that we should do something now, for the good of everyone. There is a problem with the Fire Tax increase every vear and there should be some guidance with the budget. Rhodes, Chairman of the City of Cortland Water Board. All voting aye, the motion was carried. The letter invited the Town Board to attend a meeting to encourage forming an organization to open communication between entities to discuss Aquifer Protection within Cortland County. Councilman O'Donnell made a motion, seconded by Councilman Vesta, to receive and file a letter from Sammons Communications. All voting aye, the motion was carried. The letter advised of a rate increase, effective January 15, 1993 for two of their cable service channels. RESOLUTION #24 ACCEPT DEDICATION OF CERTAIN ROADS, WATER AND SEWER LINES WITHIN WALDEN OAKS SUBDIVISION AND SECURITY DEPOSIT SUBJECT TO APPROVAL Motion by Councilman O'Donnell Seconded. by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, Mr. Dave Olp, General Manager of Barden & Robeson Construction Division , Inc. submitted a _Istter dated December 15, 1993, to the Town Board requesting them to take action and accept the dedication of named roads, parcels, water pressure boosting pump station and water and sewer mains within the Walden Oaks Subdivision, and WHEREAS, also submitted were plans for road completion in the Spring and estimated costs of such projects, and WHEREAS, monies have been deposited, for security purposes, at the Cortland Savings Bank, Cortland, NY in the amount of $16,891.00, and WHEREAS, the Town Highway Superintendent expressed concerns about some of the named projects, therefore BE IT RESOLVED, that the Town Board shall accept dedication of certain Roads, Water and Sewer Lines within the Walden Oaks Subdivision, subject to approval by the Town Highway Sup't. and Town Attorney, as submitted in the letter of December 15, 1992, and FURTHER. RESOLVED, the acceptance of the funds on deposit at the Cortland Savings Bank in the amount of $16,891.00 for such named projects. 33� DECEMBER 16, 1992 PAGE 3 Councilman Rocco made a motion, seconded by Councilman O'Donnell, to -recess the regular meeting to hold a Public Hearing concerning the Starr Road Sewer Project. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to reconvene the Regular Meeting. All voting aye, the motion was carried. RESOLUTION #245 AUTHORIZE COMPLETION OF SHORT FORM SEQRA FOR STARR ROAD SEWER PROJECT AND DECLARE NEGATIVE IMPACT Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Town Board reviewed and completed the Short Environmental Assessment Form for the Starr Road Sewer Project, and declared that it would have no environmental impact, and further RESOLVED, that the form shall be received and filed. RESOLUTION #246 ADOPT RESOLUTION PURSUANT TO TOWN LAW SECTION 209-q (6) (C) "STARR __ROAD SEWER IMPROVEMENT" Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, there was filed in the office of the Town_ Clerk of the Town of Cortlandville, Cortland County, New York, general plans, map and engineering report relating to the establishment of a sewer improvement project for the Cortlandville area of Starr Road and designated "Starr Road Sewer Improvement", as required by Section 209-a and 209-c of the Town Law, and are available for public inspection, and WHEREAS, an Order was duly adopted by the Town Board on December 2, 1992 reciting the filing of said general Plans, the construction proposed, and the estimated expense thereof and specifying December 16, 1992 at 5:30 o'clock p.m. as the time and -the said Town Hall in the said Town of Cortlandville as the place where the said Board would meet to consider the documents filed as aforesaid and to hear all persons interested in the subject thereof, concerning the same, and WHEREAS, an Order was duly posted and published as required by law, and WHEREAS, a hearing in the matter was duly held by the Board on the 16th day of December, 1992 commencing at 5:30 p.m. at the Town Hall in the said Town and discussion upon the matter having been and all persons desiring to be heard having duly heard including members of the Board and various other persons, and NOW, upon the evidence given upon such hearing and upon the motion of Edwin O'Donnell, Councilman, seconded by Ronal Rocco, Councilman, and unanimously passed it is \J 3 DECEMBER 16, 1992 PAGE RESOLVED AND DETERMINED, that the plans heretofore filed with the Town Clerk of the Town of Cortlandville are in compliance with section 209-c of the Town Law of the State of New York and are otherwise sufficient, and that to establish the aforesaid sewer improvement is in the public interest, and it is further RESOLVED and DETERMINED, all costs, including the principal and interest on said bonds or other obligations authorized to be issued shall be borne by the lands benefited by such improvement and such costs shall be assessed, levied and collected from the several lots or parcels of land within said Town of Cortlandville in just proportion to the amount of benefit which the improvement shall confer upon such lots or parcels; it is further hereby determined that all lots or parcels in the Town of Cortlandville outside of Villages, capable of being serviced by the "Article 12-C" Sewer improvement heretofore and hereafter provided, are lots or parcels benefited by the proposed sewer project any: all previous improvements shall be spread upon and over the enlarged benefited area, all of such improvements constituting one sewer system, such system being described by and including the area set forte in the "West. Road Sanitary Sewer Improvement Project - Phases ?" and the following parcels designated on the 1992 Cortland County real property tax maps as Cortlandvil ie tax parcels: Tax Map 96.00-02: Parcels: 01, 06.2, 06.12. Tax Map 96.00-06: Parcels: 01. Tax Map 96.06-01: Parcels: 15 . 1 . Tax M,; 96.09-01 Parcels: 60, 61, 62, 63, 64, 65, 66, 68, 70, 71.1. and 71.2. Tax Map 96.09-02: Parcels: 48 and 49. Tax Map 96.10-01_ Parcels: 01, 02, 04, 05, 13, 14, 15, 16, 17, 18, 19.1, 19.2, 20, 21, 22, and 34. Tax Map 96.10-02: Parcels: 07, 08, 21, 22, 37.1, 38, 39, 40, 42, 43, 441 45, 46, 47, and 48. Tax Map 96.11-01: Parcels: 01.112, 01.12, 10, 111 12 and 13. WHEREAS, it is further proposed that the costs of management, maintenance, operation and repair of said improvement as proposed in said plans be authorized pursuant to Section 209-q(6) (c) of the Town Law; that the improvement therein mentioned be constructed and the service therein mentioned be provided for upon the required funds being made available or provided for; and that such improvement shall be designated and known as "Starr Road. Sewer Improvement", and it 1s further RESOLVED AND DETERMINED, that the proposed improvement, including cost and rights of way, construction cost, legal fees, engineering and consultant fees, and a+_1 other expenses approximated to be a maximum of -3Vv DECEMBER 16, 1992 PAGE 5 $222,000.00 shall be financed by the issuance of bonds by the Town of Cortlandville for maximum term of forty years at prevailing interest, and it is further RESOLVED AND DETERMINED, that the costs of management, maintenance, operation and repair of said improvement or services shall be a charge upon the area of the Town of Cortlandville outside of Villages and shall be levied and collected in the same manner and at the same time as other Town charaes, provided that it is the intention of the Town Board that such costs will be raised in the first instance from sewer rates, charges and fees upon all lots or parcels heretofore and hereafter serviced by Town Law Article 12-C Sewer Improvements, and it is further RESOLVED, that the Town Clerk of this Town shall within ten (10) days after the adoption of this Resolution file a certified copy of this Resolution in the Cortland County Clerk's Office as provided for by Town Law Section 209-q (6) (d). RESOLUTION #247 ADOPT ORDER PURSUANT TO TOWN LAW SECTION 209-q(3) STUPKE ROAD WATER IMPROVEMENTS AND SET A DATE FOR A PUBLIC HEARING Motion bv_ Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, there was filed in the Office of the Town Clerk of the Town of Cortlandville, Cortland County, New York, general plans, map engineering report relating to the construction of a water improvement project for the Cortlandville area of Stupke Road and designated "Stupke Road Water Improvement", as required by Section 209-q and 209-c of the Town Law, and are available for public inspection, and WHEREAS, the proposed, improvement consists of approximately 3,800 feet of new water line along the full length of Stupke Road for the purpose of improving water delivery from the )ime Hollow Pumping Station to the Blue Creek Water Tank, in accordance with the said plans now on file in the Office of the Town Clerk of the Town of Cortlandville, and WHEREAS, the maximum amount proposed to be expended for said improvement is $155,000.00 and WHEREAS, the proposed method of financing of said improvement is by the issuance of bonds by the Town of Cortlandville for a maximum term of forty years at prevailing interest; all cost, including the principal and interest on said bonds or other obligations authorized to be issued shall be borne by the lands benefited by such improvement and such costs shall be assessed, levied and collected from the several lots or parcels of land within said Town of Cortlandville in just proportion to the amount of benefit which the improvement shall confer upon such lots or parcels; it is further hereby proposed that all lots or parcels in the Town of Cortlandville outside of Villages, capable of being serviced by the "Article 12-C" Water Improvements heretofore and hereafter provided, are lots or parcels benefited by the proposed water improvement; and the cost of the proposed water project and all previous improvements shall be spread upon and over the enlarged benefited area, all of such improvements constituting one water system, such system being described by and including the areas set forth in the DECEMBER 16; 1992 PAGE 6 "West Road Water Improvement" Resolution adopted by this Board on July 1, 1992, and the following parcels designated on the 1992, Cortland County real property tax maps as Cortlandville tax map parcels: Tax Map 95.15-01: Parcels: 04, 05, 06, 12, 13, 14.1 and 14.2. Tax Map 95.15-02: Parcels: 01, 02, 03, 04, 5.111, 5.112, 5.12 and. 5.2. Tax Map 95.15-03: Parcels: 07, 08, 13, 14, 15, 23 and 24. WHEREAS, it is further proposed that the costs of management, maintenance, operation and repair of said improvement of services shall be a charge upon the area of the Town of Cortlandville outside of Villages and shall be levied and collected in the same manner and at the same time as other Town Charges, provided that it is the intention of the Town Board that such costs will be raised in the first instance from water rates, charges and fees upon all lots or parcels heretofore and hereafter serviced by Town Law Article 12-C Water Improvements, and WHEREAS, an Environmental Assessment Form has been prepared pursuant to the State Environmental Quality Review Act, and is available for review by the public at the Cortlandville Town Hall, IT IS HEREBY ORDERED, that a meeting of the Town Board of the said Town of Cortlandville shall be held at the Town Hall, Terrace Road, Cortland, New York on the 6th day of January, 1993 at 7:00 o'clock p.m. of that day to hear all persons interested in the proposed water improvement, and for such other action of said Town Board wit1h relation to the said water improvement as may be required by law or be deemed proper. RESOLUTION #248 AUTHORIZE COMPLETION OF SHORT FORM SEQRA, FOR STUPKE ROAD WATER IMPROVEMENT PROJECT AND DECLARE NEGATIVE IMPACT Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Town Board reviewed and completed the Short Environmental Assessment Form for the Stupke Road Water improvement Project and declared it to have no environmental impact, and further RESOLVED, that the form shall be received and filed. Councj.lman O'Donnell made a motion, seconded by Councilman Rocco, to adjourn the regular meeting. All voting ave, the motion was carried.
