Town of Danby Planning Board
July 17, 1985

The meeting was called to order at 7133 P.M.
Minutes of the June meeting were approved.
Privilege of the Floors
Joel brought up the question of the Junk law, since if we were to do
anything to it prior to its going to referendum, if indeed it was going
to go to referendum, we needed to get to it. There ensued a discussion
of whether or not it was legal to put it to referendum, and in what
form it should be put, if at all. Don thought that only the general
question could be put on the ballet in November, such as "Do you think
the Town of Danby should have a junk law ?" Joel thought that would
be of little help to the Town Board, which has to vote on a particular
version of a junk law. Most of us believed that any referendum would
be advisory, with the Town Board having to make the.decision in the end.
We agreed that Don should contact the Town Attorney to clarify the op-

in order to ad ress some of the criticisms that were made at the public

hearing last spring. No one else agreed. It was generally felt that
we had been around and around on it as much as was useful, and that
we were as close to agreement as we were going to get. Mildred said

The question of Steam Mill Road plots came up again. Mildred said that
If the Planning Board wants the Town Board to act on.a recommendation,
then it should be communicated to the Board in writing. Don agreed to
draft a letter to the Town Board advising them that it was our recom-
mendation that the owner of the Steam Mill Road land be advised of
zoning restrictions on construction of residences on the plots for sale
there (you can't get a building permit to build a house in Danby unless
you have 150 feet of frontage on a public road). [(S retar 's n I s
