Stewart Before the board proceeded with the public hearing, a correction was made in the minutes of last months meeting. Under concerns of the board, #2 - concerning Lot #6, was not properly stated. It read, something to be done with houses on lots that have backyards to Hanshaw Road - especially Lot #6, possibly buffer area of trees. Should be, lots that have backyards to Hanshaw Road was in the future ext- ension which was not formally proposed. Concern with Lot #6 was whether or not the shape of it could be changed such that different access to the future exten- sion might be considered. No other corrections, minutes stand except for above change. PUBLIC HEARING - ROCCO LUCENTE SUB - DIVISION IN AREA OF HANSHAW DRIVE Mr. Fabroni outlined the sub - division as follows: ROAD AND CARDINAL 1) Asking for approval of seven lots. All either on extension of Cardinal Drive or on a road named Oriole Drive. 2) Location future a eight of started. build up now. map showed topographic lines to show what will happen in rea. Water line put in as phase #1 of Cardinal Drive. It looped around to Meadow Lark already. 8) Have letters from Soil Conservation Service and County Planning Depart- ment. • 9) Have to go Town Board for approval of the area that encompasses the seven lots for water and sewer district. The seven lots are last area that can be served by gravity sewer without going to a pump station. Not include two lots that border on Hanshaw Road. By doing sewer dis- trict this way leaves open possibility for Ludgate property and lot Q 0 r Planning Board Town of Dryden -2- January 15, 1981 to West connecting into the pump,station, if they desire. 0 10) Health Department approval after gone to the Town Board, Mr. Fabroni answered question board had last time concerning traffic, water pressures and future area - airport zones. 1) Traffic - see no problems. Expect some houses on Meadow Lark to use as way out to Hanshaw Road. Should relieve some pressure of intersection where Sapsucker Woods comes into Hanshaw Road which has bad sight distance to East. 2) Water pressure that was tested on Meadow Lark is 32 pounds per square inch. When open hydrant and draw 730 gallons per minute, can still maintain 29 pressure in main. Fire Department wants to draw basically 750 gallons per minute. Test done by Fire Underwriters when Meadow Lark developed. Land there above 1090 elevation and area on Cardinal Drive and Oriole below 1090 and can expect same pressure range. 3) Future airport zone - on master plan for county, study showed people affected by noiseyness than by loudness. On sketch 100 is noise rating where people affected more. Between 100 and 115 only multiple family should be allowed. Residence affected in that range are in town of Lansing and near where Hanshaw Road makes O bend toward Route 13. The seven lots are not affected by noise zone. Mr. Hunt also stated that the board raised the question on layout of future division , determined by shape of lot #6. What are options or other possibility. Mr. Fabroni said one option is to extend Cardinal Drive through, which he thought had disadvantage because could create raceway. Other than that could hold off construction on that lot at least until board made decision on other piece. Lot 1#6 could be held off to tenth or eleventh lot when they come back and discuss whole area to East. Also stated Lot #6 could be left out of this approval. One option is it could become.part of two lots. No intersection down there then. Mr. Lavine thought that two intersections would be just as dangerous. Mr. Fabroni thought no problem because of low density. One option to take Cardinal Drive straight through or take Meadow Lark a little differently to East. QUESTIONS FROM RESIDENCE: Deborah Levin - 1608 llanshaw Road concerning future plan. She thought reason why Oriole Drive was put in was because someone from state level ob- jected to a loop without an outlet. Mr. Bonn statdd reason why board supported it was safety factor. Mr. Lavine did not want to see another intersection onto Hanshaw Road. Katherine Brown - 515 Lower Creek Road concerned on traffic on Hanshaw Road. In August 1977 asked how many units Mr. would Lucente quoted in Ithaca Journal, - -- be rented to students. Mr. Bonn stated original concern with renting was litigation concerning Sapsucker Woods in town of Ithaca. No one wants a repeat of that. Mr. Lavine asked Mrs. Levin if concern with noise area. She stated no real problem, you do get use to it. Mr. Lavine said when formal consideration, map will show lines for hazard zone. The last time a question was discussed about concern of pond on Ludgate property. The board wanted to know their concerns. Mrs. Rebecca Ludgate stated they were concerned. That her husband had spoken to one of Mr. Lucente's formans about moving pond onto their property and use fill from their land to fill in pond. They like to keep it because they use it to swim in. They then would fence it in. The pond is seven feet deep in center, when full and four feet deep in edge. Its a dug pond and is filled by run off. When they bought the property from Cangis, pond was already there. Mr. Lavine wanted to make clear to himself about discussion concerning pond. Ludgates would prefer the pond be completely on their land and Mr. Lucente just as soon not have on his two lots. After discussion the agreement between Mr. Lucente and Ludgate would be acceptable to both. Mr. Lucente would move pond and Ludgate would fence it themself for their own protection. Chairwoman Caldwell left a note concerning something she wanted to know, what affect water site -sewer area would have on Ludgate land. If Ludgate want to be part of it would it be possible? i Mr. Fabroni said easement could be given if wish to hook into either one. Mrs. Ludgate said interested in hooking into sewer. The following motion was made by Mr. Bonn that board give preliminary •approval of plans as amended during the meeting to reflect the holding of Lot #6 until, construction on Lot X16, until board sees plans for remainder of devel- opment, remaining forty -five shown lots, also reflecting easement across Lot #7 to provide access for water and sewer to Ludgate lots and movement of pond re- flecting fact that Mr. Lucente will move the pond onto Ludgate propetty. 0 F Planning Board -4- January 15, 1981 Motion second by Mr. Dann, Discussion on motion, Mr. Hunt wondered if can have Mr. Lucente move pond - thought a matter of agreement between the two. If our part to assign responsi- bilities. Mr. Lavine wanted to know if to show in motion as had been agreed at this meeting between two parties. Mr. Bonn stated he said as reflected by discussion. Mr. Hunt stated the motion can stand. Mr. Lavine had one question concerning Lot X16, wording, if requiring it be held or reflecting? .Mr. Bonn said if we approve the lot, all seven, he's reflecting the dis- cussion that stated if they were to build on Lot #6, we would have right to redesign or hold up any further approval of forty -five lots. Mr.. Lavine said not requiring just recognizing situation. After discussion, the board voted on motion with all members voting yes, motion carried. OTHER DISCUSSION: A booklet on Solar Access Guidelines from New York State Energy Office was given to board from Mr. Cotterill, to read over. Mr. Hunt stated the State passed new chapter law that provides the opportunity of municipalities to protect access to sun for purpose of generating solor energy. Variety of ways to be done. How to fit into zoning code. He will read booklet and have suggestions for next meeting. Mr. Dann wanted to know if town has parking ordinance. Mr. Stewart said town did have something because of snow plows. Mr. Dann concerned about Lake Road where resident has been parking on side of road, on the line between town and the village. They are having driveway problems due to the snow. Mr. Lavine wondered if have ability to do something about parking on side of road? Mr. Dann stated propetty on the line, whose problem. Mr. Lavine stated maybe could get in touch with village about situation. A resolution was made to Town Board by Mr. Dann that a safety problem exists on Lake Road on the line between the village and town because of parking and village should be contacted. Motion second by Mr. Bonn. All members voted on the resolution. Mr. Dann wanted to know about Kirk Road. Mr. Stewart stated that he thought letters were written to state. 1 Planning Board -5- January 15, 1981 • Mr. Dann also concerned about the two different ends of Beam Hill Road with emergency vehicles. One:.part.is off Route 38 and other off Irish Settlement Road. Wondered if something done here like on Mineah Road, Mr. Stewart thought possibly could be East and West. He knew of no com- plaints so far concerning emergency vehicles having problems. Mr. Lavine stated possibly could talk to people who live there and tell them our concern and suggestion calling East or West and see what their response is. Just add East or West to name. A resolution was made by Mr. Dann to write letters and see if have problem and want something done. Second by Mr. Hunt. All members voted yes. Motion carried.
