SPECIAL TOWN BOARD MEETING The Special Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 3577 Terrace Road, Cortland, New York, with Deputy Supervisor Testa presiding. Members present: Deputy Supervisor, Theodore Testa Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Karen Q. Snyder Absent: Supervisor, Raymond Thorpe Councilman, Edwin O'Donnell Others present were: Town Attorney, John Folmer and Town Engineer, Hayne Smith. Deputy Supervisor Testa called the meeting to order and offered privilege of the floor to Town Clerk Snyder to discuss an item not on the agenda. Town Clerk, Karen Snyder apprised the Board that the Town Justice was interested in utilizing Point of Sale (POS) credit cards to accept payment for fines. The New York State Unified Court System gave permission to the Cortlandville Town Court to accept payment of fines through POS. The Town Justice would present information regarding the POS at the next Town Board meeting. Attorney Folmer explained that by using POS the Town Court would not have to worry about collecting bounced checks from fines since the credit card company collects the money. The Town would have to pay a percentage of the amount collected. He commented that the people who owe money to the Town Court are not always the most reliable people that money can easily be collected from. Deputy Supervisor Testa requested the Board award the bid for the Highland Road Sewer Improvement Project — 2004. The lowest bidder for the project was G. DeVincentis & Son Construction Co. Inc. Councilman Rocco questioned Town Engineer Hayne Smith whether he had a problem awarding the bid to G. DeVincentis & Son Construction Co. Inc. Town Engineer Smith stated he did not have a problem awarding the bid to the construction company. The issue the Town had in the past with G. DeVincentis & Son Construction Co. Inc. was that they company did not begin work at the scheduled time. He apprised the Board that the company has never done any work for the Town. Deputy Supervisor Testa commented that the second lowest bidder, Vacri Constuction Corp., has worked for the Town many times. Attorney Folmer apprised the Board they were required to accept the lowest responsive and responsible bidder. With the exception of the problem the Town had with G. DeVincentis & Son Construction Co. Inc. on a past bidding and contract, there was no reason for the Town to doubt that the company could do the work. Councilman Rocco questioned whether the company was still in trouble with the courts. Attorney Folmer apprised Councilman Rocco there were a series of inquiries made by the New York State'Department of Labor into Masciarelli Construction Company. Councilman Rocco made a motion for the Board to award the bid to the lowest bidder. RESOLUTION #114 AWARD BID FOR HIGHLAND ROAD SEWER IMPROVEMENT PROJECT — 2004 TO G. DEVINCENTIS & SON CONSTRUCTION CO. INC. IN THE AMOUNT OF $1,778 000.00 Motion by Councilman Rocco Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED WHEREAS, bids were advertised for the Highland Road Sewer Improvement Project — 2004, and 1 1 93 JUNE 11, 2004 TOWN BOARD MEETING PAGE 2 WHEREAS, sealed bids were opened on June 10, 2004 at 3:00 p.m. and provided to Town Engineer, Hayne Smith for review as follows: G. Inc. $1,778,000.00 7 Belden Streeet Binghamton, New York 13903 Vacri Construction Corp. $1,885,000.00 One Brick Avenue Binghamton, New York 13901 Marcellus Construction Co. Inc. $2,254,284.00 4615 Crossroads Park Drive Liverpool, New York 13088 Villager Construction, Inc. $2,647,290.00 425 Old Macedon Center Road Fairport, New York 14450 Highlander Construction Co. Inc. $2,738,580.00 5774 Kester Road Memphis, New York 13112 F.P. Kane Construction, Inc. $2,899,000.00 137 Washington Avenue Endicott, New York 13760 Grant Street Construction, Inc. $2,934,000.00 48 Grant Street Cortland, New York 13045 BE IT RESOLVED, the bid as recommended by Town Engineer, Hayne Smith is hereby awarded to G. DeVincentis & Son Construction Co. Inc. of 7 Belden Street, Binghamton, New York in the amount of $1,778,000.00. Town Engineer Smith commented that if G. DeVincentis & Son Construction Co. Inc. does not start on time problems could arise. He apprised the Board he had a commitment to two engineers who are expecting to begin work on July 19th, 2004. Deputy Supervisor Testa questioned whether Engineer Smith discussed his concern with G. DeVincentis & Son Construction Co. Inc., and suggested that he do so. Engineer Smith stated he did not discuss the issue with the construction company. However, the construction company cannot start until the Notice to Proceed is issued, which cannot be issued until the agreement is signed. The agreement cannot be signed until the company's insurance is given to the Town in the form of a bond. Attorney Folmer commented that the project would be a great job for G. DeVincentis & Son Construction Co. Inc. Deputy Supervisor Testa commented it was nice to receive two bids under the Engineer's estimate of $2 million. Councilman Rocco made a motion, seconded by Councilman Pilato, to adjourn the Special Town Board Meeting. All voting aye, the motion was carried.
