PUBLIC HEARING
FEDERAL REVENUE SHARING AND PRELIMINARY BUDGET FOR 1986
November 14, 1985
A public hearing was held November 14, 1985 at the Danby Town Hall, 1830 Danby
Road, Town of Danby, County of Tompkins, New York.: The purpose of the hearing
was to hear_all interested persons for or against the preliminary buget and
the proposed use of the federal revenue sharing budget. The meeting was called
to order at 7:35 PM.

Others present: Donald Graham, Donald Burdick, Judy Tagliavento, Joel Gagnon,
Pamela Clermont, Roy & Mary Casterline, Edward Roberts, Francis & Onalee Wright,
Herbert Engman.
The notice of public hearing as advertised in the Ithaca Journal was .read by
the town clerk.
The preliminary budget was summarized by Supervisor Miller. Total appropriations
are $661,506. The amount to be raised by taxes totals $370,755. The tax rate
is -$8.5541,000. West Danby residents will pay an additional $1.95/$1,000 for
water tax. The total tax increase for 1986 amounts to .35/1,00000
The Federal Revenue Sharing budget is as follows:

Councilman Shay voiced concern over the increase in the highway superintendent's
salary from $17,500 to $20,000. He felt the increase was too high and would like
to see the salary dropped to $18,500.
With no further comments the hearingwas adjourned at 7:55 PM

The regular meeting of the Danby Town Board was called to order at 8:03 PM at
the Danby Town Hall, 1830 Danby Road, Town of danby, County of Tompkins, New
York, November 14, 19850

Supervisor Miller requested a correction of the October 14 minutes, page two,
third paragraph; delete the words "rather the town helping ". Councilperson Oltz
moved to approve the minutes as corrected, seconded by Councilperson Roberts,
carried by unanimous vote.
Communications:
1. Memo from Tompkins County Municipal Officers Association. The next meeting
will be held November 20 at Lehigh Valley Restaurant, 6:30 PM. James Mason from
Tompkins County Board of Reps. -.will speak on plans for the new county jail.
2. Memo from City of Ithaca. There will be a presentation on current status on
the Rte 96 alternate plan on November 19, 3 PM at the Court House and also at the
Ithaca High School, 7 PM, that same day.
3. Memo from Board of Reps regarding Herb Engman's term to expire December 31,
1985 as representative on the Environmental Management Council.

Councilman Shay questioned if the board members were aware a 1946 FWD truck /plow,
tow grader and trailer were sold ^ Discussion followed and the matter will.be

Ed Roberts reported,the zoning board of appeals met with Margaret Adams regarding
her property in West Danby and to show cause why her property should not be cleaned
up by the town. Upon agreement between Mrs. Adams' lawyer and the BZA, if no purchase
offer is is made on her property by December 6, the town board may proceed with
action on having her property cleaned up.
The BZA also heard_r the appeal of Loren Stevens, West Danby, for trailer to be
placed on his property for use by his mother, six months a year. The appeal was
granted.
Mr. Roberts also reminded the town board, the BZA is in need of new members.
Frank Proto reported on status of landfill site in Danby. There waskeeting
held at Danby Town Hall in October and was attended by a majority of Spencer
residents.
Mr. Proto presented a copy of the County Budget. He reported the County tax
rate for Danby will be approximately $1.05/1,000.
The Board of Reps. .approved a microwave communication system and one of the ten
towers involved in this system will be located on Durfee Hill Rd. This system
will tie the entire county together for emergency purposes.
Frank said work on the Jennings Pond will begin within a few weeks. The holdup
has been a result of transferring of funds tothe proper accounts. The State
Parks office needs to know when the town would like swimming to begin at the
pond. It will also be up to the town to work on improving the beach front; and
best time to do this work would be while work_.is..progressing on the dam and
the water level is- .down.

ord the State Parks Commission (Jesse Miller) needs a permit from
P hiay department for the time when they hauled gravel from Upper Treman
Park. The problem is the Town of Ithaca wants to haul gravel from Upper Treman
Parks if Danby supplies the permit to Jesse Miller, then Danby will have first
option on the gravel.
Roy Casterline reported the Water District received their annual inspection by the
health department and all is in order.
Herbert Engman gave a brief report for EMC. The discussed the avast disposal system
regarding Landstrom's landfill and whether the landfil site is contaminating area
waters.
Mr. Engman: has been looking into the protection of deer and livestock from dogs
with assistance for the dog warden.
• Judy Willis, Daniel Brown, and Mr. & Mrs. Robinson all spoke of concern over present
dog control in Danby and would like the town to give SPCA a chance to hear their
contract offer.

Committee Reports:
Senior Citizens: Councilperson Roberts reported the group took their last trip
for the year to see a play and dinner in Elmira.
Supervisor, Miller reported the town has an agreement with the County regarding
the Landstrom Landfill site for liability arising out of alleged pollutions.
The town attorney suggests the town request an extended resolution from the
County for increase in liability protection stemming from litter, property damage, etc.
The town attorney suggests the town supervisor go ahead and sign the present
agreement and work on extending the agreement due to anticipated increase in use
of the town roads. The supervisor signed the agreement between the county and
town and asks town attorney to inform the County of the town's intent for an extended
agreement.

ItSuuervisor Miller said "Old Town Road" appears on town map as a maintaind road. There
is land on this road owned by Mr. Johanson and he is trying to sell the land. It
appears to be landlocked because Old Town Road was never dedicated to the town.
The town attorney felt the town has no legal obligation to rescue landlocked property.
Supervisor Miller asked board members if they would consider listening to SPCA's
offer at the December town board meeting along with Lori Bard in attendance.
The board agreed to have representatives from SPCA attend the next scheduled
town board meeting.
Supervisor Miller said a resolution is needed to add unpaid water bills to the
1986 tax roll.

Councilperson Roberts moved to approve.. the appointment of Herb Engman to a two
year term to the Environmental Management Council, term to expire December 31, 1987,
seconded by Councilperson Oltz, carried by unanimous vote..
Supervisor Miller said a resolution is needed to adopt,the 1986 town budget.
RESOLUTION #43 APPROVE TOWN BUDGET FOR 1986 WITH ONE CHANGE TO
LOWER THE HIGHWAY SUPERINTENDENT SALARY TO $18,500.
THE PRELIMINARY BUDGET WAS FOR $20,000..;

Supervisor Miller said Rick Dobson would like to meet with town board members
to discuss purchase offer for his property. Board agreed to meet with Mr. Dobson
on November 21, 7 :00 PM. Board members will also discuss the sale of the highway
equipment as reported by Councilman Shay.

Councilperson Roberts to approve payment of the General Fund Warrant #11

five ayes and no noes.
Councilperson Oltz moved to appoove payment of the Highway Fund Warrant #11 in
iq�� the amount of $5053.16, seconded by Councilperson Roberts. carried by a vote of

Supervisor Miller moved to approve payment of the West Danby Water District Warrant
g 3�- #11 in the amount of $155,92, seconded by Councilman Shay, carried by a vote of
five ayes and no noes.
Councilman Shay moved to approve the Supervisor's reports as presented, seconded
by Councilperson Roberts, carried by unanimous vote.
Supervisor Miller said a resolution is needed to approve the highway CSEA contract.

Supervisor Miller submitted her resignation to the board effective November 15, 1985.
Motion to.:.accept Supervisor's resignation made by Councilperson Oltz, seconded by
Councilman Shay, carried by vote of five ayes and no noes.
Supervisor Miller moved to appoint Don Burdick to fill Supervisor's position
effective November 15 to such time as when Mr. Burdick will take over the duties
as the elected choice January 1, 1986, seconded by Councilperson Roberts, carried
by vote of five ayes and no noes.
At 9:45 PM, Supervisor Miller moved to adjourn the meeting seconded by Council-
person Oltz, carried by unanimous vote.
