THIS AGREEMENT made this 31st day of December, 1996, by and between the
TOWN of ENFIELD, a municipal corporation, of Tompkins County, New York,
hereinafter called the "TOWN" and the ENFIELD VOLUNTEER FIRE COMPANY,
INC., a corporation organized under the laws of the State of New York, of the Town of
Enfield, Tompkins County, New York, hereinafter called the "FIRE COMPANY".
AGREEMENT:
WHEREAS, there has been duly established a Fire Protection District which
includes the entire geographic territory of the Town of Enfield and,
WHEREAS, that following a public hearing duly held as provided, for in Section
184 of the Town Law of the State of New York, the TOWN is thereby duly authorized to,
contract with the FIRE COMPANY for fire protection services and emergency service in
case of accidents, calamities or other emergencies in the Enfield Fire Protection District.
NOW THEREFORE, the TOWN, engages the FIRE COMPANY to provide fire
protection and emergency services to the Enfield. Fire protection District fora term ofone
(1) year commencing 1 January 1997 and ending 31 December. 1997 upon the following
terms and conditions:
1. The FIRE COMPANY shall be subject to call for attendance upon any. fire
or emergency or any reported fire or emergency occurring in the district.
2. The FIRE COMPANY shall, when notified by alarm ortelephone call or
otherwise of a fire or emergency or reported fire or emergency occurring in the district,
respond and attend without delay with suitable equipment apparatus, and personnel,
including but not limited to in the case of fire, with pumping and hose apparatus, proceed
with diligence to make every reasonable effort to extinguish said fire and prevent.the loss
of life and/or property in the case of fire; or in the case. of emergency, to react
appropriately to prevent the loss of life.
3. The FIRE COMPANY shall keep and maintain in good'repair and working. .
order, suitable and adequate motorized fire -fighting apparatus, including but not. limited,
to pumpers, tankers, hoses, ladders.. and all other necessary fire -fighting tools, implements
and equipment and emergency service equipment to properly discharge its obligations
hereunder.
4. The FIRE COMPANY agrees to supply the services of a sufficient number
of trained and equipped fire-fighters and emergency medical personnel to properly
discharge its obligations hereunder; utilizing mutual aid when necessary.
5. The FIRE COMPANY agrees to procure, obtain and maintain in full force
and effect during the term of this agreement, sufficient insurance coverage for the fire-
fighting and emergency apparatus and personnel to be used in discharging its duties
herein, including but not limited to personal liability, property damage, collision, and
workman's compensation payable to a volunteer fire-fighter as provided by Section 205
of the General Municipal Law of the State of New York. Proof of said coverages shall- be
provided to the TOWN at the inception of this agreement.
6. The TOWN acknowledges that the FIRE COMPANY is a member of the
Tompkins County Mutual Aid network, and that in the event the fire -fighting apparatus
and personnel of the FIRE COMPANY are out of the district, the FIRE COMPANY shall
arrange through Mutual Aid for fire protection for the district, as herein required, during
its absence.
7. The TOWN agrees, on behalf of the district, to pay the FIRE COMPANY
the sum of one hundred fifty-six thousand, three hundred and seventy-four dollars and no
cents $I56,374.00 payable in four (8)installments as follows: I

In order to receive said payments, the designated fiscal officer of the FIRE COMPANY
shall provide to the Town Supervisor a completed payment voucher one week prior to the
scheduled meeting of the Town Board for each month in which a payment is due.
The parties agree that it is not their intention that the cost to the FIRE COMPANY of
responding to spills or other emergencies involving hazardous materials be covered by the
consideration set forth above, but rather that the FIRE COMPANY may be separately
reimbursed by the TOWN for any such costs of responding to a hazardous materials
emergency from monies which the TOWINT may be able to obtain from other sources,
available to the TOWN, but not available to the FIRE COMPANY. In the event that a
incident of such type should occur, the TOWN shall art in good faith to collect any such
compensation as may become available. However, in the event that the TOWN is
unsuccessful in collecting funds for such an incident, both parties to this contract agree to
abide by a binding decision as to any amount of compensation as -adjudicated by a
committee of five persors two person (s)selected by each party to this
agreement and the�ifth member being#4te—Torrrx'j .A#efffe a member ofthe
County Board of Representatives that represents the Town of Enfield.
8. The TOWN and FIRE COMPANY agree that Eight Thousand Dollars and
no cents ($8,000.00) of the above payment of $156,374,00 shall be set aside in an interest
bearing account and used for the purpose of purchasing replacement emergency
equipment. This paragraph does not however imply, directly or indirectly, approval by
the TOWN BOARD of the acquisition of any equipment.
9. As the fiscal affairs of the FIRE COMPANY and the TOWN are closely
related one to the other, the FIRE, COMPANY agrees not to enter into any obligation for
the purchase of any emergency vehicle without the express written agreement of a
majority of the TOWN BOARD, as evidenced by a properly raised and passed motion of
the TOWN BOARD., if such a purchase would require an increased appropriation by
the Town.
10. The Town agrees that all monies paid hereunder shall be a charge upon the
fire protection district and shall be assessed and levied upon the taxable property in the
district and therefore subject to collection with TOWN taxes.
11. The FIRE COMPANY and the TOWN acknowledge that in performing
the terms of this contract, the FIRE COMPANY is performing an essential public
function which is paid for largely by public funds. The parties agree that it is in their
mutual interest and in the interest of the public to assist each other in maintaining the
public trust. In order to further theseinterests, and assist each other in maintaining the
public trust, the FIRE COMPANY and the TOWN agree to the following:
a. The parties agree to meet a minimum of four times during the year,
or more often, at the request of either party, to discuss the provision of FIRE COMPANY
services as contained herein. Said meetings shall take place as a part of the regularly
scheduled meetings of the TOWN BOARD in March, June, September, and December of
1997. At said meetings, the FIRE COMPANY shall provide to the TOWN BOARD a
written summary of the following:
1. Information as to the number and types of calls/responses made by the
FIRE DEPARTMENT since the last report.
2. A synopsis of staffing and training levels of the FIRE COMPANY,
including a complete listing of all members of the FIRE COMPANY
3 A statement of income and expenses as they relate to the activities of
the FIRE COMPANY under this contract,(.

basis, at the close if the Fire Company's fiscal year, the Fire Company will provide to
the Town Board a statement of outstanding debt
b. The-T04VN may request an ,pay the expense of an independent

FIRE COMPANY pertaining solely to the town funds received pursuant to this contract
and to the use of said funds in the discharge of the obligations contained in this agreement
or any other agreement between the parties since 1 January 1.996-1992.

C. The FIRE COMPANY and the TOWN agree to act in good faith
and to take steps to accomplish the provisions of the preceding paragraph, should the
TOWN elect to exercise its audit rights.. The FIRE COMPANY agrees to provide
reasonable access to necessary audit information, as determined by the independent
auditor, when given reasonable notice of the same. ,The Town specifically acknowledges
the extensive amount of time required for the completion of an audit. Accordingly, any
audit instituted under the terms and conditions of this agreement shall be so conducted so
as to be completed as expeditiously as prudently possible. The TOWN further agrees to
compensate the FIRE COMPANY an amount not to exceed $1,000.00 to offset any
unusual expenses incurred by the FIRE COMPANY in the completion of the
aforementioned audit.
11. The parties acknowledge that this agreement represents the entire
agreement between the parties, superseding any previous agreement (s).
IN WITNESS WHEREOF, the parties have duly executed and delivered this
Agreement the day and year above written, to become effective the first day of January,
1997.

We discussed. at our general meeting on 1/2/97, the issue you raised about the Town Board using
the Enfield Fire -Company meeting room to hold monthly Board meetings during the months of
January through April. Many issues were raised by the membership with specific questions of the
impact on the basic operation of the Fire Company.
With the best interest of the Town in mind, I have been directed, by the membership, to research
what impact this will have on the fire company's operations and to hold off on voting until such
impact study has been adequately completed. A committee has been appointed to investigate the
impact of holding Town Board meetings at the EVFC.
In the interim, we have checked the availability of using the school. It is available for public use
with the only restriction being that the meetings must adjourn by 10:00 p.m. Since I'm sure you'll
want to move on this as quickly as possible (being January), you may contact Amy Ruta in the
school office, for more information and forms to complete.
We thank you for your efforts in working out the issues for the 1997 contract. We also look
forward to working together in 1997 and extend our wishes for a in New Year.

FIRE PROTECTION CONTRACT
TOWN OF ENFIELD
1997
THIS AGREEMENT made this 31 st day of December, 1996, by and between the
TOWN of ENFIELD, a municipal corporation, of Tompkins County, New York, -
hereinafter called the "TOWN" and the ENFIELD VOLUNTEER FIRE COMPANY,
INC., a corporation organized under the laws of the State of New York, of the Town of
Enfield, Tompkins County, New York, hereinafter called the "FIRE- COMPANY".
AGREEMENT:
WHEREAS, there has been duly established a Fire Protection District which
includes the entire geographic territory of the Town of Enfield and,
WHEREAS, that following a public hearing duly held as provided for in Section
184 of the Town Law of the State of New York, the TOWN is thereby duly authorized to
contract with the FIRE COMPANY for fire protection services and emergency service in
case of accidents, calamities or other emergencies in the Enfield Fire Protection District.
NOW THEREFORE, the TOWN, engages the FIRE COMPANY to provide fire
protection and emergency services to the Enfield Fire Protection District for a term of one
(1) year commencing L January 1-997 and ending 31 December 1997 upon the- following
terms and conditions:
I . The FIRE COMPANY shall be subject to call for attendance upon any fire
or emergency or any reported fire or emergency occurring in the district.
2, The FIRE COMPANY shall, when notified by alarm or telephone- call or
otherwise of a fire or emergency or reported fire or emergency occurring in the district,
4. The FIRE COMPANY agrees to supply the services of a sufficient number
of trained and equipped fire-fighters and emergency medical personnel to properly
discharge its obligations hereunder,utilizing mutual aid when necessary.
5. The FIRE COMPANY agrees to procure, obtain and maintain in full force
and effect during the term- of this agreement, sufficient insurance coverage for the fire
fighting and emergency apparatus and personnel to be used in discharging its duties -
herein, including but not limited to personal liability, property damage; collision;; and
workman's compensation payable to a volunteer fire-fighter as provided by Section 205
of the General Municipal Law of the State of New York. Proof of said coverages shall be
provided to the TOWN at the inception of this agreement.
6. The TOWN acknowledges that the FIRE COMPANY is a member of the
Tompkins County Mutual Aid network, and that in the event the fire -fighting apparatus
and personnel of the FIRE COMPANY are out of the district, the FIRE COMPANY shall
arrange through Mutual Aid for fire protection for the district, as herein required,' during
its absence.
7. The TOWN agrees, on behalf of the district; to pay the -FIRE COMPANY
the sum of one hundred fifty-six thousand, three hundred and seventy-four dollars, and no
cents ($156,374.00)., payable in four (8)installments as follows:
1/15/97:$15,000 5/15/97: $10,000
2/15/97: $355040 6/15/97: $30,000
3/15/97: $10,000 7/15/97: $10,000
4/15/97: $35.000 8/15/97: $11,374.
In order to receive said payments, the designated fiscal officer of the FIRE COMPANY
shall provide to the Town Supervisor a completed payment voucher one week prior to the
scheduled meeting ofthe Town Board for each month in which a payment is due:
The parties agree that it is not their intention that the cost to the FIRE COMPANY of
responding to spills or other emergencies involving hazardous materials be "covered by -the
consideration set forth above, but rather that the FIRE COMPANY maybe separately
reimbursed by the TOWN for any such costs of responding to a hazardous materials ,
emergency from monies which the TOWN may be able to obtain from other sources,
available to the TOWN, but not available to the FIRE COMPANY. In the event that a
incident of such type should occur, the TOWN shall act in good faith to collect any such
compensation as may become available However, in the event that the TOWN is
unsuccessful in collecting, funds for such "an incident, =both parties to this contract agree to "
abide by a binding decision as to any amount of compensation
as adjudicated by,a
committee of five persons, two persons selected by each party to this agreement and the
fifth member being a member of the County Board of Representatives that represents -the
Town of Enfield.
8. The TOWN and FIRE COMPANY agree that Eight ThousandDollars and
no cents ($8,000.00) of the above payment of $156,374.00 shall be set aside in an interest
bearing account and used for the purpose of purchasing replacement emergency
equipment. This paragraph does not however imply, directly or indirectly, approval by
the TOWN BOARD of the acquisition of any equipment.
9. The -Town agrees that all monies paid hereunder shall be a charge upon the
fire protection district and shall be assessed and levied upon the taxable property in the . -
district and therefore subject to collection with TOWN taxes.
10. The FIRE COMPANY and the TOWN acknowledge that in performing
the terms of this contract, the FIRE COMPANY is performing an essential public
function which is paid for largely by public funds. The parties agree that itis in their
mutual interest and in the interest of the public to assist each other in maintaining the
public trust. In order to further these interests, and assist each other in maintaining the
public trust, the FIRE COMPANY and the TOWN agree to the following:
a. The parties agree to meet a minimum of four times during the year,
or more often, at the request of either parry, to discuss the provision of FIRE -COMPANY
services as contained herein. Said meetings shall take place as a part of the regularly
scheduled meetings of the TOWN BOARD in February, May, August, and November of
1997. At said -meetings, the FIRE COMPANY shall provide to the TOWN BOARD a
written summary of the following:
1. Information as to the number and types of calls/responses made by the
FIRE DEPARTMENT since the last report.
