HomeMy WebLinkAbout1986-02-10C • 175 TOWN OF DANBY TOWN BOARD MEETING MINUTES February 10, 1986 The regular meeting of the Danby Town Board was called to order at 8:00 PM at the Danby Town Hall, 1830 Danby Road, Town of Danby, County of Tompkins, New York, February 10, 1986, Supervisor Burdick led the pledge of allegiance. Board members present: Councilperson Judy Tagliavento Councilperson Dorothy Roberts Councilman Ric Dietrich Councilman Edward Shay Supervisor Don Burdick Others present: Roy Casterline, Kenneth Coddington, Judd Leonard, Don Graham, Pamela Clermont, Frank Proto, Joel Gagnon, Edward Roberts, Francis Wright, Milton Todd, Councilperson Roberts moved to accept the January 13 minutes as presented, seconded by Councilperson Tagliavento, carried unanimously. Communications: None Privilege of the floor: Councilperson Roberts read a letter she received from Sam McNeil regarding liab- ility insurance for municipalities. Frank Proto suggested sending a copy of the letter to our insurance representative for his information. Councilperson Tagliavento has spoken with Ed Roberts, chairman of the pond com- mittee, in hopes that the committee will become active once again now that repair of the dam is under way. The committee will meet, January 16, Councilman Dietrich asked the board if they would like news of the board meetings be put in the Ithaca Journal. The board felt reporters for the Journal should attend the meetings to get the information. Frank Proto suggested the town clerk post the minutes in the stores in Danby. Councilman Shay said the highway department needs to replace the present excavator as it is very old and to replace parts would be very costly. He knows of an excavator for sale. Supervisor Burdick said he would look in the budget and check with the bank to see if funding is available for this before going any further. Frank Proto reported the bookmobile in West Danby has ceased; however a mailer is going out to residents in West Danby regarding other options available to them. He spoke with Jesse Miller at the State Parks Office regarding the recent winter thaw and rain which caused excessive run off of the Danby Pond. The state reassured him work will still continue on schedule. Mr. Proto reported the town clerk will be receiving notice from County Board of Reps regarding dog monies from the county in the amount of $422.44 to go to Danby. Frank reported Ben Hogben was appointed to the County Fire & Disastor Advisory Board and Ric Dietrich was appointed to the County Youth Advisory Board, Committee Reports: Supervisor Burdick reported he was in contact with the Department of Environmental Conservation regarding the loss of water from the outer section of Danby Pond during the recent thaw and rain; he was informed the wildlife would not suffer from the amount of water loss. Highway: Pete reported the men are still working on Emery Road; however he is waiting to.hear from Conrail corporation regarding their moving of railroad crossing signs so the road can be widened. Senior Citizens: Councilperson Roberts reported Rhoda Larson is the secretary for the group this year. They have viewed movies for the month of February. Mary Smith is in charge of all trips for the group. Councilperson Roberts reported the town has to develop another election district for Danby as there are too many voters in District #1; new boundary lines are being developed. 176 Page #2 Town Board Meeting Minutes: February 10, 1986 Committe reports, continued. Zoning: Judd Leonard would like to meet with the board and town attorney to discuss zoning matters. Fob Supervisor Burdick congratulated Don Graham its his recent award received by Human Services Coalition for outstanding service. Planning Board: Don Graham reported the board are still working on zoning revisions and hope to present the revised regulation section to the town board for review in the spring. Mr. Graham questioned when the town board was going to act once again on the junk law issue- presented to them in the fall of 1984. Supervisor Burdick said this matter will be tabled for the time being. Water District: Roy Casterline said he would like a copy of the health depart- ment inspection. He reported he will be on vacation the first part of March, and George Armstrong will be in charge. Pam Clermont said the town should look into renting a section of the dog warden's property as this is the legal way for the town to contract for her services . Dog Warden: Miss Bard presented a written report as read by Councilman Dietrich. She received seven complaints for the month, consisting of agressive behavior, dogs harrassing livestock, running at large. She adopted out six dogs. A vet charge of $8.00 is now on top of the $10.00 adoption fee. The vet charge is for vaccinations and worming. Board of Zoning Appeals: Ed Roberts reported the town clerk will be sending a letter out to interested individuals to meet-with the town board to discuss serving on the BZA . The town attorney reported the appeal of Klaus Holand for trailer violation has been sent to Albany. Fire District: Councilman Dietrich reported the fire departent will be holding a Safety Awareness Day April 12, 10 to 2 PM. Programs will consist of groundwater study, fingerprinting and ID's by the Sheriff's Department, informa- tion and referral services. Old Business: A letter will be going out to Margaret Adams regarding the town cleaning up her property once the town clerk receives correct wording.for advertisement in the Journal for contracting of the work. Supervisor Burdick said Resolution #8 needs to be amended as follows: RESOLTUION #16 AMEND RESOLUTION #8. SET MILEAGE FOR TOWN BUSINESS AT .20¢ PER MILE. Moved by Councilperson Roberts Seconded by Councilman Dietrich Roll Call Vote: Dietrich - aye Roberts - aye Shay - aye Tagliavento - aye Burdick - aye Supervisor Burdick reported the town attorney has drawn up the purchase offer to be presented to Rick Dobson for his property. The supervisor will meet with Mr. Dobson sometime this week. The town attorney reported she has spoken with Attorney Abbott regarding the property line dispute between Rhoda Larson and George VanDeMark and a town road. Mrs. Clermont said she is waiting to hear from Mr. VandeMark's attorney on the matter. The town attorney reported Charles Bruce has applied for a health deparment sewer construction permit and in turn Mrs.:Clermont has sent a letter to the health department regarding Mr. Bruce's planned development violations. 0 1 • • Page #3 Town Board Meeting Minutes: February 10, 1986 1_'77 Mrs. Clermont feels this is a good time to start proceedings for violations of their planned development. Mr. Graham said Mr. Bruce should approach the town board to have his planned development rescinded. Supervisor Burdick will have the town attorney send a letter to Mr. Bruce to meet with the planning board, attorney, zoning officer and town board to discuss his planned development. Supervisor Burdick reported he will be out and so moved to appoint Councilman Dietrich Councilperson Roberts, carried unanimously. Warrants: of town for March town board meeting to fill in for him, seconded by Councilman Dietrich moved to approve payment of Warrant #2, General Fund in th.e amount of $19,639.98, seconded by Councilperson Roberts, carried unanimously. Councilman Shay moved to approve payment of Warrant #2, Highway Fund in the amount of $11,156.95, seconded by Councilperson Tagliavento, carried unanimously. Councilman Dietrich moved to approve payment of Warrant #2 .,. West Danby Water District in the amount of $1064.50, seconded by Councilperson Roberts, carried unanimously. Councilperson Roberts moved to accept the Supervisor's reports as presented, seconded by Councilman Dietrich, carried unanimously.
