HomeMy WebLinkAbout1966 EVFC- 1 - THIS AGREEMENT,. made as of October 5, 15166 by and 'between the TOWN BOARD OF THE TOWN OF ENFIELD, County of Tompkins, and State of New York, acting pursuant to authority conferred ,upon it by Section 184 of the Town Law, as the party of the first part, and ENFIELD VOLUNTEER FIRE COMPANY, INC., of the Town of Enfield, County of Tompkins, and State -of New York, as party of ,the second part, WITNESSETH: WHEREAS, there has been duly established in the said ITown of Enfield a fire protection district including the entire territory of said Town of Enfield, and WHEREAS, following a public hearing duly held as 1provided in Section 184 of the Town Law, the party of the first 4part duly authorized the making of a contract with the party of lithe second part for fire protection service in said Enfield Fire ,JProtection District upon the terms and conditions hereinafter set liforth and WHEREAS, this agreement has also been duly authorized ,by the Board of Directors of the party of the second part, NOW THEREFORE, the party of the first Dart does hereby ilengage the party of the second part to furnish fire protection to 11said fire protection district, and the party of the secondpart 1hereby agrees to furnish such fire protection in the manner following to wit: 1. The party of the second part at all times during the Bg 11period of this Agreement shall be subject to call for attendance .1upon any and all fires occuring in said fire protection district, Mand, when notified by alarm, telephone call or otherwise of a fire within -said fire protection district, the said party of the second part shall respond and attend upon the fire without delay and with suitable ladder, -pump, hose and other apparatus of the party of thesecondpart. Upon arrival at the scene of any such fire, - 2 - the party of the second part shall proceed to extinguish the same and shall use its utmost endeavors to prevent loss of life or property in connection therewithin. 2. In order to effectually carry out this Agreement, the party of the second part agrees that it will at all times keep :and maintain in first-class repair and order suitable motorized !'fire apparatus with pumper, booster tank, hose, ladders and necessary fire fighting implements for use pursuant to the terms of this Agreement in the protection of life and property from lifire within the said Enfield Fire Protection District, and will supply the services of a sufficient number of firemen to perform the services necessary hereunder. 3. It is further mutually agreed that in case the fire ,;fighting apparatus should be out of town, the party of the second part shall arrange through Mutual Aid for fire protection for the Town by some other district during this time. 4. It is mutually understood and agreed between the parties hereto that the party of the second part will procure and keep in effect during tht term of this agreement adequate insurance covering the fire apparatus to be used by it in the rendition of fire protection service under this Agreement, for personal liability, property damage and collision. 5. it is further mutually understood and agreed between the parties hereto that the party of the first part will procure insurance covering the liability of said Enfield Fire Protection District for compensation payable to a volunteer fireman to the extent provided in Section 205 of the General Municipal Law of the State of New York, or will arrange with the Board of Super- visors of Tompkins County for the inclusion of such coverage in the Tompkins County and Town Mutual Self -Insurance Plan, without expense to the party of the second part. - 3 - 6. in consideration of the faithful performance by the party of the second part of its obligations under this Agreement, the party of the first part agrees to pay to the party of - the second part, on behalf of said fire protection district $3,400.00 per year for one year January 1, 1967 to December 31, 1967. / 1 7 This Agreement shall become effective January 1, 1967 and 4A .4 9 710 shall continue for one year, January 1, 1967 - December 31, 1967, with Fthe"_ivilege of either party terminating the same on thirty ir I day's notice at any time after the expiration of the first year. and delivered this Agreement as of the day and year first above written.
