Home My WebLink About1984-12-10a TOWN OF DANBY PUBLIC HEARING VETERAN'S REAL PROPERTY TAX EXEMPTION December 10, 1984 A public hearing was held December 10, 1984, at the Danby Town Hall, 1830 Danby Road, Town of Danby, Tompkins County, New York. The purpose of the hearing was to hear all interested persons in relation to exemption from property taxes for veterans of the armed services. The meeting was called to order at 7:40 PM. Board Members present: Councilman Edward Shay Councilman Ric Dietrich Councilperson Mary Oltz Coundilperson Dorothy Roberts Supervisor Mildred Miller Others present: Donald Graham, James E. Johnson, John Benjamin, Joan Babbitt, Carol Benjamin, Mike Ballo, Joel Gagnon, Herb Engman, Juddson Leonard, Parsons, Richard Ryant, Pam Clermont, Paul Nazer, Babbitt, Roy Casterline, Florence Starr, Ken Codd Edward M. Roberts, Frank Proto, Willy Pierce. Jr., Rolland Manley, Thurnheer, Carle James Burgess, Richard Toni Nazer, Ray ington, Helen Mundell, Supervisor Miller opened the meeting and asked the pledge of allegiance. The notice of public hearing as advertised in the Ithaca Journal was read by the town clerk. Herb Engman said if the state wants offer this alternative veterans' exemption, it should be done thru the income tax in order to honor every individual not just property owners. Mr. Engman said a needs factor should be considered. Joel Gagnon said an explanation of what the veteran's exemption involves is needed. The town clerk read from the Town and County Topics what the veterans' exemption consists of. The exemption consists of 15% of the assessed valuation on property not exceeding $12,000. For veterans who served in a combat zone will receive an additional 10% of assessed valuation not to exceed $81000. Disabled veterans' receiving disability from the Veteran's Administration is eligible for further exemptions equal to the assessed valuation by 50% of the disability rating not exceeding $40,000. The flat exemption would continue for a period of ten years commencing with the assessment roll prepared as of taxable status date occurring after December 31, 1984. Carl Ballo thinks the town should first find out how many veterans there are for Danby. Rick Parsons said if veterans are willing to lay their lives on the line, they should be given the exemption. Richard Ryant feels the exemption is a good idea. Ray Babbitt is for the veteran's exemption. Joel Gagnon asked if the widows of vets would be eligible for this exemption. Carole Benjamin feels a homeowner versus a renter deserves a tax break, therefore she is in favor of this veterans exemption. Joan Babbitt asked if the town board know how many veterans in Danby are already getting exemptions. 10 • Public Hearing - December 10, 1984 Page 2 Supervisor Miller said approximately 49 parcels have the $5000 exemption which was granted to those serving in WW1 and WW2. Dorothy Roberts moved to approve the minutes of the November 12 Public Hearing and November 12 Regular Town Board Meeting, seconded by Councilperson Oltz, carried by a vote of five ayes and no noes. Councilperson Roberts said the November 20 Special Meeting Minutes need a correction, paragraph #3, second line, should read November 12, not November 20. With requested correction, Councilman Dietrich moved to approve the November 20 Public Hearing, and November 20 Special Meeting minutes, seconded by Councilperson Oltz, carried by a vote of five ayes and no noes. Communications: 19 Letter from County Representative Florence Starr, submitting her resignation as County Representative for the Town of Caroline and Danby, effective December 31, 1984. 20 Minutes of West Danby Water Commissioners Meeting were presentted and read by the town clerk. The Water Commissioners recommended Earl Colburn be reappointed for another five years as Water Commissioner. 3. From Frank Liguori, Commissioner of Planning. The NYS Department of Transportation has included Tompkins County as a keeper of data used in high accident prone intersections or locations. 4. The Federal Emergency Management Agency has determined Danby will be converted to regular phase of the National Flood insurance program, effective May 15, 19850 5. Resolutions from County Board of Representatives: 1. Worker's Compensation Budget & Apportionment for Danby. The total assessed valuation is $37,737,410.. The full value apportionment for Danby is $109.36. 2. Apportionment of Election Expenses for Danby - $1771.12. 3. Apportionment of Mortgage Tax for Danby - $8,948.15. for the period of April 1, 1984 to September 30, 1984 6. Letter from Board of Representative, Chairman, Harris Dates Designating December 10, 1984 as Human Rights Day in Tompkins County. Supervisor Miller said the board will need to appoint Earl Colburn later in their meeting. Privilege of the floor: Councilperson Roberts said she regretfully accepts Mrs. Starr's resignation. The rest of the board members were in agreement. • • • 53 Town Board Meeting Minutes - Dec. 10, 1984 Page 2 Florence Starr reported County Representatives will be hearing from the media on what is going on for plans for the old hospital. Also on December 18, the jail site committee will report on the newest site for the county jail. Mrs. Starr reported this will be her last meeting and she has enjoyed being the representative for Danby and will miss her work with the County Representative. Councilperson Roberts said a meeting needs to be set between Towns of Caroline and Danby to appoint a replacement for Mrs. Starr. Councilperson Roberts moved to schedule January 3, 8:00 PM in the Danby Town Hall, Caroline and Danby Town Boards will meet and vote for a candidate to fill Florence Starr's position as County Representative, seconded by Councilman Dietrich, carried by a vote of five ayes and no noes. Supervisor Miller stated the Town Board did not drop the junk law as proposed by the planning board. The Town Board are still p ussuing this matter. Supervisor Miller asked the Town Attorney to explain how the Town can increase the highway superintendent's salary. Mrs. Clermont said the town can increase the highway superintendent's salary, for one year, if passed by a local law. Prior to his term beginning, it does not have to be made subject to permissive referendum. If done after his term begins, it would be subject to permissive referendum. She explained this law can be passed at the Town's December 27 meeting. RESOLUTION 44 CHANGE HIGHWAY SUPERINTENDENT'S SALARY FOR ONE YEAR, FROM $16,660. TO $175500 BY ADOPTION OF LOCAL LAW. Moved by Councilperson Roberts, seconded by Councilperson Oltz. Roll Call Vote: Dietrich - aye Oltz - aye Roberts - aye Shay - aye Miller - aye Mr. Willie Pierce is requesting a public hearing for his Company, Ithaca Theatre Lighting's proposal for purchase of Danby School. Supervisor Miller recommended Mr. Pierce attend the next Planning Board on December 19 for their recommendations. Supervisor Miller would like board's approval to reappoint Donald Graham as chairman of the town's planning board as well, as the town's representative to the County planning board for a term of three years, January 1, 1985 to December 31, 1987. Moved by Councilperson Roberts, seconded by Councilperson Oltz, carried by a vote of five ayes and no noes. Supervisor Miller moved to appoint Earl Colburn as Water Commissioner • for a five year term, seconded by Councilperson Roberts, carried by a vote of five ayes and no noes. Supervisor Miller said a resolution is needed to authorize town clerk to advertise for public hearings scheduled on December 27 for adoption of local law on highway superintendent salary change and local law on administration of uniform fire prevention and building codes. RESOLUTION 45 AUTHORIZE TOWN CLERK TO ADVERTISE FOR PUBLIC HEARING ON LOCAL LAW IN RELATION TO HIGHWAY SUPERINTENDENT'S SALARY CHANGE FOR DECEMBER 27, 7:30 PM AND TO ADVERTISE FOR PUBLIC HEARING ON LOCAL LAW FOR ADMINISTRATION OF UNIFORM FIRE PREVENTION AND BUILDING CODES FOR DECEMBER 27, 8:00 PM Town Board Meeting Minutes - Dec. 10, 1984 Page 3 Moved by Councilman Dietrich, seconded by Councilperson Roberts. Roll Call Vote: Dietrich - aye Oltz - aye Roberts - aye Shay - aye Miller - aye Committee Reports Environmental Management Council: Herb Engman reported in 1985 there will be only one landfill site for Tompkins County, which will be Landstrom's. The pesticide cleanup day held by EMC this fall was a big success. They collected 16 barrels of pesticides. Mr. Engman said he will need to be reappointed to County EMC as representative from Danby, if the board would like him to serve again. Youth: Councilman Dietrich reported increased monies will be coming in next year for youth services from the County. He reported Community Council is planning to sponsor films for children sometime in January to help raise money for their Community Center. Community Council will have their annual town Christmas party on December 15. Highway: Pete Coddington reported the crew has done gravel and ditch work; but mainly have been doing nothing but continuous repair work to their equipment. Supervisor Miller said she received communications from Mary Smith for the Senior Citizens regarding monies spent in 1984. There is a balance of $500 left in their 1984 budget. RESOLUTION 46 ENCUMBER BALANCE OF $500 FROM ACCOUNT CF7610.4 FOR SENIOR CITIZENS FROM 1984 BUDGET TO 1985 BUDGET. Moved by Councilman Dietrich, seconded by Councilman Shay. Roll Call Vote: Dietrich - aye Oltz - aye Roberts - aye Shay - aye Miller - aye Zoning: Judd Leonard reported effective January 1, 1985, new installations of wood burning stoves will need to be inspected. Planning Board: Don Graham reported the following action was taken at their November 28 meeting: Action taken on planned unit development on Michael Loehr's Children's Community of Tompkins County. The purpose of this PUD was for Children's Community to take over the property at 1820 Danby Road (Miller property) and use as a family oriented and therapeutic home for behaviorally and emotionally disturbed children. Mr. Loehr presented sufficient evidence that there is a need for this type of facility in Tompkins County. The Planning Board is recommending to the Town Board that the PUD be approved following a public hearing. Carol Benjamin pointed out this property would become tax exempt if purchased. Supervisor Miller said the board will set a public hearing at their December 27 meeting; moved by Councilperson Oltz, seconded by Councilman Shay, carried unanimously. Supervisor Miller said Herb Engman should be reappointed to the EMC as representative for town of Danby for two years, moved by Councilperson Roberts, seconded by Councilman Shay, carried unanimously. • • r- -1 LJ /D Town Board Meeting Minutes - Dec. 7J1, 1984 Page 4 Committee.Reports, continued / Water District: Roy Casterline reported the electro rustproofing contract has been received for the Water District. Supervisor Miller would like approval to use monies from other accounts to pay end of year bills as needed. RESOLUTION 47 ALLOW SUPERVISOR TO USE EXCESS MONIES IN SOME ACCOUNTS TO PAY END OF YEAR BILLS AND TO USE CONTINGENCY FUNDS IF NECESSARY. Moved by Councilperson Oltz, seconded by Councilman Dietrich. Roll Call Vote: Warrants: Dietrich - aye Oltz - aye Roberts - aye Shay - aye Miller - aye General Fund Warrant #12 in the amount of $3,587.74 was approved to be paid, moved by Councilperson Roberts, seconded by Councilperson Oltz, carried by a vote of five ayes and no noes. W West Danby Water District Warrant #12 was approved to be paid in the amount of $304.64, moved by Supervisor Miller, seconded by Councilperson Roberts, carried by a vote of five ayes and no noes. Highway Fund Warrant #12 was approved to be paid in the amount of $13,623.09, moved by Councilman Dietrich, seconded by Councilperson Roberts, carried by a vote of five ayes and no noes. Highway CHIPS Fund Warrant #12 in the amount of $1813.00 was approved to be paid, moved by Councilperson Oltz, seconded by Supervisor Miller, carried by a vote of five ayes and no noes. Councilman Shay moved to approve the Supervisor's reports as presented, seconded by Councilman Dietrich, carried by a vote of five ayes and no noes. Supervisor Miller said the board needs to meet with Zoning Officer, Judd Leonard, to review his position for 1985. The Board agreed to do this at 6:30 on December 270 Joel Gagnon asked if board members will be making a decision on the proposed veteran's exemption. Supervisor Miller said a decision is not needed until January 30, 19850 Pam Clermont pointed out the Town should adopt by Local Law their own plan for the veteran's exemption, otherwise if town does nothing, then they will have to go along with the State's plan. After general discussion, the board agreed a public hearing will be held December 27 to adopt a local law for veteran's exemption so as inot to go with the state's recommendations. RESOLUTION 48 AUTHORIZE TOWN CLERK TO ADVERTISE FOR PUBLIC HEARING TO ADOPT LOCAL LAW IN RELATION TO ALTERNATE VETERAN'S EXEMPTION FROM REAL PROPERTY TAXATION FOR DECEMBER 27 AT 7:00 PM. Moved by Supervisor Miller, seconded by Councilman Dietrich. Roll Call Vote: Dietrich - aye Oltz - aye Roberts - aye Shay - aye Miller - aye M Town Board Meeting Minutes - Dec. 10, 1984 Page 5 Florence Starr pointed out by opting out of the state's recommendations for veteran's exemption now, it will give the board a year to review all the statistics. Supervisor Miller would like a resolution passed to thank Florence Starr for her service to Danby as County Representative, RESOLUTION 49 THANK YOU FLORENCE STARR AS COUNTY REPRESENTATIVE TO THE TOWNS OF DANBY AND CAROLINE Moved by Supervisor Miller, seconded by Councilperson Oltz.
