SPECIAL TOWN BOARD MEETING The Special Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 3577 Terrace Road, Cortland, New York, with Deputy Supervisor Testa presiding. Members present: Deputy Supervisor, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, Richard C. Tupper Deputy Town Clerk, Kristin E. Rocco Absent: Town Clerk, Karen Q. Snyder Others present were: Town Attorney, John Folmer; Water & Sewer Sup't. Peter Alteri; Town Assessor, David Briggs; Deputy Town Clerk, Chavonne LaPlant; Deputy Town Clerk, Valerie Schmidt; Town Bookkeeper, Marcia Hicks; Supervisor's Secretary, Patricia O'Mara; John C. Proud; and News Reporter, Patrick Ruppe from the Cortland Standard. Deputy Supervisor Testa called the Special Meeting to order. Attorney Folmer announced that Richard Tupper submitted his letter of resignation as Town Councilman to the Town Clerk as required by statute, effective September 15, 2005. He requested the Board receive and file and accept the resignation of Mr. Tupper as Town Councilman. RESOLUTION #167 ACCEPT RESIGNATION OF RICHARD C. TUPPER AS TOWN COUNCILMAN Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED Abstain: Councilman Tupper BE IT RESOLVED, that the Town Board does hereby accept the letter of resignation from Richard C. Tupper as Town Councilman of the Town of Cortlandville effective September 15, 2005, and it is further RESOLVED, that the resignation is hereby received and filed. Councilman Rocco made a motion to appoint Richard Tupper as Town Supervisor. He commented that Mr. Tupper is an experienced individual who has lived in the Town for a considerable amount of time and knows the Town as well as knows County government. He stated that Mr. Tupper was not only interested in the position but has the time that it requires. Councilman Rocco continued by stating that the Board was grateful to have him. Councilman O'Donnell seconded the motion. RESOLUTION #168 APPOINT RICHARD C. TUPPER AS TOWN SUPERVISOR Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED Abstain: Councilman Tupper WHEREAS, due to the untimely death of Raymond G. Thorpe, the elected Supervisor for the Town of Cortlandville, a vacancy has occurred, therefore BE IT RESOLVED, that the Town Board of the Town of Cortlandville does hereby appoint Richard C. Tupper, of 3741 Lyncort Drive, Cortland, New York, as Town Supervisor for the Town of Cortlandville, effective immediately, and it is further RESOLVED, that such term shall expire December 31, 2005. 4 /. SEPTEMBER 16, 2005 SPECIAL TOWN BOARD MEETING PAGE 2 Deputy Supervisor Testa and the Members of the Board congratulated Mr. Tupper. Richard Tupper addressed the Board and Town employees. He stated the sudden passing of Supervisor Thorpe called for a new leader. The Board first looked to Deputy Supervisor Testa to fill the void, however he politely declined. He noted that neither Councilman Rocco nor Councilman O'Donnell were interested in the position because they enjoy their current positions as councilmen. Supervisor Tupper thanked the Board for the appointment, which he stated came as a shock since he was the newest member of the Board. He stated he was pleased and privileged to have an opportunity to serve the Town. Councilman Rocco stated the Board would be remiss if they did not thank Deputy Supervisor Testa for his role as Deputy, and for "picking up the slack whenever needed." He hoped he would continue to serve the public as Deputy Supervisor as he is always available to the people. Supervisor Tupper stated that one of his first official acts was to appoint a Deputy Supervisor. Because of his number of years of service to the Town, Councilman Testa would remain Deputy Supervisor. RESOLUTION #169 REAPPOINT THEODORE V. TESTA AS DEPUTY TOWN SUPERVISOR Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, the Town of Cortlandville has a newly appointed Town Supervisor, Richard C. Tupper, and WHEREAS, the newly appointed Supervisor's first official act is to recommend to the Town Board the appointment of a Deputy Town Supervisor, which is Theodore V. Testa, therefore BE IT RESOLVED, the Town Board does hereby reappoint Theodore V. Testa as Deputy Town Supervisor for a term commencing September 16, 2005, which shall expire December 31, 2005. Deputy Supervisor Testa asked the Board what their pleasure was with regard to the vacant Councilman position. Councilman Rocco nominated John Proud for the vacant Councilman position. He stated the Board needed someone who is "quiet, reserved, listens, is well-educated, has a very good background and experience with the Department of Environmental Conservation ... a man who can pick up a project and run with it." He continued by stating "John Proud fits that to a tee, and that's the sort of person that we need on the Board." Councilman O'Donnell stated he would be honored to have John Proud "come on board" with the Town. RESOLUTION 4170 APPOINT JOHN C. PROUD AS TOWN COUNCILMAN Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, due to the resignation of Richard C. Tupper, an appointed Councilman for the Town of Cortlandville Town Board, a vacancy has occurred, therefore BE IT RESOLVED, that the Town Board of the Town of Cortlandville does hereby appoint John C. Proud, of 686 Sterling Park, Cortland, New York, as Councilman for the Town of Cortlandville, effective immediately, and it is further RESOLVED, that such term shall expire December 31, 2005. He stated he has been interested in local government, is impressed with the Board, and felt privileged to be asked to serve on the Board. He stated he would do his best the serve the people of the Town of Cortlandville. No further comments or discussion were heard. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to adjourn the Special Meeting. All voting aye, the motion was carried.
