HomeMy WebLinkAbout1986-04-141 • 1.83 TOWN OF DANBY TOWN BOARD MEETING MINUTES April 14, 1986 The regular meeting of the Danby Town Board was called to order at 8:00 PM at the Danby Town Hall, 1830 Danby Road, Town of danby, County of Tomp'Kins, New York, April 14, 1986. The pledge of allegiance was led by Supervisor Burdick. Board members present: Councilperson Julia Tagliavento Councilperson.Dorothy Roberts Councilman Ric Dietrich Councilman Ed Shay Supervisor Don Burdick Others present: Bill Scott, Jr., insurance agent, Edward Roberts, Pamela Clermont, Roy Casterline, Frank Proto, Mildred Miller, Ken Coddington, Don Graham, Robert & Elizabeth Roe, Joel Gagnon, Mike Day, Rick Dobson, Judd Leonard, Councilman Dietrich moved to approve the March 10 minutes as presented, seconded by Councilperson Tagliavento, carried unanimously. Privilege of the floor Bill Scott, the town's insurance representative spoke regarding the town' liability insurance. As far as the dog warden being covered, she is covered for liability only as a regular town employee. Mr. Scott explained Miss Bard should have her own insurance policy as well. The town's limit of liability is now at $1,000,000 for judgements; he explained the town does not have extended liability coverage referred to as an umbrella policy. Mr. Scott also mentioned the town does not have public officials liability which provides coverage for a public.official if a claimant comes after the person individually. As far as the Jennings Pond issue; when swimming season starts the town will need to add a binder to cover all activity by the town at the pond; otherwise the state imposes full responsiblity to the town for the pond for liability. If there is an individual who is putting on a program for the residents and using a town facility; they should provide to the town a certificate of insurance showing ot they are insured and the town should set a minimum amount. Mr. Sct gave a brief report on coverages on the Town Buildings, contents, highway equipment and the Water District. Councilperson-Roberts reported the school board elections will be held May 5 1986 at the Danby Town Hall from 12 noon to 9:00 PM. Frank Proto reported from the County Board of Representatives. He has a new list of appointments of vacancies of the County Advisory Board. The reps voted to restore summer jobs for youth. Frank was in touch with the Finger Lakes Parks commission regarding Jennings Pond. The town needs to renew the license to operate the pond as a public park. Supervisor Burdick said he wants to meet with the pond committee to make sure the pond will be ready for swimming before signing the permit. Mike Day, Danby Road, questioned the status of creek damage to his property resulting from Jennings Pond draining out in March. Counciman Dietrich explained he and the highway superintendent looked over all damaged areas along the creek and have drawn up a plan of what the highway department would propose to do to help clean up the properties involved. Rick Dobson voiced opposition to the town trucks working on Jennings Pond as well as on private properties on the pond damage cleanup. Elizabeth Roe, Danby Road, voiced concern over the time frame involved to get the creek cleaned up in addition to clean up to owners' property along the creek. 184 Town Board Meeting - minutes April 14, 1986 Pam Clermont pointed out the Town should make it clear to property owners that the town has no obligation to do this creek clean up. She also pointed out each property owner should sign an agreement they understand the work the highway department proposes to do on their property and the creek. Committee Reports: Community Council: Councilperson Tagliavento reported they are working on the budget and are asking for an additional $1100.00 from United Way. They have put together the summer recreation and swimming budget for this summer which amounts to $8428.500 Zoning: Judd said advertisment for bids to demolish and clean up Margaret Adams property in West Danby has been done. He questioned what specs should be written up for this work. He also questioned what type of action the board would like him to take on BZA violations and trailer violations. There is a violation on Bald Hill Road, regarding a BZA extension; the property owner has gone over the extension and has not applied for a building permit. There is also one on Danby Road, in regards to a trailer violation as.well a health department violation. Councilperson Roberts moved to authorize the Zoning Officer to proceed with legal action on the BZA violation and the trailer violation, seconded by Councilman Dietrich, carried unanimously. Mr. Leonard reported there are two BZA hearings scheduled for April 23. Thomas Cowan, 583 Troy Road is requesting a use variance to construct a medical office on his property for his medical profession. The other appeal is for Robert Edwards in West Danby to operate an auto repair shop on his property. Judd would like board approval to present to the planning board for consideration the rules and regulations for systems of mobile homes, support, manufacture and housing to be put into local law. He would also like board approval to hire an additional building inspector to inspect all rental income properties. He pointed out the additional cost would be reimbursed by the state, The board tabled both decisions for the time being. Planning Board: Don Graham reported the March planning board meeting was cancelled so members could attend two meetings, March 17 & 18 in the Town of Ulysses on planning and zoning. Water District: Roy announced there will be a meeting of the Rural Water Association in Elmira on May 13 at the Holiday _inn, 8:00 AM. He questioned if the Supervisor would be interested in attending this meeting. BZA: Ed Roberts is reviewing a list of new people interested in serving on the I oard of zoning appeals. He will present the names for approval at the next town board meeting. He said he attended the Town of Ulysses planning and zoning meeting and found it to be very educational. Ed also suggested to the board a set of rules on use of the town hall for various activities is needed. The doors are being left unlocked and lights left on. Fore. F4-r� District: Councilperson..:.Dietrich reported the district held their first Fire Safety and Awareness Day at the fire house on April 12. Approximately 170 people attended the educational event. The fire department is looking to build a storage area off the back of the building. Ric mentioned the county youth are still working on their three year budget plan. Rick Dobson voiced his disapproval of the sale of highway equipment in September of 1985. Councilperson Tagliavento moved to approve payment of Warrant #5), West Danby Water District in the amount of $251.55, seconded by Councilman Shay, carried unanimously. Councilman Dietrich moved to accept the Supervisor's reports as presented, seconded by Councilman Shay, carried unanimously. Supervisor Burdick said the board will meet.April 21, 7:00 PM with the residents who received damage to their property to update them on the progress of the clean up. The board will also discuss the bids received on Margaret Adams property and discuss town clerk's hours. Supervisor Burdick also mentioned the town board will meet with the planning board May 5; issues to be discussed will be zoning and planning issues.
