Planning Board: Don Graham reported they met with Ithaca Theater Lighting
Company regarding their request for amendment to their planned development
to allow for a bakery in the building.
It is the planning board's recommendation that the town board approve the
amendment as follows: 1. The bakery operate between the hours of 6:00 AM
and 10:00 PM. 2. No more than five people work at the bakery at one time.
3. The amount of space needed by the bakery should be left up the Ithaca
Theater Lighting Company.
Mr. Graham said the planning board would like to have a,joint meeting with
the town board to give direction on revisions of the Zoning Ordinance.
Mr. Graham said there is one vacancy on the planning board after the verbal
resignation of Jim Hovance,
Water District: Roy reported the board needs to appoint a water commissioner
for another five year term.
Zoning Board of Appeals: Ed Roberts reported the BZA are still in need of
members. He said Royal Lipscomb has expressed interest in serving on the
BZA.
EMC: Supervisor Burdick read a report prepared:by Herb Engman. His report
explained the status of Jennings Pond.
The town clerk read a letter from Margaret Adams addressed to the town attorney
and requested by the attorney to be read to the town board. After brief
discussion the board agreed the town attorney will address a letter to Mrs
Adams to inform%her of the town's action to take steps in cleaning up her
property.
Pam Clermont suggested a resolution is needed to allow the town clerk to
advertise for bids to contract cleaning up of Mrs. Adams property.

BID OUT FOR CONTRACT TO CLEAN UP
MARGARET ADAMS PROPERTY IN WEST DANBY
AND TO COMPLY WITH SECTION 509 OF THE
ZONING ORDINANCE AS WELL AS CHARGE A
LEIN AGAINST MRS. ADAMS REAL PROPERTY,
Judd Leonard pointed out there are presently violations with Ithaca Lighting
Company and before the town board approves the amendment, the company will
need to comply with the violations. The town clerk will send a letter to
Ithaca Theater Lighting regarding their violations. The town attorney
reminded the town board a public hearing will be needed to amendment the
present planned development.
New Business:
Supervisor Burdick said a resolution is needed to ratify the sale of
a 1946 FWD truck which was sold this fall.

TOWN OF DANBY
SPECIAL MEETING
December 9, 1985
A special meeting of the Danby Town Board was called to order at 7:30 PM
at the Danby Town Hall, 1830 Danby Road, Town of Danby, County of Tompkins,
New York, December 9, 1985. The purpose of the special meeting was to hear
SPCA's presentation to the Town for contracting with them for dog control.
Board members present: Couneilperson Roberts, Councilman Dietrich, Council -
person Mary Oltz, Supervisor Don Burdick.
Absent: Councilman Edward Shay
Others present: Judd Leonard, Bill Farrell, Paul Seeley, Judy;;Tagliavento,
Joel::Gagnon, Lorraine Bard, Robert Roe, Elizabeth Owens -Roe, Gwendolyn Scott,
Robin Remick, Dan Brown, Ronda Engman, Betsy Robinson, Judith Willis, Doug
Robinson, Philip Cohen, Frank Proto, Edward M. Roberts, Roy Casterline,
Mary Casterline,
Mr. Dan Brown, treasurer for SPCA gave a brief presentation. The SPCA has
offered dog control to Danby for a fee of $2380. The fee consists of picking
up of dogs wandering at large, as well as a 24 hour emergency service, seven
days a week.
Joel Gagnon voiced concern over how SPCA handles dog complaints.
Rhonda Engman questioned euthanization procedures by both SPCA and the town's
present dog warden, Lorraine Bard,
Elizabeth Owens -Roe questioned how many dogs on a percentage wise are euthanized
by the SPCA.
With no further comments by the public the meeting was adjourned by Supervisor
Burdick at 8:20 PM.

December 9, 1985
The regular meeting of the Danby Town Board was called to order at 8:30 PM
at the Danby Town Hall, 1830 Danby Road, Town of Danby, County of Tompkins,
New York, December 9, 19856
Board members
present:
Councilperson Roberts,
Councilman Ric Dietrich,
Councilperson
Mary Oltz,
Councilman Edward Shay,
Supervisor Burdick.
Others present: Judd Leonard, William Farrell, Paul Seeley, Judy_
Tagliavento, Joel Gagnon, Frank Proto, Edward M. Roberts, Roy and Mary
Casterline, Pete Coddington, Mildred Miller.
Supervisor Burdick led the pledge of allegiance to the flag.
Supervisor Burdick said there is an error in the October 21, Special
Meeting minutes; correct Councilman Edward Roberts to read Councilman
Edward Shay. Councilman Dietrich moved to approve /__the October 21, Special
Meeting minutes as corrected, seconded by Councilperson Roberts, carried
unanimously.
Supervisor Burdick said Councilman Shay's name was omitted from the November
14 regular meeting minutes and the General Fund Warrant should be corrected
to read $2729.23 as bill,-, #168 and 173 were not paid; moved by Councilman
Dietrich, seconded by Councilman Shay, carried unanimously.
Councilperson Roberts moved to approve the November 14, public hearing minutes
as presented, seconded by Councilperson Oltz, carried unanimously.
Communications:
1. Resolution from Tompkins County Board of Reps on apportionment of
t mortgage tax for Danby. Danby will received $7385.41.
Privilege of the Floor:
Frank Proto presented.to the board the final copy of the Tompkins County
budget for 1986.
Frank reported wells:-,near the Landstrom landfill are being tested by�the
health department.
Mr. Proto also reported Jennings Pond is presently being worked on by
the State Parks office.
Frank reported the bookmobile service to West Danby will be discontinued
as of December 31, 19850
Bill Farrell and Paul Seeley approached the town board regarding the plans
to build a road off Durfee Hill Road according to town specifications.
It is their hope to road will be maintained by the town once built.
Supervisor Burdick suggested the men meet with the highway superintendent
to review the town road specifications. Once the road is completed, it
will need to be inspected by the County.
Committee reports:
Highway:; Mr. Coddington reported the men have been busy patching holes and
building their supply of cinders for the winter.
Zoning: Mr. Leonard reported as of November 1 he has taken in $2,079. in
fees for building permits. Mr. Leonard would like to know the board's action
on Margaret Adams_.property in West Danby. He also reminded the board his
position as Zoning Officer and Ed Hughes' position as building inspector are
up for reappointment in December.
