HomeMy WebLinkAbout06-12-2014JUNE 12, 2014 10:00 A.M. SPECIAL TOWN BOARD MEETING The Special Meeting of the Town Board of the Town of Cortlandville was held at the Raymond G. Thorpe Municipal Building, 3577 Terrace Road, Cortland, New York, with Supervisor Tupper presiding. Members present: Supervisor, Richard C. Tupper Councilman, Theodore V. Testa Councilman, Ronal L. Rocco Councilman, John C. Proud Town Clerk, Karen Q. Snyder, RMC Excused: Councilman, Gregory K. Leach Others present were: Town Attorney, John Folmer; Linda Smith from Assemblywoman Barbara Lifton's office. Supervisor Tupper called the Special Meeting to order. Supervisor Tupper explained the purpose of the Special Meeting was for a Home Rule Request by the Town of Cortlandville for the enactment of Assembly Bill A.10050A and Senate Bill 5.7276B. The Home Rule Request would authorize the Town of Cortlandville to alienate and convey certain parcels of land used as parkland and to acquire other parcels of land to replace such parkland. Supervisor Tupper stated that the Bills have been amended. Councilman Rocco questioned what was amended in the Bills. Supervisor Tupper explained that a clause was added that was already in the Bills. Because an amendment was made the Board would have to wait until they see the new Bills to allow Attorney Folmer to review them. Supervisor Tupper suggested the Board recess the meeting and reconvene on Friday, June 13, 2014 at 8:00 a.m. Councilman Proud suggested the Board reconvene after they know that the amended Bills have been introduced in the Assembly and Senate. Discussion continued about what time the Board should reconvene. At this point in the meeting, Linda Smith from Assemblywoman Lifton's office arrived. She provided Town Clerk Snyder with the appropriate paperwork for the Home Rule Request. She explained that once the Bills have been introduced it would be indicated on the Assembly's website. She would contact the Town once the Bills are up on the website. She noted that the Assembly Bill would become A.10050A and the Senate Bill would become 5.7276B. Mrs. Smith explained that the Home Rule Request paperwork could not be completed until after the Bills have been introduced. Mrs. Smith indicated that she would be driving the Town's completed Home Rule Request paperwork to Albany herself. She and Town Clerk Snyder would be in contact to discuss when and where they would meet so she could pick up the completed paperwork. Supervisor Tupper suggested the Board recess the meeting to an unspecified time and date. The Board would reconvene after the Bills have been introduced in the Assembly and Senate. There was a brief discussion regarding how the paperwork for the Home Rule Request should be completed. Mrs. Smith explained that the paperwork could be completed the same day as the Bills are introduced to the Assembly and the Senate. Supervisor Tupper recessed the Special Town Board Meeting at 10:15 a.m. to an unspecified time and date. Supervisor Tupper reconvened the Special Town Board Meeting at 3:00 p.m. on June 12, 2014. Attorney Folmer and Linda Smith were not in attendance at this time. Supervisor Tupper explained that Town Clerk Snyder was in receipt of the final documentation for the Town's Home Rule Request involving Assembly Bill A.10050A and Senate Bill 5.7276B. Town Clerk Snyder would complete the required paperwork. Supervisor Tupper explained that the Bills were now identical. The Assembly amended its Bill once and the Senate amended its Bill twice. 1 1 1 JUNE 12, 2014 SPECIAL TOWN BOARD MEETING PAGE 2 RESOLUTION # 107 ADOPT HOME RULE REQUEST OF THE TOWN OF CORTLANDVILLE Motion by Councilman Testa Seconded by Councilman Proud VOTES: AYE - Tupper, Testa, Rocco, Proud NAY - 0 ABSENT - Leach ADOPTED BE IT RESOLVED, the Town Board does hereby adopt the Home Rule Request of Assembly Bill No. A.10050A and Senate Bill No. 5.7276B authorizing the Town of Cortlandville, in the County of Cortland to alienate and convey certain parcels of land used as parkland to acquire other parcels of land to replace such parkland. No further comments or discussion were heard. Councilman Testa made a motion, seconded by Councilman Proud, to adjourn the Special Meeting. All voting aye, the motion was carried. The meeting was adjourned at 3:05 p.m. Respectfully submitted, Karen Q.
