SPECIAL TOWN BOARD MEETING
12:00 P.M.
The Special Meeting of the Town Board of the Town of Cortlandville was held at the
Raymond G. Thorpe Municipal Building, 3577 Terrace Road, Cortland, New York, with
Supervisor Tupper presiding.
Members present: Supervisor, Richard C. Tupper
Councilman, Theodore V. Testa
Councilman, John C. Proud
Councilman, Gregory K. Leach
Deputy Town Clerk, Kristin Rocco-Petrella
Absent: Councilman, Ronal L. Rocco

Others present were: Town Attorney, John Folmer.
Supervisor Tupper called the Special Meeting to order.
Supervisor Tupper explained that the purpose of the Special Meeting was to award the bid
for the NYS Route 13 Sanitary Sewer Rehabilitation Project to Vacri Construction Corp. for the
Base Bid amount and Alternate #2. The Board had a copy of the bid list as received and filed at the
May 7, 2014 Town Board Meeting.
Attorney Folmer interjected and stated that before doing so the Board must first adopt a
resolution to waive the forms that were not submitted with the bids, which he read aloud.
RESOLUTION # 98 RESOLUTION TO WAIVE IRREGULARITIES WITH
REGARD TO THE BID FOR THE NYS ROUTE 13 SANITARY
TRUNK SEWER REHABILITATION PROJECT

ADOPTED
WHEREAS, it appears that three of the four bidders failed to submit MBE/WBE Forms dealing
with Disadvantaged Businesses, but it also appears that such forms are not required to be
submitted until prior to the execution of a contract, and that one bidder did not respond to
Addendum 1, which did not increase the scope of the work and the information required by the
addendum was included in the scope of the work from that bidder, now therefore
BE IT RESOLVED, the Board considers these irregularities to be minor informalities which the
Board can waive, and by this Resolution adopts that waiver.
The Board discussed awarding the bid for the NYS Route 13 Sanitary Trunk Sewer
Rehabilitation Project to Vacri Construction Corp. for the Base Bid amount and Alternate #2.
Councilman Leach questioned what the difference was between the work to be done
under Alternate #1 and Alternate #2. Supervisor Tupper explained that Alternate #2 called for
the laterals to be replaced, while Alternate #1 was for the laterals to be relined, which was more
expensive. If the Base Bid came in too high, the Town would have left the laterals alone. The
total Base Bid did not include work on the laterals.
Councilman Leach questioned what the problem was that arose with the
telecommunications boxes and the outcome.
Attorney Folmer clarified that Addendum 91 came as a result of a suggestion from one of
the contractors to Rich DeGuida of Clough Harbour & Associates (CHA) that it would be helpful
to know how much it would cost to do the relocations. Addendum #1 asked the bidders to show
the dollar amount for the relocations. It did not increase the scope of the work. Attorney Folmer
explained that when CHA emailed Addendum #1 to the plan holders, the receptionist for Vacri
Construction Corp. received the email and failed to submit it to the proper people. Therefore,
Vacri never saw Addendum #1. Since Addendum #1 did not increase the scope of the work and
the relocations were included in the work that Vacri bid, Rich DeGuida from CHA indicated that
the Board should be able to waive that.

Supervisor Tupper noted that in Vacri's bid, the box was checked that there were no
addendums to the project.
Attorney Folmer mentioned that the bid from Grant Street Construction was $400,000+
more than Vacri's bid. Grant Street attributed $96,000 of its bid to the removal process of the
telecommunications boxes. Attorney Folmer stated that even if you subtracted $96,000 from
Grant Street Construction's bid, their bid would still be $300,000+ higher than Vacri's bid.
Councilman Leach wanted to make sure that Vacri could not claim that they did not
anticipate some of the work to be done once the bid was awarded to them. Supervisor Tupper
stated that it was in the scope of the work that they may have to move the bunkers if Verizon
would not move them voluntarily. The contractor may also have to move a total of 13 vaults as
well because Verizon put the vaults over the Town's sewer line. The work was done within the
New York State Route 13 easement, therefore Verizon did not have to ask the Town permission
to put the vaults over the Town's sewer line.
Councilman Leach was satisfied with the explanations and awarding the bid.

$78.000.00

ADOPTED
WHEREAS, bids were advertised for the NYS Route 13 Sanitary Trunk Sewer Rehabilitation
Project to provide all labor, materials, machinery, tools, equipment, and other means of
construction necessary and incidental to completion of the work shown on the plans and
described in the specifications including but not necessarily limited to the following:
1. Installation of approximately 300 linear feet of 8 inch, 3,275 linear feet of 15 inch,
and 2,650 linear feet of 18 inch diameter Cured -In -Place Pipe (CIPP) lining, with pre -
construction sewer cleaning and CCTV inspection, and post -construction CCTV
inspection.
2. Installation of approximately 275 linear feet of 6 inch, 2,150 linear feet of 8 inch, 400
linear feet of 10 inch, 200 linear feet of 15 inch, and 2,350 linear feet of 18 inch
diameter PVC SDR 35 sewer pipe, and post -construction CCTV inspection.
3. Cutting of any protruding laterals or tree roots prior to CIPP lining.
4. Installation of about 410 vertical linear feet of cementitious manhole lining.
5. Installation of fifteen (15) new pre -cast concrete sanitary sewer manholes.
6. Reconnecting 44 existing laterals to the proposed sewer lines.
7. Installation of 29 waterproof manhole covers along NYS Route 13, to fit under the
existing manhole cover and prevent surface runoff from entering the sewer via the
manhole cover.
8. Proposed Alternate #1: CIPP line all existing sewer laterals along NYS Route 13
from the main line sewer to the property line: 38 short -side laterals and 6 long -side
laterals.
9. Proposed Alternate 42: replace all sewer laterals along NYS Route 13 from the main
sewer line to the property line, where a cleanout will be installed. The short side
laterals can be installed by open trenching replacement methods. The long side
laterals shall be installed by horizontal directional drilling methods under Route 13:
38 short -side laterals and 6 long -side laterals.
10. Bypass pumping of sanitary sewage around sewer construction, as necessary.
11. Maintenance and Protection of Traffic (M&PT), per latest version of NYSDOT
Standard Specification.
12. Complete site restoration.
AND, WHEREAS, sealed bids were opened on April 29, 2014 at 11:00 a.m. and provided to
Richard DeGuida, P. E. of Clough Harbour & Associates, for review as follows:

BE IT RESOLVED, the bid is hereby awarded to Vacri Construction Corp. of One Brick
Avenue, Binghamton, New York, for the Base Bid amount of $2,120,000.00 and Alternate #2 in
the amount of $78,000.00.
No further comments or discussion were heard.
Councilman Testa made a motion, seconded by Councilman Leach, to adjourn the
Special Meeting. All voting aye, the motion was carried.
The meeting was adjourned at 12:07 p.m.
