TOWN BOARD MEETING MINUTES
September 9, 1985
The regular meeting of the Danby Town Board was called to order at 8:00 PM
at the Danby Town Hall, 1830 Danby Road, Town of Danby, County of Tompkins
New York, September 9, 19850
Board members present: Councilperson Dorothy Roberts
Councilperson Mary Oltz
Councilman Ric Dietrich
Councilman Edward Shay
Supervisor Mildred Miller
Others present: Laurence Knuutila, Joyce Knuutila, Alton Jackson, Doug
Gillogly, Gary Bortz, Roger ;V Joan Grant, John Shepardson, Valerie Shepardson,
John Shepardson, Jr. Debbie Maycumber, Ronald Maycumber, Ray Babbitt, Judd
Leonard, Roy Casterline, Pam Clermont, Joel Gagnon, Don Graham,
Councilperson Oltz said the August 12 minutes needed one correction, to
add Supervisor Miller's name under Board members present as it was omitted.
With above correction, Councilman Dietrich moved to approved the minutes
seconded by Councilperson Roberts. Adopted: Dietrich

Communications:
1. Letter from Board of Representatives to Bill Mobbs, Commissioner of
Public Works, Tompkins County regarding the closing of Caswell Road
Landfill, voicing concern as to'-iahose responsibility it is to police
and maintain access to the Landstrom Landfill,
2. Letter from Board of Representatives to Jack Miller, Tompkins County
Fire & Disaster Coordinator regarding fire protection at the Landstrom
Landfill site.
Privilege of the Floor:
Frank Proto gave brief report for County Board of Representatives. There
will be no policing on Michigan Hollow Road, when Landstrom Landfill takes
Caswell Road Landfill trash;However, the county will provide legal defense
for any lawsuits arising out of Landstrom Landfill.
Maps on proposed bids for work on Jennings Pond have been distributed and
biA opening will be September 10. Work should begin this fall .
Ed Roberts reported he is still obtaining estimates for painting of the
Town Hall,
Mr. Gillogly, the Knuutila's, Mr. Bortz, and the Grants, all of Michigan
Hollow Road all spoke of concern of the increased traffic and mess the
road will receive once Caswell Road Landfill is closed in October.
John Shepardson spoke in regards to the proposed junk law going to public
referendum this November; he questioned why the vote to have a zoning
ordinance wasn't going to also be put on the November ballot.
Joel Gagnon reported the issue of cleanup of the Margaret Adams property
in West Danby has gone to the Zoning Board of Appeals.
Ray Babbitt reported the highway department purchased a new plow. The
men have been cleaning brush on Michigan Hollow Road and preparing the
road for oiling and stone. Mr. Babbitt met with Glenn Grossmann of Howland
Road. Mr. Grossmann is requesting the highway department maintain John
Hill Road year round ag he would like to put his driveway out thru his
property which runs on John Hill Road.

Pam Clermont voiced concern regarding an Ithaca College Fraternity having
parties on their property located on Steam Mill Road. After such parties
there is litter strewn all over the road. Supervisor Miller suggested
Mrs. Clermont, as town attorney, address a letter to the fraternity
alerting them of this problem.
Mrs. Clermont also said thertwill be a Supreme.Court ruling on the Klaus
Holand case pertaining the voting down by the BZA board for allowing a
trailer to be placed in Danby. The hearing is scheduled for September 13.
Ric Dietrich reported Community Council is planning youth programs for the
upcoming fall and winter.

programs.

Councilperson Roberts reported the Senior Citizens have a trip planned to
Jamesville scheduled for September 22.
Mr. Jackson asked the board members if they have made any decision as to
whether the road he resides on will be maintained year round (Emery Road).
Supervisor Miller stated that for the time being the road will be widened
to allow for snow plow access and road will be cleaned and gravelled.
The board requested Mr. Babbitt meet.with County highway department to
look over Emery Road to determine amount of work needed on the road.
Discussion followed on proper facilities for a dog kennel for Danby. The
state has mandated the town comply with state regulations. Miss Bard
checked into prices for building that would comply with state regulations.
Grossman's have a building that can be constructed for $1400; there would
be additional costs for concrete floor. A second building could be built
for $5700 which includes. insulation and floor.
Councilman Dietrich questioned the legalities of having a town dog kennel
on private property. After brief discussion the board tabled any decision
on building the facilities.
Supervisor Miller said a resolution is needed to appoint an election inspector
to replace Irene Mohlar who has moved out of the area

Supervisor Miller said a resolution is needed to pay Susan Hautala $150.00
for purchase of a cabinet to store historical items in for -he town.
The cabinet will be placed at the town hall.

Discussion followed on the number of trailers placed in Danby that are in
violation. Edward Roberts pointed out there are at _least four that are
beyond their eighteen months extension. Supervisor Miller asked Mr. Leonard
to compile a list of owners who are in violation and submit to town attorney
for her handling.
Supervisor Miller moved to authorize zoning officer to submit list of property
owners who have trailer violations to town attorney, seconded by Councilman

The town clerk read a letter from Moses Peter donating $500.00 to the Town
Historian to initiate a permanent display of historical memorabilia, and
to be used solely at the town historian's discretion.
Supervisor Miller has.reque ted Cuncilperson Oltz and town attorney, Pam
Clermont to meet with Scott e M 00
regarding county insurance and legal defense
regarding the Landstrom Landfill issue.
Supervisor Miller reported Mr. Dobson has refused the purchase offer on the
purchase of the present highway barns. He does not want the building and
prefers the town to purchase his land for $35,000; he would like a down
payment of $500, and the balance in sixty (60) days.
After brief discussion the board agreed to make another purchase offer
for less ($25,000) to be handled by the town attorney. Councilman Shay
voiced dissatisfaction over the way the highway barns is being handled.
Supervisor Miller said it is budget time again and the board needs to have
a budget workshop soon. After brief discussion the board agreed to hold
a,;workshop on September 19, 7:00 PM.

At 9:50 PM, Councilman Dietrich moved to adjourn the meeting, seconded by
Councilperson Oltz. carried unanimously.
