SPECIAL TOWN BOARD MEETING
The Special Meeting of the Town Board of the Town of Cortlandville was
held at the Town Hall, 3577 TeiTace Road, Cortland, New York, with Deputy
Supervisor Testa presiding.
Members present: Deputy Supervisor, Theodore Testa
Councilman, Edwin O'Donnell
Councilman. Ronal Rocco
Towa Clerk, Karen Q. Snyder
Absent: Supervisor, Raymond Thorpe
Councilman, John Pilato
Others present were: Town Attorney, John Folmer and Town Engineer,
Hayne Smith.
Deputy Supervisor Testa called the meeting to order.
Town Engineer Hayne Smith explained to the Board G. DeVincentis & Son
Construction Co. Inc. contracted to commence construction today July 2, 2001. For
the Page Green Road and Crestwood Court Water and Sewer Improvement
projects. They did not begin work. Engineer Smith was told that the contractors
had gone to Ocean City, New Jersey and would begin work on July 9, 2001.
Engineer Smith indicated he has not received all paper work from them.
Engineer Smith recommended awarding the contract to the second lowest
bidder, Masciarelli Construction Co. at the same price as G. DeVincentis.
Attorney Folmer read aloud the contract for G. DeVincentis & Son
Construction Co. Work was to begin on July 2, 2001. The town would need to
give G. DeVincentis & Son Construction Co. Inc. ten days notice to terminate the
contract.
A discussion was held regarding rebidding the project and whether
complaints would be received from the other original bidders.
Engineer Smith stated there were a total of four bidders for this project. He
has letters from two other bidders stating they are not interested in the project. This
will eliminate risk of complaints.
Engineer Smith requested formal authorization from the Board to proceed.
He will contact the Bonding Co. on July 15, 2001 to terminate the Bond.

NOTICE TO G. DEVINCENTIS AND SON
CONSTRUCTION CO. INC. ON
TERMINATION OF CONTRACT FOR PAGE
GREEN ROAD AND CRESTWOOD COURT/
NYS ROUTE 281 WATER AND SEWER
IMPROVEMENT PROJECTS
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
WHEREAS, as per Resolution #119 of 2001 the Town Board did award the Page
Green Road, Crestwood Court, Groton Avenue, NYS Route 281 Water and Sewer
Improvement Projects to G. DeVincentis & Son Construction Co. Inc. of
Binghamton, NY in the amount of $592,000.00, and
WHEREAS, said contractors did not begin construction on July 2, 2001 as
scheduled per contract, therefore
BE IT RESOLVED, the Board does hereby authorize and direct the Town Attorney
to serve termination notice to G. DeVincentis & Son Construction Co. Inc. for Page
Green Road, Crestwood Court, Groton Avenue, NYS Route 281 Water and Sewer
Improvement Projects.

Councilman Rocco apprised the Board the Cortland County SPCA is looking
for assistance with their driveway at their McLean Road location.
A discussion was held regarding the SPCA contract for services rendered.
It would be necessary to look for donations, as town funds cannot be spent on
private property.
Attorney Folmer stated that he would investigate how the town can help to
improve their driveway.
Councilman Testa discussed Highland Road and Thoma Development.
Councilman O'Donnell made a motion, seconded by Councilman Rocco, to
adjourn the Special Meeting. All voting aye, the motion was carried.
The meeting was adjourned at 4:35 p.m.
