TOWN BOARD MEETING
The Regular Meeting of the Town Board of the Town of Cortlandville was held at the
Raymond G. Thorpe Municipal Building, 3577 Terrace Road, Cortland, New York, with
Supervisor Tupper presiding.
Members present:

Rhodes, Jamie Dangler, and Grace Meddaugh; and Sharon Stevans for Channel 2, Access TV.
Supervisor Tupper called the meeting to order.

Supervisor Tupper offered privilege of the floor to Councilman Testa
Councilman Testa questioned the status of the Town's draft sidewalk ordinance.
Attorney Folmer apprised the Board he drafted a sidewalk ordinance, which he would
submit to the Town Board for their consideration at the next Town Board Meeting.
Supervisor Tupper offered privilege of the floor to Grace Meddaugh.
Grace Meddaugh read an excerpt from the Cortland Standard, which stated "the Town
only recently approved the revised code and zoning ordinance that has been in development for
years." Mrs. Meddaugh questioned whether the statement was true.
Supervisor Tupper explained that the Town Board held a public hearing on December 19,
2007 regarding the proposed Zoning. Ordinance and tabled action until tonight's meeting.

Councilman and Town Historian Rocco apprised the Board that the Cortland County
Historical Society invited everyone for a presentation, "Cortland County Remembers the 1940s-
1970s." The presentation would be held Sunday, January 13, 2008 from 1:00-3:30 p.m. at the
Cortland Historical Society.
Councilman O'Donnell apprised the Board the Village of McGraw created a book titled
"Faces of McGraw" which told the history of the people and businesses in McGraw in the early -
mid 1900s. The book could be purchased at the Lamont Memorial Library.
Monthly reports of the Town Clerk and Code Enforcement Officer for the month of
December 2007 were on the table for review and are filed in the Town Clerk's office.
Attorney Folmer reported:
Local Law - Proposed Revised Zoning Ordinance:
Attorney Folmer reminded the Board they tabled action on the proposed Revised Zoning
Ordinance until tonight's meeting. He explained that the Industrial and Business Bulk
Regulation charts, which are part of the proposed Zoning Ordinance, were inadvertently omitted
from the public notice and the notice that was published on the Internet. Therefore, he suggested
the Board table action on the proposed Zoning Ordinance until a public hearing was conducted
on the Bulk Regulations. Attorney Folmer provided Town Clerk Snyder with a public hearing
notice for the revised Zoning Ordinance, and suggested the Board schedule a public hearing for
January 16, 2008.
RESOLUTION #03 SCHEDULE PUBLIC HEARING FOR LOCAL LAW — 2008,
BULK REGULATIONS FOR PROPOSED REVISED ZONING
ORDINANCE FOR JANUARY 16, 2008

BE IT RESOLVED, the Town Board does hereby .schedule a Public Hearing regarding the
enactment of a Local Law of 2008 that would revise the Zoning Code of the Town of Cortlandville
to include Bulk Regulations relating to Business and Industrial Districts within the Town, for
January 16, 2008 at 5:00 p.m. at the Raymond G. Thorpe Municipal Building, and it is further
RESOLVED, that the Board may vote on the proposed Revised Zoning Ordinance after conducting
the Public Hearing.
Bond Anticipation Note:
Attorney Folmer apprised the Board the Starr Road Park Serial Bond - 2007 was settled on
December 27, 2007 at the First National Bank of Dryden, by Supervisor Tupper and Town Clerk
Snyder.
Councilman Rocco reminded Supervisor Tupper that he did not offer privilege of the
floor to those in attendance.
Supervisor Tupper stated he did not receive any requests for privilege of the floor prior to
the meeting via phone call. To help control the meetings, privilege of the floor would be open to
those who called in advance.
Councilman Rocco felt that privilege of the floor should be offered to anyone in
attendance, regardless of whether they made a request prior to the meeting.
Supervisor Tupper stated he would make an exception tonight.

Supervisor Tupper offered privilege of the floor to Jeanne Gablenz.
Jeanne Gablenz apprised the Board that she and her husband Scott have been residents of
Winkle Way for the past 19 years and have enjoyed the neighborhood. She thanked the Board
for purchasing the land on Cedar Crest Drive, which residents use as a walking trail to connect
the neighborhoods.
Mrs. Gablenz reiterated the comments she made at the December 19, 2007 Town Board
Meeting, and protested the request made by Mr. Dovi to purchase the land from the Town. She
apprised the Board that not only did she represent her family, but also the 67 neighbors who
signed the petition previously submitted to the Board.
Mrs. Gablenz introduced her neighbors who also requested privilege of the floor.
Robin Decker, apprised the Board that he and his family have been residents of the
neighborhood for the past 8 years. Both he and his sons utilize the walking trail.
Melissa Stockholm introduced herself to the Board and asked to read a letter addressed to
Supervisor Tupper.
Supervisor Tupper reminded those in attendance that the issue regarding Cedar Crest
Drive was not on the agenda.
Councilman Rocco requested Supervisor Tupper allow Mrs. Stockholm to read her letter.
He also informed the Board that she lives behind the United Methodist Church walking trail, and
has experience with people walking behind her house.
Mrs. Stockholm read her prepared letter to the Board, in which she asked the Town to
continue to own and maintain the greenspace adjacent to the Ecker property on Cedar Crest
Drive. She stated that the greenspace was utilized by neighborhood residents as a walking trail
for years. When her son was growing up, he and neighborhood children would utilize the land as
a recreation path to access the sledding hill. She and other residents used the land to walk their
dogs and access the neighboring developments.
As a taxpayer in the Town of Cortlandville, Mrs. Stockholm stated she valued the
greenspace and stressed the importance of the path and its continued use.
Kathy Wright apprised the Board she was a 19 year resident of the neighborhood and was
also in favor of the walking trail. Ms. Wright stated she submitted a letter to Supervisor Tupper.
Councilman Proud commented that prior to being a member of the Board he approached
the Town regarding the development of the First United Methodist Church walking trail. He
stated he was a proponent of walking trails and access. Twenty years from now, more people
would be walking in the Town and need to be able to do so safely.
Councilman Proud stated that the Town has owned the Cedar Crest Drive property for
one year. Prior to that, the property was privately owned. Whether residents were granted
permission to utilize the land as a walking trail was at the previous owner's discretion.
Councilman Proud stated he had not seen the proposal from the Eckers to purchase the land from
the Town.
Councilman Proud sensed there was a greater issue in the neighborhood that the Town
Board could not resolve. He suggested the neighborhood residents work together to resolve their
issues and recommended that a neighborhood meeting be held.

BE IT RESOLVED, the Cortland Standard is hereby designated as the official newspaper for the
Town of Cortlandville for the year 2008.
There was a brief discussion regarding elections. Town Clerk Snyder apprised the Board
the automatic voting machines were still being used, but must be replaced in 2008 due to the new
law. Town Clerk Snyder apprised the Board she was no longer responsible for the election
inspectors, and that the Town no longer pays the inspectors. The Cortland County Board of
Elections takes care of the election process entirely. Town Clerk Snyder requested the item be
removed from the agenda next year.

(10) days after receipt thereof, stating that a copy of such report is on file in the Town Clerk's office
and available for public inspection and copying, in accordance with Town Law, Section 29, Article
10-A, amended June 29, 1979.

additional duties.
* * * * Each step is based on job title and performance. It is not necessarily based on years of service.
**** Steps are only given at the anniversary date of the employee's hiring.
**** Town Board can choose to place any employee at any step with the Department Head recommendation
and employees prior experience.
**** Salaries will be listed with the Bookkeeper (on payroll) as an hourly rate for a 35-hour workweek. It
will eliminate the extra two workweek period that happens for salary people every seven years. It will allow
payment for a shortened workweek for an employee with no time left or leaving Town employment in the
middle of a pay period.
**** Any extra pay should only be given for extra hours worked above the normal 35-hour week or 1820
hours per year. It should not be given for helping another Department or being a back up for another
Department.

NIGHT SHIFT RATE:
$1.00 per hour is added to the regular hourly base wage.
(The night shift is a regular scheduled shift 8:00 p.m. to 5:00 a.m.)
WAGES NOTE:
An H.E.O. that does not have the required CDL license that is needed to
move the Town's equipment using the largest equipment trailer the Town
has will receive $.40 per hour less than the H.E.O. employees that do
have the license.

For the record, Councilman Rocco clarified that he was not. being paid for his appointed
position as Town Historian.
Councilman O'Donnell thanked Councilman Rocco for his service as Town Historian. He
mentioned that with upcoming Cortland County bicentennial, he hoped the Town would participate
in the festivities.
Councilman and Historian Rocco informed that Board that each Town/City in the County
was asked to create a float for the parade. He and other Historians were working with the County
Historian on the bicentennial. He would have more information on the event after the next
Historian meeting. He also noted that according to Town Law, the Historian could spend up to
$1,000 on special events.
Councilman Testa stressed the importance of the Town's participation in the bicentennial.
Supervisor Tupper informed the Board that over the past few weeks, the staff had worked
a significant amount of overtime to ensure a successful close to the 2007 year. He thanked the
staff for their hard work.

Regular Meeting. All voting aye, the motion was carried.
