July 16, 2002, in Town Hall, 215 N. Tioga St, Ithaca, New York, at 7:00 p.m. PRESENT: Fred Wilcox, Board Member; Eva Hoffmann, Board Member; George Conneman, Board Member; Larry Thayer, Board Member; Rod Howe, Board Member; Kevin Talty, Board Member; Jonathan Kanter, Director of Planning; Bill Troy, Attorney for the Town; Susan Ritter, Assistant Director of Planning. EXCUSED: Tracy Mitrano, Board Member; Dan Walker, Director of Engineering; Michael Smith, Environmental Planner; Christine Balestra- Lehman, Planner. Buffalo Street, Chairperson Wilcox declared the meeting duly opened at 7:04 p.m. and accepted for the record the Secretary's Affidavit of Posting and Publication of the Notice of Public Hearings in Town Hall and the Ithaca Journal on July 8, 2002, and July 10, 2002, together with the properties under discussion, as upon the Clerks of the City of Ithaca and the Town of Danby, upon the Tompkins County ,appropriate, Commissioner of Planning., upon the Tompkins County Commissioner of Public Works, and upon the applicants and /or agents, as appropriate, on July 10, 2002. (Affidavit of Posting and Publication is hereto attached as Exhibit #1.) Chairperson Wilcox read the Fire Exit Regulations to those assembled, as required by the New York State Department of State, Office of Fire Prevention and Control. Chairperson Wilcox - We have Bill Troy the Third sitting in tonight. He is probably just as pompous as I am because we both use the third. Attorney Troy — I have a William the Fourth. Chairperson Wilcox — I have a Fred the Fourth. We have a lot in common. AGENDA ITEM: PERSONS TO BE HEARD Chairperson Wilcox opened this segment of the meeting at 7:04 p.m. Chairperson Wilcox — The first item is persons to be heard. If there is a member of the audience who wishes to address the Planning Board this evening on an issue, an item, a topic, which is not on this evening's agenda, we ask you to please step to the microphone, give us your name and address and we will be very interested to hear what you have to say this evening. There being none I will move •onto the next item on this evening's agenda. PLANNING BOARD JULY 16, 2002 MINUTES APPROVED - SEPTEMBER 3, 2002 - APPROVED Chairperson Wilcox closed this segment of the meeting at 7:05 p.m. PUBLIC HEARING: Consideration of Final Subdivision Approval for the proposed two -lot subdivision located at 154 Indian Creek Road, Town of Ithaca Tax Parcel No. 22.- 2 -6.1, Residence District R -30. This is a revised proposal to subdivide the 38,362 ± square foot parcel into two parcels of 15,011 ± square feet (Parcel A) and 23,351 ± square feet (Parcel B), each containing an existing house. This received Preliminary Subdivision Approval at the June 4, 2002 Planning Board meeting, subject to revisions and conditions regarding lot sizes and septic system requirements. John G. & Nancy I. Gould, Owners /Applicants. Chairperson Wilcox — Good evening. If you have a statement go ahead, if not that is fine. Nancy Gould, 102 Happy Lane — I really don't have a statement except to say that we did revise the original plans to increase the size of the lots to 15,000 square feet for the first lot. The second lot then becomes 23,351 square feet. We received a letter from the Health Department indicating that they would like to see one of several things created to protect the person who owns the first house. One of the items that he suggested was create an easement for the Indian Creek Road house to maintain a system on the Happy Lane property. I don't believe any of the septic system itself is on the Happy Lane property. I believe that some of the run -off, the pipe that goes underground is there. It would have to be an easement to maintain that run -off. Chairperson Wilcox — The draft resolution prepared for us by staff also contains language; an easement agreement between owners of parcel A and parcel B to allow the owners of parcel A access and maintenance of any portions of the sewer system that may be situated on parcel B to be approved by the Attorney for the Town. I suspect that the leach field or something... Ms. Gould — Yeah, whatever goes underground I think part of it is on the... Ms. Ritter — It is a coronation pipe or coronation chamber and discharge pipe is what they described to us. Chairperson Wilcox — Should that fail or for whatever reason the owners of that parcel would... Questions? There are none. Do you want to take a seat? I will give the public a chance to speak. Board Member Howe — Are there other examples of easements like that where folks have been granted access to property system maintenance? We have seen that sort of thing. Bill, have you seen easements for that sort of thing? Attorney Troy — Not for this in particular, but easements are granted regularly for all sorts of reasons. Board Member Howe — I'm not opposed. I was just curious of how common it might be. Chairperson Wilcox — Any other questions? Good evening, Eva. We were going to have boys' night and you ruined it. PB RESOLUTION NO. 2002 -080 - Final Subdivision Approval, Gould Two -Lot Subdivision, 154 Indian Creek Road, Tax Parcel No. 22- 2 -6.1. MOTION made by George Conneman, seconded by Larry Thayer. WHEREAS: 1. This action is consideration of Final Subdivision Approval for the proposed two -lot subdivision located at 154 Indian Creek Road, Town of Ithaca Tax Parcel No. 22- 2 -6.1, Residence District R -30. The proposal is to subdivide the 38,362 +/- square foot parcel into two parcels of 15, 011 +/- square feet and 23,351 +/- square feet, each containing an existing house. John G. & Nancy 1. This is an Unlisted Action for which the Town of Ithaca Planning Board, acting as lead agency in environmental review with respect to Subdivision Approval, did on June 4, 2002, make a negative determination of environmental significance, after having reviewed and accepted as adequate a Short Environmental Assessment Form Part I, submitted by the applicant, and Part II prepared by the Town Planning staff, and 91 PLANNING BOARD JULY 16, 2002 MINUTES APPROVED - SEPTEMBER 3, 2002 - APPROVED 3. The Planning Board, at a Public Hearing held on July 16, 2002, has reviewed and accepted as adequate a survey map entitled "Map of Survey Lot To Be Subdivided by John G. and Nancy I. Gould, Town of Ithaca, Tompkins County, State of New York, " prepared by Robert S. Russler, Jr., Licensed Land Surveyor, dated May 1, 2002 and Town date stamped June 25, 2002, and other application materials, NOW, THEREFORE, BE IT RESOLVED: 1. That the Town of Ithaca Planning Board hereby waives certain requirements for Final Subdivision Approval, as shown on the Final Subdivision Checklists, having determined from the materials presented that such waiver will result in neither a significant alteration of the purpose of subdivision control nor the policies enunciated or implied by the Town Board, and 2. That the Planning Board hereby grants Final Subdivision Approval for the proposed two -lot subdivision at 154 Indian Creek Road, Town of Ithaca Tax Parcel No. 22- 2 -6.1, as shown on a survey map entitled "Map of Survey Lot To Be Subdivided by John G. and Nancy I. An easement agreement between Parcel A and B, to allow the owners of Parcel A access and maintenance of any portions of the sewage system (the chlorination chamber and discharge pipe) that may be situated on Parcel B, to be approved by the Attorney for the Town, and prior to the signing of the plats by Planning Board Chair. AND BE IT FURTHER RESOLVED: The Planning Board finds that there is no need for any park land reservation created by this proposed subdivision, and hereby waives the requirement for any park land reservation. M PLANNING BOARD JULY 16, 2002 MINUTES APPROVED - SEPTEMBER 3, 2002 - APPROVED Ms. Gould — Thank you. That was fast. Chairperson Wilcox — That's a nice compliment. That was fast. I guess we can't do much better than that. Board Member Thayer — Well, they did what we asked. Chairperson Wilcox — That's right. A minor complication but the lawyers will hash out the language on that one. AGENDA ITEM: SEAR, Determination, Walker /Van Valen Subdivision, Coddington Road. Chairperson Wilcox opened this segment of the meeting at 7:09 p.m. Richard Walker, 929 Coddington Road — We own property in the Town of Danby that fronts on Coddington Road. This property, on the north side of the land is in the Town of Ithaca. In order to meet the Town of Danby zoning requirements in order to dispose of these lots, we are requiring additional property. The Town of Danby zoning is at least 200 feet of frontage and at least two useable acres. Chairperson Wilcox — Questions? We have about five minutes to kind of waste here. The public hearing is scheduled at 7:15 p.m., so questions are encouraged. Board Member Hoffmann — Just like last time when we talked about this, I had trouble when I went out to look at the land figuring out what land we were talking about, which was the land that is on the map here. Chairperson Wilcox — If the Town line were not there, this wouldn't be complicated. As Jonathan said, it is complicated, but simple. Are you aware of any environmental issues with regard to the subdivision? Mr. Walker — No. Chairperson Wilcox — You or someone has been before the Town of Danby. They have either said we will grant you subdivision if you get the lots enlarged to two useable acres or when and if this subdivision is approved you will go back to the Town of Danby and get final approval. Mr. Walker — You are losing me. Mr. Kanter — I think if you refer to the letter from the Town of Danby in your packet, it is pretty much self - explanatory. The Town of Danby has an expedited review process for minor subdivisions. It is kind of ironic that for the two big lots on Coddington Road it was an administrative permit that was issued by Danby contingent on getting approval from the Town. The Town, on the other hand, requires a full subdivision approval process for the two little triangular pieces. MOTION made by Kevin Talty, seconded by Rod Howe. WHEREAS: 1. This action is consideration of Preliminary and Final Subdivision Approval for the proposed subdivision on Coddington Road at the Town of Danby line, Town of Ithaca Tax Parcel No. 47- 2 -6.52, Residence District R -30 and Conservation District. The proposal is to subdivide two parcels totaling 0.49 +/- acres from the 62.73 +/- acre parcel, which will be consolidated with two parcels resulting from subdivision of the existing 0.37 +/- acre triangular parcel in the Town of Ithaca. Parcels in the Town of Ithaca will be attached by deed to parcels in the Town of Danby, creating two lots that meet minimum lot size requirements in the Town of Danby. Neither parcel in the Town of Ithaca will have road frontage and will be deed restricted so as not to be conveyed separately from the lots in Danby to ensure required road frontage. This is an Unlisted Action for which the Town of Ithaca Planning Board is legislatively determined to act as Lead Agency in environmental review with respect to Subdivision Approval, and 3. The Town planning staff has recommended a negative determination of environmental significance with respect to the proposed Subdivision Approval; NOW, THEREFORE, BE IT RESOLVED: That the Town of Ithaca Planning Board hereby makes a negative determination of environmental significance in accordance with the New York State Environmental Quality Review Act for the above referenced action as proposed and, therefore, neither a Full Environmental Assessment Form, nor an Environmental Impact Statement will be required. MOTION by Fred Wilcox, seconded by Larry Thayer. 7 PLANNING BOARD JULY 16, 2002 MINUTES APPROVED - SEPTEMBER 3, 2002 - APPROVED RESOLVED, that the Planning Board does hereby approve and adopt the July 2, 2002 minutes as the official minutes of the Town of Ithaca Planning Board for the said meeting as presented with corrections. Chairperson Wilcox opened the public hearing at 7:15 p.m. Robert Wagner, 1018 Coddington Road — This is directly across Coddington Road. Not to be confused with another Robert Wagner I understand someplace in California. My concern of his issue doesn't relate so much to the specific configuration that you are looking at this evening as much as it does as a different ultimate plan for the use of all that... I purchased the land across the street from Mr. Walker. The primary asset being the view. We can look across to Cornell University, City of Ithaca and Cayuga Lake. I am certainly not adverse to other people building and having homes, but if any relationship between this adjustment and the west of the property that exists would lead to further development, perhaps with many homes, then I would be concerned because the primary asset of the property being the view would be then obstructed by part of these buildings. I'm not sure if you folks can even determine that. That would be my concern, what ultimately would happen around those two lots. Chairperson Wilcox — Thank you, sir. Anybody else? Mark Chanlin, 604 E. Buffalo — I am the nervous owner of the land. We plan on building a small log home, very small, 28 feet by 36 feet. It shouldn't be any problems. We're going to put some trees and brushes here and there. E:3 PLANNING BOARD JULY 16, 2002 MINUTES APPROVED - SEPTEMBER 3, 2002 - APPROVED Chairperson Wilcox — That would be on one of the two lots? Mr. Chanlin — Yes. Chairperson Wilcox — Thank you, sir. Anybody else? There being none, 1 will close the public hearing at 7:19 p.m. and bring the matter back to the board. I think one thing in your favor is the development of the pond across the street. It certainly has, at least at this point and I don't know what Mr. Walker is going to do and there is no obligation for him to tell us what he is going to do with the land, the new pond ... the one that is closest to the road that you can see certainly indicates that for at least some time that portion of the property is not going to be developed. Part of the land is in a conservation zone, which doesn't prohibit development, but allows only for one house every seven acres and that the houses must be clustered to conserve open space. I also think Mr. Walker has shown us over the years as he has subdivided off parcels of his land to be a steward of his land. I don't know what future owners will do with the land. Mr. Walker has been a good steward of that property. He is going to retire ... he has retired. The land could eventually be sold. Some of it may go into a land trust. I don't know. How far up the hill are you on that piece of property? Mr. Wagner — (Comments not audible) Chairperson Wilcox — That is a beautiful piece of property. Comments? Questions? Are we all set? I will look to Jonathan. Let me pull the draft resolution and look at it real quickly. Who is going to sign the subdivision plat? I'm going to sign the subdivision plat for the portion in the Town of Ithaca, which is this one. Mr. Kanter — We have two subdivision maps. One is the larger picture parcel and the other is the more detailed parcel combination. I'm not positive, but I'm pretty sure that the Town of Danby will also... Chairperson Wilcox — I thought Susan Beeners memo said that she was going to be signing them as well. Mr. Kanter — I'm sure the County Clerk's office would want the Town of Danby to sign it as well. Chairperson Wilcox — Of course, as we know, subdivisions get filed without any signatures at all. So you will deal with that issue for me. Mr. Kanter — The one proposed condition dealing with the deed restrictions or deed provisions attaching the Town of Ithaca parcels to the Town of Danby parcels would have to be provided to the Attorney for the Town's satisfaction before you would sign the plat to make sure that we have that. Condition a has to deal with consolidation of the parcels. Then b has to do with the deed restrictions. Chairperson Wilcox — Thank you, Jon. All set? Chairperson Wilcox — Sitting in front of you this evening when you came in was a proposed memo of support that was provided to us with regard to the proposed Town of Ithaca application for transportation planning grant money. Jonathan, anything you want to add other than, as the resolution states, grant money would create information which could be, would be useful to this board in some of its decision making processes. Mr. Kanter — We tried to just put some illustrated examples in some of the things this board has talked about. These are things that we'll do whether or not we get the grant money. We probably shouldn't let the State hear that. It is something that the town has decided we have to do anyway. It seems to fit in with the grant framework. The grant program is geared towards the State's quality community initiative. It fits in with so many things: vital communities, quality communities, smart growth, neotraditional, new urbanist... if you put those all together that is what we'll do. We'll do anything you want us to, just give us the money. It seems like a possible opportunity. We think the funds will be pretty competitive. Chairperson Wilcox — Is it available to all municipalities in the state? Mr. Kanter — It is, although I sensed it wasn't that highly publicized. I don't know... maybe we do have a good chance. What we are doing are typical transportation planning things. So we will leave it up to the state ... (comments not audible). Sue, maybe you talk about ... one of the things... Chairperson Wilcox — We have a goal of 7:30 p.m. here. Mr. Kanter — Yes, I know. Essentially we want to get an idea of some of the attitudes about transportation and what they would like to see. What do they think are problems and then just gather some general data about themselves. It would help us get some idea on with this transportation plan, do people want more multi - modal, are they unhappy with the way things are. Certainly, there are certain areas of the Town that we know are problems. There are certain neighborhoods that are experiencing problems. I think we need to get a little more perception from the Town residents. We are hoping to get some money to do that. Chairperson Wilcox — Questions? Eva? Board Member Hoffmann — I would love to have us insert in that very last point, point 7 in the last line ... to insert something about preservation of the special views from the roadway, the visual character and beautiful views as a goal. It is in our Comprehensive Plan. It wouldn't hurt to add it here, too. Mr. Kanter — Inserting at the end, "and preservation of the neighborhood and visual character ". Board Member Hoffmann — Okay. Chairperson Wilcox — Any other questions? Comments? The County gets a lot of money for transportation planning right now. Would the Town coordinate its...? Ms. Ritter — The County more is for bigger projects. This is more for a plan so we can have projects in the future and have a decision - making way to plan those projects. Chairperson Wilcox — Okay. The County Planning Department received some $150,000 from the State or Federal government, which they are going to use to help promote their vital communities initiative. The Town of Ithaca Transportation Committee was established by the Town Board to, among other duties, prepare a Transportation Plan pursuant to the recommendation of the 1993 Comprehensive Plan; and 2. The Transportation Committee has discussed the possible elements of a Transportation Plan; and 3. The New York State Department of Transportation has announced the availability of funds through a grant program for Technical Assistance in Traffic Engineering and Transportation Planning for Localities; and 4. Said grant program is an 80120 matching reimbursement program (i.e., 80% state funds, 20% local match) intended to assist the NYS Quality Communities Initiative and to advance coordinated land use and transportation planning; and 5. Eligible activities under the grant program include preparation of the transportation plan element of the local comprehensive plan and transportation planning elements (e.g., official map, corridor management plan, traffic calming plan, or finance plan for improvements), among others; and 6. The Transportation Committee recommends pursuing funding assistance under this grant program in order to complete at minimum the following components of a transportation plan: review of transportation goals and objectives as stated in the 1993 Comprehensive Plan, resident survey regarding transportation problems and issues, official map update, consultant assistance regarding traffic volumes and capacity analysis at selected intersections and revision of road /transportation planning and design standards, as well as the possible hiring of a student intern (or interns) to assist with the preparation of a transportation plan; and 7.
