HomeMy WebLinkAbout1985-08-12TOWN OF' DANBY TOWN BOARD MEETING MINUTES AUGUST 12, 1985 The regular, meeting of the Danby 'Town Board was called to order at 8:00 PM at the Danby Town Hall, 1830 Danby Road, Town of Danby, County o' Tompkins New York, August 12, 19850 Board members present: Councilperson Mary Oltz, 4_ �/)/Z ((c:LUCL yf Y L (%r� Councilperson Dorothy Roberts Councilman Edward Shay Absent: Councilman Ric Dietrich Others present: Lorraine Bard, Roy & Mary Casterline, Frank Proto, Judd Leonard, Robert Dutcher, Joan Bordenet, Helen Muhdel, Joel Gagnon, Mr. & Mrs. Alton Jackson, Ray Babbitt, Pamela Clermont Supervisor Miller said the July 8 minutes should be corrected to read, Warrant #7, Federal Revenue Sharing total is $500.00, West Danby Water District Warrant �f7 total to read $150.90, and General Fund Warrant correct total should read $1327.08. Councilperson Roberts to accept the minutes as corrected, seconded by Councilperson Oltz. Adopted: Oltz - aye Roberts - aye Shay - aye Miller - aye Communications: 19 Letter from SPCA requesting the town enter into a dog control program with them for 1986. annual amount would be $2.383.00 for basic dog control, ie., pick -up of dogs, special patrols for known at large dogs, 7 issuance of appearance tickets for unlicensed dogs. All other towns in Tompkins County will need to enter into their program in order to offer the above annual fee. 2. Letter from Don Graham, Chrmn, Planning Board, regarding Lots for sale on Steam Mill Road. The planning board recommends the town board send a letter to the property owner, Dr. L. 0. Nezvesky making him aware of required road frontage needed for building lots. 3. Letter from Don Graham, chrmn, planning board, regarding putting the proposed junk law up for referendum this November election. Following the referendum, if the town board makes revisions, it would be put to a public hearing, and the board would vote to approve or disapprove the proposed.junk law. The town attorney's opinion.is the town board will not be bound by whatever the results of the referendum. 4.. Letter from County Rep, Frank Proto, advising the town that Tompkins County Arts Council has available funds to bring certain types of art events to each municipality. 5. Minutes of West Danby Water District were presented. Privilege of the Floor: Tie Town Clerk requests the clothes stored in the basement of the town hall pw taken out as they are drawing mice into the building. Moved by CLp. Oltz, and seconded by Clp. Roberts, to have custodian remove- the clothing. Councilperson Oltz voiced concern over the closing of the Caswell Road Landfill in Dryden scheduled for October. The Landstrom Landfill in the town of Danby will be receiving this additional trash and wondered whether the County will be taking over the maintenance of Michigan Hollow Road. Lorraine Bard reported things have been quiet with dog control. Her facilities were inspected two weeks ago by the state inspector. The inspector reminded her she will need to improve the facilities by October (housing) Discussion followed on redoing the present building to pass state regulations, or to build a cement structure either on her property or a designated location. Town Clerk presented pictures of a dog kennel in Candor which meets state regulations, consisting of 6 stalls and made of concrete blocks. 132 Frank Proto gave a ..report on what has been happening at the County Board of Representatives. He mentioned when the Caswell Road Landfill is closed Danby (Landstrom Landfill) will receive, about 80% of County's trash. Brush type material will still go to Caswell Landfill. Mr. Proto will be at the Danby Fire Station, August 21, 5 to 8 PM to hear concerns from area residents. He also reported a petition was placed at Benjamin's One Stop and Pyps regarding keeping the Bookmobile in Danby. 106 signatures were received and it now stands that the Bookmobile will continue to come to Danby, but residents in West Danby will lose the service. Highway: Ray Babbitt reported they paved part of East Miller, Sandbank Roads, They replaced pipe on Sandbank and King Road.. Corimunity Council: Joan Bordenet reported they had 54 children enrolled in the summer recreation program; swimming was offered twice weekly and held at Buttermilk: Park. Alton Jackson requested to the board members to consider yearly maintenance of Emery Road in West Danby. This road presently is classified as seasonal use. He plans to build a home on this road and his mortgage company requests the road be maintained year round. Zoning: Judd Leonard reported at last month's board meeting, Pamela Clermont reported an abandoned home on Troy Road was being occupied. Mr. Leonard checked this out and said the home owned by Gerald Baker has been purchased by Thomas West. The West's are not living in the dwelling, but are renovating it. Supervisor Miller reminded the board there will be a meeting September 18 at 7:30 PM with the planning board 12 a presentation of Lickbrook as a.natural history center. -7� o vie Supervisor Miller said there will be a special meeting with the board members on August 26, 7:30 PM to discuss Mr. Jackson's request of Emery Road, the proposed junk law, and facilities for a dog kennel. Discussion followed on planning board's request to have town board notify Dr. Nezvesky of zoning regulations in relation to his lots.for sale on Steam Mill Road. Supervisor Miller said since Judd Leonard has spoken to Dr. Nezvesky about this matter, there is no need to pursue the matter any further. The board discussed briefly the proposal made by the Tompkins County SPCA to contract with Danby for dog services. No d!�cisi.ons were made at this time. The town clerk read a report from Ed Roberts regarding care of town hall. He is presently getting estimates for painting the outside of the town hall. Mr. Roberts also prepared a report on status of board of zoning appeals. The report as read by town clerk mentioned the board would like status of Chuck Bruce's trailer, the Dorn trailer, and Davenport trailer. The matter if removing these trailers should be taken care of soon The BZA would like the Maycumber trailer on Comfort Road be checked out as their 18 month's variance. is up. The BZA held a hearing on July 24 to consider the appeal of Klaus Holand to place a trailer on his property on Danby.Road. He was denied a permit as the board did not feel there was sufficient hardship to grant a variance. Discussion.followed.on board's decision on cleanup of Margaret Adams'. property in West Danby. RESOLUTION # 31 AUTHORIZE TOWN BOARD TO NOTIFY MARGARET ADAMS TO APPEAR BEFORE "ZONING BOARD OF APPEALS TO SHOW CAUSE WHY TOWN BOARD SHOULD NOT CONTRACT PRIVATELY TO_DEMOLISH AI4D /OR REMOVE DWELLING ON HER PROPERTY AND FILLING IN OF EXCAVATION SITE WITH FILL LOCATED AT VALLEY VIEW ROAD, PARCEL #l'j -1 -23 AND FURTHER WHY ANY EXPENSE INCURRED BY THE TOWN BOARD IN ACCOMPLISHING SUCH WORK SHOULD NOT BE ASSESSED BY THE TOWN BOARD AGAINST THE REAL PROPERTY OF MARGARET ADAMS, ACCORDING TO SECTION 509 OF THE DANBY ZONING ORDINANCE. • 133 Moved by Councilperson Roberts, seconded by Supervisor Miller. Roll call vote: Oltz - aye Roberts - aye Shay - aye Miller - aye Councilperson Oltz moved to approve payment of Highway Chips Warrant #8 in the amount of $31,604.34, seconded by Supervisor Miller, Adopted: Oltz - aye Roberts - aye Shay - aye Miller - aye Councilperson Roberts moved to approve payment of Highway Fund Warrant in the amount of $7,460.79, seconded by Councilman Shay, Adopted: Oltz - aye Roberts - aye Shay - aye Miller - aye Councilman Shay moved to approve payment of the General Fund Warrant #8 inthe amount of $1844.90, seconded by Councilperson Roberts. Adopted;.Oltz - aye Roberts - aye Shay - aye Miller - aye Supervisor Miller moved to approve payment Fund Warrant #8 in the amount of $357.03, Adopted: Oltz - aye Roberts - aye Shay - aye Miller - aye of the West Danby Water District seconded by Councilperson Roberts. Supervisor Miller moved to approve payment of the Federal Revenue Sharing Fund Warrant #8 in the amount of $215.00, seconded by Councilperson Oltz. Adopted: Oltz - aye Roberts - aye Shay - aye Miller - aye Councilman Shay moved to approve the Supervisor's reports as presented,seconded by Councilperson Oltz.
