THS AGREEMENT, made as of 'September 3, 1963 by and between the
TOWN BOARD OF THE TOW 07F'I , County of Tompkins, and State of New Fork,
acting pursuant to authority conferred upon it by Section 184 of the Torn
Law, as the party of the first part,, and ENFIELD VOLUNTEER FIRE COMPANY, INC.,
of the Town of Enfield, County of Tompkins, and State of Hew 'York, as party i
of the second part#WITNESSETH:
I&MEAS, there has been duly established in the said Town of
Enfield a fire protection district including the entire territorry of said
Town of Enfield, and
WHMtEAS, following a public hearing duly held as provided in
Section 184 of the Town Law, the party of the first part duly au=thorized
the raking of a contract vith the patty of the second part for fire protec-
tion service in said nfiel:d Fire Protection District upon the terns and
conditions hereinafter set•iorth and
this agreement has also been duly authorized by the
Board of Directors of the party of the second part,
N01W THEREFORps, the party of the first part does hereby engage
the party of -the second part to furnish fire protection to said fare
protection district, and the party of the second part hereby agrees to
furnish such fires protection in the manner following to wit.
1. The party of the second part at all tines during the period of
tiffs Agreement- shahs subject to call for attendance upon any and all fires
oceuring U said ffre protection district and, when notified by alarm, telepho
cal] or otherwise of a fire within s4id fire protection district, the said

party of the second pant shall respond and attend upon the fire without delay
and with suitable ladder, pump, hose and other apparatus of the party of the

second part. Ripon arrival at the scene of any such fire, the party of the I
second part shall proceed to extinguish the same and shall use:its-utao_st
ifid ivai to prevent loss of life or property in connection there thin.
2. In order tor -effectually carry out this Agreementq the party
of the second part agrees that it will at all tines keepand maintain in
first-class repair and oar suitable motorized fire apparatus with pumper,
booster tank, hose, ladders -and -necessary fire fighting implements for use �
pursuant to the - terms of this Agreement in the protection- cif lifer -and- property
from fire within the said Enfield Fire Protection District, and will supply

the services of a sufficient number of fireman to perform the services
necessary hereunder.
3- It is further mutually agreed that in case the fire fighting
apparatus should be out of town-, the party of the second part shall arrange
through Mutual Aidforfire-protection for the Town by some other district
during th-ts time.
4. It is mutually understood and agreed between the parties here-
to that the party.of the second part will procure and keep in effect during
the terms of this agreement adequate insurance covering the fire apparatus to
be used by it in the rendition of fire protection service under this Agreement,
for personal liability, property damage and collision.
5. It is further-mutuany understtood and agreed between the
parties hereto that the party of the first part will procure insurance cover -
Ing the liability of said Wield Fire Protection District for compensation
payable to a volunteer fireman to the extent provided in Section 205 of the
General Mfunicipal Law of the Mate of New York, or will arrange wi.th the
Boardof Super ors of Tompkins County for the inclusion of such coverage
in the Tompkins County and.Town Mutual Self -Insurance Plan, without expense to
the party of the second part.
6. In consideration of the faithful performance by the party of
the second partofIts obligations under this Agreementq the party of the
first part agrees to p to the party of the second part, on behalf of said

This Agreement shall becorva effective January Ij 1964 and shall

continue for the-70&-S-,491965,--and-4966 with the privilege of either party
terminating the same on thirty day*s notice at any time after the expiration
of the first year*
