HomeMy WebLinkAbout1985-03-21Town of Dryden Planning Board . March 21,1985 • The planning board met on March 21,1985 at 8:00P.M. with members J. Hunt, B. Lavine, H. Slater, R. Lamp ila., Chr. B. Caldwell, and Zoning Officer S.Stewart present. Chr.B.Caldwell called the meeting to order at 8:10P.M. Minutes of March 14th meeting were read. The word two in front of commercial. garages on page one was deleted.. Motion made by B.Lavine,secondec by H.Slater to approve minutes, 4 Yes 1 Abstention(R.Lampila) carried. Mr.James Aist presented a proposal for a small subdivision on Snyder Hill. Showed the Board a survey map of 16 acres he owns at He wants to cut three parcels off of the east end. Had contour mF to show the slope -land slopes to N.W. -all open field on east end. Had letter from health dept. stating alright with them for lots, B.La.vine------ -- "Looking at your contour map it looks like parcel: B & C a.re on the slope around 17 -18%, which is reasonably steep. Am I correct ?" ' J.Aist--------__ "For that area I'd say not too steep. It's a gr yes, but I have never had it measured." J.Hunt----______ "I think the Board would like to see a more detai contour map of this specific area." J.Aist---- ---___ "What's your concern here ?" J.Hunt--=--_____ "We may want to make some specific requirements o drainage to avoid damage to adjacent lands. I'm talking in terms of a 2ft. contour." J. Aist------ - -__ "Oh, o. K. " J.Hunt-------___ "When you get into slopes like that, we begin aski for engineering advise." B.Caldwell------ "Any other questions or specific material you'd li him to prepare for public hearing ?" B. Lavine-------- ',I'd. like to ask for a report from S.C.S. .. All you have to do is call and tell them you'd like a repo: for the purpose of Planning Board Review." not familiar with them. What kind of report ?' B.Lavine------__ "Soil conditions regarding the development here." J. Aist-- ----____ "We had a test hole dug before I put the ponain ova: here. They went down 7 feet and didn't hit any roc:: It's clay. I can bring more maps in." J. Hunt-----_____ "tJe have soil maps, but S.C.S. will know what we need." B. Ca.ldwell------ "They have a. standard summary form they work up for planning boards. The final map should be at two foot contour levels. Anything else ?" i 2. B. Laviine------ - - "I'd like to know what, if any, arrangements i are made or planning to be made, regarding the way in which parcels is to..be sold to Per's. Sievert Will it be consolidated with her parceliso it all becomes one parcel or what are the details for what is planned"' J.;Aislt--------- "All I know is that she has given us a purchase offer which we've amended. I don't know what she plans." B.Laviine------ - - "I would have some concern as to approving a lot for development that would be landlocked there, i it were not consolidated with the next lot. I'm not saying it can't be approved that way, it's just -that I'm concerned about it. It would be to your benefit too." J. A is.t r --------- "I' m not -sure what you mean by consolidation, " B. Lavi ne------ -- "Consolidation plainly means that her existing parcel and this parcel would become one parcel an! not two on the tax maps." i J. Aist "I can find out. I don't think she's thought of it actually." B.Caldwell------ "You said something about you actually planned building restrictions on the transcript." J.Aist, - - -- !'Yes, we did. A deed restriction is what it wou® end up being, prohibiting building an obstructiut on that piece because that's my best view right through there." B.Lavine------ - - "I'm concerned what would happen if she sold her land- -and deed restrictions are often not suffici: J.Aist--------- "What would you like me to get from her - -a letter`: B. Lavine------ - -" Perhaps yes - -that may be useful as to what her Intentions are and if they are to consolidate it. I would think along the lines of making that a contingency in an approval. J.Aist!----- - - - - "I have a question - -if she does consolidate, will I have to drop the deed restriction ?" J, Hunt --- -7----"That would be a question for your attorney." B.Lavine------ - - "It would be best to consult one. We don't know the best way to go about it where a lawyer would. I'm concerned with approving a lot which we would be approving for development if the deed restricti somehow disappeared.(which is not unusual.) J.Hunt------ -- "This is a subdivision involving 3 separate lots. We're approving a subdivision. We are in essence violating Town law, because-we're approving a lot which doesn't have road frontage. This is our dilemma. We can't violate the law. We're both working toward the '�itcome. " 39 B.Lavine--- ---- =!'I'd like you to be able to keep your deed restrictions and put this in too, but I don't know if it's possible. 11 • J..Aist--------- -- "What happens if it's not possible to consolida it with the deed restrictions applying to that piece ?" B. Caldwell --- - - -- "We'll check from ourpoint, you check from your: Ou$ next regular meeting is April 18th for a public hearing at 8:OOP.M. We'll see you then.' (We'll keep at least one of these maps with our records,") Mrs.Levin & Brown "Essentially we have some questions to ask and , can answer some. We're concerned about the pro- posed M.A.Zone amendment and-resulting ordinance and site review board amendments. We found out about this for the first time when they had the public hearing and we found out we were supposes in one of the M.A.Zones. We have since then me sented a petition to the Town Board. Have they shown that to you ?" I B.Caldwell------ - "No- -they have been working on that directly as a committee." Levin - Brown------ "This was our first question. Does this come b! to you, the Planning Board, at all? "(These amens ments. ) B.Caldwell ...... "We were updated at our meeting last Thursday on where they were at and we were told that they wear continuing to work on them. Whether we will see again in another form, I don't know, or if they T^ take it again directly to the public hearing. I believe that they have to take the amendments to public hearing." Levin - Brown--- - "We've had a neighborhood meeting and we would lii<, to talk compromises on this, as areas-are concerne J.Hunt-------__ "They get a copy of our minutes so why don't you explain the areas you're concerned about." B.Caldwell---- - "We can make sure our secretary gets a copy of our minutes to them as soon as possible." B.Lavne--- - - "I would expect that your concern is not only to lea these residential lots out of the proposed M.A.Zone but to make sure there is some kind of a border Zone that will give some protection to those residential lots from the M.A. use. Do you feel that each of thr lots has enough space behind?" Levin;Brown -- "Except here -- -we've talked to all these residents t have long thin lots. Back here is all swamp - -they fe it provides a good enough buffer." B. Lavine - - - -- " You realize that with the Armory in this area it wi; probably bring utilities(sewer & water) to this area- which is one of the reasons we saw it as an appropri- area. for an M. 9. zone. " Levin' Brown -- "This man has a trailer on his property now and p e to build a house there in it's place. Another man a lot here and wishes to build there this year. Are these men going to be able to alo this if the zone is changed to M.A.? We don't want to live in an M.A.zoi where further residential development it prohibited.' 5. B.Lavine------ "That is certainly a conflict. The purpose of ma.kir. M. Z. zones to provide the land for M.A. development a.r at the same time not to have any undo taking from t.1 existing, what would be nonccnf orming uses." • Leven - Hrown - -XWe have 41 signatures on the petition who live there now and do not want to be in M.A.zone." B.Lavine------ "But what you're talking about is not an existing u:, You're talking about people's plans to build in the future. Both things are perfectly understandable concerns. I'mjust trying to point out the fact 'there Is indeed a stronger conflict in my opinion with the idea that we must reserve the right for people to build houses in what we see as an appropriate area f MoA.zone. Lampila--- -- "Perha.ps I can answer some questions. The whole con of development has been considered by this board for over two years. There's no question about it, if we going to provide places for our existing businesses grow, and hopefully for some new ones to grow, we ha to look at some areas where this could happen, and a John stated, we had to have available water and sewe The Town Board has seen fit to see that the Town of Dryden shares an ownership of point water as well as water treatment plant in Ithaca. Obviously if we're going to utilize this facility we have to look at where we can potentially bring these lines to service the customer. Hopefully what we're looking at is providing development, and this is a. logical area for it to happen." Levin - Brown--- "Does this Board want to make this end of the Town o Dryden look like the Elmira Road? It says retail businesses(hamburger stands, used car dealers, etc.) J.Hunt------ - - "No- -this is the reason for site restrictions." Levin - Brown --- "If there is no public hearing to question what goes in there, it's 8.11 up to the Board." J.Hunt---------XI suggest you take your map back to your neighbor and see what you can come up with now with oux j suggestions. Get one proposal and bring it to next Town Board meeting and present it. They me the second Tuesday of the month." Levin = .Brown ---- "Has there been any SEQR study of this area ?" J.Hurnt--------- "Each proposal as it comes up, is reviewed under the SEQR. If a, change is controversial then a publ hearing is required by law." ` B.Lavne------ - "I would propose a resolution of the board that t major premise of leaving the existing residential use as far as possible out of the proposed zone, be something that we forward as a premise, that va: would support. We're from Beam Hill Rd.- -Fite 38 side. There was a special Town Board meeting a couple weeks ago. There was a fell who wants to build a multi family dwelling on somE property he's buying there. Approximately 20 families who live on that road got together- -we'r( not in favor of any multi family development on ot• road - -no objection to single family dwellings. lie are wondering if there's anything that can be done to keep out or limit multi family units in this ai J.Hunt ........ "Under the present zoning code we have nolpower in this kind of situation. These things are allowed b special permit which the Town Board grants. We are in long range process of reviewing entire zoning structure of town. One of the things we are worki n away from are special permits. The present zoni ® requirement is simply that the owner gets special permits from the Town Board, The Board has to hole a public hearing and at that point you can present any opposition or encouragement you have.. Then the Town Board makes its decision. 7. B.Iavine------ - -" ?Make your concerns known to us and work with us on zoning, We need your imput.
