Thorpe Municipal Building, 3577 Terrace Road, Cortland, New York, with Supervisor Tupper presiding. Members present: Supervisor, Richard C. Tupper Councilman, Theodore V. Testa Councilman, Gregory K. Leach Councilman, John C. Proud Town Clerk, Karen Q. Snyder, RMC Absent: Councilperson, Kristin E. Rocco-Petrella Others present were: Town Attorney, John B. Folmer; Highway Sup't. Carl A. Bush, Jr.; Town Residents, Steve Flatt; Barb Leach, Pat Leach, Andrea Niggli; Pam Jenkins; Cortlandville Town Justice; David Alexander; and Sharon Stevans for Channel 2, Access TV. Supervisor Tupper called the meeting to order. Councilman Proud made a motion, seconded by Councilman Leach to receive and file the Cortlandville Planning Board Minutes of May 23, 2017. All voting aye, the motion was carried. RESOLUTION #119 AUTHORIZE SUPERVISOR TO SIGN PURCHASE ORDER #1376 Motion by Councilman Leach Seconded by Councilman Proud VOTES: AYE — Tupper, Testa, Proud, Leach NAY-0 ABSENT - Rocco-Petrella ADOPTED BE IT RESOLVED, the Town Board does hereby authorize and direct the Supervisor to sign Purchase Order #1376 submitted by Highway Sup't Carl A. Bush, Jr., for the rental of an over the rail roadside mower for one month, to be paid to Tracey Road Equipment for the total amount of $6,800.00. RESOLUTION # 120 AUTHORIZE SUPERVISOR TO SIGN PURCHASE ORDER #1377 Motion by Councilman Leach Seconded by Councilman Proud VOTES: AYE — Tupper, Testa, Proud, Leach NAY-0 ABSENT - Rocco-Petrella ADOPTED BE IT RESOLVED, the Town Board does hereby authorize and direct the Supervisor to sign Purchase Order #1377 submitted by Sup't Highway Carl A. Bush, Jr., for steel plates and beams to replace concrete lids over towns sediment pit for garage sewer system floor drains to be paid to Homer Iron Works, for the total amount of $ 3,550.00. RESOLUTION # 121 AUTHORIZE SUPERVISOR TO SIGN PURCHASE ORDER Motion by Councilman Proud Seconded by Councilman Leach VOTES: AYE — Tupper, Testa, Proud, Leach NAY-0 ABSENT - Rocco-Petrella ADOPTED BE IT RESOLVED, the Town Board does hereby authorize and direct the Supervisor to sign Purchase Order #1375 submitted by Sup't Highway Carl A. Bush, Jr., for repairs to the shared tub grinder with the City of Cortland, the Village of Homer and the Town of Cortlandville to be paid to the City of Cortland, for the total amount of $6,000.00. There were no requests. The monthly reports of the Town Justices for the month of June 2017 were on the table for review and are filed in the Town Clerk's office. Councilman Proud recapped monthly reports are to be submitted to the Supervisors office to be placed on the agenda in order for the Board members to review prior to a Board meeting. Councilman Leach made a motion, seconded by Councilman Proud to receive and file communication from Charter Communications regarding programming dated July 11, 2017. All voting aye, the motion was carried. Councilman Proud briefed the Board on the Source Water Protection Grant being applied for by the Town, to help protect the Lime Hollow well. The grant will be stalled for one year because one of the key requirements is a commitment letter from the landowner. The landowner indicates they would not be able to commit within this fiscal year, but will entertain the offer in the next fiscal year. JULY 19, 2017 TOWN BOARD MEETING PAGE 3 RESOLUTION # 123 ACKNOWLEDGE RECEIVING NOTICE OF PETITION FOR REVIEW OF ASSESSMENTS Motion by Councilman Proud Seconded by Councilman Leach VOTES: AYE — Tupper, Testa, Proud, Leach NAY-0 ABSENT - Rocco-Petrella ADOPTED BE IT RESOLVED, the Town Board does hereby acknowledge, by receiving and filing, the Notice of Petition regarding their current assessment for the following: Walgreens Eastern Co., Inc. RESOLUTION # 124 3948 Route 281 tax map #86.13-01-49.000 ACKNOWLEDGE RECEIVING THE SMALL CLAIMS ASSESSMENT REVIEW PETITION Motion by Councilman Leach Seconded by Councilman Testa VOTES: AYE — Tupper, Testa, Proud, Leach NAY-0 ABSENT - Rocco-Petrella ADOPTED BE IT RESOLVED, the Town Board does hereby acknowledge, by receiving and filing, the Small Claims Assessment Review Petition from John Pellegrino for property located at 4530 McGraw North Road, McGraw, New York, tax map #78.00-01-10.000 regarding their current assessed property value. Councilman Leach made a motion, seconded by Councilman Testa to receive and file an application to the NYS Liquor Authority, dated July 14, 2017 from 281 Bowl, Inc. located at 3898 Route 281. All voting aye, the motion was carried. Councilman Leach made a motion, seconded by Councilman Testa to receive and file an application to the NYS Liquor Authority, dated July 6, 2017 from Statewide Country Music Association, Inc. located at 1804 -1824 Route 13. All voting aye, the motion was carried. Attorney Folmer reported: Gutchess Lumber Park Bonding: Attorney Folmer stated the thirty day Permissive Referendum for the Town's $3,000,000 Bond for the construction of Guthchess Park has expired. He continued by stating Town Clerk Snyder will have the twenty day Permissive Referendum "Summary of Bond Resolution" published on July 21, 2017. Once the twenty day Permissive Referendum is reached and no petition is submitted, Town Clerk Snyder will prepare a Certificate of No Referendum. Gutchess Lumber Park official name: Attorney Folmer relayed he has had discussion with Council for Gutchess Lumber in regards to changing the name of the Gutchess Park to Gutchess Lumber Sports Complex, as agreed July 5, 2017 Town Board Meeting, in order to better reflect the nature of the construction. He suspects there will be no objection to the change as it would be only a minor change to the original contract. Attorney Folmer stated an answer is expected by July 20, 2017 from Gutchess Lumbers Attorney. J JULY 19, 2017 TOWN BOARD MEETING PAGE 4 RESOLUTION# 125 AUTHORIZE SUPERVISOR TO SIGN CONTRACT WITH VIRTUAL TOWNS & SCHOOLS FOR A NEW TOWN WEBSITE DESIGN Motion by Councilman Proud Seconded by Councilman Leach VOTES: AYE — Tupper, Testa, Proud, Leach NAY-0 ABSENT - Rocco-Petrella ADOPTED BE IT RESOLVED, the Town Board does hereby authorize and direct the Supervisor to sign the Virtual Towns & Schools license and agreement to design, support and host a new town website, and it is further RESOLVED, the Town Board does hereby authorize the one-time expense for Design & Development agreed to be paid over a three year payment process for a total amount of $5,495.00 and annual charges of $1,995.00 for Support and Hosting Services, subject to Town Attorney approval. Councilman Proud made a motion, seconded by Councilman Leach to receive and file correspondence dated July 17, 2017 from NYS Homes & Community Renewal regarding approval of "Request for Release of Funds" for the Town -wide Housing Rehabilitation Grant Program #287HR326-16. All voting aye, the motion was carried. Councilman Leach inquired if the rain from the past thirty days had negatively affected Cortlandville. Highway Sup't., Carl A. Bush Jr. responded that the impact on the Town of Cortlandville was minor. No further comments or discussion were heard. Councilman Leach made a motion, seconded by Councilman Proud, to adjourn the Regular Meeting. All voting aye, the motion was carried.
