TOWN OF ENFIELD
2004
THIS AGREEMENT made this day of December, 2003, by and
between the TOWN of ENFIELD, a Mu In" at corporation, of Tompkins County, New
York, hereinafter called the "TOWN" and the ENFIELD VOLUNTEER. FIRE
COMPANY, INC., a corporation organized under the laws of the State of New York; of
the Town of Enfield, Tompkins County, New York, hereinafter called the "FIRE
COMPANY".
AGREEMENT:
WHEREAS, there has been duly established a Fire Protection District,which
includes the entire geographic territory of the Town of Enfield and,
WHEREAS, that following a public hearing duly held as provided .for Jn Section

case of accidents, calamities or other emergencies in the Enfield Fire Protection District.
NOW THEREFORE, the TOWN, engages the FIRE COMPANY to provide fire
protection and emergency services to the Enfield Fire Protection District for a term of
three (3) years commencing 1 January 2004 and ending 31 December 2006 upon the
following terms and conditions:
1. The FIRE COMPANY shall be subject to call for attendance upon any fire,
medical emergency or life threatening emergency occurring in the district.
2. The FIRE COMPANY shall, when notified by the Tompkins County 911
Center or otherwise of a fire, medical emergency or life threatening emergency occurring
in the district, respond and attend without delay with suitable equipment apparatus, and
personnel, including but not limited to in the case of fire, with pumping and hose
apparatus, proceed with diligence to make every reasonable effort to extinguish said fire
and prevent the loss of life and/or property in the case of fire, or in the case of emergency,
to react appropriately to attempt prevent the loss of life.
3. The FIRE COMPANY shall keep and maintain in good repair and working
order, suitable and adequate fire -fighting apparatus and all other necessary fire -fighting
tools, implements and equipment and emergency service equipment to properly discharge
its obligations hereunder.
4. The FIRE COMPANY agrees to supply the services of trained and
equipped fire-fighters and emergency medical personnel utilizing mutual aid when
necessary.
5. The FIRE COMPANY agrees to procure, obtain and maintain in full force
and effect during the term of this agreement, sufficient insurance coverage for the fire-
fighting and emergency apparatus and personnel to be used in discharging its duties herein,
including but not limited to personal liability, property damage, collision, and workman's
compensation payable to a volunteer fire-fighter as provided by Section 205 of the
General Municipal Law of the State of New York. Proof of said coverage's shall be-
provided
eprovided to the TOWN upon request.
6. The TOWN acknowledges that the FIRE COMPANY is a member of the
Tompkins County Mutual Aid network, and that in the event the fire -fighting apparatus
and personnel of the FIRE COMPANY are committed or unable to respond, the- FIRE
COMPANY and/or Tompkins County 911 Center shall arrange through Mutual id for
fire protection for the district, as herein required. -
Ta For the year 2004, the TOWN agrees, on behalf of the district, to pay the
FIRE COMPANY the sum of two hundred twenty two thousand six hundred four -dollars
and no cents ($222,604.00) payable in four (4) installments as follows:

7.c. For the year 2006, the TOWN agrees, on behalf of the district, to pay the
FIRE COMPANY the sum of two hundred forty thousand seven hundred sixty nine
dollars and no cents ($240,769.00), payable in four (4) installments as follows:
1/20/06 $35,000.00
2/20/06 $75,000.00
3/20/06 $25,000.00
5/20/06 $105,769.00
The parties agree that it is not their intention that the cost to the FIRE COMPANY of
responding to spills or other emergencies involving hazardous materials be covered by the
consideration set forth above, but rather that the FIRE COMPANY maybe separately
reimbursed by the TOWN for any such costs of responding to a hazardous materials
emergency from monies which the TOWN may be able to obtain from other sources,
available to the TOWN, but not available to the FIRE COMPANY. In the event that an
incident of such type should occur, the TOWN shall act in good faith to:collert any such
compensation as may become available. However, in the event that the TOWN is
unsuccessful in collecting funds for such an incident, both parities to this contract agree to
abide by a binding decision as to any amount of compensation as adjudicated by a
committee of five persons, two persons selected by each party to this agreement and the
fifth member being a senior member of the County Board of Representatives that
represents the Town of Enfield
8. The TOWN agrees that all monies paid hereunder shallbib,a charge upon. .
the fire protection district and shall be assessed and levied upon the taxable -property iii the
district and therefore subject to collection with TOWN taxes.
9. The FERE .COMPANY and the TOWN acknowledge that; in. performing the
terms of this contract, the FIRE COMPANY is performing an essential public function
which is paid for largely by public funds. The parties agree that it is in their .mutual
interest and in the interest of the public to assist each other in maintaining the ;public trust.
In order to further these interests, and assist each other in maintaining the public trust, the
FIRE COMPANY and the TOWN agree to the following:
a. The parties agree to meet during the year at the request of either
party, to discuss the provision of FIRE COMPANY services as contained
herein. Said meetings shall take place as a part of the regularly scheduled
meetings of the TOWN BOARD. The Fire Company shall provide
quarterly the following:
i. Information as to the number and types of calls/responses made
by the FIRE COMPANY since the last report.
ii. A synopsis of staffing and training levels of the FIDE
COMPANY, including a complete listing of all active members of the FIRE
COMPANY.
in. A statement of income and expenses as they relate'to the
activities of the FIRE COMPANY under this contract. These deports are
Fire Company Treasurer reports labeled Quarterly report and budget
report. On an annual basis, at the close of the Fire Company's fiscal year,
the Fire Company will provide to the Town Board a statement`of
outstanding debts.paragraph , ply direcly or
indirectly,approal by the TOWN BOARD
of he acquisition of any
equipment.
b. The TOWN may request by resolution of the Town Board_ and shall- '
pay the expense of an independent audit, by a creditable public accounting .
agency, of the financial records maintained by the FIRE COMPANY
pertaining solely to the town funds received pursuant to. this contract and
to the use of said funds mi the discharge of the obligations'; contained in:this
agreement or any other agreement between the parties since I : anbarjy
1995.
C. The "FIRE COMPANY and the TOWN agree to act in good faith
and to take steps.to accomplish the provisions of he preceding paragraph,
should the TOWN elect to exercise its audit rights.. The FIRE COMPANY
agrees to provide reasonable access to necessary audit information, as
determined by he independent auditor, when given reasonable notice of the'
same. The Town specifically acknowledges the extensve_amountfoitime
required for the completion of an audit. Accordingly, any; audit instituted
under he terms and conditions of this agreement shall be so conducted., so
as to be completed as expeditiously as prudently possible.: The TOWN "
further agrees to compensate the FIRE COMPANY an amount not to
exceed $4,500.0046 offset any expenses actually incurred by the FIRE
COMPANY in the completion of the aforementioned audit.
10. With the safety of it's emergency responders and citizens as a priority
goal, the FIRE COMPANY and the TOWN agree that it is mutually beneficial to both
parties to recognize and acknowledge the need for the Fire Company's compliance with all
applicable standards, including Federal, State and Local statutes and voluntary consensus
standards, and to reasonably -fund such compliance.
11. The parties acknowledge that this agreement represents the entire .
Agreement between the parties, superseding any previous agreement(s).
12. The TOWN and the FIRE CONWANY agree that sources of water are
an important aspect of the fire protection of the Town of Enfield- and
agree to carry on mutual discussions of appropriate ways to address
water needs with respect to fire service during the duration of this
agreement.
13. This ,agreement shall commence as of January 1, 2004 and continue
through December 31, 2006.
14. Both parties agree that any surplus funds left (if any) at thei end"of the
year be placed in a reserve account. It is further agreedthat these funds will be- used at the
Fire Company's discretion to reduce costs of capital projects or emergency repairs.
15. If any provision of this agreement is held to be invalid. or unenforceable;.
all other provisions hereof shall nevertheless continue in full force and effect:

205. Payments to injured or representatives of deceased volunteer
firemen. First. If an active member of a volunteer -fire company in any
city, incorporated village or in any fire district of a town outside of
z.z incorporated village or in any part of a town protected by a
-olunteer fire company incorporated under the provisions of the
r.embership corporations law, or"if an active member of any duly
organized volunteer fire company, dies from injuries incurred while in
the performance of his duties as such fireman or as:a member of a fire
department emergency relief squad, a fire police squad or a fire -patrol
v.ithin one year thereafter, the city, village, fire district or town
Vhich is responsible as -provided in subdivision fourth. of this section
Shall pay as follows:
a. If such --'volunteer fireman is a member of a volunteer fire company,
located`in any city in which a pension fund is maintained, the relatives
of such volunteer -fireman shall be entitled to a pension in the same
manner and at the same rates as if he were'a member of the paid fire
department of such city:
b. If in any other place"the sum of three thousand dollars shall be
paid to the widow of such deceased volunteer fireman or to the executor
or administrator of his estate if he is not survived by a.widow..In
addition there shall be paid to the widow of such volunteer fireman for
the benefit of such child or children the sum of 'twenty-five dollars a
month for each surviving child, including a posthumous"ch'ld,=of.such
deceased fireman under the age of eighteen years, but not more than
total of fifty dollars a month for all such ,children, or if the decedent
be not survived by a'widow, or if she dies before the payments cease,-
then such payments for a child or children shall be made to their
guardian or to relatives with whom they are living for their benefit.:
Second. Any such volunteer fireman who shall become permanently
incapacitated for performing the full duties of a volunteer fireman by
reason of disease or disability caused or inducedby actual performance"
of the duties of his position, without fault or misconduct on,his part,
shall
a. If a member of a volunteer fire company located in any city -in
which a pension fund is maintained, be paid a pension in the same manner,
and at the same rate as if he were a member of the paidfiredepartment
of such city.
b. If a member•of a volunteer fire company in any other place, -be paid
one-half the amount which would have been payable in case "of death to .
his executor or administrator under the provisions"of subdivision first -
of this section;
Provided, however; that if such volunteer fireman shall .at the
expiration of the disability payments provided for in subdivision third
of this section be totally incapacitated to engage in any occupation for
remuneration or profit by reason of disease or disability :caused "by -
actual performance of the duties of his position, without -fault or
misconduct on his part, he shall be paid the sum of fifteen dollars per
week during the period thereafter that such total incapacity shall
continue and, in addition thereto, during such period there shall be
paid to him for the benefit of his -child or children"the Sum of twelve
dollars fifty cents a month for each child under the ageo,f eighteen
years, but not more than a total of twenty-five dollars a month for all -
such children, but".no payment on account of a child shall.contintxe after
such child shall have attained the age of eighteen years. In the event
payments to a volunteer fireman and his children. on account of total
incapacity, as heretofore in this subdivision provided, shall -not have
amounted to the sum'to which he.would otherwise have been entitled on:
account of permanent incapacity for performing the full duties of a
volunteer fireman and he shall be found to have recovered to such extent
that he is no longer totally incapacitated but is still permanently
incapacitated for performing the full duties of a volunteer fireman,
there shall be paid to him the difference between the payments already

the amount to which he would be entitled under -this subdivision on
account of permanent incapacity for performing the full duties of a
volunteer fireman. The authorities having jurisdiction to audit the
claim of any volunteer fireman claiming total disability benefits under -
this subdivision shall have the right to cause such injured volunteer
fireman to be examined from time to time at reasonable intervals by the
municipal health authorities.or any physician appointed bp.them for that
purpose to determine whether total disability continues and; in case'a
volunteer fireman receiving total disability benefit's hereunder shall
refuse to permit any such examination to be made, such authorities shall.
be authorized to discontinue the payment of benefits to him urit-il such
examination is allowed.' Third. Any such volunteer fireman who shall
receive injuries while performing his duties as such, while in the fire
house, while going to or .returning from a fire by any means of -travel,
transportation, or conveyance whatever, or, while working at -the fire or -
answering a call or fire alarm or while officially engaged in '-testing or
inspecting the apparatus, or equipment, or while engaged as a member of
a fire department, or fire company, emergency relief squad or.fire
police squad, or fire patrol or while attending a fire school,' or,while
instructing or being instructed in fire duties or while attending any
drill or parade or inspection in which his company or department is
engaged, or while engaged in emergency work not related -to fire -
extinguishment or prevention or going to or returning therefrom when
duly authorized to participate therein, so as to necessitate medical or
other lawful remedial treatment or prevent him from following .his usual
vocation on account thereof, shall be reimbursed for.such<sums as -are
actually and necessarily paid for medical or other lawful remedial
treatment, not exceeding five hundred dollars. He shall also be
compensated for the time he was actually and necessarily prevented from
following his vocation or for the time of his disability on account of
such injuries, at the rate of thirty-six dollars per week not to exceed
one thousand eight hundred dollars
Notice of an injury or death for which benefits are payable under this
section shall be given to the municipal corporation or fire district
responsible for the payment thereof within thirty days after receiving
such injury, and also in -.case of the death of the volunteer fireman
resulting from such injury within thirty days after -such death. Such
notice may be given 'by any person claiming to be entitledo such'
benefits or by someone it his behalf. The notice shall be in writing,
shall contain the name -and address of the volunteer fireman, and state
in ordinary language the time,.place, nature and cause of 'the,'injury and
shall be signed by him or by a person on his behalf or, in case of
death, by any one or more of his dependent -s, or by a:person on their
behalf. The notice shall be given to the comptroller or chief :financial €'
officer of the city, the clerk of the village, the secretary of the fire
district, or the town clerk of the town, as the case.may be, by
delivering it to such officer or by registered letter properly, addressed
to such officer. The failure to give notice of injury or notice of death
shall be a bar to any claim under this section. �`ailure to give notice
of such injury or death within such thirty day period may be excused by
the county judge who would have jurisdiction of a controve:rsy under this
section, upon petition and notice in the manner provided ih -subdivis,ion
fifth of this section, either upon the ground that for some sufficient
reason the notice had not been given, or that any member of a :,body ,in
charge of, or any officer of the fire department or fire company. had
knowledge within such thirty day period, of the injuries or death, or Io
that the municipal corporation or fire district has not been prejudiced•
by a delay in giving such notice.
Any such volunteer fireman who shall receive injuries as;aforesaid
snail, when certified,by the chief or other executive officer bf-the
fire department or by the appropriate administrative officers under whom
he serves, be received by any public, private, or semi -private hospital
fDr care and treatment at the usual ward or semi -private patient rates,
including charges at the prevailing ward or semi -private patient rates

for necessary nursing, laboratory tests, x-ray examinations and physical
therapy, or, in case any such hospital has a contract with the
-
municipality served by such volunteer fireman, then at the rates
specified in such contract.
Within two years after receiving the injury, or if death results
therefrom withintwoyears after such death, a claim for -the benefits
under this section shall be filed with the same officertowhom a not -ice
of an injury must be given, as aforesaid. The claim shall -be in
substantially the same form and shall give substantially the same
information as is required to be given in a claim under the provisions
of section twenty-eight of the workmen's compensation law.
Notwithstanding the provisions of any other law, any such claim need not
be sworn to, verified or acknowledged.
Payments of weekly benefits under this section shall commence within
fifteen days after the filing of such claim, -and payments .of lump sum,
and monthly, death benefits under this section shall be made or
commenced within thirty days after such filing. In the event of a
failure --to make such payments within any such period or -to continue the
same for the time required therefor, a controversy -shall be -presumed to
have arisen and a proceeding may thereupon be institutedpursuant to
subdivision fifth of this section to compel such payment.
Fourth. In cities any benefit under this section shall be a_city
charge and any claim therefor shall be audited and paid in the same
m_-nner as other city charges, except that no part of the moneys payable
under this section shall be paid from the pension funds of the said
departments therein. In villages any such benefit shall be a village
charge and any claim therefor shall be audited and paid in the same
manner as other village charges, and shall be assessed upon the property
11able to taxation in said village, and levied and collected in the same
m,-.nner as village taxes. In fire districts any such benefit shall be a
fire district charge and any claim therefor shall be audited and paid in
the same manner as other fire district charges, and -shall be assessed
u:on the property in such fire districts liable to taxation, and -levied
and collected in the same manner as fire district taxes. If such -fireman
was a member of a town fire company or fire department or:a member of a
f --re company incorporated under the membership corporations law, located
o-tside of a city, village or fire district, any such benefit -shall be -a
t-wn charge and any claim therefor shall be audited and paid in the same
m-nner as town charges and shall be assessed upon the property liable to
tE.xation in the territory protected by such fire company and levied and
collected in the same manner as town charges therein-. If such fireman
w, -s a member of a fire company -or fire department operating in, or
mAntained jointly by -two or more villages, or two or more towns, or two
oar more fire districts, any such benefit shall be a charge against the
v_llage, town or fire district, in which the fire occurred. If such
i -_jury occur while assistance is being rendered to a neighboring city,
town, village, fire district, fire protection district (including a fire,
p-otection district served by the company or department of which such
f--reman is a member), fire alarm district, or territory outside any such
d --strict upon the call of such city, town, village, fire district, fire
p_otection district, fire alarm district, or territory outside -any such
district, or while going to or returning from the place from whence such
call came, or death shall result from any such injury, any such benefit
s_all be a charge against such neighboring city, town, village, fire
d__strict, fire protection district, fire alarm district, or territory-
o tside any such district, so issuing the call for assistance and after
a--,dit shall be paid and assessed upon the property liable;to taxation -in
such neighboring city, town, village, fire district., fire protection
d- :_strict, fire alarm district, or territory outside. any such district -f-
a --d
istrict;
a -_d levied and collected in the same manner as other charges against the
s -.me are levied and collected.
Any city, village, fire district or town may finance the payment -of
a, -.y benefits payable under the provisions of this section by the
i.suance of serial bonds or capital notes pursuant to the.local finance
1-.w unless it is required by some other law to pay such benefits from-

current funds.
Any such city, village, fire district or the town -board acting for and
on behalf of any fire protection district, fire alarm district or
territory outside any such district; may contract for insurance
indemnifying against the liability imposed by this section, provided
fl- rther that such contract of insurance shall also indemnify against the
1 -ability imposed by the workmen's compensation law in relation to
injuries or death of volunteer firemen, and the cost of such insurance
shall be paid and provided in the same manner as benefitsare required
to be paid and provided in this section.
If any claim under this section is one for which an insurance company
might be liable, or if it is a claim for which a mutual self-insurance
pian under subdivision three -a of section fifty of the workmen's`
compensation law might be liable, the officer to whom a notice of injury
is required to be delivered or mailed and with whom a claim is required
to be filed under the provisions of this section shall send a copy of
any such notice or claim and a copy of any notice of a proceeding
relating to an injury or claim. to such insurance company or plan, as the
case may be, promptly after receiving the same.
Any money paid to -an executor or administrator under any of the
provisions of this section shall.be distributed in -the manner provided
b- law for the distribution of personal property, and allmoney paid
under this section shall be exempt from any process for the collection
o�' debts either against the volunteer fireman, or any beneficiary to whom
the same is paid -under the provisionsof this section.
No release from the liability imposed by this section .shall be'valid
if it shall appear that the person executing such release hasnot
received the full amount to'.which he is entitled under the provisionsof
this section.
The words "injury" and "injuries", as used in this section, include
any disablement of a volunteer fireman as the direct result of the
p,rformance of his duties.
If for the purpose of obtaining any benefit or -payment under the
provisions of this section, or for the purpose of influencing --any
dFtermination regarding any benefit or payment under the provisions of
t.is section, either for himself or for any other person, any -person
w-lfully makes a false statement or representation, he shall be guilty
of a misdemeanor.
The provisions of this section relating to giving notice of injury and
fling claim, and to the contents of any such notice or claim, shall be
c(nstrued liberally in order to effectuate the objects and purposes of
t} is section.
Fifth. Any controversy arising at any time under the provisions of
this section shall be determined by the county judge of any county in
w;.ich the city, village, fire district, or town, which would be
responsible for payments under this section, is located. 1'or that
pi-.rpose, any party may present a petition to such county judge, setting
fcrth the facts and rights which are claimed. A copy of such petition
and notice of the time and place when the same will be presented shall >•'
b<, served on all persons interested therein, at least eight days prior
to such presentation.
Sixth. The provisions of this section shall not apply to volunteer .
f_remen killed or injured on or after the first day of Marsch, nineteen
hindred fifty-seven, or who die from the effects of injuries received on
ol: after such date.
S 205-a. Additional right of action to certain -injured or
representatives of certain deceased firefighters. 1. In addition to any'
o':ier right of action or recovery under any other provision of law, ir,-
tLe event any accident, causing injury, death or a disease which results
ir: death, occurs directly, or indirectly as a result of any, riagloct,
orission, willful or culpable negligence of any person or persons in
foiling to comply :,ith the requirements of any of the statutes,
o-dinances, rules, orders and.requrements of the federal, state,
county, village, town -or city aovernme;nts or of anv and all.their .

&-oartments, divisions and bureaus, the person or persons:guilty of said
ncglect, omission, willful or culpable negligence at the time of such-"
injury or death shall be liable to pay any officer, member, agent or
er-ployee of any fire department injured, or whose life may be lost while
ir_ the discharge or performance at any time or place of any duty imposed
b.- the fire commissioner, fire chief or other superior"officer of the
f_re department, or to pay to the wife and children, or to pay to the -
parents, or to pay to the brothers and sisters, being the surviving
heirs-at-law of any deceased person thus having lost his life, a sum of
m-ney, in case of injury to person, not less than -,ten thousand dollars,
aTd in case of death not less than forty thousand dollars; such .
lability to be de' -ermined and such sums recovered in an action to be
ir,stituted by any person injured or the family or relatives of any
p-rson killed as aforesaid.
?, Notwithstanding any other provision of law, including sections
fifty -e and fifty ---'I of this chapter, section thirty-eight'hundred'
t irteen of the education law, section ten of the court of claims act
aid the provisions of any general, special or local law or charter
r.-.quiring as a condition precedent to commencement of an action -or
s ocial proceedinc that -a notice of claim be filed or present; every
cz•ase of action fcr the personal injury or wrongful"death of a
f_refighter which was pending on or after January first, nineteen
h•adred eighty-seven, or which was dismissed on or after January first, -
n=.neteen hundred e=_ghty-seven, because this section "was not yet _
effective, or which would have been actionable on or after January
frst, nineteen hundred eighty-seven had this section been effective is
h-reby revived and an action thereon may be commenced at any time
p=pvided that such action is commenced on or before June thirtieth, two
ti Dusand.
3. This section shall be deemed to provide a right of action
r(-.jardless of whether the injury or death is caused•by"the violation of
a provision which ,-odifies a common-law duty and regardless of.whether
tip injury or death is caused by the violation of a provision
p.Dhibiting activi4ies or conditions which increase the dsnge.�s already
ii'ierent in the work of any officer, member, agent or employee of, any
f.'re department.
S 205-b. Relief of volunteer firefighters engaged in the performance
of duty as such firefighters from civil liability and liability -0,f fire
d::;tricts for the acts of volunteer firefighters. Members of duly"
ojanized volunteer fire companies in this state shall not be liable
c -.Tilly for any ac- or acts done by them in the performance of their
d- --y as volunteer irefighterS, except for wilful negli.gerice or
m=_feasance. Nothi-..g in this section contained shall, in any manner
a.- ect the liability imposed.upon cities, towns and villages by section$
f-IFty-a and fifty -b of this chapter, but fire districts created pursuant
tc law shall be liable for the negligence of volunteer firefighters duly
a-,�ointed to serve therein in the operation of vehicles owned by the
f:. --e district upon the public streets and highways of the•fire district,
