Enfield Establishment of Enfield Fire District Dear Mr. Hubbell: This will acknowledge receipt of certified copies of a resolution of the town board of the Town of Enfield approving the establishment of -the Enfield Fire District. Please be advised that pursuant to section 173(2) of the To4m Law, the consent of the comptroller is required for the establishment of a fire district. A formal application for such consent must be made by the town. We enclose herewith a copy of our booklet, Legal Ile uirements and Administrative Procedures for Approval of Fire, Fire Alarm and Fire. Protection Districts, which contains instructions and a sample application. We will need the following documents, in duplicate: 1. the verified application; 2. a certified copy of the resolution calling the public hearing; 3. original affidavits of posting and of publication of the notice of public hearing; 4. a statement of the manner in which it is intended to provide fire protection, including whether or not any capital improvements or purchases are contemplated, and if so, at what estimated cost. IN THE MATTER OF THE CREATION OF ENFIELD FIRE DISTRICT IN THE TOWN OF ENFIELD, COUNTY OF TOMPKINS AND STATE OF NEW YORK, TO: THE COMPTROLLER OF THE STATE OF NEW YORK STATE DEPARTMENT OF AUDIT AND CONTROL STATE OFFICE BUILDING ALBANY, NEW YORK SIR: The Petition of the Town Board of the Town of Enfield, County of Tompkins, and State of New York, for permission to create a fire district in the said Town of Enfield, to be known as the Enfield District, pursuant to Section 173 of the Town Law of the State of New York, respectfully shows: 1. This application is made pursuant to a Resolution of the Town Board of the Town of Enfield adopted at a meeting of said Town Board held in said town on the 4th day of December 1985, approving the establishment of such fire district, a certified copy of which is hereto annexed, marked, "Exhibit A," and made a part hereof, and wherein your petitioner was duly authorized and directed to make this application for permission to create a fire district in the Town of Enfield, County of Tompkins and State of New York, in compliance with the statutes in such cases made and provided. 2. That no petition was filed with the Town Board of the Town of Enfield for the establishment of such district. That the proceeding to establish a fire district for the Town of Enfield was initiated by Resolution of the Town Board pursuant to the authority vested in said Board by Article 11, Section 170 (2) of the Town Law of the State of New York. That a public hearing was duly held after notice published in accordance with law, and as stated in the Resolution of said Town Board, certified copy of which is attached hereto, and at said public hearing all persons attending were given the opportunity to express their views and ask any questions which they might have had in regard of the establishment of such district. That attached hereto and made a part hereof, marked "Exhibit B," is an official map of the County of Tompkins which indicates the territorial boundaries of the Town of Enfield, the area which shall be encompassed in said district. 3. The total assessed valuation of all taxable real property in the Town of Enfield, according to the latest completed assessment,roll for the year 1986, was the sum of $31,833,042. The aggregate assessed valuation of the taxable real property situtated in the territory comprising the proposed fire district, according to the said assessment roll, was the sum of $31,833,042. 2 - 4. A list of all State lands or institutions in the Town of Enfield is included in "Exhibit C," attached hereto and made a part hereof. 5. The proposed fire district is situated outside of any incorporated village or city; and no part of any existing fire, fire protection or fire alarm district is included within the area and boundaries of the proposed fire district. 6. There are no special districts in the Town of Enfield comprising or extending into any of the territory embraced with the proposed fire district. 7. A complete and itemized statement of the existing indebtedness of the Town of Enfield, both temporary and bonded, including the indebtedness of the town for all special district purposes, is set forth in "Exhibit D," attached hereto and made a part hereof. The Town of Enfield has no other indebtedness, temporary or bonded, or indebtedness for special district purposes. 8. The taxes payable during the year 1985 on the real property situated within the area to be embraced by the proposed Fire District in said Town of Enfield, for various purposes, excluding school taxes, amounted to a total rate of $F,4Aa per thousand. The rate and purpose of said taxes were as follows: 1985 Rate Rate State, County and Town taxes, 6.537 Town 1.885 Fire including highway taxes In addition there are the following school taxes established for the year 1985 to 1986: (in Enfield) Ithaca School District 23.55 Newfield School District 22.7251 Odessa School District 20.15428 Trumansburg School District 19.2948 9. Attached hereto and made a part hereof, is a certificate of the County Treasurer of Tompkins County, marked "Exhibit E," showing the extent of the non-payment of taxes in the area to be included in the proposed district during the three years last past. 10. The proposed district was set up for the purpose of having fire protection in the territory embraced within the district. There is at present, organized and existing, a local fire company known as Enfield Volunteer Fire Company, Inc., which serves the district. This particular company owns seven fire trucks and owns a 7+ acre plot of land (with a pond) on which the company owns the existing fire house building. 11. The population of the territory embraced in the proposed district is approximately 2375 persons and is increasing by reason of recent construc- tion of new homes. 3 - 12. A description of the territory to be included in the proposed district is as follows: The boundaries of the district shall be coterminous with the boundaries of the Town of Enfield. WHEREFORE, the Town Board of the Town of Enfield, County of Tompkins, New York, through its supervisor, Etta C. Gray, respectfully prays and requests permission to create said fire district of the Town of Enfield, County of Tompkins, State of New York, in accordance with the foregoing. 'ii O LAN GELI Notary Public, State of New York No. 4664561 Qualified in Tompkins County Term Exoires Dec_ 31, 19 c' s- RESOLUTION OF TOWN BOARD APPROVING THE ESTABLISHMENT OF A FIRE DISTRICT At a meeting of the Town Board of the Town of Enfield, Tompkins County, held at the Town Hall in the Town of Enfield, New York, on the 4th day of December, 1985, at 7:30 p.m. Present: Roger Hubbell , Supervisor David Bock , Councilman Roger Laue Councilman Robert Scofield Councilman Larry Stilwell Councilman In the matter of the Establishment of ENFIELD FIRE DISTRICT in the Town of Enfield, Tompkins County, New York, pursuant to Section 173 of the Town Law. WHEREAS,.an Order was duly adopted by the Town Board of Enfield on October 2, 1985, specifying November 13, 1985, at 7:30 p.m. on that day, at the time, and the Town Hall of said town as the place where the said Town Board would meet to consider approving the establishment of ENFIELD FIRE DISTRICT in said town, and to hear all persons interested in the subject thereof concerning the same, and to take such action thereon subject therefor concerning the same, and to take such action thereon as is required or author- ized by law, and WHEREAS, such Order was duly published and posted as required by law, and WHEREAS, pursuant to such notice, a public hearing was duly held by said Town Board on the 13th day of November, 1985, commencing at 7:30 p.m. at the Town Hall of Enfield, Tompkins County, New York, being within the limits of the proposed fire district and, WHEREAS, all persons interested, who desired to be heard, were duly heard, and due deliberation having been had, now, upon the evidence given at such public hearing and on motion of David Bock, Councilman and seconded by Roger Laue, Councilman, it is hereby RESOLVED AND DETERMINED, pursuant to Article Eleven of the Town Law of the State of New York, (a) That all the property and property owners within the proposed district are benefited thereby; (b) That all the property and property owners benefited are in- cluded within the limits of the proposed district; (c) That it is in the public interest to establish said fire district coterminous with the boundaries of the Town of Enfield, Tompkins County, New York and it is further, RESOLVED, that this Board in all respects approves the establishment of a fire district within the Town of Enfield, Tompkins County, New York, to be known as the ENFIELD FIRE -2 - DISTRICT and to be contained in and embrace the following boundaries, said boundaries to be coterminous with the Town Boundaries of the Town of Enfield, Tompkins County, New York. RESOLVED, that the Town Clerk of.this town shall within ten days from adoption hereof cause a certified copy of this resolution, in duplicate,to be filed in the State De- partment of Audit and Control at Albany, New York, together with an application by this Board, in duplicate, for permission to create such district as provided for by Town Law, Section 173; and that such application shall be executed and verified by and in behalf of the Town Board by the supervisor of the town. The adoption of the foregoing resolution was duly put to a vote and, upon roll call, the vote was as follows: Roger Hubbell Supervisor, voting Aye David Bock Councilman, voting Aye Roger Laue Councilman, voting Aye Robert Scofield Councilman, voting Aye Larry Stilwell Councilman, voting Aye The resolution was thereupon declared duly adopted. N.Y. 14850 December 4, 1985 RESOLUTION OF THE ENFIELD TOWN BOARD CREATING FIRE DISTRICT At a Regular Meeting of the Town Board of the Town of Enfield, held on the 4th day of December 1985 at 7:30 PM at the Enfield Town Hall, on Route 327 in the Town of Enfield: Members present were: Roger.Hubbell, David Bock, Roger Laue, Robert Scofield and Larry Stilwell. Also present were: Dan Winch, Jim Mason, Etta Gray, Carlton Thall, Shirley Holcomb, Shirley Egan,__Larry-Lanning_-and-M. Clyde Hubbell. J The meeting was called to order by Roger W. Hubbell, Supervisor. David Bock offered the following resolution and moved its adoption. WHEREAS, heretofore and on the 2nd day of October 1985, this Town Board adopted a resolution directing that a public hearing be had on the creation of a Fire District in the Town of Enfield, whose territory was to consist of the territory of the Town of Enfield, and WHEREAS, the Town Clerk caused a notice of such public hearing to be published on October 25th 1985 in the Ithaca Journal, a newspaper having general circulation throughout the proposed district and being the newspaper designated by this Town Board for the publication of legal notices of the Town, and such notice having been published not less than 10 days nor more than 20 days before the day designated therein for the hearing, and the said Town.Clerk also posted 5 copies of such notice conspicuously in 5 different places..-withintthe territory affected, not less than 10 nor more than 20 days before the day designated for the hearing, and WHEREAS, the published notice and the posted notices contained a description of the proposed Fire District and prescribed the boundaries thereof and also the place where the Town Board would meet to consider creation of said district and to hear all persons'inter:ested_.in-the subject concerning the same, and WHEREAS, this Town Board did meet and hold a public hearing as provided in said notice on the 13th day of; November 1985, at the Enfield Town Hall at 7:30 PM on Route 327, being located in the Town of Enfield and within the territory of the proposed district, and Page Two WHEREAS, various persons.appeared and all persons -who -desired to be:,heard were heard, NOW, upon all the evidence given at such public hearing and due deliberation having been had, it is hereby RESOLVED, that pursuant to Article 11 of the Town Law of the State of New York, it is hereby determined that it is in the public interest to create the Fire District proposed in the notice of hearing, and there hereby is established a Fire District within the Town of Enfield, Tompkins County, New York, the same to be known as the Enfield Fire District and to be contained in the territory embraced within and coterminus with the boundaries of the. Town of Enfield, and it is further RESOLVED, that this Board does hereby find and determine that all the property, property owners and interested persons in the territory embraced within the foregoing boundaries are benefitted thereby, and it is further RESOLVED, that the Town Clerk and Town Supervisor of this Town, shall cause a certified copy of this resolution to be recorded in the Office of the Tompkins County Clerk and submit duplicate certified copies of this resolution together with a request by law or regulation, to be filed with the New York State Department of Audit and Control.
