HomeMy WebLinkAbout06-17-2009303 JUNE 17, 2009 5:00 P.M. TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Raymond G. Thorpe Municipal Building, 3577 Terrace Road, Cortland, New York, with Supervisor Tupper presiding. Members present: Supervisor, Richard Tupper Councilman, Theodore Testa Councilman, Ronal L. Rocco Councilman, John Proud Councilman, Gregory Leach Town Clerk, Karen Q. Snyder, RMC Others present were: Town Attorney, John Folmer; Highway Sup't. Carl Bush; James Wildman; Grace Meddaugh; News Reporter, Eileen Hughes from the Cortland Standard, and Sharon Stevans for Channel 2, Access TV. Supervisor Tupper called the meeting to order. Councilman Proud made a motion, seconded by Councilman Rocco, to approve the Final Town Board Minutes of April 15, 2009 as written. All voting aye, the motion was carried. The Draft Town Board Minutes of May 20, 2009 were presented to the Board for their review. RESOLUTION #101 AUTHORIZE PAYMENT OF VOUCHERS — JUNE Motion by Councilman Rocco Seconded by Councilman Proud VOTES: ALL AYE ADOPTED BE IT RESOLVED, the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers #420 - 449 $102,683.54 General Fund B B 117 - B 132 $ 11,646.10 Highway Fund DB D195 - D215 $ 10,090.87 Water Fund W149 - W160 $ 6,353.41 Sewer Fund S55 - S60 $ 2,105.46 Supervisor Tupper offered privilege of the floor to James Wildman. James Wildman, on behalf of the Cortland County Fair Board, requested the Town Board authorize a temporary closure of a section of Fairground Drive and Carroll Street for the purpose of the Cortland County Fair. He explained that the portion of the roadways they wanted closed was the "corner" of the roads — where Fairground Drive and Carroll Street connect, near the Cortland Sports Complex. Emergency vehicles would be able to access Carroll Street from Route 11 (N. Homer Ave.) and Fairground Drive from Fisher Avenue. Mr. Wildman apprised the Board the fair would run 6 days, from July 7, 2009 at 10:00 AM through July 12, 2009 at 5:00 PM. Signage would also be provided by the Cortland County Fair Board. RESOLUTION #102 AUTHORIZE "TEMPORARY CLOSURE" OF A SECTION OF FAIRGROUND DRIVE AND CARROLL STREET FOR THE CORTLAND COUNTY FAIR Motion by Councilman Proud Seconded by Councilman Leach VOTES: ALL AYE ADOPTED WHEREAS, the Town Board received a request from the Cortland County Fair Board to authorize a "Temporary Closure" of a section of Fairground Drive and Carroll Street during the 2009 Cortland County Fair, and 30 JUNE 17, 2009 TOWN BOARD MEETING PAGE 2 WHEREAS, the temporary closure will not prohibit emergency vehicles access to Fairground Drive or Carroll Street, therefore BE IT RESOLVED, the Town Board does hereby authorize a "Temporary Closure" on a portion of Fairground Drive and Carroll Street, being the "corner" where the two roadways connect, from July 7, 2009 at 10:00 AM to July 11, 2009 at 5:00 PM, for the 2009 Cortland County Fair, and it is further RESOLVED, signage for the temporary closure shall be provided by the Cortland County Fair Board. Councilman Rocco commented on the arrival of the New York Jets NFL football team to Cortland County and the impact it will have on residential neighborhoods. Although admission cannot be charged to watch the practices at SUNY Cortland, there will be a charge for parking. To avoid the parking fee and traffic, Councilman Rocco foresaw that streets near the practice fields would be congested with parked cars, which would create problems for residents and emergency vehicles. He questioned how the Board could accomplish "No Parking" in certain areas near the SUNY Cortland fields. Supervisor Tupper stated that according to Highway Sup't. Bush, in order to establish "No Parking" on specific streets, residents should submit a petition to the Board. He apprised the Board that meetings were being held to discuss problems that may occur in both the Town and. the City of Cortland. The State Police/Sheriff's Department may also post signs for no parking at their discretion. RESOLUTION #103 ACCEPT 2009 TAX COLLECTOR'S SUMMARY Motion by Councilman Proud Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, the 2009 Tax Collector's Summary is hereby accepted and shall be received and filed. The monthly reports of the Town Justice and Water & Sewer Department for the month. of May 2009 were on the table for review and are filed in the Town Clerk's office. Under old business there was discussion regarding the adoption of the Town Procurement Policy, which was tabled at both the January 7, 2009 and January 21, 2009 Town Board Meetings. According to Supervisor Tupper, the auditors questioned why the Procurement Policy had not been adopted. He suggested the Board readopt the Procurement Policy of 2000 for the year 2009 with no changes. The auditors may suggest changes to the Policy for the Board to adopt in the future. RESOLUTION #104 READOPT TOWN OF CORTLANDVILLE PROCUREMENT POLICY 2000 - FOR 2009 Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Board does hereby readopt the Town of Cortlandville Procurement Policy 2000 for the year 2009 with no changes. Town Clerk Snyder apprised the Board she was contacted by the Board of Elections regarding the Town's polling sites. The Cortlandville Fire District polling site would be moved to Walden Place, located at 839 Bennie Road, effective for September 15, 2009 for the Primary. Voters in district 13-4 would be notified of the change by mail from the Board of Elections office. 305- JUNE 17, 2009 TOWN BOARD MEETING PAGE 3 Attorney Folmer reported: Amendments to Town Zoning Code: Attorney Folmer reminded the Board they scheduled a work session to discuss the proposed revisions to the Town Zoning Code for June 19, 2009 at 9:00 a.m. Walt Kalena from Clough Harbour & Associates, and Planning & Zoning Officer, Bruce Weber, would be in attendance to discuss the proposed revisions. Workplace Violence Policy: Attorney Folmer recalled that he submitted a proposed "Workplace Violence Policy" to the Board for review at the May 20, 2009 Town Board Meeting. The Town is required to have such policy in place. He questioned whether members of the Board had additional comments. Supervisor Tupper apprised the Board there was a section in the proposed Town Personnel Policy regarding workplace violence. He commented that Attorney Folmer's draft was more extensive. No other comments were made. Councilman Proud made a motion, seconded by Councilman Rocco, to receive and file correspondence from Senator James Seward, dated June 1, 2009, to the Empire State Development Corporation, regarding his support of the Town of Cortlandville's Restore -NY Grant Application on behalf of the Homer -Cortland Community Agency's Central New York Living History Center. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman Leach, to receive and file correspondence from Assemblywoman Barabara S. Lifton, dated June 2, 2009, to the Empire State Development Corporation, regarding her support of the Town of Cortlandville's Restore - NY Grant Application on behalf of the Homer -Cortland Community Agency's Central New York Living History Center. All voting aye, the motion was carried. Councilman Proud made a motion, seconded by Councilman Rocco, to receive and file correspondence from Planning & Zoning Officer Bruce Weber to Don Gardner, dated June 9, 2009, regarding the violation of the terms of the variance granted to him for property located off Starr Road, tax map #96.00-15-06.000. All voting aye, the motion was carried. RESOLUTION #105 REFER CODE VIOLATION OF DON GARDNER FOR PROPERTY LOCATED OFF STARR ROAD TO THE TOWN ATTORNEY FOR REVIEW AND AUTHORIZE HIM TO PROCEED AS REQUIRED Motion by Councilman Proud Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, the code violation of Don Gardner for property located off Starr Road, Cortland, New York, tax map #96.00-15-06.000, is hereby referred to the Town Attorney for review, and it is further RESOLVED, the Town Attorney is hereby directed to proceed with compliance, as required. There was discussion regarding correspondence from Matthew Petrella, Petrella Bros. Properties, LLC, requesting temporary "No Parking" in the cul-de-sac of Allen Drive, between the months of July and August 2009, when the New York Jets will be utilizing the SUNY Cortland practice fields. Supervisor Tupper explained that Mr. Petrella owns six apartment houses in the cul-de-sac of Allen Drive and was concerned for the safety and well-being of his tenants. Since Mr. Petrella owns all the parcels in the cul-de-sac, it was not necessary for other residents to sign a petition in favor of the request. 3o�> JUNE 17, 2009 TOWN BOARD MEETING PAGE 4 Highway Sup't. Bush apprised the Board he has signs for "No Parking" in turnarounds that he could post. He also suggested the Board authorize permanent "No Parking" in the turnarounds of Homestead Avenue and Halstead Road. RESOLUTION #106 AUTHORIZE TEMPORARY "NO PARKING" IN THE TURNAROUND OF ALLEN DRIVE Motion by Councilman Testa Seconded by Councilman Leach Abstained by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Board hereby authorizes temporary "No Parking" in the turnaround of Allen Drive during the months of July and August 2009 when the New York Jets are utilizing the SUNY Cortland practice fields, to allow residents and emergency vehicles safe access to such streets, and it is further RESOLVED, the Highway Sup't. is hereby authorized and directed to install temporary "No Parking" signs in the turnaround of Allen Drive during the months of July and August 2009, and it is further RESOLVED, correspondence from Matthew Petrella of Petrella Bros. Properties, LLC, dated June 5, 2009, is hereby received and filed. RESOLUTION #107 AUTHORIZE PERMANENT "NO PARKING" IN THE TURNAROUNDS OF HOMESTEAD AVENUE AND HALSTEAD ROAD Motion by Councilman Testa Seconded by Councilman Leach VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Board hereby authorizes permanent "No Parking" in the turnarounds of Homestead Avenue and Halstead Road to allow residents and emergency vehicles safe access to such streets, and it is further RESOLVED, the Highway Sup't. is hereby authorized and directed to install permanent "No Parking" signs in the turnarounds of Homestead Avenue, and Halstead Road. Councilman Leach reported that the Sheriff was patrolling Blodgett Mills at night and after the races on the weekends. Residents made complaints to the Board at the last Town Board Meeting regarding motorists speeding and running stop signs. Councilman Leach thanked the Sheriff's Department for taking action on the complaint. No further comments or discussion were heard. Councilman Rocco made a motion, seconded by Councilman Proud, to adjourn the Regular Meeting. All voting aye, the motion was carried. The meeting was adjourned at 5:35 p.m. Z ully submitted, Karen Q.
