HomeMy WebLinkAboutPB Minutes 2003-11-18FILE ;x'0,4_ DATE /gam TOWN OF ITHACA PLANNING BOARD TUESDAY, NOVEMBER 18, 2003 The Town of Ithaca Planning Board met in regular session on Tuesday, November 18, 2003, in Town Hall, 215 North Tioga, Ithaca, New York, at 7:00 p.m. PRESENT: Fred Wilcox, Chairperson; George Conneman, Board Member; Tracy Mitrano, Board Member (7:19 p.m.); Larry Thayer, Board Member; Rod Howe, Board Member; Kevin Talty, Board Member; Jonathan Kanter, Director of Planning; John Barney, Attorney for the Town (7:21 p.m.); Christine Balestra, Planner, EXCUSED: Eva Hoffmann, Board Member; Dan Walker, Director of Engineering; Susan Ritter, Assistant Director of Planning; Michael Smith, Environmental Planner, OTHERS: Jeffrey Davis, Hiscock & Barclay; Lorraine Cooper, 105 Roat Street; Jane Deathe, 101 Roat Street, Chairperson Wilcox declared the meeting duly opened at 7:07 p.m., and accepted for the record Secretary's Affidavit of Posting and Publication. of the Notice of Public Hearings in Town Hall and the Ithaca Journal on November 10, 2003 and November 12, 2003, together with the properties under discussion, as appropriate, upon the Clerks of the City of Ithaca and the Town of Danby, upon the Tompkins County Commissioner of Planning, upon the Tompkins County Commissioner of Public Works, and upon the applicants. and /or agents, as appropriate, on November 12, 20030 Chairperson Wilcox read the Fire Exit Regulations to those assembled, as required by the New York State Department of State, Office of Fire Prevention and Control. Chairperson Wilcox announced that the Public Hearing for consideration of the Modification for the Cayuga Medical Center has been cancelled and will be rescheduled for December 2 "d. A member of the Cayuga Medical Center could not be in attendance. The last item on the agenda is consideration of the sketch plan review and the proposal has been withdrawn. The applicant has decided not to proceed. AGENDA ITEM: PERSONS TO.BE HEARD Chairperson Wilcox opened this segment of the meeting at 7:08 p.m. With no persons present to be heard, Chairperson Wilcox closed this segment of the meeting at 7:09 p.m. AGENDA ITEM: SEQR Determination: Wireless Telecommunication Facility, 756 Dryden Road Chairperson Wilcox opened this segment of the meeting at 7:09 p.m. PLANNING BOARD MINUTES NOVEMBER 18, 2003 APPROVED - DECEMBER 2, 2003 - APPROVED JEFF DAVIS, HISCOCK & BARCLAY We represent T- Mobile, who is the applicant here looking to co- locate antennas on the Cornell Water Tank at 74.2 feet on the tank. The cables will run down the tank and connect to the cabinets at the base of the tank. The cabinets are approximately 6 foot by 4 foot by 2 foot in dimension. They are also white in color. We are here today before the Town to get a special approval from the Zoning Board and site plan approval from the Planning Board. One of the recommendations in the resolution was that the cabinets be painted be white, but the cabinets come in white. I would prefer to change the recommendation that the cabinets be white or if they are not white that they be painted white in color. T- Mobile is a pcs provider for wireless telephone. Their technology that they use is dsn technology. They are currently developing network in the Ithaca area. They are in two facilities and they are working to increase their coverage area, especially around the Cornell University and Ithaca College area. The green area is the existing coverage. The first is the 911 tower and the second is on the Fish tower. can answer any questions the board has. I don't want to take up the time of the board because I know you already know about what is going on. This is an ideal situation when you are looking to develop a network for a wireless provider. You come in and identify the area without coverage and try to figure out a way to provide that coverage that is the best technological standpoint and the land use perspective. This worked out in our best interested. Chairperson Wilcox — Who owns the existing antennas on that water tower? Ms. Balestra — Cingular Wireless. Chairperson Wilcox — Have you talked to Cingular? Are they any technical issues? Mr. Davis — I know Cingular knows of the application. Cingular is also a wireless provider that is operating in a different wave band that T- Mobile. T- Mobile in is the A- Band and Cingular is in the B or C -Band. They are different in frequency mode. If we were to go up there and there would be an issue, it would be primarily an FCC issue because one of the two would not be operating within their designated frequency. In the site plan, it shows a separation distance between Cingular set of antennas and T- Mobile set of antennas. That typically is all that they need, some type of separation between the antennas. Chairperson Wilcox — Other environmental issues? Board Member Howe — Chris mentioned that there might need to be screening around the north and west side. How do you feel about that? 2 PLANNING BOARD MINUTES NOVEMBER 18, 2003 APPROVED - DECEMBER 2, 2003 - APPROVED Mr. Davis — I think that it is appropriate. When I spoke to Chris before, I mentioned that we could put in evergreen and arborvitae type trees that we typically plant around the area. They start out at about 4 to 6 feet and can grow up to 8 to 10 feet in height. Board Member Howe — That would be good. Mr. Davis — There is no additional fencing proposed around the facility or something like that that is going to draw attention to the cabinets. The cabinets are pretty much hidden behind the trees. They are about the size of a small refrigerator. Mr. Kanter — This seems to be a popular location. Based upon your knowledge of technology, is there room for other providers on there that might come in? Mr. Davis — Yes. Both Cingular and T- Mobile chose to go about the 74 -foot height range. The reason being there is an existing railing and walkway around that level. It is very easy to attach to. You can go ... and I'm looking at an application right now in a different community. On top of a water tank like that you can actually put a small platform on top of the tank and put antennas up on top. In certain circumstances, you can flush mount the antennas directly to the tank if it is appropriate. Sometimes the owner of the water tank does not want you welding directly to the tank, but it can be done. There is the potential that more can be co- located. Chairperson Wilcox — Any other questions with regard to site plan or environmental review? Would someone like to move the SEQR motion? Board Member Thayer — I'll move that. Board Member Conneman — I'll second. Chairperson Wilcox — If there is no further discussion, all those in favor please signal by saying aye. Board — Aye. Chairperson Wilcox — Are there any opposed? Are there any abstentions? Board Member Mitrano abstains. The motion is passed. PB RESOLUTION NO. 2003 -094 — SEQR, Preliminary & Final Site Plan Approval and Recommendation to the Zoning Board of Appeals regarding Special Approval, T- Mobile Telecommunication Antennas on Water Tank, Dryden Road /Route 366, Tax Parcel No. 65 -1 -5.2 MOTION made by Larry Thayer, seconded by George Conneman WHEREAS: 3 PLANNING BOARD MINUTES NOVEMBER 18, 2003 APPROVED - DECEMBER 2, 2003 - APPROVED 1. This action is Consideration of Preliminary & Final Site Plan Approval and a Recommendation to the Zoning Board of Appeals regarding Special Approval for the proposed telecommunication antennas on a Cornell University -owned water tank at the McConville Barn, 756 Dryden Road /NYS Route 366, Town of Ithaca Tax Parcel No. 65- 1 -5.2, Residence District R -30. The proposal includes attaching nine panel antennas approximately 74 +1- feet high on the existing water tank, and installing three base transmitter stations on a concrete pad near the base of the tank. Cornell University, Owner, T- Mobile, Applicant; Curt Kolakowski, Agent, and 2. This is an Unlisted Action for which the Town of Ithaca Planning Board is legislatively determined to act as Lead Agency in environmental review with respect to Site Plan Approval, and 3. The Planning Board, on November 18, 2003, has reviewed and accepted as adequate a Full Environmental Assessment Form Part I, submitted by the applicant, and Part II and Visual Addendum, prepared by the Town Planning staff; a plan entitled "Site Plan, Sheet C -1, Cornell Water Tank, 756 Dryden Road, Ithaca, NY, 14853," prepared by DDS Engineers, dated October 15, 2003 and other application materials, and 4. The Town Planning staff has recommended a negative determination of environmental significance with respect to the proposed Site Plan Approval; NOW, THEREFORE BE IT FURTHER RESOLVED: That the Town of Ithaca Planning Board hereby makes a negative determination of environmental significance in accordance with the New York State Environmental Quality Review Act for the above referenced action as proposed and, therefore, an Environmental Impact Statement will not be required. The vote on the motion resulted as follows: AYES: Wilcox, Conneman, Thayer, Howe, Talty. NAYS: None. ABSTAIN: Mitrano The motion was declared to be carried. Chairperson Wilcox closed this segment of the meeting at 7:20 p.m. PUBLIC HEARING: Consideration of Preliminary and Final Site Plan Approval and a recommendation to the Zoning Board of Appeals regarding Special Approval for the proposed wireless telecommunication facility on the existing water tank at the McConville Barn of Cornell University, 756 Dryden Road, Town 4 PLANNING BOARD MINUTES NOVEMBER 18, 2003 APPROVED - DECEMBER 2, 2003 - APPROVED of Ithaca Tax Parcel No. 65- 1 -5.2, Residence District R -30. The project involves installing 9 panel antennas on the walkway handrail of the existing water tank and 3 base transmitter stations on a concrete pad near the base of the tank. Cornell University, Owner; T- Mobile, Applicant; Curt Kolakowski, Agent. Chairperson Wilcox opened the public hearing at 7:20 p.m. Chairperson Wilcox — Questions? Comments? Mr. Davis — The only comment again is number 2e in the resolution, if we could just change it. I think after equipment cabinet say, "be white or painted to match the tank ". Ms. Balestra — Eliminate "and equipment cabinet" from 2e. The equipment cabinets will already be white. Chairperson Wilcox — The other point is we want the equipment cabinet to be painted white if they do not come white. Mr. Barney — Why don't we just state, "equipment cabinets are to be the same color as the existing water tank "? Chairperson Wilcox — That works for me. Any further discussion? Ms. Balestra — I have one more change to the resolution. In 2e, it should state "north and west ". With no persons present to be heard, Chairperson Wilcox closed the public hearing at 7:23 p.m. Chairperson Wilcox — With those changes, would someone like to move the motion for preliminary and site plan approval? PB RESOLUTION NO. 2003 -095: Preliminary & Final Site Plan Approval and Recommendation to the Zoning Board of Appeals Regarding Special Approval, T- Mobile Telecommunication Antennas on Water Tank, Dryden Road /Route 366, Tax Parcel No. 65 -1 -5.2 MOTION made by Rod Howe, seconded by Fred Wilcox WHEREAS: 5 PLANNING BOARD MINUTES NOVEMBER 18, 2003 APPROVED - DECEMBER 2, 2003 - APPROVED 1. NOW THEREFORE BE IT RESOLVED: 1. That the Town of Ithaca Planning Board hereby waives certain requirements for Preliminary & Final Site Plan Approval, as shown on the Preliminary & Final Site Plan Checklists, having determined from the materials presented that such waiver will result in neither a significant alteration of the purpose of site plan control nor the policies enunciated or implied by the Town Board, and 2. That the Town of Ithaca Planning Board hereby grants Preliminary & Final Site Plan Approval for the proposed Telecommunication Antennas on the Cornell University -owned water tank at 756 Dryden Road /NYS Route 366, Tax Parcel No. 65- 1 -5.2, as shown on a plan entitled, "Site Plan, Sheet C -1, Cornell Water Tank, 756 Dryden Road, Ithaca, NY, 14853, "prepared by DDS Engineers, dated October 15, 2003, subject to the following conditions, all to be met prior to the issuance of a building permit: a. Obtaining Special Approval from the Zoning Board of Appeals, b. Submission of a copy of the negotiated lease agreement between the applicant and the property owner (Cornell University), for the location of telecommunication antennas on the water tank, C. Submission of a financial security bond for the removal of the telecommunications facility in the amount of $50,000, as per Local Law No. 4, 1998, which is to be approved by the Attorney for the Town, PLANNING BOARD MINUTES NOVEMBER 18, 2003 APPROVED - DECEMBER 2, 2003 - APPROVED d. Submission of a large size original of the final site plan (Sheet No. C -1) on mylar, vellum, or paper, bearing the original stamp, seal, and signature of the licensed engineer who prepared the site plan, to be retained by the Town of Ithaca, and e. In order to minimize potential negative aesthetic impacts, the cellular antennas and equipment cabinets are to be the same color as the existing water tank and additional vegetative screening in the form of evergreens shall be planted along the north and west corners of the proposed equipment cabinets. AND BE IT FURTHER RESOLVED: 1. That the Planning Board, in making its recommendation to the Zoning Board of Appeals, determines the following: a. there is a need for the proposed use in the proposed location, as demonstrated by the applicant; b. the existing and probable future character of the neighborhood will not be adversely affected as a result of the proposed project; c. the specific proposed change in use as a result of the proposed project is in accordance with a comprehensive plan of development for the Town of Ithaca; d. the proposed telecommunication antennas are necessary to meet current or reasonably expected demands for services; e. the facility conforms with all federal and state laws and all applicable rules or regulations promulgated by the Federal Communications Commission, Federal Aviation Administration, or any other federal agencies having jurisdiction; f. the facility is considered a public utility in the State of New York; g. the facility is sited, designed, and constructed in a manner which minimizes (i) visual impact to the extent practical, and (ii) adverse impacts upon migratory and other birds and wildlife; h. the facility complies with all other requirements of this ordinance, unless expressly superceded herein; and i. the chosen site is the most appropriate site among those available within the technically feasible area for the location of a telecommunications facility. That the Planning Board reports to the Zoning Board of Appeals its recommendation that the aforementioned request for Special Approval be approved, and 3. That the Planning Board recommends that the Zoning Board of Appeals waive the following requirements of Local Law No. 4, 1998, relating to the Construction and Maintenance of Telecommunication Facilities: a. an inventory report specifying existing telecommunication facility sites and evaluation of opportunities for shared use b. the dimensional standards indicating the fall zone having a radius equal to the height of attached antennae, c. the agreement to negotiate with subsequent applicants seeking to co- locate telecommunication facilities on the initial applicant's structures, and The vote on the motion resulted as follows: AYES: Wilcox, Conneman, Mitrano, Thayer, Howe, Talty. NAYS: None. The motion was declared to be carried unanimously. Chairperson Wilcox — At 7:25 p.m., I would like to announce that the scheduled public hearing at 7:20 p.m. for reconsideration of modifications of conditions at Cayuga Medical Center has been cancelled. A representative of Cayuga Medical Center was unable to attend this evening. We anticipate that the public hearing will be rescheduled for our next meeting on December 2, 2003. Board Member Mitrano — Fred, is that about the debate between the two parties? Chairperson Wilcox — Yes. We will just revisit it. Board Member Mitrano — Is there anything worthwhile of our going into executive session to discuss? Chairperson Wilcox — We did that at the last meeting and we agreed to bring them back. We expected them back this evening, but they could not be here. Board Member Mitrano — Thank you. Chairperson Wilcox — I will also mention that the last item for sketch plan review has been withdrawn. We had a 7:30 public hearing, which gives us about four or five minutes. So lets move on to the approval of minutes. AGENDA ITEM: Approval of Minutes — October 21, 2003 s PLANNING BOARD MINUTES NOVEMBER 18, 2003 APPROVED - DECEMBER 2, 2003 - APPROVED PB RESOLUTION NO. 2003 -096: Approval of Minutes — October 21, 2003 MOTION by Kevin Talty, seconded by Larry Thayer. RESOLVED, that the Planning Board does hereby approve and adopt the October 21, 2003 minutes as the official minutes of the Town of Ithaca Planning Board for the said meetings as presented. The vote on the motion resulted as follows: AYES: Wilcox, Conneman, Mitrano, Thayer, Howe, Talty. NAYS: None. The motion was declared to be carried unanimously. AGENDA ITEM: Approval of Minutes — November 4, 2003 Board Member Thayer — I have a change in the last page of that. I voted negative on the Cayuga Medical Center resolution. PB RESOLUTION NO. 2003 -097: Approval of Minutes — November 4, 2003 MOTION by Rod Howe, seconded by Fred Wilcox. RESOLVED, that the Planning Board does hereby approve and adopt the November 4, 2003 minutes as the official minutes of the Town of Ithaca Planning Board for the said meetings as presented with corrections. The vote on the motion resulted as follows: AYES: Wilcox, Conneman, Thayer, Howe. NAYS: None. ABSTAIN: Mitrano, Talty. The motion was declared to be carried. OTHER BUSINESS: Chairperson Wilcox — You all got my email? Board Member Mitrano — Yes. What was that? Chairperson Wilcox — Nothing, other than the email that I received from Chris. Chris said that there was someone who wanted to contact me directly and she asked how to PLANNING BOARD MINUTES NOVEMBER 18, 2003 APPROVED - DECEMBER 2, 2003 - APPROVED handle it. I don't mind and in fact I enjoy talking to them on the phone. I encourage each of you if someone wants to call you. The issue is... Board Member Thayer — Can't we discuss what we have done at a meeting? Chairperson Wilcox — Yes. The trick is, if they really have an opinion to express or they want your opinion, try to get them to do it here so that we can all hear it and the applicant can hear and staff can hear it. They were remarkably well behaved. Board Member Thayer — I have received some phone calls and letters. Chairperson Wilcox — If you got a couple of letters, I would encourage you to bring them in. I'm not aware of anything that happened other than the email that Chris sent me. I will talk to the person, but I won't talk about specifics other than what we have done and when the next meeting is. Chairperson Wilcox — Mr. Barney is asking me what email. Based upon an email that I received from Chris, I passed along a note to the Planning Board. The purpose is to try to make sure that people express their opinions in a public setting or in a written manner so that members of the public, members of the Planning Board, the applicant and members of staff have an opportunity to see those comments. You need to try to avoid private communications with selected individuals. It is difficult. We run into our friends, neighbors and collogues. They will talk to you. My response is that everybody needs to hear your opinion, not just me. Board Member Mitrano — Would you encourage the board against offering our opinion to those people? Chairperson Wilcox — Absolutely. I would caution you to offer any opinion outside the public meeting and be very careful about forming an opinion until all the information has been presented. Keep an open mind. Mr. Barney, any comments? Mr. Barney — No. I would second that. PUBLIC HEARING: Consideration of a follow up recommendation to the Town Board regarding additional changes to the proposed Town wide comprehensive revisions to the Town of Ithaca Zoning Ordinance and Map, including text changes in the "Addendum Containing Language Changes Suggested by the Codes and Ordinances Committee or the Planning Board Subsequent to January 15, 2003 [Cumulative through October 20, 2003]," and a minor update on the Proposed Zoning Map (August 25, 2003). Chairperson Wilcox opened this segment of the meeting at 7:37 p.m. Chairperson Wilcox - Materials provided by Jon Kanter are in front of us. This is reconfirming, for the most part, our recommendation. 10 PLANNING BOARD MINUTES NOVEMBER 18, 2003 APPROVED - DECEMBER 2, 2003 - APPROVED Mr. Kanter — The Town Board has scheduled a public hearing for December 8th to consider adoption of the zoning. There were a few individual property comments. The Town Board is basically going to be considering the map as basically as proposed in the environmental impact statement. I believe that they want to move ahead with it. We have a property owner that is putting together a proposal to bring before the Town Board. Whether that will result in a change from the Agricultural Zone, I don't know. It is open for consideration. The only reason this is back before you is because of the one update on the Auble property. The Department of Agricultural and Markets had a list of about 20 items that was of concern. Out of that list, we were able to agree on wording for a lot of those items. There is another list of complaints that we haven't been able to address. Board Member Talty — Is there some type of clause or statement that indicates that a rezoning for agricultural to lots of 7 acres for a single dwelling? Mr. Kanter — The new agricultural zone provision has a density provision in its development for the average density of one house per 7 acres. The homes can be clustered. It has been part of the proposal throughout. The lots could be between one and two acres. They wouldn't be on 7 acres lots necessarily. They could be clustered on lots between one and two acres. That would depend upon soil conditions and such. Board Member Talty — How would lending institutions view that? If you were a farmer and you had this land and it was rezoned that way, wouldn't a lending institution say that you don't have to be a farmer any more and the value is up? Mr. Kanter — If it is truly a farming operation, then a lending institution is going to look at it for the viability of a farm operation. I think, I'm not sure how banks necessarily look at this, but in other areas the zoning has really stabilized the agricultural areas. The lending institutions look more at the individual farmer and his ability to make money off the farm operation. Board Member Talty — I'm just worried it will have an impact on the farmer. The lending institutions might see it a different way. Mr. Barney — Most lending institutions look at whether they are able to pay off the debt that they incur, but the appraisal of the property is part of it. Mr. Kanter — I think the intention is once the zoning is established; the Town would have discussions with County Assessment to try to make sure that the issue is addressed. The County would be doing all the assessments and they have been pretty good at reflecting new situations like this with conservation easements and other things like that. You have to keep an eye on them, but they are pretty good. PLANNING BOARD MINUTES NOVEMBER 18, 2003 APPROVED - DECEMBER 2, 2003 - APPROVED A different subject is with non - conforming lots because of the large number of lots that will become non - conforming in the new zoning. We discovered that there is a provision that limited development of single - family homes only on lots that would be non- conforming. We changed that so that we could get a second dwelling unit, but they would have to go through special approval to do that. With no persons present to be heard, Chairperson Wilcox closed the public hearing at 7:50 p.m. Chairperson Wilcox — Would someone like to move the resolution as proposed? PB RESOLUTION NO. 2003 -098: Follow -up Recommendation to Town Board Regarding Adoption of the Proposed Zoning Revisions, as Incorporated in the January 15, 2003 Draft Revised Zoning Ordinance, August 25, 2003 Draft Revised Zoning Map, and Addendum With Additional Revisions [Cumulative through October 20, 2003] MOTION made by George Conneman, seconded by Larry Thayer WHEREAS, the Town of Ithaca Planning Board recommended in a resolution dates April 1, 2003, that the Town Board adopt a local law enacting the proposed Zoning Revisions included in the January 15, 2003 Draft Revised Zoning Ordinance and November 26, 2003 Draft Revised Zoning Map, and WHEREAS, the Town of Ithaca Planning Board has reviewed the Draft and Final Generic Environmental Impact Statement (GEIS) regarding the proposed Zoning Revisions, which include minor updates and revisions on the Proposed Zoning Map, dated August 25, 2003, and WHEREAS, the Town of Ithaca Planning Board has reviewed the "Addendum Containing Language Changes Suggested by the Codes and Ordinances Committee or the Planning Board Subsequent to January 15, 2003 [Cumulative through October 20, 2003]," which is included in the Final GEIS, NOW, THEREFORE, BE IT RESOLVED: 12 PLANNING BOARD MINUTES NOVEMBER 18, 2003 APPROVED - DECEMBER 2, 2003 - APPROVED That the Town of Ithaca Planning Board hereby recommends that the Town Board adopt a local law enacting the proposed Zoning Revisions included in the January 15, 2003 Draft Revised Zoning Ordinance and August 25, 2003 Draft Revised Zoning Map, with the additional revisions suggested in the "Addendum Containing Language Changes Suggested by the Codes and Ordinances Committee or the Planning Board Subsequent to January 15, 2003 [Cumulative through October 20, 2003]." Chairperson Wilcox — That will be on the agenda for next meeting. Mr. Kanter — It will be on the December 16th agenda. We will also have a resolution for the schedule of meetings. Chairperson Wilcox — Ah, do we want to talk about Mr. Quick Cash? This just came up recently at the meeting two weeks ago, but we ran a little late. I received a copy of a letter that Andy Frost sent out essentially threatening court action. I had a conversation with Jonathan Kanter yesterday about general stuff and it came up. My take on it is that Andy is vigorously pursuing this one. Mr. Barney — He is in the process of issuing an appearance ticket. Board Member Thayer — We gave him 18 or 12 months to get the trailers out? Mr. Kanter — He has until December 18th to remove the four storage trailers unless he comes back for site plan. That is the other thing. He left a voice message on my phone today. He would like to now come back to the Planning Board and rectify all the problems that are there with additional site plan modifications. Chairperson Wilcox — He is welcome to come back to the Planning Board. He will be treated fairly, but I don't think he is going to be getting the benefit of the doubt.
