TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 3577 Terrace Road, Cortland, New York, with Deputy Supervisor Testa presiding. Members present: Deputy Supervisor, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Karen Q. Snyder Absent: Supervisor, Raymond Thorpe • Others present were: Highway Sup't., Carl Bush; Town Highway employee Roger Karn and wife: town resident Lydia Ferro and News Reporter, Jill Giocondo. Deputy Supervisor Testa called the meeting to order. Councilman O'Donnell made a motion seconded by Councilman Pilato, to approve the Town Board minutes of May 15, 2002 as written. All voting aye, the motion was carried. Councilman O'Donnell made a motion seconded by Councilman Pilato, to approve the Town Board minutes of May 29, 2002 as written. All voting ayethe motion was carried. PESOL LLMON #147 AUTHORIZE PAYMENT OF VOUCHERS - JULY Motion by Councilman O'Donnell Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers #296 -317 $16,776.09 General Fund B 79 - 88 $20,535.19 Highway Fund DB 229 -241 $56,889.73 Water Fund 137 -141 $ 3,712.04 Sewer Fund 70 - 72 $ 705.12 Capital Projects 23 - 23 $ 19.20 Deputy Supervisor Testa offered privilege of the floor to those in attendance. Monthly reports for the Supervisor, Town Clerk and SPCA for June 2002 are on the table for review and filed in the Town Clerk's office. RESOLUTION #148 ACKNOWLEDGE RECEIVING OF SMALL CLAIMS ASSESSMENT REVIEW PETITION Motion by Councilman O'Donnell Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, The Town Board does hereby acknowledge, by receiving and filing, the Small Claim Assessment Review petition received, regarding their current assessment property values, from Karen and William Howe, tax map #96.09-01- 11.000. JULY 03, 2002 TOWN BOARD MEETING PAGE'-J Deputy Supervisor Testa stated Attorney Folmer is on vacation and will not be attending tonight's meeting. Councilman O'Donnell, made a motion, seconded by Councilman Pilato, to receive and file correspondence from The New York Susquehanna and Western Railway Corporation regarding the town's proposed Wellhead Protection Plan. All voting aye, the motion was carried. Councilman O'Donnell, made a motion, seconded by Councilman Pilato, to receive and file correspondence from Matthew McSherry of Port, Kashdin & McSherry Certified Public Accountants regarding the town's proposed Wellhead Protection Plan. All voting aye, the motion was carried. Councilman Pilato, made a motion, seconded by Councilman O'Donnell, to receive and file correspondence from Leslie Sandman Facilities Director of Pall Corporation regarding the town's proposed Wellhead Protection Plan. All voting aye, the motion was carried. Councilman O'Donnell, made a motion, seconded by Councilman Pilato, to receive and file correspondence from David Yaman of David Yaman Realty Services regarding the town's proposed Wellhead Protection Plan. All voting aye, the motion was carried. Councilman Pilato, made a motion, seconded by Councilman O'Donnell, to receive and file correspondence from John Lutz Superintendent of the Cortland City School District regarding the town's proposed Wellhead Protection Plan. All voting aye, the motion was carried. Councilman O'Donnell, made a motion, seconded by Councilman Pilato, to receive and file correspondence from Charlotte Angell a resident of the City of Cortland regarding the town's Land Use. and Wellhead Protection Plan. All voting aye, the motion was carried. Councilman O'Donnell, made a motion, seconded by Councilman Pilato, to receive and file correspondence from City of Cortland Mayor Leonard regarding a $200,000 grant from the Economic Development Initiative from the US Department of Housing and Urban Development for the proposed Cortland Sports Complex. All voting aye, the motion was carried. RESOLUTION #149 AUTHORIZE HIGHWAY SUP'T. TO HIRE LARRY DRACH AS A MOTOR EQUIPMENT OPERATOR Motion by Councilman O'Donnell Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Highway Sup't. is hereby authorized and directed to hire Larry Drach, of 1520 Congdon Lane, Cortland, NY as a Motor Equipment Operator, in accordance with the Highway Pay Schedule, effective July 8, 2002. Councilman O'Donnell, made a motion, seconded by Councilman Pilato, to receive and file correspondence from Town Highway employee Roger Karn. The correspondence was in regards to Chapter 69 of the NYS Retirement System offering a temporary retirement incentive benefit for certain public employees. All voting aye, the motion was carried. r (2- JULY 03, 2002 TOWN BOARD MEETING PAGE 3 RESOLUTION #150 ACCEPT UNDER CHAPTER 69 OF THE NYS RETIREMENT SYSTEM A TEMPORARY RETIREMENT INCENTIVE BENEFIT FOR CERTAIN PUBLIC EMPLOYEES Motion by Councilman O'Donnell Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Board does hereby accept under Chapter 69 of the NYS Retirement System a temporary retirement incentive benefit for certain public employee, and it is further RESOLVED, the Town Board does hereby authorize and direct the Town Attorney to proceed with Local Law - 2002 Retirement Incentive Program (Chapter 69, Laws of 2002) to include an effective date of October 3, 2002 through December 31, 2002. RESOLUTION #151 REFER AQUIFER PROTECTION PERMIT APPLICATION SUBMITTED BY MARK R. BRAUN (DOUG'S FISH FRY) TO TOWN AND COUNTY PLANNING BOARDS FOR THEIR REVIEW AND RECOMMENDATIONS Motion by Councilman O'Donnell Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Aquifer Protection Permit application submitted by Mark R. Braun (Doug's Fish Fry) for property located at 3638 Route 281, owner Bruench Incorporation tax map #95.12-01-08.000, shall be referred to the Town and County Planning Boards for their review and recommendations. A brief discussion occurred on the towns. proposed Wellhead Protection Plan. It was stated the Town Board is not anti business or anti industry. The Town Board has never denied any business or industry from coming into Cortlandville. The town's Wellhead Protection Plan is proposed to protect the water supply for approximately 40,000 individuals. The proposed Wellhead Protection Plan was not developed to be restrictive just protective to the water supply. The plan is only in draft form. The Board is receptive to comments and concerns in order to establish a well -developed plan for all those involved. As the town increases in growth ordinances, planning documents, regulations must also be redeveloped to accommodate this change for now and the future. Councilman Rocco, made a motion, seconded by Councilman Pilato to adjourn the Regular Meeting. All voting aye, the motion was carried.
