The Regular Meeting of the Town Board of the Town of Cortlandville was held at the
Town Hall, 3577 Terrace Road, Cortland, New York, with Deputy Supervisor Testa presiding.
Members present: Deputy Supervisor, Theodore Testa
Councilman, Edwin O'Donnell
Councilman, Ronal Rocco
Councilman, John Pilato
Town Clerk, Karen Q. Snyder
Absent: Supervisor, Raymond Thorpe
Others present were: Town Attorney, John Folmer; Highway Sup't. Carl Bush; Water &
Sewer Sup't. Peter Alteri; and Katlin Snyder, daughter of Town Cleric Snyder.
Deputy Supervisor Testa called the meeting to order.
Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file
the Planning Board Minutes of April 5, 2004. All voting aye, the motion was carried.
RESOLUTION #115 AUTHORIZE PAYMENT OF VOUCHERS - JUNE
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the vouchers submitted have been audited and shall be paid as follows:

Monthly reports for the Supervisor for the month of April 2004, for the Town Justice for
the month of May 2004, and for the Tax Collector for the months of May and June 2004 are on
the table for review and filed in the Town Cleric's office.
Councilman Pilato made a motion, seconded by Councilman Rocco, to receive and file
the Annual Water Supply Inspection Report — 2004, from the Cortland County Health
Department, Division of Environmental Health. All voting aye, the motion was carried.
Deputy Supervisor Testa clarified the June 15, 2004 article published in the Cortland
Standard regarding the upcoming Highland Road Sewer Improvement Project. The article gave
the starting date of the project as July and the completion date of October lst. Deputy Supervisor
Testa clarified that the project was scheduled to commence in July 2004 and be completed by
October 2005.
Town Cleric Karen Q. Snyder apprised the Board she added item H-8 to their packets,
which was the Tax Collector Summary for 2004.

Town Clerk Snyder apprised the Board she was in receipt of a Notice of Filing from the
New York State Department of Labor regarding Masciarelli Construction Co., Inc.
RESOLUTION 4116 ACKNOWLEDGE RECEIVING NOTICE OF FILING IN THE
MATTER OF MASCIARELLI CONSTRUCTION CO., INC.
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Town Board does hereby acknowledge, by receiving and filing, the
Notice of Filing in the matter of Masciarelli Construction Co., Inc.
Attorney Folmer had nothing to report to the Board.
Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and
file correspondence from New York State Assemblywoman, Barbara Lifton, regarding support
for the Community Development Block Grant application for the Blodgett Mills area. All voting
aye, the motion was carried.
Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and
file correspondence from Planning Board member, Dr. James Bugh regarding the proposed
changes in the Town Zoning Ordinance. All voting aye, the motion was carried.
Attorney Folmer commented that with the exception of the Big Box Specifications, the
revisions to the Zoning Amendment have been sent to the County Planning Board for their
review and recommendations. The Board should be in receipt of the County's recommendations
by the first Town Board meeting in July.
Attorney Folmer apprised the Board the correspondence from Planning Board member,
Dr. James Bugh, was of interest.
Deputy Supervisor Testa apprised the Board they were in receipt of the 2004 Cortland
Youth Bureau contract between the City of Cortland and the Town of Cortlandville.
Attorney Folmer informed the Board he reviewed the contract and found that it was the
same contract the Town has executed for the past several years.
RESOLUTION #117 AUTHORIZE SUPERVISOR TO SIGN THE 2004 CORTLAND
YOUTH BUREAU CONTRACT BETWEEN THE CITY OF
CORTLAND AND THE TOWN OF CORTLANDVILLE
Motion by Councilman O'Donnell
Seconded by Councilman Pilato
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Town Board does hereby authorize and direct the Supervisor to sign the
2004 Cortland Youth Bureau Contract between the City of Cortland and the Town of
Cortlandville for an annual fee of $9,000.00.
Deputy Supervisor Testa apprised the Board they were in receipt of correspondence from
Town Justice Francis Castillo regarding the Town's participation in the credit card program. The
Town Justice would like his clerks to be able to utilize a credit card device to process the
payment of fines.
Town Clerk Snyder apprised the Board that Justice Castillo received approval from the
New York State Unified Court System to participate in the credit card program.

Councilman O'Donnell made a motion, seconded by Councilman Pilato, to receive and
file correspondence from Town Justice, Francis Casullo regarding the Town of Cortlandville's
participation in the credit card program. All voting aye, the motion was carried.
Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and
file the Termination of Payment in Lieu of Tax Agreement between Seneca Automatic Door, Inc.
and the Cortland County Industrial Development Agency. All voting aye, the motion was
carried.
RESOLUTION #118 ACCEPT 2004 TAX COLLECTOR'S SUMMARY
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the 2004 Tax Collector's Summary is hereby accepted and shall be received
and filed.
Councilman O'Donnell questioned whether Town Engineer, Hayne Smith was
comfortable with awarding the bid for the Highland Road Sewer Improvement Project — 2004 to
the lowest bidder, G. Devincentis & Son Construction Co. Inc.
Attorney Folmer apprised Councilman O'Donnell that the Town must award the bid to
the lowest responsible bidder. Engineer Smith could find no reason why G. Devincentis & Son
Construction Co. Inc. could not complete the project. The problem the Town had with the
construction company in the past was in regard to the starting date. Attorney Folmer commented
that the bid was significantly lower than other bids submitted, which were from $100,000 to over
$1,000,000 more than the awarded bid.
Councilman Pilato apprised the Board he would not be attending the July 7, 2004 Town
Board meeting. The same evening, at 5:00 p.m., the Barry School field would be dedicated in
honor of the late David Guido, who was also a Cortland County Legislator. A fountain would be
erected with David Guido's photo, and the field would be named David E. Guido Field in his
honor. Councilman Pilato, the Chairperson of the committee, invited the Town Board to attend
the dedication.
Attorney Folmer apprised the Board he would be out of Town Friday, June 18"', as well
as Tuesday the 22°d through Thursday the 241h of June.
No further comments or discussion were heard.
Councilman Rocco made a motion, seconded by Councilman Pilato, to adjourn the
Regular Meeting. All voting aye, the motion was carried.
The meeting was adjourned at 5:05 p.m.
