SPECIAL TOWN BOARD MEETING
The Special Meeting of the Town Board of the Town of Cortlandville was held at the
Raymond G. Thorpe Municipal Building, 3577 Terrace Road, Cortland, New York, with
Supervisor Williams presiding.
Members present: Supervisor, Thomas A. Williams
Councilman, Jay E. Cobb
Councilman, Douglas E. Withey
Town Clerk, Kristin E. Rocco-Petrella
Absent: Councilman, Theodore V. Testa
Councilman, Jeffrey D. Guido
Others present were: John A. DelVecchio.
Supervisor Williams called the special meeting to order. He explained the purpose of the
meeting was for the appointment of a Town Attorney. The appointment would typically occur at
the organizational meeting of the Town Board, however since that meeting would not occur until
after the Town Zoning Board of Appeals and Town Planning Board conducted their first meeting
of the year on January 7, 2020, there was urgency in making the appointment.
Supervisor Williams read the proposed resolution aloud to those in attendance, which
called for the reappointment of John A. DelVecchio, Esq. as Town Attorney for a two-year term.
Councilman Withey stated that he would like to appoint Attorney DelVecchio for a one-year
term similar to his initial appointment. Town Clerk Rocco-Petrella commented that the initial
appointment of Attorney DelVecchio was to fill the vacancy of the previous Town Attorney
which was for the remainder of the term and stated that the appointed Town Attorney is typically
a two-year term. There was a brief discussion regarding the difference between the Office of
Town Attorney and retaining an attorney as an independent contractor.

Motion by Councilman Cobb
Seconded by Councilman Withey
VOTES: AYE – Williams, Cobb, Withey NAY – 0
ABSENT – Guido, Testa
ADOPTED
BE IT RESOLVED, the Town Board of the Town of Cortlandville does hereby reappoint John
A. DelVecchio, Esq. as Town Attorney for a two-year term (per NY Town Law § 24)
commencing January 1, 2020 until December 31, 2021.
No further comments or discussion were heard.
Councilman Cobb made a motion, seconded by Councilman Withey, to adjourn the
Special Meeting. All voting aye, the motion was carried.
The meeting was adjourned at 4:07 p.m.
