HomeMy WebLinkAbout08-15-2001AUGUST 15, 2001 993 5:00 P.M. 1 1 1 PUBLIC HEARING NO. 1 COMMUNITY DEVELOPMENT BLOCK GRANT A Public Hearing was held by the Town Board of the Town of Cortlandville at the Town Hall, 3577 Terrace Road, Cortland, New York, concerning the submission of an application to New York State for funding under the Small Cities Community Development Block Grant (CDBG)-Economic Development Program. Members present: Absent: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, John Pilato Town Clerk, Karen Q. Snyder Councilman, Ronal Rocco Others present were: Highway Sup't., Carl Bush; Bernie Thoma of Thoma Development Consultants; and News Reporter, Chris Nolan. Supervisor Thorpe called the Public Hearing to order. The Town Clerk read aloud the Legal Notice, as published, posted and filed. Supervisor Thorpe offered privilege of the floor to Bernie Thoma of Thoma Development Consultants. Mr. Thoma explained this is the first of two required Public Hearings to inform the public of basic information regarding the Community Development Block Grant program. The second Public Hearing on September 5, 2001will give more detail about the specific business requesting a loan. Mr. Thoma explained the Community Development Block Grant program is administered through the Governor's Office of Small Cities. The town will be applying for the economical development component of that program for the fiscal year of 2000-2001. The grant will be received by the town and established as Community Development Block Grant Income to be used for community development activity only. The town is required to use the grant as direct assistance to a company with the objective of providing new jobs to low and moderate income people. The loan would be repaid to the town and used as a revolving loan fund for other businesses to utilize. Councilman Pilato expressed his personal viewpoint stating that the town should not become involved in the banking business. In response to Councilman O'Donnell Mr. Thoma explained at this time bookkeeping would not be a burden. There would be one loan payment made on a monthly basis and kept in a separate account. This account would be included in the town's financial report to the State. Other concerns can be addressed when the money is reloaned. Mr. Thoma stated the Business Development Corporation is not eligible to submit an application. The county could loan to businesses in smaller towns but they do not have an existing program. Mr. Thoma recommended the town be the applicant as Cortlandville has a significant number of businesses. No further comments or discussions were heard. Councilman Testa made a motion, seconded by Councilman Pilato, to close the Public Hearing. All voting aye, the motion was carried. The Public Hearing was closed at 5:09 p.m. 19 - 1 AUGUST 15, 2001 5:09 P.M. PUBLIC HEARING NO.2 SEWER IMPROVEMENT PROJECT CRESTWOOD COURT/GROTON AVENUE/ NYS ROUTE 281 A Public Hearing was held by the Town Board of the Town of Cortlandville at the Town Hall, 3577 Terrace Road, Cortland, New York, concerning the installation of approximately 1,152 feet of collector line along Crestwood Court, installation of approximately 1,142 feet of sewer main along NYS Route 281 and the replacement of sewer laterals in the Town of Cortlandville. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, John Pilato Town Clerk, Karen Q. Snyder Absent: Councilman, Ronal Rocco Others present were: Highway Sup't., Carl Bush, Bernie Thoma of Thoma Development Consultants; and News Reporter, Chris Nolan. Supervisor Thorpe called the Public Hearing to order. Town Clerk, Karen Snyder, presented a synopsis of the published, posted and filed legal notice stating it was determined at a Public Hearing on January 17, 2001 that it is in the public interest to construct sewer improvement lines along Crestwood Court/Groton Ave/NYS Route 281. Due to increased cost for materials and labor for this project the estimated cost for construction will increase by $46,000. Supervisor Thorpe offered privilege of the floor to those in attendance. No comments or discussions were heard. Councilman Pilato made a motion, seconded by Councilman Testa, to close the Public Hearing. All voting aye, the motion was carried. The Public Hearing was closed at 5:13 p.m. 1 AUGUST 15, 2001 5:13 P.M. 195 1 1 PUBLIC HEARING NO. 3 SEWER IMPROVEMENT PROJECT PAGE GREEN ROAD A Public Hearing was held by the Town Board of the Town of Cortlandville at the Town Hall, 3577 Terrace Road, Cortland, New York, concerning the installation of approximately 1,600 feet of sewer main near the intersection of Page Green Road and Saunders Road in the Town of Cort.landville. Members present: Absent: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, John Pilato Town Clerk, Karen Q. Snyder Councilman, Ronal Rocco Others present were: Highway Sup't., Carl Bush; Bernie Thoma of Thoma Development Consultants; and News Reporter, Chris Nolan. Supervisor Thorpe called the Public Hearing to order. PUBLIC HEARING NO.4 WATER IMPROVEMENT PROJECT PAGE GREEN ROAD A Public Hearing was held by the Town Board of the Town of Cortlandville at the Town Hall, 3577 Terrace Road, Cortland, New York, concerning the installation of watermains near and around Page Green Road. Members present: Absent: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, John Pilato Town Clerk, Karen Q. Snyder Councilman, Ronal Rocco Others present were: Highway Sup't., Carl Bush; Bernie Thoma of Thoma Development Consultants; and News Reporter, Chris Nolan. Supervisor Thorpe called the Public Hearing to order. Town Clerk, Karen Snyder, presented a synopsis of the published, posted and filed legal notice stating it was determined at a Public Hearing on February 7, 2001 that it is in public interest to construct water improvement lines along Page Green Road. Due to increased cost for materials and labor for this project the estimated cost for construction will increase by $60,000. Supervisor Thorpe offered privilege of the floor to those in attendance. No comments or discussions were heard. Councilman Pilato made a motion, seconded by Councilman Testa, to close the Public Hearing. All voting aye, the motion was carried. Members present: Absent: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, John Pilato Town Clerk, Karen Q. Snyder Councilman, Ronal Rocco Others present were: Highway Sup't., Carl Bush; Bernie Thoma of Thoma Development Consultants; and News Reporter, Chris Nolan. Supervisor Thorpe called the meeting to order f ollowing f our Public Hearings. RESOLUTION #172 AUTHORIZE SUPERVISOR TO FILE AN APPLICATION FOR FUNDS FROM THE NEW YORK STATE OFFICE OF PARKS, RE-CREATION AND HISTORIC PRFS RVAT ON Motion by Councilman Pilato Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that Raymond Thorpe, as Supervisor of the Town of Cortlandville, is hereby authorized and directed to file an application for funds from the New York State Office of Parks, Recreation and Historic Preservation in accordance with the provisions of Title 9 of the Environmental Protection Act of 1993 or Title 3 of the Clean Water/Clean Air Bond Act, in an amount not to exceed $175,000 in cash, in -kind services, and upon approval of said request to enter into and execute a project agreement with the State for such financial assistance to the Town of Cortlandville for the Community Parks Project. Councilman Testa made a motion, seconded by Councilman O'Donnell, to approve the Town Board Minutes of March 21, 2001, as written. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Pilato, to approve the Town Board Minutes of April 4, 2001, as written. All voting aye, the motion was carried. Councilman Testa made a motion, seconded by Councilman O'Donnell, to approve the Town Board Minutes of April 18, 2001, as written. All voting aye, the motion was carried. Councilman O'Donnell made a motion seconded by Councilman Testa, to receive and file Board of Assessment Review Minutes of 2001. All voting aye, the motion was carried. 198 AUGUST 15, 2001 TOWN BOARD MEETING PAGE 2 RESOLUTION #173 AUTHORIZE PAYMENT OF VOUCHERS -AUGUST Motion by Councilman O'Donnell Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, the vouchers submitted have been audited and shall be paid as f ollows: General Fund A Vouchers #378 -394 $ 4,656.97 General Fund B 79 - 81 $ 142.23 Highway Fund DB 309 -328 $ 53,534.91 Water Fund 180 -193 $168,140.11 Sewer Fund 109 -119 $184,542.78 Capital Projects 33 - 34 $138,075.28 Supervisor Thorpe offered privilege of the floor to those in attendance. Councilman O'Donnell apprised the Board he had attended a McGraw Village meeting regarding McGraw's recent flooding. The residents were upset with Alliance Bank closing their village branch due to structural damage after the flooding. Town Highway Sup't., Carl Bush agreed there is a problem. The village is attempting to obtain financial help. Councilman O'Donnell recommended the Village Board forward a letter to the Town Board enlisting support for McGraw's efforts for aid. The village spoke with Cortland County Soil and Water and learned they do not qualify for FEMA. Councilman O'Donnell explained when reconstruction of Route 41 occurred several years ago, the State built a culvert where three creeks flow into the village. The culvert is too small, often clogs and then overflows. The village is trying to involve the State to correct this culvert. The difficulty is Trout Stream. As it is protected and may only be worked on at certain times of the year. Councilman O'Donnell requested the Board draft a letter of support upon receiving the request from the Village of McGraw. Supervisor Thorpe agreed this could be accomplished. Under privilege of the floor Councilman Pilato apprised the Board of attending a Cortland City Council meeting to speak on behalf of the proposed park project for Starr Road. City Council approved the project by a close vote. Councilman Pilato stated he heard many positive connnnents. The concerns heard were with the possible loss of Citizens Park and traffic flow on Starr Road. He stated the traffic flow could be worked out as the park is being built in phases. Councilman O'Donnell made a motion seconded by Councilman Pilato, to receive and file Cortland Free Library annual report for 2000. All voting aye, the motion was carried. Monthly reports for the Town Clerk and SPCA for July 2001 are on the table for review and filed in the Town Clerk's office. RESOLUTION #174 ACKNOWLEDGE NOTIFICATION FROM THE STATE FOR FILING OF LOCAL LAW NO.4 OF 2001 Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, NYS Dept. of State acknowledged receipt of Local Law No. 4 of 2001, to be effective on July 23, 2001, establishing a moratorium on development along the NYS Route 281 and Route 13 corridor for a period of eight months. AUGUST 15, 2001 TOWN BOARD MEETING PAGE 3 199 Councilman Testa, made a motion, seconded by Councilman O'Donnell, to receive and file a letter from Scott Becker, advising of his intent to renew their liquor license located at 281 Bowl, 276 West Road, (3898 Route 281) Cortland, New York. All voting aye, the motion was carried. RESOLUTION #175 ACKNOWLEDGE RECEIVING A NOTICE OF JUDG 4 NT FOR AVID C LIZOTTE Motion by Councilman Testa Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Board does hereby acknowledge, by receiving and filing, a Notice of Judgement for David C. Lizzotte was dismissed without prejudice, rendered July 16, 2001 by Honorable Thomas A. Meldrim. Councilman Pilato made a motion seconded by Councilman Testa, to receive and file correspondence from NYS DOT Regional Traffic Engineer, Barry Stevens. All voting aye, the motion was carried. Mr. Stevens correspondence was in response to Supervisor Thorpe's letter regarding the NYS DOT determination the intersection of Route 281 and Commons Avenue did not warrant a traffic signal. Mr. Stevens stated the DOT would examine the intersection further and report their findings. Councilman Testa made a motion seconded by Councilman O'Donnell, to receive and file correspondence from Walter Priest, Eight County Physician Organization to NYS DOT Regional Traffic Engineer, Barry Stevens. All voting aye, the motion was carried. Mr. Priest expressed his concerns regarding the Route 281 and Commons Ave. intersection and outlined his reasons a traffic signal is warranted. Councilman O'Donnell made a motion seconded by Councilman Testa, to receive and file correspondence from Clough, Harbour & Associates regarding three areas not addressed in the Express Mart -Filial Scoping Document submitted. All voting aye, the motion was carried. RESOLUTION #176 AUTHORIZE SUPERVISOR TO AMEND THE 2001 BUDGET TO ESTABLISH A NEW ACCOUNT WITHIN THE GENERAL FUND TOWN WIDE AND TRANSFER $1 000 INTO THE NEW ACCOUNT Motion by Councilman Pilato Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, the Bookkeeper has requested an amendment to the 2001 Budget to establish a new research account for grant writing expenses, and WHEREAS, the Bookkeeper requested a cash advance be transferred from Al990.4-Contingent Fund into fund A8030.4-Research, therefore BE IT RESOLVED, the Supervisor is hereby authorized and directed to amend the 2001 Budget and establish a new fund within the General Fund Town Wide, and it is further RESOLVED, the Supervisor is hereby authorized and directed to transfer $1,000.00 from the Contingent Fund A1990.4 into the new Research Fund A8030.4. Councilman Testa made a motion seconded by Councilman Pilato, to receive and file correspondence from Lee Scott -Mack regarding concerns for the proposed park on Stair Road. All voting aye, the motion was carried. 2-O O AUGUST 15, 2001 TOWN BOARD MEETING PAGE 4 Councilman Pilato apprised the Board of a discussion he had with Highway Sup't Carl Bush. The Citizens Park is used frequently. Due to the use it becomes very dry and dusty. They discussed several options to recetify the problem. Councilman Pilato will report back to the Board at a later date with ideas. Councilman O'Donnell made a motion, seconded by Councilman Testa, to adjourn the Regular Meeting.
