PUBLIC HEARING
SEWER RENT INCREASE FOR INDUSTRIAL USERS
A Public Hearing was held by the Town Board of the Town
of Cortlandville on December 19, 1990 at,5:30 p.m. at the
Town Hall, 15 Terrace Road, Cortland, New York for the
proposed increase of sewer rents for industrial users in the
Town of Cortlandville. .
Members Present: Supervisor Melvin Pierce
Councilman Raymond Thorpe
Councilman Edwin O'Donnell
Councilman Ronal Rocco
Councilman Theodore Testa
Town Clerk Pauline Parker
Others present were Attorney, Phillip Rumsey; Highway
Supt., Carl Bush; Newsreporter, Laura Jones and Mr. Fred
Craft and Lois Schmeider.
Supervisor Pierce called the Public Hearing to order at
7:30 p.m.
The Town Clerk read the legal notice as posted and
filed.
Councilman O'Donnell asked how our industrial rate
compared to others.
It was reported that when rates were originally set,
they were about the same, but a comparison was not done at
this time.
No other comments or questions were heard.
Councilman Thorpe made a motion, seconded by Councilman
Testa, to adjourn the Public Hearing. All voting aye, the
motion was carried.
The Public Hearing was closed at 5:35 p.m.

TOWN BOARD MEETING
The Regular Meeting of the Town Board of the Town of
Cortlandville was held at the Town Hall, 15 Terrace Road,
Cortland, New York on December 199 1990 at S:30 p.m. with
Supervisor Melvin Pierce presiding.
Members present: Supervisor Melvin Pierce
Councilman Raymond Thorpe
Councilman Edwin O'Donnell
Councilman Ronal Rocco
Councilman Theodore Testa
Town Clerk Pauline Parker
Others present were: Town Attorney, Phillip Rumsey;
Highway Supt., Carl Bush; Nancy Jarvis of the Cortland
County Planning Dept.; Todd Miller of US Geo Survey; Carl
Schepillo of NYS-DEC; James Feuss of the County Health
Dept.; Newsreporter, Laura Jones and Frederick Kraft and
Lois Schmeider.
The meeting was called to order by Supervisor Pierce at
7:30 p.m. with the pledge of allegiance, followed by a
Public Hearing for a proposed increase of the sewer rent for
industrial users of the Town.
Councilman O'Donnell made a motion, seconded by
Councilman Thorpe, to approve the minutes of March 7, 1990;
(larch 21, 1990; April 4, 1990; April 18, 1990; May 2,
1990; flay 16, 1990; November 07, 1990 and November 20,
1990. All voting aye, the motion was carried.
RESOLUTION #319 AUTHORIZE PAYMENT OF VOUCHERS FOR
DECEMBER
Motion by Councilman Thorpe
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the vouchers submitted have been
audited and shall be paid as 'follows:

of the floor to
Nancy Jarvis.
She introduced
Todd Miller of the US
Geological Survey
from the Ithaca
Office. Mr. Miller has
been involved with
conducting the
Otter Creek / Dry Creek
Remedial Investigation,
concerning
the settlement with Smith
Corona.
Mr. Miller
showed a slide
presentation of the
monitoring of
pollution in the
area, since 1986 to the
present time.
He advised
of the importance
of protecting our well
head area and
the need for careful
planning of future
development. The
location of our new
well is away from the
current problem,
however it still needs
to be protected.

A discussion was held with James Feuss
and Nancy Jarvis
concerning
the types of development that
could occur over
our aquifer
and those that should not. Allowing growth that
damaged or
polluted our water supply is a
real concern and
could also
effect the supply of neighboring
municipalities.
It is
.information
the desire of everyone to
as possible to the public and property
provide as much
owners of
proper uses
of the land over the Aquifer.
Carl Schepello of the NYS DEC explained his involvement
of investigating the lands on South Hill, which used to be
used as a dump. He has found some barrels that contain
hazardous waste,. It may have been legal to'place it there
at the time, however it is necessaryto proceed at this time
to check what may be there. The dump was closed in 1972.
,A discussion was held whereby it was decided that the
land should be posted by the Town, and make sure that the
gates -are locked -as someone is dumping.garbage there now.
A letter,should be forthcoming from -the state advising
the Town of their findings and procedures -•.to follow.
Reports will be forwarded from both the County Health Dept.
and the NYS DEC.
Councilman Testa made a motion, seconded by Councilman
Thorpe, to receive and fi-le� the temporary agreement with
Nancy R. Ambrose of Renaissance .1 Subdivision. All voting
aye, the motion was carried.
The agreement allowed the Town to operate the pump
located at the base of the subdivision to provide town water
to. the Mitchell residence.
Councilman Testa made a motion, seconded by Councilman
Rocco, to receive and -file a copy of the letter sent to the
County Health Dept. from Resource Associates. All voting
aye, the motion was carried.
The letter advised of the status for the Renaissance
Subdivision, Sections-1 and 11 in regards to water lines and
erosion.
Councilman O'Donnell made a motion, seconded by
Councilman Testa, to receive and file a copy of the letter
sent to the Cortlandville Planning Board from the law firm
of Costello, Cooney & Fearon. All voting aye, the motion
was carried.
The letter included information for the SEORA process
regarding the. Cortland Housing Group :Conditional Permit
Application.
RESOLUTION # 320 APPROVE CHANGE ORDER FOR NORTHWEST WATER
PROJECT AND!BELL•DRIVE AND MARYLAND AVE.
SEWER PROJECT
Motion by Councilman O'Donnell
Seconded by Councilman. -Thorpe
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the change order No. one for Northwest
Water Project,. Bell Drive :and Maryland Ave. Sewer
Improvement Project in the amount.of . $1b,450.1B is hereby
approved.

RESOLUTION #321 APPROVE AQUIFER SPECIAL PERMIT #8
OF 1990 - PALL TRINITY MICRO CORP.
Motion by Councilman O'Donnell
Seconded by Councilman Thorpe
VOTES: ALL AYE ADOPTED
WHEREAS, this Town Board duly held a Public Hearing on
December 5, 1990 regarding the application of Pall Trinty
for an Aquifer Special Permit, and
WHEREAS, the Town Board declared a negative impact for such
project, and the project has been approved, subject to
conditions by the Town Planning Board,therefore
BE IT RESOLVED, that the Town Board does hereby approve the
Special Permit #8 of 1990 for Pall Trinity Micro Corp.
subject to the applicant receiving approval of the Cortland
Wastewater Treatment Plant for discharge into their
facility.
RESOLUTION #322 APPROVE AQUIFER PERMIT #7 OF 1990 TO
FRED KRAFT ON LUKER ROAD
Motion by Councilman Thorpe
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, this Town Board duly held a Public Hearing on
December 5, 1990 regarding the application of Fred Kraft for
a Special Permit to construct an office building on the
Luker Road, and
WHEREAS, a Negative Impact was declared for this project and
the project has been approved by the Town Planning
Board,therefore,
BE IT RESOLVED, that the Town Board does hereby approve
Special Permit #7 of 1990 for Fred Kraft.
A discussion was held concerning the portion of the
personnel policy regarding the requirement for a physical
for all new employees hired. It shall remain in affect.
No action was taken.
RESOLUTION #323 APPROVE TO AMEND SEWER RENTS FOR
INDUSTRIAL USERS
Motion by Councilman Thorpe
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, by March 4, 1981 amendment to the Sewer Ordinance,
originally enacted September 30, 1957, authorization was
given to the Town Board to establish sewer rents from time
to time by resolution after public notice and hearing, and
WHEREAS, a Public Hearing, upon due notice, was held by the
Town Board of the Town of Cortlandville at the Town Hall on
December 19, 1990 in the matter of amending said sewer rents
for industrial users, and
WHEREAS, the Town Board deems such proposed sewer rents to
be in the best interests of the Town and sewer users
therein, now therefore

BE IT RESOLVED, that the following sewer rents for
industrial users shall be charged:
Industrial Users - $.95 per one thousand (1000) gallons
of consumption per quarter for all water consumed.
Councilman Rocco asked if the Code of Ethics of the
Town is being reviewed to be updated.
Supervisor Pierce stated that the Town's Personnel
Policy needed to be totally reviewed and updated.
A discussion was held concerning an emergency water
connection between the Village of Homer and the Town. It
will be necessary to install a meter to accomplish this.
Supervisor Pierce apprised the Town Board of -the status
of the pump at the Renaissance property,
No action was taken.
RESOLUTION # 324 APPROVE PLUMBERS APPLICATION OF
GEORGE MASLER
Motion by Councilman Thorpe
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, an application has been received from George Masler
to be approved to make water and sewer connections within
the Town, and
WHEREAS, such application has been reviewed, therefore
BE IT RESOLVED, that the Town Board does hereby approve
George Masler to install water and sewer connection within
the Town.
RESOLUTION # 325 APPROVE PLUMBERS APPLICATION OF
RICHARD JOHNSON
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
WHEREAS, an application has been received from Richard
Johnson to be approved to make water and sewer connections
within the Town, and
WHEREAS, such application has been reviewed, therefore,
BE IT RESOLVED, that the Town Board does hereby approve
Richard Johnson to install water and sewer connections
within the Town.

RESOLUTION #326 AUTHORIZE SUPERVISOR TO EXECUTE
CONTRACTS FOR 1991
Motion by Councilman Thorpe,
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Supervisor is hereby authorized to
execute contracts for the year of 1991 with Ryan and Rumsey,
Cortland County SPCA, Cortland Free Library, Lamont
Memorial Library, Hayes Ambulance and Atlantic Inland.

RESOLUTION #327 SET DATE OF JANUARY 2, 1991 AS THE
ORGANIZATIONAL TOWN BOARD MEETING
Motion by Councilman O'Donnell
Seconded by Councilman Thorpe '
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Organizational Town Board Meeting
shall be held on January 2, 1991 at 7:30 p.m.
A discussion was held about the easements for the
Branchini water and sewer project.
Supervisor Pierce apprised the Town Board that a member
Of the Cortland County Sheriff's Dept. has requested
information regarding enforceability of Handicap Parking and
parking in the fire lanes within the Town.
We do not have a local law for this at the present
time.
Supervisor Pierce advised that a representative of
General Codes will be here tomorrow for the editorial
conference.
Councilman O'Donnell made a motion, seconded by
Councilman Rocco to adjourn the meeting. All voting aye,
the motion was carried.
The meeting was adjourned at 7:30 p.m.
