HomeMy WebLinkAbout12-27-1979Thursday, December 27, 1979 Page 1 The final meeting of the Cortlandville Town Board for the year 1979, was held at 7:35 p.m. at Town Hall, 15 Terrace Rd., Cortland, N.Y. with Supervisor Nadolski presiding. Other Board members present were: Councilman, Edwin O'Donnell; Councilman, Warren Manning; Councilman, Melvin Pierce; and Councilman, Raymond Thorpe. Also present were; Town Clerk, Pauline Parker; Justice, Donald Eaton; Confidential Sec'y,,Edna Puzo; Engineer, Charles Feisli; and Highway Sup't, Carl Eaton. The adjourned Public Hearing was held in regards to trans- ferring of surplus Federal Revenue Sharing Funds at 7:30 p.m. The Town Clerk read the Legal Notice published in the • Cortland Standard on Dec. 15, 1979. No opinions were expressed by those in attendance. The hearing was closed upon motion of Councilman Manning, seconded by Councilman Thorpe. All voting aye, motion was carried. Supervisor Nadolski called the meeting to order. Highway Sup't, Carl Eaton, apprised the Town Board of two obselete trucks which are now obselete. He requested permission to sell them. It was recommended that he look for prospective buyers trucks and report back at the next meeting. Highway Sup't, Carl Eaton, apprised the Town Board of a Spring St. problem at the Spring St. bridge located in the Village of McGraw.bridge - Originally, the bridge was a county bridge, but it was shortened McGraw and now it is classified as a town bridge. A few years ago, the town put in a retaining wall at that location. Now the water is eroding the banks after the retainer wall. The matter was tabled for further investigation. No action was taken. Supervisor Nadolski referred to the letters recently sent to those homeowners of the McLean Rd. - Terrace Rd. area that letters for were not using the sewer. As a result of the letters, three Sewer hookup more are now using the sewer, and one more will be hooked up soon. Two will be making application soon and there was no reply from four homeowners. The matter will be discussed further with the Attorney. Ludwig BE -IT RESOLVED that Fred Ludwig, homeowner on McLean Rd. delay sewer shall be allowed a six months delay until June 1, 1980 to make his sewer hookup, as requested, and hookup RESOLVED that a minimum charge will be billed to him commencing January 1, 1980. RESOLUTION #:192 AUTHORIZE PAYMENT TO HAYES AMBULANCE FOR JANUARY 1980 TO REMAIN SAME AS 1979 Motion by Councilman Thorpe Seconded by Councilman Pierce VOTES: All AYE ADOPTED payment for WHEREAS the contract with Hayes •Ambulance for'1980 has not been agreed upon with both parties, and Hayes Ambulance WHEREAS Mr. Purdy is to present more statistical figures, therefore, BE IT RESOLVED that the payment due Hayes Ambulance for January 1980 will remain on the same basis as 1979. Upon motion of Councilman Pierce, seconded by Councilman Thorpe. all voting aye... the meeting was recessed for a public hearing. The adjourned Public Hearing was reopened at 7:45 p.m. in regards to the Fire Protection Contract with the Village of McGraw. The Town Clerk read the Legal Notice that was published in The Cortland Standard on December 15, 1979. No opinion was expressed by those in attendance. The hearing was closed upon motion of Councilman Manning, seconded by Councilman Thorpe. All voting aye, motion was carried. Councilman Thorpe made a motion, seconded by Councilman O'Donnell to reconvene the regular meeting. All voting aye, motion was carried. 0 RESOLUTION # 193 AUTHORIZE TRANSFER OF SURPLUS FEDERAL REVENUE SHARING FUNDS Motion by Councilman Pierce Seconded by Councilman Thorpe VOTES: All AYE ADOPTED WHEREAS a Public Hearing was duly held by the Town Board, Transfer of according to law, and surplus Federal WHEREAS there were no objections voiced at such hearing, Revenue Sharing therefore, Fund BE IT RESOLVED that surplus Federal Revenue Sharing Funds in the amount of $10,873.73 shall be transferred from DR5110.4 to DM5130.4 1 • 1 1 t I �ii Y Thursday, December 27, 1979 Page 3 RESOLUTION # 194 AUTHORIZE SIGNING OF THE FIRE PROTECTION CONTRACT WITH THE VILLAGE OF MC GRAW Motion by Councilman Manning Seconded by Councilman Pierce VOTES: All AYE ADOPTED WHEREAS a Public Hearing was duly held by the Town Board, according to law, and Signing of the Fire Protectic WHEREAS there were no objections voiced at such hearing, Contract therefore, ® BE IT RESOLVED that the Supervisor, is hereby authorized and directed to sign the two year Fire Protection Contract with -the Village of McGraw, in the amount of $13,500. to be paid annually in February. RESOLUTION # 195 AUTHORIZE SIGNING OF THE CONTRACT WITH THE S.P.C.A. Motion by Councilman Zierce .Seconded by Councilman Thorpe -VOTES: All AYE ADOPTED WHEREAS the Cortland County S.P.C.A has been appointed Signing as DCO and shelter agency for the Town of Cortlandville, Contract therefore, S.P. C.A. BE IT RESOLVED that the Supervisor is hereby authorized and directed to sign the one year contract with the Cortland County S.P.C.A. in the amount of $7,600. to be paid in -twelve monthly installments. Councilman Manning was requested to contact the Cortlandville Committee to make arrangements for the procedure to arrange for a memorial for Ray Miller, to be placed in the Town Hall. In accordance with Section 284 of the Highway Law, Highway Superintendent, Carl Eaton, presented the agreement Agreement for the Expenditure of Highway Monies - for 1980. No opinion was expressed by those in attendance after explanation of such change. The hearing was closed upon motion of Councilman Pierce, seconded by Councilman O'Donnell. RESOLUTION # 197 AUTHORIZATION TO AMEND SECTION 2 and 3 OF TOWN SEWER ORDINANCE Motion by Councilman Pierce Seconded by Councilman Thorpe VOTES: All AYE ADOPTED Amend Section 2 and 3 of Sewer Ordinance WHEREAS a Public Hearing was held by the Town Board of the Town of Cortlandville, at the Town Hall, on December 279 1979 at 8:00 p.m., in the matter of amending Sections Two and Three of the Sewer Ordinance, and WHEREAS there were no objections to the change, therefore, BE IT RESOLVED that Sections Two and Three of the Sewer Ordinance of the Town of Cortlandville, is hereby amended as followss Section 2. The basis of the charge for such sewer rent shall be the consumption of water and sIxch-i rent-c-shall equal the sum of 850 per 1,000 gallons of metered consumption of water on the premises. Notwithstanding the foregoing in no event shall the sewer rent for any premises served be less than $3.00 per quarter. Section 3. The sewer rent shall be due and payable within ten (10) days following the rendering of a bill or notice demanding payment thereof which bill or notice shall be mailed at quarterly intervals or oftener in the discretion of the Town Board. A penalty of 10 percent of the amount due shall be added to the unpaid sewer rent in arrears for 30 days or longer. If the sewer rent remains unpaid for 60 days from the date due, the sewer service is subject to being discontinued without notice. A charge of $5.00 will be made for each dis- continuance and each re -connection of sewer service because of non-payment of sewer rent, which charge or charges shall be treated as sewer rent. Such rent shall constitute a lien upon the real property served by such sewerage system, which lien shall be prior and superior to every other lien or claim except the l;e.n of an exist- ing tax or local assessment. 226 Thursday, December 27, 1979 page 6 BE IT FURTHER RESOLVED that this resolution shall become effective January 1, 1980, and upon publishing and posting as required by law. RESOLUTION # 198 AUTHORIZE HIRING OF ADDITIONAL HELP FOR THE ENGINEER Motion Uy Councilman Thorpe Hire Seconded by Councilman O'Donnell Help for VOTES: All AYE ADOPTED engineer BE IT RESOLVED,that the Engineer is hereby authorized to.`hire additional help to repare the specs for the • McLean Trunk Line Sewer at $4.00 per hr. Assessor, Robert Wells, is acting as co-ordinator for the R. Wells census taking for 1980 for the Town. of Cortlandville. co-ordinator It has been recommended that a committee of local citizens for 1980 be appointed to help with the -project; census Supervisor Nadolski requested that names be submitted at the next meeting to serve on this committee. RESOLUTION # 199 SETTING DATE FOR PUBLIC HEARING FOR SAMMONS COMMUNICATIONS Motion by Councilman Pierce Seconded by Councilman O'Donnell VOTES: All AYE ADOPTED BE IT RESOLVED that a tentative date of February 6, 1980 setting date at 7:30 P.M. was set for a Public Hearing for Sammons for public HeariMmmunicat ions, to be held at Town Hall, 15 Terrace Rd, for Sammons Cortland, NY, for the purpose of a rate increase requested Com, by Sammons Communications. Supervisor Nadolski discussed a statement prepared by Assessor, Robert Wells. This was in regards to the drop of the equalization rate for the Town of Cortlandville of 8%.
