HomeMy WebLinkAbout1986-12-18PLANNING BOARD MEETING • December 18, 1986 I Barbara Caldwell called the meeting order. Those present: Gene Rotunda, Ron Chase, Rosemarie Bobnick, Julie Lee. Absent: Mr. Levine. Mr. Slater was delayed and would arrive soon. The minutes of December 4, 1986 were presented in draft form. There were two additions: 1.) The name change proposal for Sodom Road would be investigated further. 2.) The drainage report on Dryden Housing project to be included. There were no other additions, corrections or clarifications. A motion was made to approve the minutes as amended. MOTION SECONDED. CARRIED. FOR YOUR INFORMATION! Due to the deed restrictions and legalities each person is to be given a copy of the final subdivision map. • Barbara Caldwell introduced Mr. Larry Fabroni. Mr. Fabroni is engineer- surveyor for Rocco Lucente presenting a seven lot subdivision which was presented previously in December 1980 for sketch plan approval. In January after receiving preliminary subdivision approval the Town Board was petitioned for approval. Water and sewer districts were established for the seven lots and were approved by the Town Board in May 1981. Once that process was completed it took the better part of 1981 to get the state health department approval of the water district. Simultaneously approval from the Village of Cayuga Heights to connect the sanitary sewer to the seven lots was also sought. To date that still has not happened. Mr. Lucente felt that six years was long enough to wait and decided to come back to the Planning Board for an re- reading of the whole proposal before beginning again. A description of the seven lots and their configuration followed: On the last map in the set the Board members received there is the key map for the Cardinal Drive subdivision, which was an earlier 12 lot subdivision. Prior to the approval of the Planning Board the water line was required to be looped down Cardinal Drive and up the future proposed road to the Meadowlark Road subdivision which already existed. The preliminary layout for the future road would come down Hanshaw Road so that the water line could be placed in a North, South direction. When following the subdivision ordinances and curvatures required you take that North, South Road to Hanshaw Road at a right angle east of Ludgates with the resulting configuration seen on your maps particularly for lot seven. • • I When trying to obtain permission for connedtion to the sewer district the Town Board was approached. Mayor Cotterill asked for permission and was told "no ". John Anderson approved the utility extensions for the subdivision which now will have to have some specification update. An explanation of both Cardinal Drive subdivision and the Meadowlark subdivision followed. Mr. Fabroni further explained that the Town Board approved the sewer and water districts but didn't get permission from the Village of Cayuga Heights to connect the sewer. Once a year and a half had elapsed it was felt that the planning board's approval needed to be updated. Mr. Fabroni had been asked if they were still planning to get connect the sewer and water with the Village of Cayuga Heights to which he responded that that is the first request. The second is that if there is public water what to do if there is a need to temporarily have a private sewer. There is definitely no problem obtaining public water. An alternative to the sewer problem could be to install septic tanks and remove the solids and put the liquid into the public sewer and then just pump the tanks. The Newfield system was used as another example - each lot has its own holding tank and then the waste goes into the public system and then to a combined field. In this case it would go into a public sewer and the only reason would be if somehow that satisfies the Village of Cayuga Heights. The question of road frontages being less than 125 feet was brought up. It was clarified that the ordinance allows for less frontage with public water and sewage. Mr. Fabroni was asked whether these would be single family dwellings or multiple family dwellings and the response was that the units would be two family units. j Mr. Fabroni was further asked what exactly he was asking of the Board. He responded, "We're asking you essentially to re- affirm the preliminary approval so that we can go back to where we were with John and the village five years ago ". It was then explained to Mr. Fabroni that this would have to be treated as a new request. There would have to be another public hearing and presented as if no one had ever seen it before, because the time limit had expired and also because approval had been contingent on water and sewer and lot size. Mr. Fabroni said that there was no question about the water that the Town Board had asked Bolton Water Commission whether there could be a connection. Bolton Water Commission requested that an independent engineer look at everything. The town hired an independent engineer and he stated that what was presented was factual and correct and there proceeded to be much correspondence before the Health Department application was completed to everyones satisfaction and sent to the state. So, V there's no problem on the water at all. The Board decided that it wants to look at the Environmental Assessment Form. A motion was made to declare an unlisted action. MOTION SECONDED. CARRIED. Public Hearing is set for 9:30 on January 15. The next issue: Renaming Sodom Road. A petition was presented which included everyone on Sodom Road that did not sign the positive request except two people who were unavailable for signature. 900 of the people did not want the name changed. The people petitioned previously didn't live on the road. Julie recommended to the Board that the name not be changed. MOTION SECONDED. Discussion followed. MOTION CARRIED. Meeting adjourned. I
