TOWN BOARD MEETING
The Regular Meeting of the Town Board of the Town of Cortlandville was held at the
Town Hall, 3577 Terrace Road, Cortland, New York, with Supervisor Thorpe presiding.
Members present: Supervisor, Raymond Thorpe
Councilman, Theodore Testa
Councilman, Edwin O'Donnell
Councilman, Ronal Rocco
Councilman, John Pilato
Town Clerk, Karen Q. Snyder
Absent: Town Attorney, John B. Folmer
Others present were: Highway Sup't. Carl Bush; Eric Mulvihill from WXHC; and News
Reporter, Patrick Ruppe from the Cortland Standard.
Supervisor Thorpe called the meeting to order.
RESOLUTION #158 AUTHORIZE PAYMENT OF VOUCHERS - OCTOBER
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the vouchers submitted have been audited and shall be paid as follows:

Supervisor Thorpe offered privilege of the floor to those in attendance.
Councilman O'Donnell apprised the Board he received a phone call from Dan Bilodeau
of the McGraw Recreation Department regarding their budget request. Mr. Bilodeau wondered
whether there were any questions regarding their request, which was submitted to the Board at a
prior meeting. Councilman O'Donnell apprised Mr. Bilodeau he did not see a problem with the
budget request since there was no change from the prior year, and assured him the Board would
contact him with any questions.
Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and
file the 41h Quarter Water & Sewer Report. All voting aye, the motion was carried.
Councilman O'Donnell made a motion, seconded by Councilman Pilato, to receive and
file correspondence from the Cortland Country Club, Inc. regarding their intent to renew their
liquor license. All voting aye, the motion was carried.
RESOLUTION #159 ACKNOWLEDGE RECEIVING NOTICE OF PETITION IN
THE MATTER OF MY RYAN, LLC. VS. THE TOWN OF
CORTLANDVILLE PLANNING BOARD
Motion by Councilman Rocco
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Town Board does hereby acknowledge, by receiving and filing, the
Notice of Petition in the matter of MY Ryan, LLC vs. the Town of Cortlandville Planning Board.

Town Clerk Snyder apprised the Board she is now required, under Chapter 680 of the
Laws of 2002 which enacted General Municipal Law §209-cc, to report the presence of wild
animals being harbored in the Town. The owner of the wild animal must report and register the
animal to the Town Clerk. The Town Clerk must then contact the local health department, State
Police, Sheriff's Department, Fire Department and EMT's. If the owner does not report the wild
animal they may be subject to fines.
Supervisor Thorpe commented that a person could acquire a fawn. from the woods and
questioned how the Town Cleric would know that someone was harboring the wild animal.
Town Clerk Snyder apprised the Board that although a fawn is not on the list of wild
animals, it is the owner's responsibility to report the wild animal to the Town Clerk. If the
animal is not reported and registered with the Town Clerk and other agencies, the owner would
be fined.
Monthly reports of the Town Justice for the month of August 2004, and for the
Supervisor, Town Clerk and Town Justice for the month of September 2004 are on the table for
review and filed in the Town Clerk's office.
RESOLUTION #160 ACKNOWLEDGE RECEIVING 2005 TENTATIVE BUDGET
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Town Clerk received the 2005 Tentative Budget on September 301n,
2004, and has presented it to Town Board members, in accordance with Town Law.
Councilman O'Donnell made a motion, seconded by Councilman Pilato, to receive and
file correspondence from Bernie Thoma of Thoma Development Consultants regarding the
denial of the Community Development Block Grant application for Blodgett Mills. All voting
aye, the motion was carried.
Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and
file correspondence from the NYS Governor's Office for Small Cities regarding the denial of the
Community Development Block Grant application for Blodgett Mills. All voting aye, the
motion was carried.
There was a brief discussion regarding the TEA-21 Recreational Trails Program.
Supervisor Thorpe apprised the Board that according to Thoma Development Consultants
the Town could apply for a grant to construct new recreational trails within the Town. The grant
application is due no later than November 12, 2004.
Councilman Testa stated that Thoma Development Consultants thought the Town should
apply for the grant and use it in connection with the Starr Road Park and Recreation Center. He
did not believe the Town should complicate the Starr Road Park and Recreation Center project.
He suggested the Board discuss the issue with Clough, Harbour & Associates as he thought a
walking trail was already included in the plans for the park.
Councilman Pilato apprised the Board that a 20% local match was required by applicants
that received the grant. He agreed with Councilman Testa that applying for the grant was not
necessary.
Councilman Testa made a motion, seconded by Councilman Pilato, to receive and file
correspondence from Bernie Thoma of Thoma Development Consultants regarding the TEA-21
Recreational Trails Program. All voting aye, the motion was carried.
There was a brief discussion regarding a grant application for Geographic Information
System Software. According to the correspondence from Thoma Development Consultants,
Tricia Salnier Littlejohn, a GIS Specialist for the Cortland County Planning Board, offered to
demonstrate the capabilities of GIS at the October 20, 2004 Town Board meeting.
Supervisor Thorpe requested Town Clerk Snyder invite Ms. Littlejohn to attend the next
meeting to conduct the GIS presentation.

Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and
file correspondence from Ann Hotchkin of Thoma Development Consultants regarding
Geographic Information System Software. All voting aye, the motion was carried.
Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and
file correspondence from Ronald Denniston, President and CEO of First National Bank of
Dryden, regarding banking services. All voting aye, the motion was carried.
Councilman Testa made a motion, seconded by Councilman Rocco, to receive and file
correspondence from Town Attorney, John Folmer, regarding the termination of cleaning
services by TC Cleaning Services, Inc. for the Town Hall. All voting aye, the motion was
carried.
Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and
file the official statement for Town of Cortlandville Refunding Serial Bonds — 2004. All voting
aye, the motion was carried.
RESOLUTION #161 REFER CODE VIOLATION OF JESSE GALE FOR PROPERTY
LOCATED AT 4151 CARR HILL ROAD TO TOWN
ATTORNEY FOR REVIEW AND PROCEED AS REQUIRED
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the code violation of Jesse Gale for property located at 4151 Carr Hill Road,
Cortland, New York, is hereby referred to the Town Attorney for review, and it is further
RESOLVED, the Town Attorney is hereby directed to proceed with compliance as required.
Councilman Rocco made a motion, seconded by Councilman Testa, to receive and file
correspondence from Cortland County Legislator, Paul Allen of the Governance Evaluation
Committee, regarding Local Law No. 1 of the County Legislature. All voting aye, the motion
was carried.
Supervisor Thorpe reminded the Board they discussed the issue at a prior meeting and
decided the Town would not allow the Governance Evaluation Committee to give their power
point presentation at the Town Hall. Supervisor Thorpe apprised the Board he would have his
secretary contact the appropriate person regarding the Board's decision.
Councilman O'Donnell made a motion, seconded by Councilman Pilato, to receive and
file correspondence from John Sidd of Riehlman, Shafer & Shafer, Attorneys at Law regarding
the In Lieu of Tax Agreement between the Cortland County Industrial Development Agency and
Essex Structural Steel Co. Inc. All voting aye, the motion was carried.
RESOLUTION #162 AUTHORIZE SUPERVISOR TO GO OUT TO BID FOR THE
DELIVERY AND ADMINISTRATION OF SERVICES FOR
THE COMMUNITY DEVELOPMENT BLOCK GRANT OF
ESSEX STRUCTURAL STEEL CO. INC.
Motion by Councilman O'Donnell
Seconded by Councilman Testa

BE IT RESOLVED, the Town Board does hereby authorize and direct the Supervisor to go out
to Bid for the delivery and administration of services for the Community Development Block
Grant of Essex Structural Steel Co. Inc., and it is further
RESOLVED, the Bid shall be awarded at the Regular Town Board Meeting, Wednesday,
October 20, 2004.
Supervisor Thorpe apprised the Board he recently met with Dave Denniston, Chief of the
Cortlandville Fire Department. Chief Denniston informed Supervisor Thorpe that the Town's
contract with TLC Ambulance Service was not necessary. Chief Denniston believed the
residents of Cortlandville would receive the same level of care with or without the $9,000
contract. Supervisor Thorpe stated he was not aware that the contract was not necessary, and
questioned why the Town needed to renew the contract with TLC.
Councilman O'Donnell mentioned the only difference with having a contract with TLC
was that they would have a stand by ambulance at working structure fires.
Councilman Rocco suggested the Board invite Trish Hansen from TLC Ambulance
Services to come before the Board at the next meeting and explain the contract. He felt that the
Town has had a good relationship with the company in the past and should give Ms. Hansen the
opportunity to speak on TLC's behalf.
Supervisor Thorpe agreed and stated he would contact Ms. Hansen and give her the
opportunity to discuss the contract at the October 20, 2004 Town Board meeting.
Councilman Rocco made a motion, seconded by Councilman Pilato, to receive and file
correspondence from Jack Harvey and Dave Denniston from the Cortlandville Fire Department
regarding Ambulance Services to the Town. All voting aye, the motion was carried.
Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and
file correspondence from Michael Hale of Environmental Facilities Corporation to Gerard
Fernandez of Hawkins Delafield & Wood, LLP regarding financing for the Highland Road
Sewer Improvement Project (NYS Water Pollution Control Revolving Fund). All voting aye, the
motion was carried.
Councilman Rocco made a motion, seconded by Councilman Testa, to receive and file
correspondence from Chuck Paul of the National Safety Council's Defensive Driving Course.
All voting aye, the motion was carried.
RESOLUTION #163 AUTHORIZE USE OF TOWN HALL FOR THE DEFENSIVE
DRIVING COURSES FOR THE YEAR OF 2005
Motion by Councilman Rocco
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Safety Council of Central New York is hereby authorized to use the Town
Hall to conduct their Defensive Driving Course for the year of 2005, per the schedule submitted.
No further comments or discussion were heard.
Councilman Rocco made a motion, seconded by Councilman Testa, to recess the Regular
Meeting to the Informational Meeting concerning the proposal by the Madison Cortland Chapter
NYSARC. All voting aye, the motion was carried.
The meeting was recessed at 7:25 p.m.

INFORMATIONAL MEETING
MADISON CORTLAND CHAPTER NYSARC, INC.
4015 COLLEGE VIEW DRIVE
An Informational Meeting was held by the Town Board of the Town of Cortlandville at the
Town Hall, 3577 Terrace Road, Cortland, New York, concerning the proposal by the Madison
Cortland Chapter NYS ARC, Inc. involving the purchase and renovation of a home known as 4015
College View Drive in the Town of Cortlandville to serve as a group residence for six adults.

Reporter, Patrick Ruppe from the Cortland Standard.
Supervisor Thorpe called the Informational Meeting to order and noted that no one was in
attendance from NYSARC, nor any College View Drive area residents.
Town Clerk, Karen Q. Snyder apprised the Board the Legal Notice was published, posted
and filed. She also mentioned that the Madison Cortland Chapter NYSARC mailed letters to the
neighborhood residents regarding the proposed site.
Councilman O'Donnell apprised the Board he visited the ranch style home on College
View Drive, and stated his only concern was that the proposed home was in a condensed
neighborhood with houses on all sides. However, he was not concerned that the home would
create problems in the neighborhood.
Supervisor Thorpe suggested the Board close the Informational Meeting due to the fact
that nobody was in attendance.
No further comments or discussion were heard.
Councilman Rocco made a motion, seconded by Councilman Testa, to close the
Informational Meeting and reconvene to the Regular Meeting. All voting aye, the motion was
carried.
No action was taken.

Regular Meeting. All voting aye, the motion was carried.
The meeting was adjourned at 7:31 p.m.
