Leland Cornelius, Highway Superintendent, would like to buy air compressor for Town at Tichenor's Auction. Moved by Mr. VanBenschoten, seconded by Air. Cummings, to authorize Highway Superintendent to purchase air compressor and miscellaneous tools at Tichenor's Auction* Ayes - Sovocool, VanBenschoten, Cummings, Graham, Robinson. Pierson Town Clerk MINUTES OF TOWN BOARD MEETING HELD TUESDAY, DECS10IBLR 11, 1984- @ 7:30 P.M* Those present: Teresa M. Robinson, Supervisor Ellard- L. Sovocool, Councilman Donald E. Cummings, Councilman Joseph H. Graham, Councilman Jack Fitzgerald, Attorney Absent: Gordon C. VanBenschoten, Councilman Also present: Leland Cornelius Moved by Mr. Sovocool, seconded by Air. Cummings, -that the minutes of November 7 be approved as mailed. Ayes - Sovocool, Cummings, Graham, Robinson. Claim Nos. 334 to 358 of the Highway Fund in the amount of $20,788.55; Claim Nos. 335 to 430 of the General Fund in the amount of $13,704.67; and Claim No. 14. of the Federal Revenue Sharing Fund in the amount of $1,482.07 were presented for audit. Mr. Sovocool moved that the bills be paid and. instructed clerk to draw warrant for them. Seconded by Mr. Graham. Ayes -- Sovocool, Cummings, Graham, Robinson. Monthly reports from Town Clerk, Town Justice Heffron and Zoning Officer were reviewed. Supervisor Robinson reported that all municipalities are having trouble getting insurance. Comp. goes down because of good record but insurance will go up about $3000 because of SCM acid .pits being within the township, SCM had testing done but hasn't released entire results. Supervisor will contact County to see what information was provided by DE7C. Meeting recessed. at 8PM for Aged Exemption Hearing (Local Law m3 of 1984). Hearing opened at 8PI•i. Supervisor read legal notice that was published in the Journal & Courier on Novmeber 21 amending Local Law #1 for the year 1.966. T. Robinson: Are there any questions? E. Sovocool.: We end up with $8000 exemption? T. Robinson: This brings us up to date and makes us legal. Local Law and amended by resolutions since 1966. It was a You can't amend a local law by resolutions. Does everybody understand? D. Cummings: What ,percentage do they get? T. Robinson: 50 %. Income up to $8000 for Town, Village & School. J. Graham: Do they have to file every year? T. Robinson: Yes, since there income may change. Any more If not, we will close the hearing questions? RESOLUTION NO. 32 - ADOPT LOCAL LAW #3 FOR THE YEAR 1984 AIkrMDING LOCAL LAW ffl FOR THE YEAR 1966 PROVIDING FOR PARTIAL TAX EXEMPTION OF REAL PROPERTY FOR THE ELDERLY Moved by Mr. Cummings, seconded by Mr. Gra.harn Ayes - Sovocool, Cummings, Graham, Robinson RESOLVED that the Town of Groton adopt Local Law No. 3 for the year 1984 amending Local Law No. 1 for the 1966 which provided for a partial tax exemption of real property owned by certain persons with limited income sixty -five (65) years of age or older. (See Local Law Book) 0 Jim Anasiewicz, Director of the SPCA, was present to discuss proposed 1985 Dog Contract. He indicated amount of money requested is exactly what it cost the SPCA to do the job. Bid is $7800 and that's it - take it or leave it. It's not an ultimatum, it's a fact. This past year the SPCA made 692 calls in Groton. Board. felt it was too much money for dog control services. RESii;.UTION NO. 33 - CONTRACT WITH SPCA FOR 1985 DOG CONTROL SERVICES Moved by Mrs. Robinson, seconded by Mr. Graham Ayes - Robinson, Graham Nay - Cummings Abstained - Sovocool RESOLVED, that the Town of Groton will contract with the SPCA for 1985 Dog Control. Services in the he can prepare papers amount of $7800.00. Board discussed Vets Exemption and hearing held on December 4. There are approximately 796 people who would qualify for exemption. Exemption goes from ten years from the time we enact it. Consensus of board is that we currently don't have enough information 'to know what affect it will have on property owners. RESOLUTION NO. 34 - IN`1RODUCE PROPOSED LOCAL LAW #1 FOR THE YEAR 1985 - OPTION NOT TO GRANT VETERAN'S EXEMPTION Moved by Mrs. Robinson, seconded. by Mr. Sovocool Ayes - Sovocool, Cummings, Graham, Robinson RESOLVED, that the Town of Groton introduce proposed Local Law No. 1 for the year 1985 - Option Not to Grant Veteran's Exemption. Moved by Mrs. Robinson., seconded by Mr. Graham, to schedule hearing for January 8, 1985 at 8:00 P.M. to consider adoption of a Local Law No. 1 for the year 1985 regarding Veteran's Exemption from Real Property Tax. ~eyes - Sovocool, Cummings, Graham, Robinson. Moved by Mr. Sovocool, seconded by Mr. Cummings, to schedule Special Town Board Meeting for .December 27 at 10:00 A.M. to perform annual accounting of all Town :records. Ayes - Sovocool, Cummings, Graham, Robinson. Discussed status of property transaction. Attorney Fitzgerald said info-has been sent to Abstract Co. who will put in reference deeds. Water rights are in proposed deed stating that water rights cease when Mr. Tichenor and wife die. Town wants this changed to read water rights cease when Mr. Tichenor sells property. Main water line will be maintained ' by Town and. spur line maintaned by Tichenor. Rights reserved as long as he owns property. Consensus of Town Board was that Mr. Tichenor be paid in•one lumps suin for property as stated in Purchase Agreement. Discussed abandoned roads - Leland Cornelius will get information to Attorney Fitzgerald so that he can prepare papers for same. Board members and Attorney discussed Zoning Code pertaining to approval of Motor Vehicle Repair Shop applications by the Site Plan Review Board. Atty, said power is given to Planning Board to decide on a hearing or not. Consensus of Board was that since previous M VRS applicants had a hearing, any new ones should also. Town Board feels we should exert more control over special items. Also, procedure for application should be adhered. to to avoid non - payment by applicants. There being no further business, Air.
