The hearing County of Tompkins on at 7:35 PM. Board Members present: Absent: April 8, 1985 Town of Danby, #3, a Local Law was held at the April 8, 19850 held a public hearing to consider establishing Flood Damage Pre - Danby Town Hall, 1830 Danby Road, The hearing was called to order Councilperson Dorothy Roberts Councilman Ric Dietrich Councilperson Mary Oltz Supervisor Mildred Miller Councilman Edward Shay Others present: Judy Tagliavento, Joel Gagnon, Roy Casterline, Edward M. Roberts, Lorraine Bard, William Genter, Bertha Griffen,Donald Graham, Juddson Leonard,Alan Roland, Walter & Carol Sczepanski, Frank Proto. The town clerk read the notice of public hearing as advertised in the Ithaca Journal. Supervisor Miller introduced Mr. Alan Roland, assistant sanitary engineer from the Department of Environmental Conservation. Mr. Roland explained if the town did not pass the Local Law, which is required to maintain elegibility in the Flood Insurance Program, the Federal Emergency Management Agency will withdraw the community from the program. One of the stipulations of the Flood Insurance Program is any Federal lending institution requires the applicant to have flood insurance on the property. If the community has not adopted the Flood Law, the transfer of property within a flood plan area can be hampered by the fact no federall, backed loan can be granted. He also pointed out if there is a federal flood disaster declared in a community and it does not participate in the flood insurance program, then the community can- not receive any federal funds for relief under the disaster act. Mr. Roland pointed out Danby is considered a minor flood prone area. Donald Graham said he feels the town would be better off managing the flood insurance program than to allow the state to take it over. Mr. Roland explained the flood insurance rate is based on new construction and improvements in present structures that are changed 50% or better, after adoption of the Flood Law. Mr. Leonard felt the town has nothing to lose by adopting the Local Law. With no further comments the hearing was closed at 8:10 PM. Resp ctfully submitted, 4 Linda Fetherbay, clerk s TOWN OF DANBY TOWN BOARD MEETING MINUTES April 8, 1985 The regular meeting of the Danby Town Board was called to order at 8:15 PM at the Danby Town Hall, 1830 Danby Road, Town of Danby, County of Tompkins, New York, April 8, 19850 Board Members present: Councilperson Mary Oltz Councilperson Dorothy Roberts Councilman Ric Dietrich Supervisor Mildred Miller Absent: Councilman Edward Shay • Others present: Judy Tagliavento, Joel Gagnon, Roy Casterline, Edward M. Roberts, Lorraine Bard, Donald Graham, William Genter, Juddson Leonard, Walter & Carol Sczepanski, Frank Proto, Communications: Letter from New York Board of Fire Underwriters acknowledging the towns' adoption of the Electrical Code Enforcement, Councilperson Roberts moved to approved the March 11 minutes as presented, seconded by Councilperson Oltz, carried by a vote of four ayes and no noes. Privilege of the Floor: Supervisor Miller reported the state legislature has appropriated $150,000 to rebuild the Jennings Pond dam and swimming should be allowed again the summer of 1986. She received a report on the State Revenue Sharing funds (per capital tax); for 1986 it has been increased to $38,283 (an increase of $2,513) and for 1987 will be $40,331 (increase of $4,561)0 Frank Proto reported the board of reps will be meeting in April to complete the plans for the SDA PIC program on hiring of youths to help area farmers. He reported the DEC money for the fire companies will be coming in May. The board of reps will be voting this week on the revised plan for sale of the old hospital to Tompkins Community Hospital. The lamprey situation in Cayuga Lake will not be taken care of this year. Mr. Proto reported the Buttermilk Creek bridge in not going to be repaired and traffic will be rerouted thru the gravel pit road. Plans are to abandon . the bridge. Committee reports: Community Council: Judy Tagliavento reported they have been busy completing plans for the summer recreation program. The program will be held at the former Danby School. The community council is still trying to get more people involved in the meetings. Dog Control: Lorraine Bard reported she dealt with 65 dog cases for 1984. She advertises for dog adoptions on the radio, channel 13 television and in the newspaper, and has had great success in finding homes for most of the dogs she has received. Highway: Ray reported the men installed a new culvert pipe on Howland Road and for a few property owners. The men have been busy patching on Michigan Hollow Road. On rainy days the men painted the 1969 Brockway tractor and and the bottom section of the brine trailer. He reported a new bucket is need for the catloader; and checked around on getting it repaired. He reported he can repair the bucket for $540.00. To purchase a new bucket would cost approximately $5700. Walt Sczepanski questioned what happens on the planned developments that have since been sold. Mr. Graham said a public hearing should be held to dissolve the planned development when it is no longer used for the intended purpose. Joel Gagnon reported he is still working on putting together a brief summary of the Local Fire and Building Code adopted by the town, to be put in the Danby Area News. Roy Casterline asked if the highway department could install more "children as play" signs on Maple Avenue, as the signs that were put up last fall have been stolen. The board agreed to purchase more signs and have the highway install them. Zoning: Judd Leonard presented to the board members forms that will need to be used in conjunction with the new fire and building code and would like their approval before using the forms. This also includes a revised building permit application. Supervisor Miller said a resolution is need2dto approve the forms. RESOLUTION #24 ADOPTION OF FORMS FOR BUILDING OFFICIAL TO BE USED WITH ZONING APPLICATIONS IN CONJUNCTION WITH WITH FIRE AND BUILDING CODE LAW. Moved by Councilperson Oltz, seconded by Councilperson Roberts. Roll Call Vote: Councilman Dietrich - aye Councilperson Oltz - aye Councilperson Roberts - aye Supervisor Miller - aye Absent: Councilman Shay Planning Board: Don Graham presented to the board a schedule of fees for Zoning as follows. 10 Appeal to Board of Zoning Appeals (Article 10, Section 1007 & 1008) $30.00 .including advertising in official newspaper 2. Special Permit (Article 8, Section 800 et seq) $50.00 including advertising in official newspaper 30 Special Permit with Environmental Review (Article 8, Section 810 et seq) $60.00, including advertising in official newspaper The above are payable to the zoning official. 40 Amendment to Zoning Ordinance, including Planned Development (Article 11, section 604 et seq) $100.00 including advertising in official newspaper The above payable to the town clerk. All of the above excludes fees for building permits. RESOLUTION #25 APPROVE SCHEDULE OF FEES FOR ZONING CASES, EXCLUDES FEES FOR BUILDING PERMITS AS RECOMMENDED BY PLANNING BOARD. Moved by Councilman Dietrich, seconded by Councilperson Roberts Roll Call Vote: Dietrich - aye Oltz - aye Roberts aye Miller - aye Absent: Shay r1 LJ 0 After brief discussion the board agreed to adopt the flood damage prevention law. RESOLUTION #26 ADOPT LOCAL LAW #3, ESTABLISHMENT OF FLOOD DAMAGE PREVENTION Moved by Councilman Dietrich, seconded by Councilperson Oltz. Roll Call Vote: Dietrich - aye Oltz - aye Roberts - aye Miller - aye Absent: Shay Warrants: is General Fund warrant #4 in the amount of $5,002.87 was approved to be paid. Moved by Councilman Dietrich, seconded by Councilperson Oltz, carried by a vote of four ayes and no noes. West Danby Water District fund #4 in the amount of $136.65 was approved to be paid, moved by Councilperson Roberts, seconded by Councilperson Oltz, carried by a vote of four ayes and no noes. Highway Fund #4 in the amount of $4,268.51 was approved to be paid, moved by Councilman Dietrich, seconded by Supervisor Miller, carried by a vote of four ayes and no noes. • Councilperson Roberts moved to approve the Supervisor's reports as presented, seconded by Councilperson Oltz, carried by a vote of PM, seconded by four ayes and carried no noes.
