TAX MAP #77.00-09-02.000 A Public Hearing was held by the Town Board of the Town of Cortlandville at the Town Hall, 3577 Terrace Road, Cortland, New York, concerning an Aquifer Protection Permit permitting the construction of a single story addition to its existing building to house laboratory space at its location at 1911 Loring Crossing Road in the Town of Cortlandville. Members present: Absent: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Town Clerk, Karen Q. Snyder Councilman, John Pilato Others present were: Town Attorney, John Folmer; Highway Sup't., Carl Bush; Water & Sewer Sup't., Peter Alteri; Suit-Kote Corp. Vice President, Paul Suits; Dave Alexander, representing First Baptist Church of Homer: Walt Priest, Executive Director for Commons Imaging Centre; and News Reporter, Chris Nolan. Supervisor Thorpe called the Public Hearing to order. The Town Clerk read aloud the published, posted and filed legal notice. Supervisor Thorpe apprised the Board that both Town and County Planning Boards have recommended approval for this Aquifer Protection Permit application. Supervisor Thorpe offered privilege of the floor to those in attendance. No further comments or discussions were heard. Councilman Rocco made a motion, seconded by Councilman Testa, to close the Public Hearing. All voting aye, the motion was carried. PUBLIC HEARING NO.2 AQUIFER PROTECTION PERMIT FIRST BAPTIST CHURCH OF HOMER TAX MAP #76.18-01-26.000 A Public Hearing was held by the Town Board of the Town of Cortlandville at the Town Hall, 3577 Terrace Road, Cortland, New York, concerning an Aquifer Protection Permit permitting the construction of a new church building with parking at the intersection of Route 281 and Fisher Avenue in the Town of Cortlandville. Members present: Absent: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Town Clerk, Karen Q. Snyder Councilman, John Pilato Others present were: Town Attorney, John Folmer, Highway Sup't., Carl Bush; Water & Sewer Sup't., Peter Alteri; Suit-Kote Corp. Vice President, Paul Suits; Dave Alexander representing First Baptist Church of Homer; Walt Priest, Executive Director for Commons Imaging Centre; and News Reporter, Chris Nolan. Supervisor Thorpe offered privilege of the floor to those in attendance. Councilman O'Donnell requested verification of the location of the new Baptist Church. The church will be located at the intersection of Fisher Ave. and NYS Route 281 and not NYS Route 13. No further comments or discussions were heard. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to close the Public Hearing. All voting aye, the motion was carried. The Public Hearing was closed at 5:03 p.m. Ll 1 1 FEBRUARY 21, 2001 TOWN BOARD MEETING 5:03 P.M. 6-i L1 1 1 The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 3577 Terrace Road, Cortland, New York, with Supervisor Thorpe presiding. Members present: Absent: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Town Clerk, Karen Q. Snyder Councilman, John Pilato Others present were: Town Attorney, John Folmer; Highway Sup't., Carl Bush; Water & Sewer Sup't. Peter Alteri; Suit-Kote Corp. Vice President, Paul Suits; Dave Alexander representing First Baptist Church of Homer; Walt Priest, Executive Director for Commons Imaging Centre; and News Reporter, Clods Nolan. Supervisor Thorpe called the meeting to order following two Public Hearings for Aquifer Protection Permits. Councilman Rocco made a motion seconded by Councilman O'Donnell, to receive and file Town Planning Board Minutes of January 9, 2001. All voting aye, the motion was carried. Councilman O'Donnell made a motion seconded by Councilman Rocco, to receive and file Town Zoning Board of Appeals Minutes of January 9, 2001. All voting aye, the motion was carried. Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers 486 -110 $ 9,688.66 General Fund B 14 - 17 $ 806.60 Highway Fund DB 49 - 68 $ 57,415.97 Water Fund 41 - 51 $193,756.53 Sewer Fund 21 - 32 $159,187.85 Capital Projects 6 - 7 $ 111.64 Supervisor Thorpe offered privilege of the floor to those in attendance. Walt Priest, Executive Director of Commons Imaging Centre, stated he is in receipt of a letter from Supervisor Thorpe inviting him to attend tonight's Board meeting. Supervisor Thorpe's letter was in response to concerns expressed by physicians at the Commons Ave. medical complex regarding the intersection of Commons Ave. and NYS Route 281. Mr. Priest explained about several traffic accidents caused by pulling out onto NYS Route 281 from Commons Ave. Mr. Priest is requesting an opportunity to work with the Board given the current project coming up on NYS Route 281. He feels he may have additional recommendations for the State. Mr. Priest listed individuals at the Commons Ave. complex interested in having something done to correct the situation at this intersection. Mr. Priest will be meeting with Barry Stevens, Traffic Engineer for NYS DOT, this Friday. Mr. Priest would like to take the information from that meeting, consolidate it and present recommendations to the Board at its next meeting. Supervisor Thorpe stated that would be fine. Councilmen Rocco commented the Board advised the NYS DOT of the need for a light at Commons Ave. and NYS Route 281. The Board understands the problems at this intersection. He believes the State will do something when NYS Route 281 is widened. l0 4FEBRUARY 21, 2001 TOWN BOARD MEETING PAGE 2 Mr. Priest stated they haven't gotten as far determining if a traffic light would be installed. Originally one option was to align the Commons Ave. exit with the light at Madison Street and Route 281. In response to Councilman Rocco's question regarding accidents at the Commons Ave. intersection, Mr. Priest stated there have been three accidents in the last seven months. The Board thanked Mr. Priest for attending tonight's meeting. Monthly reports for the Town Clerk, Justice and SPCA for January 2001, are on the table for review and filed in the Town Clerk's office. Councilman Rocco made a motion seconded by Councilman O'Donnell, to receive and file correspondence from Senator James Seward to Barry Stevens, Regional Traffic Engineer for the NYS Department of Transportation. All voting aye, the motion was carried. The correspondence was in regards to lowering the speed limit on Lime Hollow Road, Gracie Road, Fairview Drive, Luker Road and McLean Road. Councilman Testa made a motion seconded by Councilman Rocco, to receive and file correspondence from Councilman O'Donnell to Trevor Bilodeau of the Village of McGraw. All voting aye, the motion was carried. Councilman O'Donnell requested the use of the McGraw Community Building meeting room for a Town Board meeting to be held on May 2, 2001, at 7:00 p.m. Councilman O'Donnell made a motion seconded by Councilman Rocco, to receive and file correspondence from Councilman O'Donnell to Reverend Terry Majors of Blodgett Mills. All voting aye, the motion was carried. Councilman O'Donnell requested the use of the Independent Baptist Church in Blodgett Mills for a Town Board meeting to be held on June 6, 2001, at 7:00 p.m. Councilman O'Donnell stated he would follow up his letters to confirm that the dates are acceptable and apprise the Board. Supervisor Thorpe requested a resolution to establish a Capital Reserve fund for the future Town Hall expansion. RESOLUTION #52 ESTABLISH A CAPITAL RESERVE FUND FOR FUTURE TOWN HALL EXPANSION Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Board does hereby authorize and direct the Supervisor to establish a Capital Reserve fund to be identified as.Phase I & II Town Hall expansion. In response to Councilman O'Donnell's question regarding the addition for Suit - Kole, Paul Suits, Suit-Kote's Vice President, explained this would be a 76 ft. x 60 ft, addition to their laboratory facility. Attorney Folmer explained when Suit-Kote's original building was built, the town approved its construction including a laboratory facility. The Zoning Board of Appeals discussed the need for a variance for this proposed addition. The Zoning Board granted a variance because under the ordinance Suit -Kole could expand its laboratory within the boundaries of its present structure without a need for a variance. This meant Suit-Kote would need to construct a building of this size to relocate their offices. The Zoning Board decided it would be a hardship to require Suit- Kote to relocate their offices for this purpose. Consequently, the Zoning Board granted the variance based on that hardship determination. The laboratory has always been located in the building that is to be expanded due to industry requirements. FJ 1 u FEBRUARY 21, 2001 TOWN BOARD MEETING PAGE 3 froJ RESOLUTION #53 DECLARE NEGATIVE IMPACT FOR AQUIFER PROTECTION PERMIT #2 OF 2001 SUIT-KOTE CORPORATION FOR PROPERTY Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, an Aquifer Protection Permit application was submitted by Suit-Kote Corporation, for property located at Loring Crossing permitting the construction of a single story 76 ft. X 60 ft. addition to its existing building to house laboratory space, tax map #77.00-09-02.000 and WHEREAS, the Town Board as Lead Agent, duly reviewed and completed the Short Environmental Assessment Form, therefore BE IT RESOLVED, the Town Board, as Lead Agent, does hereby declare the proposed project of Suit-Kote Corporation, Aquifer Protection Permit #2 of 2001, shall have no significant environmental impact. RESOLUTION #54 AUTHORIZE SUPERVISOR TO SIGN SEQRA APPLICATION OF AQUIFER PROTECTION PERMIT #2 OF 2001 Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Supervisor is hereby authorized and directed to sign the SEQRA application relating to Aquifer Protection Permit #2 of 2001, submitted by Suit-Kote Corporation. RESOLUTION #55 APPROVE AQUIFER PROTECTION PERMIT #2 OF 2001 SUIT-KOTE CORPORATION FOR PROPERTY LOCATED AT CORING CROSSING SUBJECT TO CONDITIONS Motion by Councilman Testa Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, the Cortland County Planning Department and the Town Planning Board have reviewed and recommended approval of this Aquifer Permit Protection application subject to conditions, and WHEREAS, a Public Hearing was duly held by this Town Board, therefore BE IT RESOLVED, the Town Board does hereby approve Aquifer Protection Permit #2 of 2001, submitted by Suit-Kote Corporation, for property located at Loring Crossing permitting the construction of a single story addition to its existing building to house laboratory space, tax map #77.00-09-02.000, subject to the following conditions: 1. The applicant demonstrating that there are unnecessary hardships in the way of carrying out the strict letter of the "Town of Cortlandville Zoning Law" as is necessary before any use variance may be granted. 2. The applicant documenting the total employees for both the lab and Suit-Kote offices. If there are more than 25 total employees, the facility would be considered a public water supply and must meet the standards as such. 3. The applicant demonstrating the measures to be taken to prevent or minimize erosion of stored material, and subsequent runoff to the river. 4. A negative declaration of environmental impact under SEQRA. and it is further RESOLVED, the Supervisor is hereby authorized and directed to sign the permit. RESOLUTION #58 APPROVE AQUIFER PROTECTION PERMIT #3 OF 2001 FIRST BAPTIST CHURCH OF HOMER FOR PROPERTY LOCATED AT THE INTERSECTION OF NYS ROUTE 281 & FISHER AVENUE SUBJECT TO CONDITIONS Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, the Cortland County Planning Department and the Town Planning Board have reviewed and recommended approval of this Aquifer Permit Protection application subject to conditions, and WHEREAS, a Public Hearing was duly held by this Town Board, therefore BE IT RESOLVED, the Town Board does hereby approve Aquifer Protection Permit #3 of 2001, submitted by the First Baptist Church of Homer, for property located at the intersection of NYS Route 281 and Fisher Avenue permitting the construction of a new church building with parking, tax map #76.18-01-26.000, subject to the following conditions: 1. The applicant considering providing a second means of access to the proposed development even if it is for emergency purposes only. 2. The Town's approval of connection to its public water system. 3. If public sewer is considered, the Town's approval of connection to its public sewer system. If on -site sewage treatment were needed, it would have to be approved by the County Health Department. 4. The applicant completing a stormwater pollution plan for the site which is acceptable to the Town and which protects the federally designated wetlands area from stormwater pollution as result of this development. 1 1 FEBRUARY 21, 2001 TOWN BOARD MEETING PAGE 5 6 / 5. Submittal of plans to the County Highway Department for review of the proposed road drainage structures showing the proposed driveway and its locational relationship to the previously approved Whispering Rails driveway. 6. Submittal of any future plans for storage of fuels on the site to the County Health Department. 7. Review of the kitchen facility plan with the County Health Department to assure that it meets sanitary requirements for any future food service operations. 8. A negative declaration of environmental impact under SEAR. and it is further RESOLVED, the Supervisor is hereby authorized and directed to sign the permit. Town Clerk, Karen Snyder apprised the Board of a list of teleconferences to be held at the County Office Building. She stated she has attended a number of the conferences and were excellent. Town Clerk Snyder also apprised the Board of the 19' annual Town Clerks Association Conference to be held at Buffalo, NY from April 22na — April 25th, 2001. Due to family obligations Town Clerk Snyder will not be able to attend. She requested the Board approve sending her two deputy clerks in her absence. RESOLUTION #59 AUTHORIZATION FOR DEPUTY TOWN CLERKS, VALERIE SCHMIDT AND ELIZABETH D'AMBROSIO, TO ATTEND THE 19TH ANNUAL NYSTCA CONFERENCE Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, Deputy Town Clerks, Valerie Schmidt and Elizabeth D'Ambrosio are hereby authorized to attend the New York State Town Clerks Association Conference to be held at Buffalo, NY from April 22, 2001 - April 25, 2001. Councilman O'Donnell made a motion seconded by Councilman Testa, to receive and file a letter from Joyce M. Burk, advising of their intent to renew their liquor license at Bear's Place, 3303 Route 11, McGraw, New York. All voting aye, the motion was carried. Attorney Folmer reported: Bond for the Municipal Water & Sewer building: Attorney Folmer stated that the time frame has passed for the new Municipal Water & Sewer building. Attorney Folmer will forward the paperwork to New York and within the next week to ten days Supervisor Thorpe will sign the necessary Bond to provide money f or construction of the new building. Yellow Lantern/Suit-Kote litigation: Attorney Folmer apprised the Board of the Yellow Lantern Kampground representatives made a motion before Judge Dowd to implement the provisions of the Appellate Division's determination in regard to the Suit-Kote rezoning litigation. Attorney Folmer has not finalized his position in regard to that motion. McDermott Water Booster Station: Attorney Folmer stated he has not heard from Tian Buhl of Resource Associates in regards to the letter they were to forward concerning Mr. McDermott's booster station. A time frame was not established. Attorney Folmer wanted the record to indicate Mr. Buhl was to write him. He has not heard from Mr. Buhl as yet. Town Clerk Snyder apprised the Board her office has removed and disposed of certain records located in the vault. Some of the large items were moved to the County Records Storage Building for shredding. The smaller items were shredded at Town Hall. C FEBRUARY 21, 2001 TOWN BOARD MEETING PAGE 6 Town Clerk Snyder apprised the Board a grant is available to fund the purchase of a master shredder for the town. Town Clerk Snyder stated she would like to apply next year for the grant. The deadline to apply this year was February 1'. The records that remain will be rotated and will be easier to maintain. The records disposed of were from the bookkeeper and the Town Clerk's office. RESOLUTION #60 ACCEPT ANNUAL REPORT OF TOWN RMO AND SCHEDULE OF DISPOSED RECORDS IN 2000 IN ACCORDANCE WITH THE RECORDS RETENTION AND DISPOSITION SCHEDULE Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Board does hereby accept the Annual Report of the Records Management Officer of the Town, including the list of disposed records in 2000, in accordance with the Records Retention and Disposition Schedule, MU-1. Councilman Rocco made a motion, seconded by Councilman Testa, to adjourn the Regular Meeting. All voting aye, the motion was carried.
